Guidelines for Implementing Decree No. 19/2002/NĐ-CP

dated February 19, 2002 of the Government on Mobilizing State Scientific and Technological Potential for National Defense

science and technology of the State for national defense

Pursuant to Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government on mobilizing state scientific and technological potential for national defense; following the unified opinions of the Ministry of Home Affairs (in Circular No. 3639/BNV-VP dated December 14, 2005), the Ministry of Planning and Investment (in Circular No. 9042/BKH-QPAN dated December 29, 2005), the Vietnam Academy of Science and Technology (in Circular No. 1279/KHCNVN-VP dated November 17, 2005), the Ministry of Finance (in Circular No. 7802/BTC-VI dated June 23, 2006), the Ministry of National Defense and the Ministry of Science and Technology issue guidelines for implementing certain provisions of the Decree as follows:

I. GENERAL PROVISIONS

1. State Scientific and Technological Potential for National Defense

State scientific and technological potential for national defense is the capability in science and technology that can be mobilized to address immediate and long-term national defense tasks, including:

a) Scientific and technological organizations: research institutions, research and development organizations; universities, academies, colleges; scientific and technological service organizations; scientific and technological organizations within state-owned enterprises; state-owned scientific and technological enterprises.

b) Scientific and technological personnel comprising those directly involved in scientific and technological activities, in the process of creating scientific and technological products.

c) Financial resources consisting of monetary investments for scientific and technological activities.

d) Material infrastructure ensuring scientific and technological activities include all workshops, equipment, raw materials, auxiliary materials, laboratories, libraries, etc., serving scientific research and technological development.

e) Scientific and technological information includes data, statistics, facts, news, knowledge in natural sciences, engineering sciences, social sciences, and humanities.

2. Subjects, Scope, Timeframe, System, and Policies for Organizations and Individuals Engaged in Scientific and Technological Activities Mobilized for National Defense

Implemented according to the provisions of Joint Circular No. 01/2005/TTLT-BQP-BTC dated January 4, 2005 of the Ministry of National Defense and the Ministry of Finance.

II. SPECIFIC PROVISIONS

1. Content and Methods of Mobilization

The content and methods of mobilizing state scientific and technological potential for national defense are implemented according to the provisions of Articles 7, 8, 9, 10, 11, and 12 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government on mobilizing state scientific and technological potential for national defense.

2. Developing a Regular Mobilization Plan

a) Basis for developing a mobilization plan

- National economic and social development strategy,

- Strategy for developing science and technology in military and national defense fields,

- Equipment strategy of the Vietnam People's Army.

b) Procedure for developing a mobilization plan is carried out according to Clauses 1, 2, and 3 of Article 14 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government on mobilizing state scientific and technological potential for national defense.

3. Developing a Mobilization Plan in Emergency Situations

a) The following situations are considered emergency situations:

When there are natural disasters, fires, dangerous epidemics that the State and Government entrust the Ministry of National Defense to handle or urgent situations related to national defense, not reaching the level of declaring a state of emergency, but requiring mobilization to limit and mitigate consequences.

b) When an emergency situation occurs, based on specific needs, the Ministry of National Defense develops a mobilization plan according to Clause 4 of Article 14 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government on mobilizing state scientific and technological potential for national defense; notifies relevant ministries, agencies, provincial people's committees, and other state organizations about the mobilization plan.

4. Contents of the Mobilization Plan Include

a) Scientific and technological tasks to be mobilized

b) Organizations, human resources, material infrastructure, scientific and technological information to be mobilized;

c) Ministries, agencies, provincial people's committees, state-owned enterprises (hereinafter referred to as managing agencies) responsible for mobilization tasks;

d) Timeframe and progress of mobilization;

e) Conditions ensuring the mobilization plan;

g) Mobilization results;

h) Time, location, and method of transferring mobilization results to the Ministry of National Defense.

5. Approving the Mobilization Plan

Implemented according to Article 15 of Decree No. 19/2002/NĐ-CP dated February 19, 2002 of the Government on mobilizing state scientific and technological potential for national defense and the following provisions:

a) Five-year and annual regular mobilization plans integrated into the national five-year and annual science and technology development plans are approved together with the national five-year and annual economic and social development plans;

b) After the mobilization plan is approved, the Ministry of National Defense informs the managing agencies and other relevant agencies of the mobilization plan.

6. Responsibilities for Implementing the Mobilization Plan

a) Ministry of National Defense

- Taking the lead and coordinating with the Ministry of Science and Technology, the Ministry of Planning and Investment, the Ministry of Finance, and relevant ministries, localities, agencies, and units to develop the mobilization plan, incorporating it into the annual and five-year budget estimates of the Ministry of National Defense, submitting them to the Ministry of Planning and Investment and the Ministry of Finance for approval by competent authorities; preparing detailed forms for the mobilization plan to ensure uniformity for ministries, agencies, and localities to implement.

- Taking the lead and coordinating with the Ministry of Science and Technology, the Ministry of Planning and Investment, and the Ministry of Finance to develop supplementary mobilization plans for state scientific and technological potential when there is a need for emergency mobilization, to be submitted to the Prime Minister for decision.

- 主持并协调科学技术部、计划投资部和财政部制定检查计划,并组织实施每六个月、每年或随时进行的定期检查,以督促各机关和单位履行动员任务;汇总评估各主管机关执行动员任务的情况,并向政府总理报告。

- 对国家科学和技术潜力动员计划的实施向政府负责。

b) 计划投资部和财政部应与国防部配合编制预算草案,并提交有审批权的机关批准。

c) 科学技术部应主持并会同国防部、计划投资部和财政部审核五年科学和技术规划及年度规划中的科学和技术潜力动员计划,并提交有审批权的机关批准;会同国防部指导实施为国防服务的国家科学和技术潜力动员计划。

d) 各部委、行业、省和直辖市人民委员会

- 按照经政府总理批准的动员计划的内容和要求,报告下属单位的科学和技术潜力;

- 制定实施计划,并分配具体任务和指标,需要动员下属单位;

- 定期向政府(通过国防部)报告动员计划的执行情况;

- 根据第19/2002/NĐ-CP号决议第十八条的规定,将动员结果移交给国防部;

- 在未能按计划完成动员进度或延迟移交动员成果的情况下,向政府报告并说明原因及解决措施;

7. 检查、评估和报告动员计划的执行情况

a) 检查组成员包括:国防部、计划投资部、科学技术部、财政部、主管机关和相关机关的代表。

b) 实施单位的动员计划执行情况报告须经主管机关批准后,通过国防部提交给政府;

- 在六月三十日前提交上半年动员计划执行情况报告;

- 在十二月十五日前提交全年动员计划执行情况报告;

8. 动员计划实施的资金

a) 资金来源

根据第19/2002/NĐ-CP号决议第十九条第一款的规定。

b) Implementation method

- 对于国家预算资金,其管理和使用按照《国家预算法》及其实施细则的规定分级管理。

- 在突发情况下需从科技发展基金中动员资金,包括国家级科技发展基金、部委和行业的科技发展基金、省市级科技发展基金以及组织和个人的科技发展基金时,决定动员资金的机关有责任将已动员的资金总额纳入本机关的预算草案,以便由有审批权的国家管理机关决定从国家预算中偿还这些基金。

9. 奖励和处罚

a) 奖励

- 对被动员为国防服务的科研机构:每年或在特殊情况下,如果其科研成果具有较高的科学价值,经国防部所属的国家科研管理部门审查并建议有关机关奖励,按照国防部所属科研机构的规定办理。

- 对被动员为国防服务的个人:可以申请并推荐授予国防部和国家颁发的科研奖项,对于具有规定价值的研究成果和解决方案,按照国防部所属人员的规定办理;计入业绩,以评定职称和培训资格。

b) 处罚

按照第19/2002/NĐ-CP号决议第二十一条的规定和以下规定执行:

- 为了获得优惠和奖励,在科研活动中弄虚作假,违反本通令和2005年1月4日联合部令第01/2005/TTLT-BQP-BTC号文的规定;

- 将用于动员为国防服务的科学和技术潜力的任务资金挪作他用;

- 其他违反科学技术法律的行为。

III. IMPLEMENTATION

1. 各部部长、相当于部长级的机关负责人、中央政府机关和其他机关、各省和直辖市人民委员会主席、被动员为国防服务的科研机构和个人,有责任组织、指导并执行本通令的规定。

2. 本通令自发布之日起十五日后生效。在执行过程中如遇困难,请各部委、行业、省和直辖市人民委员会将意见反馈至联合部研究解决。/。
