Based on the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Land Law dated November 26, 2003;
Pursuant to Resolution No. 39/2012/QH13 adopted by the National Assembly at its fourth session on November 23, 2012 on continuing to enhance the effectiveness of implementing policies and laws in handling complaints and petitions from citizens regarding administrative decisions on land;
Pursuant to Resolution No. 16/NQ-CP dated June 8, 2012 of the Government promulgating the Action Program to implement Resolution No. 13-NQ/TW dated January 16, 2012 of the Central Committee of the Communist Party of Vietnam on building synchronous infrastructure to basically transform Vietnam into an industrialized country with modern orientation by 2020;
Pursuant to Decree No. 102/2009/NĐ-CP dated November 6, 2009 of the Government on Management of Investment in Information Technology Applications Using State Budget Funds;
Pursuant to Decision No. 1605/QĐ-TTg dated August 27, 2010 of the Prime Minister approving the National Program on the application of information technology in the activities of state agencies for the period 2011-2015;
Pursuant to Decision No. 1892/QĐ-TTg dated December 14, 2012 of the Prime Minister approving the Project to enhance capacity in land management for the period 2011-2020;
Considering the proposal of the Ministry of Natural Resources and Environment,
DECISION:
Article 1. Approves the Project "Establishment of the National Land Information Database" with the following main contents:
1. General information about the project:
Project name: Establishment of the National Land Information Database
Managing agency: Ministry of Natural Resources and Environment
Project investor: State Land Management Agency.
Investment form: Construction of new and standardization, integration of existing land data; inheriting technical infrastructure of information technology that has been and is being invested in from other projects at the central level, ministries, sectors, and localities.
2. Scope of implementation, content, and main activities of the Project:
- Establishing, deploying, managing, operating, exploiting, and updating the national land information system including specialized land data throughout different periods:
+ Establishing and deploying the central land database and the management, updating, and exploitation system at the Ministry of Natural Resources and Environment.
+ Establishing and deploying the component land database and the management, updating, and exploitation system at localities.
- Connecting the land database with relevant sectors.
- Establishing regulations on updating, exploiting, and operating the system over the long term to ensure synchronization, responsibility, and compliance with authority of organizations and individuals participating in the system from the central to local levels.
- Organizing training courses on data integration, security, data safety, original software systems, development tools, geographic information systems (GIS), and system operation and maintenance.
3. Implementation time of the Project:
The project will be implemented from 2012 to 2018 as stipulated in Decision No. 1892/QĐ-TTg dated December 14, 2012 of the Prime Minister approving the Project to enhance capacity in land management for the period 2011-2020, divided into two phases:
Phase 1: Expected to start in September 2013 and end in December 2015; implementing the following contents:
- Designing a unified land information system from the central to local levels.
- Building software systems to manage, update, and exploit the land database.
- Building the land database from existing central data at the State Land Management Agency; prioritizing the construction of the rice cultivation land database.
- Building and integrating the land database for three counties in three provinces representing the North, Central, and South regions which have completed basic conditions such as land surveying, registration, and issuance of land use rights certificates.
- Integrating the land database produced by nine provinces under the Vietnam Land Administration Project (VLAP) into the national land database system.
- Integrating the land database of 41 pilot counties under the Comprehensive Project for Building Land Records and Land Management Databases.
- Standardizing and integrating the land database within the scope of a county (down to commune level) in two localities that have initially built land databases using local funds: Dong Nai Province and Ho Chi Minh City.
- Connecting the land database with relevant sectors, prioritizing the Tax Sector for tax calculation related to land management and use; the Banking Sector for loan purposes and mortgage registration; the Construction Sector and the Transport Sector for basic investigation and overall planning purposes.
Phase 2: After completing Phase 1, implementing remaining contents.
- Establishing regulations on updating, exploiting, and operating the system over the long term to ensure synchronization, responsibility, and compliance with authority of organizations and individuals participating in the system from the central to local levels.
- Organizing training courses on data integration, security, data safety, original software systems, development tools, geographic information systems (GIS), and system operation and maintenance.
At the end of each phase, the Ministry of Natural Resources and Environment will evaluate results, conduct mid-term reviews, and final summaries of the Project to perfect the system and effectively implement it by 2020.
4. Project Costs and Funding Sources:
The costs for implementing the Project are sourced from the central government's economic budget for tasks carried out by the Ministry of Natural Resources and Environment.
The estimated cost for Phase 1 of the Project is: 258,066,000,000 VND.
In words: Two hundred fifty-eight billion, sixty-six million dong.
The total investment for the entire Project will be determined after receiving the official review result from the Ministry of Information and Communications.
In addition to the aforementioned budget, the following sources of funding will also be utilized:
- Local budgets allocated from land use fee revenues to implement the component database construction content under the Comprehensive Project for Building Land Records and Land Management Databases.
- Official Development Assistance (ODA) funds from the World Bank for constructing the component database for nine provinces under the VLAP Project; part of these funds will be mobilized to restructure the VLAP Project to build the Central Data Integration Center for Land Databases at the State Land Management Agency.
- It is planned to mobilize non-refundable aid funds from the Korean Government - Korea International Cooperation Agency (KOICA) to implement the system design and pilot testing according to a similar model to South Korea's Unified Land Information System.
1. The Ministry of Natural Resources and Environment shall be responsible for performing the following tasks:
Article 2. Implementation
a) Working with relevant agencies to complete the necessary procedures for review and total investment estimation.
(a) Work with relevant agencies to complete the procedures for appraisal and total investment amount.
b) Approve specific tasks and projects consistent with the contents of this Decision and the Project to enhance state management capacity in the land administration sector for the period 2011-2020.
c) Ensure the alignment of the Project with the National Program on Information Technology Application in State Agency Operations for the period 2011-2015.
d) Take the lead and coordinate with the Ministry of Agriculture and Rural Development in implementing the construction of rice cultivation land databases.
đ) Take the lead and coordinate with the Ministries of Justice, Information and Communications in developing the legal framework and policies for operating the land information system.
2. The Ministry of Finance, the Ministry of Planning and Investment, and related agencies shall balance the annual budget to allocate funds for the Ministry of Natural Resources and Environment to implement the Project according to schedule.
3. The Ministry of Information and Communications shall be responsible for coordinating with the Ministry of Natural Resources and Environment to review the Project and the total investment amount for the entire Project; guide the implementation of investment management for the application of information technology using state budget funds.
4. Provincial People's Committees under the central government shall be responsible for allocating funds from land revenue to implement the component database construction content; direct relevant departments to implement Project contents at the local level.
Article 3. This Decision takes effect from the date of issuance.
The Ministers of Natural Resources and Environment, Planning and Investment, Finance, Agriculture and Rural Development, Justice, Information and Communications; the Chairpersons of the People's Committees of provinces and centrally governed cities, and related agencies shall be responsible for enforcing this Decision./.
