DECISION
Regarding the announcement of Ben Dam Fish Port for domestic and foreign vessels to enter and exit for cargo operationsin addition to foreign trade, engaging in commerce

THE MINISTER OF TRANSPORTATION
Pursuant to Article 57 of the Vietnam Maritime Code dated June 30, 1990;
Pursuant to Decree No. 34/CP dated April 4, 2003 of the Government stipulating the tasks, powers, responsibilities for state management, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 13/CP dated February 25, 1994 of the Government promulgating the "Regulations on the Management of Maritime Activities at Seaports and Marine Areas in Vietnam"; Decree No. 24/ND-CP dated May 30, 2001 of the Government amending and supplementing certain articles of the "Regulations on the Management of Maritime Activities at Seaports and Marine Areas in Vietnam" promulgated together with Decree No. 13/CP dated February 25, 1994 of the Government;
Pursuant to the Prime Minister's opinion expressed in Official Letter No. 2600/VPCP dated May 27, 2003 of the Government Office;
Considering the Report No. 108/TT.BQL dated May 27, 2003 of the Ben Dam Port Management Board requesting the announcement of Ben Dam Fish Port for foreign vessels to enter and exit for cargo operations and related documents;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,
DECISION:
Article 1. - Now hereby permits Ben Dam Fish Port under the Ben Dam Port Management Board, Con Dao District, Ba Ria-Vung Tau Province to accept domestic and foreign vessels with up to 2,000 DWT to enter and exit for cargo operations.
The position for pilot boarding and disembarking and quarantine of Ben Dam Fish Port is specifically as follows:
Latitude: 08°40' 30" N; Longitude: 106°32' 42" E.
Article 2. - Vung Tau Port Authority shall be responsible for specialized state management over maritime activities in the Ben Dam Fish Port area and based on the actual conditions of the wharf, ship channel, depth limit of the water area before the wharf, and weather conditions, permit vessels with appropriate technical specifications to enter and exit for cargo operations at this wharf, ensuring safety and collecting fees as prescribed by law.
Article 3. - The Ben Dam Port Management Board, Con Dao District, Ba Ria-Vung Tau Province shall be responsible for managing and organizing the operation of the wharf according to the approved design, ensuring safety, economic purpose, and collecting fees as prescribed by law.
Article 4. - Relevant state management agencies of related sectors shall perform their tasks and powers within the Ben Dam Fish Port area in accordance with the provisions of law.
Article 5. - This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
Article 7. - The Heads of the Ministry’s Office, Department Heads of Departments under the Ministry, Director of the Vietnam Maritime Administration, Director of the Ba Ria-Vung Tau Provincial Department of Transport, Director of Vung Tau Port Authority, Director of the Ben Dam Port Management Board, and Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Decision./.
