Regarding the approval of the Program for resettling residents in areas affected by natural disasters, extremely difficult conditions, border regions, islands, spontaneous migration, fragile and very fragile protective forest zones, strict protection zones of special-use forests for the period and orientation until 2015 Considering the proposal of the Minister of Agriculture and Rural Development (report No. 1317/TTr-BNN-HTX dated June 1, 2006) and the opinions of the Ministries of Planning and Investment, Finance, Labor - Invalids and Social Affairs, Justice, Natural Resources and Environment, Public Security, and the Committee for Ethnic Minorities,

 2006 - 2010 Article 1. Approves the Program for resettling residents in areas affected by natural disasters, extremely difficult conditions, border regions, islands, spontaneous migration, fragile and very fragile protective forest zones, strict protection zones of special-use forests for the period 2006-2010 and orientation until 2015 (hereinafter referred to as the Resident Resettlement Program) with the main contents as follows:

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Implementing planning, resettling, and rearranging residents in disaster-prone areas and areas with extremely difficult living conditions, border regions, islands, stabilizing spontaneous migrants, fragile and very fragile protective forest zones, strict protection zones of special-use forests, aiming to stabilize and improve the livelihood of residents, minimize losses caused by natural disasters and spontaneous migration; solving employment, increasing income, contributing to eradicating hunger and reducing poverty, protecting the environment, and consolidating national defense and security.

DECISION:

- During the period 2006-2015, implement the resettlement and rearrangement of 150,000 households, including 75,000 households during the period 2006-2010, comprising:

1. Objectives

Determining the Administrative Reform Index to monitor and evaluate in a substantive, objective, and fair manner the annual implementation results of administrative reform of ministries, agencies equivalent to ministries (referred to as ministries), and people's committees of provinces and central-supervised cities (referred to as provinces) during the implementation of the Comprehensive Program on Administrative Reform of State Agencies for the 2011-2020 period.

+ 30,000 households in disaster-prone areas and areas with extremely difficult living conditions.

b) Specific Objectives:

+ 10,000 households in border and island regions.

+ 33,000 households of spontaneous migrants.

+ 2,000 households in fragile and very fragile protective forest zones, strict protection zones of special-use forests.

- Reduce the poverty rate in the project areas for resettlement and rearrangement to 15%.

Article 2. Principles for implementing the program:

a) Resettlement must be carried out according to the overall planning on economic and social development of each region and province, focusing on production planning linked with processing and consumption of products suitable to the potential and advantages of each region. At the same time, priority should be given to resettlement to promote economic and social development, ensure national defense and security in mountainous and ethnic minority regions (North Central Highlands, Northwest, Southwest, and Central Highlands).

b) Resettlement and rearrangement are both goals and solutions for economic, cultural, and social development, national defense and security, and environmental protection. Resettlement must be concentrated, have key points, and be combined with stabilizing and developing production, improving new living conditions better than old ones, where developing production is considered the most important factor.

c) Resettlement is the responsibility of relevant sectors and local authorities at all levels. The State supports investment in combination with mobilizing local resources, various economic components, and residents' resources to implement the Resident Resettlement Program in each locality.

d) Resettlement mainly takes place within the commune, district, and province. In cases requiring relocation outside the province, it needs to be coordinated between the sending and receiving provinces to arrange into planned areas to stabilize the life and production of households settling permanently.

đ) Resettlement should aim to form new rural settlement models in accordance with the customs and cultural traditions of each ethnic group.

Article 3. Projects and activities under the Program:

a) Project for resettling and rearranging residents in disaster-prone areas and areas with extremely difficult living conditions.

b) Project for resettling and stabilizing residents in border and island regions.

c) Project for resettling and stabilizing spontaneous migrants.

d) Project for resettling residents in fragile and very fragile protective forest zones, strict protection zones of special-use forests.

a) Regarding planning and planning work:

- Based on the overall planning for economic and social development and sectoral planning, build the overall planning for resident resettlement for the period 2006-2010 and orientation until 2015 for each region and locality according to the target groups of migrants, submit to the competent authority for approval. Localities that already have overall planning for resident resettlement need to review their objectives, scope, target groups, and system of measures to align with the content of the Resident Resettlement Program.

4. Implementation Measures of the Program

- On the basis of the approved overall planning, carry out detailed planning, prepare, review, and approve investment projects for resident resettlement to organize implementation according to the annual plan.

- Develop plans for resident resettlement towards concentration, key points, and mobilize integration of resources in each locality to implement. First, develop specific plans to complete ongoing resident resettlement projects.

b) Financial solutions:

- Based on the provisions of the Law on State Budget, the central budget supplements targeted funds for local budgets and records them separately to implement the Resident Resettlement Program according to the annual and five-year plans, including development investment capital and economic affairs capital.

- Localities actively allocate funds managed by themselves, combine and integrate funds from programs, projects, and other legitimate sources on the territory to implement resident resettlement generally, especially prioritizing resettlement in areas affected by natural disasters (bank erosion, coastal erosion, flash floods, debris flows, landslides, subsidence, flooding), areas with extremely difficult living conditions (shortage of agricultural land, water for production and daily use, infrastructure, floating villages on rivers); border and island regions; stabilizing spontaneous migrants; fragile and very fragile protective forest zones, strict protection zones of special-use forests.

- Funding for directing the implementation of the Program: the central budget ensures funding for directing the implementation of the Resident Resettlement Program under the tasks of the Ministry of Agriculture and Rural Development and central agencies. The local budget ensures funding for directing the implementation of the Resident Resettlement Program under the tasks of localities.

c) Regarding policies and mechanisms:

- The budget for directing the implementation of the Program: the central budget ensures the funding for directing the implementation of the Program for resettling residents under the tasks of the Ministry of Agriculture and Rural Development and other central agencies. The local budget ensures the funding for directing the implementation of the Program for resettling residents under the tasks of the localities.

c) Regarding mechanisms and policies:

- Land policy: based on the current provisions of the Land Law, localities shall take measures to reclaim land areas that have not been used or have been used inefficiently by organizations, farms, or forest enterprises, or to change the purpose of land use according to the planning and plans approved by competent authorities, and allocate such land to households and individuals under residential resettlement projects.

- Investment support for infrastructure construction: the state budget shall provide funding from development investment capital to construct infrastructure in areas designated for residential resettlement, including: compensation and clearance of land; leveling of residential land at relocation sites; opening up production land; transportation; small irrigation works; kindergartens, primary schools, and junior secondary schools; health stations; water supply systems; and other essential facilities as required by actual needs.

- Direct support policies for households:

The direct support capital for households shall be sourced from economic public funds. Specific levels of support shall vary depending on the target group and shall be implemented in accordance with Decree No. 197/2004/NĐ-CP dated December 3, 2004 of the Government on "Compensation, Support, and Resettlement when the State Recovers Land," and Prime Minister's Decisions: No. 190/2003/QĐ-TTg dated September 16, 2003 on "Population Relocation Policy for Planning and Residential Arrangement during the Period 2003-2010"; No. 120/2003/QĐ-TTg dated June 11, 2003 approving the "Strategy for Economic-Social Development along the Vietnam-China Border until 2010"; No. 60/2005/QĐ-TTg dated March 24, 2005 approving the "Planning for Stabilizing Population in Border Villages between Vietnam and China until 2010," and Circulars guiding the implementation of the aforementioned regulations issued by relevant ministries and sectors.

In cases where households lose their housing, residential land, and production land due to landslides: the state budget shall provide support for housing, residential land, production land, and living water. The specific level of support shall be carried out according to the project approved by the competent authority.

- Training and capacity building policies for human resources serving the Residential Arrangement Program: the state budget shall provide support for developing training programs and organizing training sessions for management and implementation of the program for cadres involved in residential arrangement work at all levels.

d) Regarding propaganda and mobilization:

Mobilize the participation of people's mass organizations, social organizations, and mass media agencies to promote and mobilize the people to understand the Party and State's policies, actively participate alongside local authorities in implementing residential arrangements according to planning and plans.

Article 2. Implementation:

1. Responsibilities of Central Ministries and Sectors:

a) The Ministry of Agriculture and Rural Development serves as the permanent body of the Residential Arrangement Program, leading and coordinating with relevant ministries and sectors to guide provincial People's Committees (referred to as provincial level):

- To develop overall and detailed planning for residential arrangement for approval by the provincial People's Committee; to develop annual and five-year residential arrangement plans for consolidation by the Ministry of Agriculture and Rural Development and submission to the Prime Minister for approval;

- To prepare the budget estimate for directing the implementation of the Residential Arrangement Program within the central government's expenditure budget.

- To coordinate with the Ministry of Planning and Investment and the Ministry of Finance in allocating capital for the Residential Arrangement Program.

- To lead and coordinate with the Ministry of Finance and relevant ministries and sectors in researching, adjusting, and supplementing mechanisms and policies for residential arrangement.

- To coordinate with provincial People's Committees in developing and implementing certain residential arrangement models tailored to specific regions and groups to evaluate and draw lessons for wider application.

- To lead the development of training and capacity-building content and programs for residential arrangement and coordinate with localities and training institutions in organizing training and capacity-building for cadres engaged in residential arrangement work at all levels.

- To inspect, supervise, and evaluate the implementation results of residential arrangement in localities; to propose solutions to organize effective management and implementation of the Program.

b) Ministry of Planning and Investment:

- To lead and coordinate with the Ministries of Finance and Agriculture and Rural Development in allocating capital for the Residential Arrangement Program to implement annual and five-year plans.

- To unify with the Ministry of Agriculture and Rural Development and the Ministry of Finance regarding the allocation of capital to sectors and localities and record it separately in the annual plan for implementation.

- Guide sectors and localities in integrating other programs and projects within their jurisdiction with projects under the Population Resettlement Program;

c) Ministry of Finance:

- To coordinate with the Ministries of Planning and Investment, Agriculture and Rural Development in allocating capital for the Residential Arrangement Program according to the annual plan.

- To issue, monitor issuance, guide, and supervise financial expenditures of the Residential Arrangement Program.

- Coordinate with the Ministry of Agriculture and Rural Development and relevant ministries and sectors in building mechanisms and policies for the Population Resettlement Program;

d) The Ministry of National Defense:

To lead the implementation of projects under the Residential Arrangement Program in national defense economic zones.

đ) The Ministries of Public Security, Natural Resources and Environment, Labor, Invalids and Social Affairs, Culture, Information, Education and Training, Health, Ethnic Minority Commission, and related ministries and sectors shall, based on their functions and responsibilities, plan and guide localities in implementing the Residential Arrangement Program.

2. Responsibilities of Provincial People's Committees:

- To develop new or review and adjust the overall planning for residential arrangement in the province for approval by the Chairman of the Provincial People's Committee. To develop implementation plans for the Residential Arrangement Program from now until 2010 and annual plans to report to the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, and the Ministry of Finance for consolidation and submission to the Prime Minister for approval.

- To direct and organize the establishment, review, and approval of projects under the Program according to regulations.

- To develop additional budget estimates from the central government's targeted capital annually and for the period 2006-2010 for the Residential Arrangement Program in the province.

- To integrate capital from other programs and projects in the locality with the Residential Arrangement Program.

- Direct the Departments, Committees, and agencies at all levels to closely coordinate with people's organizations in promoting propaganda and mobilizing the public to actively participate in implementing the Residential Arrangement Program, strengthening management, inspection, and supervision of specific projects within their jurisdictions.

- Improve the specialized agency system for residential arrangement and reorganization at the local level; prioritize assigning dedicated staff to handle residential arrangement work at the district level and part-time staff at the commune level to effectively implement the Program. ||| to organize the implementation of the Program efficiently.

Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette.

Article 4. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for enforcing this Decision.
