PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government on the issuance of the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Parks;
Pursuant to Decree No. 42/CP dated July 16, 1996 of the Government on the issuance of the Management Regulation for Investment and Construction and Decree No. 92/CP dated August 23, 1997 on supplementing and amending certain articles of the Management Regulation for Investment and Construction issued together with Decree No. 42/CP;
Pursuant to the appraisal opinion of the State Appraisal Council regarding the Hoa Lac High-Tech Park Project, as stated in Circular No. 5494/HĐTĐ dated August 5, 1998.
At the proposal of the Minister of Science, Technology and Environment (Proposal No. 1162/TTr-BKHCNMT dated May 14, 1998) and the Director of the Vietnam Industrial Zone Management Board;
DECISION:
Article 1: Establish Hoa Lac High-Tech Park, Ha Tay Province.
Hoa Lac High-Tech Park shall be organized and operated according to the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Parks issued together with Decree No. 36/CP dated April 24, 1997 of the Government.
Article 2.
I. Approve the overall planning of Hoa Lac High-Tech Park, with the total area and planning content as stated in the submitted dossier attached to Document No. 1585/BKHCNMT-BQL CNC dated June 30, 1998 of the Ministry of Science, Technology and Environment.
1. Regarding the nature of the High-Tech Park:
Hoa Lac High-Tech Park is a crucial factor in accelerating the industrialization and modernization process of the regional and national economy, serving as a bridge to receive technology transfer and eventually develop new high technologies; it is also a testing ground and pilot site for the development of high-tech parks nationwide.
2. Regarding location and scale:
Hoa Lac High-Tech Park is located within the Miếu Môn - Xuân Mai - Hoa Lac - Son Tay urban chain planning approved by the Government in Decision No. 372/QĐ-TTg dated June 2, 1997. Based on the land fund of the entire region, combined with the exploitation of potential and capacity according to the inter-regional development planning, Hoa Lac High-Tech Park will mainly be constructed on the territory of Thach That District, Ha Tay Province, with a scale of approximately 1,650 hectares.
3. Regarding environmental management and landscape:
The overall spatial layout must be consistent with the exploitation of topography and include measures to ensure a clean environment.
4. Regarding technical infrastructure planning:
It is necessary to ensure the development of transportation works, service facilities, meeting water supply, electricity, drainage, and communication requirements for scientific and technological research and development, production, and residential life.
5. Regarding the management of Hoa Lac High-Tech Park:
The Minister of Government Organization and Personnel, in conjunction with the Minister of Science, Technology and Environment and the Vietnam Industrial Zone Management Board, shall submit to the Prime Minister for decision on establishing the Hoa Lac High-Tech Park Management Board in accordance with current regulations and other necessary management organizations.
II. Approve the Phase 1, Stage I Investment Project of Hoa Lac High-Tech Park with the following main contents:
1. Project Name: Hoa Lac High-Tech Park.
2. Construction Location: Lower Bang, Thach Hoa, Tan Xa, Binh Yen, and Co Dong communes, Thach That District, Ha Tay Province.
3. The Phase 1 area is 200 hectares, which will be accurately determined when the procedures for granting land use rights are carried out in accordance with the Land Law. If the Phase 1 project is implemented effectively, subsequent phases will be considered for approval.
4. The investment capital for Phase 1 technical infrastructure projects is 96 million USD;
5. Other construction items such as Research and Development Institutes, Software Centers, Commercial Centers, etc., will depend on the form of investment (state budget, BOT, FDI, and other sources) and will be implemented in accordance with current regulations.
6. During the implementation of Phase 1, priority should be given to the project for developing human resources for high technology and Hoa Lac High-Tech Park.
Article 3. Hoa Lac High-Tech Park shall enjoy the highest financial incentives under the Law on Domestic Investment Promotion and the Law on Foreign Investment, and other incentives at the highest level as stipulated by current regulations.
Article 4.
1. Assign the Ministry of Science, Technology and Environment:
a. Establish the Project Management Unit (PMU) of Hoa Lac High-Tech Park to carry out initial investment preparation and implementation steps.
b. Examine and approve detailed planning for functional zones within Hoa Lac High-Tech Park, serving as a basis for designing and constructing projects within the park; direct the general planning study of Hoa Lac High-Tech Park to be suitable with actual conditions and comply with current regulations.
c. Lead and coordinate with relevant ministries, sectors, and localities in drafting and submitting to the Prime Minister for promulgation of operational regulations and specific policies applicable to high-tech parks.
2. Assign the People's Committee of Ha Tay Province:
a. Carry out territorial management functions over Hoa Lac High-Tech Park in accordance with current regulations.
b. Coordinate with the Ministry of Science, Technology and Environment and related entities in managing planning, environmental management, ensuring security and public order; compensation, clearance of land, relocation of residents for the construction of Hoa Lac High-Tech Park.
c. Proactively plan resettlement areas; organize implementation to stabilize the lives and production of people in resettlement areas as soon as possible.
3. Relevant ministries, sectors, and localities:
a. Implement tasks related to Hoa Lac High-Tech Park according to their assigned functions and responsibilities.
b. Depending on the needs of constructing Hoa Lac High-Tech Park, the Prime Minister may assign additional tasks to relevant ministries, sectors, and localities when necessary.
Article 5. This Decision shall take effect fifteen days from the date of signature. The Ministers of Science and Technology, Planning and Investment, Finance, Agriculture and Rural Development, National Defense, the Governor of the State Bank of Vietnam, the Director of the Management Board of Industrial Zones of Vietnam, the Chairman of the People's Committee of Ha Tay Province, the Director General of the Land Administration General Department, and the Heads of relevant agencies within their respective functions and authorities shall be responsible for implementing this Decision./.
