 THE MINISTER OF FINANCE

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Considering the proposal of the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Position and Functions

The Cadre and Civil Servant Organization Department is a unit under the Ministry of Finance, with the function of advising and assisting the Minister of Finance in implementing unified management tasks regarding organizational structures, staffing, salaries, personnel, training, and cadre development within the Ministry of Finance.

Article 2. Tasks

1. Submit to the Minister of Finance:

a) Long-term, medium-term, and annual strategies and plans for cadre work of the Ministry of Finance;

b) Drafts of normative legal documents regulating the functions, tasks, powers, and organizational structure of the Ministry of Finance and its subordinate units and local financial administrative bodies;

c) Professional standards for positions in the finance civil service; leadership position standards within the Ministry's jurisdiction; standards for the positions of Director and Deputy Director of provincial and municipal Departments of Finance;

d) Hierarchical management systems concerning organizational structures, civil servant management, and responsibilities in performing public duties of cadres, civil servants, and officials under the Ministry of Finance.

2. Implement and guide, supervise the implementation of strategies, planning, normative legal documents, and other documents issued by the Minister of Finance regarding cadre affairs.

3. Participate in drafting policies and regulations related to areas within the department's functions and tasks.

4. Regarding organizational structures:

a) Develop and submit to the Ministry proposals for improving the organizational structure of the Ministry of Finance and its subordinate organizations;

b) Lead and coordinate with other organizations and units under the Ministry to develop documents defining the functions, tasks, powers, and organizational structure of units;

c) Submit to the Ministry decisions on establishing, merging, dissolving, renaming, and restructuring organizational units under the Ministry's machinery;

d) Coordinate with relevant organizations and units to review proposals for establishing, merging, dissolving, privatizing, reorganizing, and restructuring enterprises under the Ministry;

đ) Submit to the Ministry the establishment of temporary organizations to implement specific tasks within the Ministry's jurisdiction.

5. Regarding personnel management:

a) Develop planning and management schemes for cadres, civil servants, and officials of the Ministry of Finance;

b) Submit to the Ministry decisions or make decisions within their authority on recruitment, appointment, reappointment, dismissal, disciplinary actions, transfer, rotation, retirement, termination of employment, and policy resolution for cadres, civil servants, and officials under the Ministry's management;

c) Guide subordinate organizations in implementing procedures and decisions within their authority on planning, deployment, use, retirement, termination of employment, and policy resolution for cadres, civil servants, and officials under the Ministry's management; inspect the implementation by units;

d) Submit to the Ministry decisions on dispatching cadres, civil servants, and officials for domestic and international work, study, training, and survey according to the hierarchical management regulations of the Ministry;

đ) Guide and compile periodic evaluations and assessments of cadres, civil servants, and officials as prescribed; manage identification numbers, codes, and insignias of civil servants of the Ministry of Finance;

e) Uniformly manage comprehensive files of cadres and related documents concerning their work and study processes under the Ministry's management; guide subordinate units in managing, utilizing, storing, and retrieving cadre files according to legal provisions.

6. Regarding staffing, rank, and salary management:

a) Develop the structure of civil service and official ranks for organizations and units under the Ministry of Finance;

b) Develop annual staffing allocation plans for units and organizations under the Ministry; submit to the Ministry for approval of staffing quotas or provide guidelines for staffing standards for public institutions;

c) Submit to the Ministry issuance of guidance documents on recruitment, examination, promotion, and transfer of civil service and official ranks;

d) Develop plans and proposals for recruitment and examination, promotion, and organize implementation after approval;

đ) Implement job classification changes, rank transfers, appointments to ranks, and salary increases and allowances according to prescribed regulations and hierarchical management of cadres;

e) Participate in reviewing wage unit prices and ranking enterprises under the Ministry.

7. Regarding training and development of cadres and civil servants:

a) Develop and submit to the Ministry training and development plans for cadres, civil servants, and officials, and coordinate with relevant units to implement after approval;

b) Develop a framework for secondary education in finance and accounting;

c) Lead the organization of reviews and approvals of regular training and development programs, specialized training based on standards, and in-depth training for cadres and civil servants;

d) Manage and review training targets and plans, and guide educational and training institutions and research centers under the Ministry in implementing assigned tasks;

đ) Coordinate with units in the preparation and allocation of state-funded training and development budgets for cadres and civil servants.

8. Regarding inspection work:

a) Develop inspection plans and programs for organizational and cadre work for units and organizations under the Ministry;

b) Organize regular or surprise inspections of compliance with national and Ministry of Finance regulations on organizational and cadre work by all units and organizations under the Ministry; promptly report and propose measures to prevent violations;

c) Guide units with delegated authority in developing self-inspection plans; compile inspection plans and results and monitor the implementation by units;

d) Handle cases of violation of national and Ministry regulations on organizational and cadre work within their authority or submit to the Ministry for handling.

đ) Chair and coordinate with relevant units to resolve complaints, petitions regarding organizational and cadre work; urge and inspect organizations and units at delegated levels on the implementation of laws and regulations concerning complaint and petition resolution in the field of organizational and cadre work.

9. Advise and assist the Party Cadre Management Board of the Ministry of Finance in implementing tasks related to organizational and cadre work, internal political security work, and other assigned tasks.

10. Organize the application and management of electronic databases for cadres and civil servants in the finance sector.

11. Organize statistical work, comprehensive analysis, and evaluation of the implementation of organizational and cadre work within the Ministry of Finance.

12. Serve as a permanent member or participate in the Examination Council for issuing professional certificates in accounting, auditing, valuation, and other professional certificates as assigned by the Ministry.

13. Organize scientific research or cooperate with domestic and foreign units in scientific research on organizational and cadre work; organize the implementation of international cooperation tasks as assigned by the Ministry and stipulated by law.

14. Monitor and evaluate compliance with reporting systems by individuals and organizations participating in study tours, research, and experience surveys abroad.

15. Chair or coordinate with relevant units to organize training, information dissemination, and promotion of policies and laws in the field of organizational and cadre work of the Ministry of Finance.

16. Perform other tasks and authorities assigned by the Minister of Finance.

Article 3. Organizational Structure

The Cadre and Organization Department has a Director and several Deputy Directors.

The Director of the Cadre and Organization Department is responsible to the Minister of Finance for all activities of the Department; manages civil servants and assets allocated according to regulations.

Deputy Directors of the Cadre and Organization Department are responsible to the Director for their assigned tasks.

The Cadre and Organization Department has the following divisions:

1. Policy and Comprehensive Division.

2. Establishment and Salary Division.

3. Management Division of Units under the Ministry of Finance (shortened as Human Resources Organization 1 Division).

4. Management Division of General Departments and Equivalent Units (shortened as Human Resources Organization 2 Division).

5. Training Division.

6. Inspection Division.

Specific tasks of each division are defined by the Director of the Cadre and Organization Department.

The Cadre and Organization Department operates through a divisional structure combined with a specialist system. For tasks performed under the specialist system, the Director assigns duties to staff and civil servants in accordance with their positions, standards, and professional capabilities to ensure the completion of assigned tasks.

The establishment of the Cadre and Organization Department is decided by the Minister of Finance.

Article 4. Responsibilities and Authorities of the Director

1. Organize, direct, and implement the tasks of the Cadre and Organization Department as stipulated in Article 2 of this Decision.

2. Require organizations and units under the Ministry to report promptly and periodically on matters within the Department's jurisdiction as prescribed; receive all files, documents, regulatory texts, and other relevant documents concerning the performance of assigned functions and tasks.

3. Sign documents relating to organization, establishment, labor, salary, personnel, and training and development of cadres and civil servants as delegated and authorized by the Minister of Finance.

4. Sign guiding, explanatory, response, or working-related documents within the Department's jurisdiction.

Article 5. Effectiveness and Responsibility for Implementation

This Decision takes effect from the date of signing and replaces Decision No. 179/2003/QD-BTC dated October 23, 2003, of the Minister of Finance on the functions, tasks, authorities, and organizational structure of the Cadre and Organization Department, and Decision No. 3820/QD-BTC dated November 18, 2004, of the Minister of Finance on the establishment of the Inspection Division and renaming the Organization-Establishment Division of the Cadre and Organization Department.

The Director of the Cadre and Organization Department, the Head of the Ministry of Finance's Office, and the Heads of units and organizations under the Ministry of Finance are responsible for implementing this decision./.
