Circular No. 197/2013/TT-BTC stipulates the rate of collection, the system of collection, payment, management, and use of road usage fees at two toll stations Ninh An and Bàn Thạch on National Highway 1.

Prescribing the level of collection,policies method of collection, payment, management and use of tolls for

 the two toll stations Ninh An and Bat Thach on National Highway 1 and fees for the year 2001;

Pursuant to DecreeNo. Issued together with this Circular is the Table of Toll Rates for the two toll stations Ninh An and Bat Thach on National Highway 1 (the rates include Value Added Tax)."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation.""4. At the proposal of the Director of the Department of Tax Policy,"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."The toll collection receipts used at the two toll stations Ninh An and Bat Thach on National Highway 1 shall be implemented in accordance with Article 9 of Circular No. 159/2013/TT-BTC.;

Selling state property through public listing."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."Article 4. Management and use of toll revenuepolicies 1. The tolls for the two toll stations Ninh An and Bat Thach on National Highway 1 shall be collected, paid, managed and used in accordance with Article 8 of Circular No. 159/2013/TT-BTC. The total annual toll revenue after deducting organizational costs and taxes as prescribed shall be determined as the amount of toll revenue for the capital recovery of the investment project for constructing the highway tunnel through Cả Pass, National Highway 1. 2. The unit assigned by the Ministry of Transport to organize the collection of tolls for the two toll stations Ninh An and Bat Thach on National Highway 1 shall be responsible for: Organizing ticket sales points at the toll stations that are convenient for traffic vehicle drivers and avoid traffic congestion; implementing registration, declaration, collection, payment, and use of toll collection receipts in accordance with regulations.

Article 1. Scope of application

1. This Circular takes effect from February 5, 2014.

Article 2. Fee Collection Schedule

2. Abolish the provisions regarding the collection of tolls at the Bat Thach toll station and the Ninh An toll station in Circular No. 233/2012/TT-BTC dated December 28, 2012 of the Ministry of Finance prescribing the level of collection, system of collection, payment, management and use of tolls for toll stations under the Build-Operate-Transfer model and toll transfer stations.

Article 3. Fee Collection Documents

3. Organizations and individuals subject to toll payments, units assigned by the Ministry of Transport to organize the collection of tolls for the two toll stations Ninh An and Bat Thach on National Highway 1, and related agencies are responsible for implementing this Circular.

Article 4. Management and use of collected fees

1. The road usage fee at the two toll stations Ninh An and Bàn Thạch on National Highway 1 shall be collected, deposited, managed, and used in accordance with the provisions of Article 8 of Circular No. 159/2013/TT-BTC. The total annual revenue from tolls, after deducting organizational collection costs and taxes as prescribed, shall be determined as the revenue for repaying the investment project for constructing the tunnel through Cả Pass on National Highway 1.

2. The unit assigned by the Ministry of Transport to organize the collection of road usage fees at the two toll stations Ninh An and Bàn Thạch on National Highway 1 shall be responsible for: Organizing convenient ticket sales points at the toll stations to facilitate traffic vehicle drivers and avoid traffic congestion; implementing registration, declaration, collection, deposit, and use of toll collection receipts in accordance with regulations.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. This Circular takes effect from February 5, 2014.

2. Abolish the content regarding the collection of road usage fees at the Bàn Thạch toll station and the Ninh An toll station as stipulated in Circular No. 233/2012/TT-BTC dated December 28, 2012 of the Ministry of Finance concerning the level of collection, system of collection, deposit, management, and use of road usage fees at BOT toll stations and toll stations transferring the right to collect fees.

3. Organizations and individuals subject to payment of fees, units assigned by the Ministry of Transport to organize the collection of road usage fees at the two toll stations Ninh An and Bàn Thạch on National Highway 1, and related agencies shall be responsible for implementing this Circular.

- For the application of fee levels for container vehicles (including dedicated tractor-trailers): Apply the fee level based on the total weight of the vehicle, regardless of whether it is loaded or not loaded.
