Decision No. 1993/2000/QĐ-BGTVT Issuing the Regulation on Training, Examination, and Issuance of Certificates for Project Management Directors in the Transport Industry

GENERAL PROVISIONS

Article 1: These Regulations stipulate the management of organizing training, testing and granting certificates for project management directors for cadres eligible for appointment or currently holding the position of "Project Management Director" (hereinafter referred to as PMD) in projects within the transport industry.

These Regulations serve as a legal basis to ensure the achievement of the goal of training a cadre of PMDs with sufficient professional competence and moral qualities to effectively fulfill the role of PMD.

Article 2: The PMD certificate is a type of certificate confirming professional capability issued to individuals who have successfully completed the PMD training course, serving as a basis for appointing the PMD position in projects within the transport industry.

Article 3: The Training Institute for Transport Industry Cadres (hereinafter referred to as the Training Institute) is the sole institution authorized by the Ministry to organize and implement the training of PMDs.

PROVISIONS ON ORGANIZING PMD TRAINING

Article 4: Program and content of PMD training:

1. The Training Institute is responsible for coordinating with the Personnel and Labor Department (hereinafter referred to as the Personnel Department) and relevant agencies to establish the objectives, content, and program of PMD training, to be submitted to the Minister for approval and issuance.

2. Based on the approved objectives, content, and program of PMD training, the Training Institute will take the lead in organizing the compilation of teaching materials, lectures, and textbooks through the Personnel Department, to be submitted to the Minister for approval and issuance. In the initial courses (not exceeding three), teaching materials can be used and reviewed by the examination board specified in Clause 2 of Article 8.

3. The training program and textbooks approved by the Minister are legally binding and consistent throughout the industry for PMD training. When there is a need for modification, the Training Institute will take the lead and coordinate with the Personnel Department to review and adjust the content, and submit it to the Minister for approval.

Article 5: Directing and managing the implementation of the Steering Committee's activity plans.

1. The Training Institute is responsible for:

1.1. Coordinating with the Personnel Department to develop comprehensive long-term and annual plans for training and developing a cadre of PMDs to meet the needs of the industry.

1.2. Preparing physical facilities and other conditions necessary to organize PMD training courses at the institute and suitable locations, ensuring compliance with the approved objectives, content, and program.

1.3. Being responsible for storing all records and related documents of PMD training courses.

2. The Personnel Department is responsible for:

2.1. Regularly managing, monitoring, inspecting, and supervising PMD training activities conducted by the Training Institute.

2.2. Annually preparing training quotas for the Training Institute and informing relevant units within the industry to nominate candidates for training.

3. Each year, Project Management Boards, investors, enterprises, and provincial transportation departments (transportation companies) must develop their training and development needs for PMDs and submit them to the Training Institute by the beginning of September for consolidation and submission to the Ministry as a basis for allocating next year’s training and development quotas for PMDs in the industry.

PROVISIONS ON ENROLLMENT FOR PMD TRAINING

Article 6: Enrollment criteria:

The enrollment criteria are individuals who have graduated from university and have at least five years of work experience in the field of projects.

Article 7: Enrollment process:

1. The Training Institute, based on the annual training quota for PMDs assigned by the Ministry, issues an enrollment announcement to relevant units within the industry. The announcement must clearly specify the enrollment criteria, application deadline, start and end dates of the course, study location, training costs, and other necessary information for units to nominate candidates for training, while also submitting the announcement to the Personnel Department for management.

2. The Training Institute compiles a list of applicants, reviews them according to the enrollment criteria (as stipulated in Article 6), prepares a unified list of students to be sent to the Personnel Department, and simultaneously sends a notification to convene students for registration. Upon completion of the course, the Training Institute prepares a list of qualified students for final exams to be sent to the Examination Board for certification of PMDs for review and organization of the graduation exam.

PROVISIONS ON THE EXAMINATION BOARD AND SUPERVISORY PANEL

Article 8: Provisions on the Examination Board for Certification of PMDs:

1. The Examination Board for Certification of "PMDs" is a semi-permanent organization within the transport industry established by the Minister of Transportation to oversee the organization of final exams at the conclusion of the training course, serving as the basis for issuing PMD certificates and providing advice on issues related to the organization and management of PMD training.

2. The Examination Board for Certification of "PMDs" consists of the following members:

a. The leader of the Personnel Department is the Chairman of the Board;

b. The Director of the Training Institute is the Vice-Chairman of the Board;

c. The Deputy Director of the Training Institute in charge of training is the permanent member;

d. The Head of the Training and Research Management Department of the Training Institute is a member and secretary of the Board;

e. A representative from the Inspection and Quality Control Bureau of Transport Works is a member;

f. A representative from the Investment Planning Department is a member;

h. Representative of the Science and Technology Department is a member;

i. Training specialist from the Personnel and Labor Affairs Department is a member.

In case of necessity, additional experts may be invited to join the Council.

The specific tasks of each Council member shall be determined by the Chairman of the Council; the Council shall be valid for operation when at least 3/4 of its members are present.

3. Functions and duties of the Council for issuing the Director of Highway Development and Construction Certificate:

a. Advising the Ministry's leadership on issues related to training and issuing the Director of Highway Development and Construction Certificate.

b. Developing standard examination questions for Highway Development and Construction Director training courses, establishing examination rules and regulations, and other related matters concerning the examination period.

c. Approving the list of candidates for the examination established by the Highway Technical College according to Article 7.

d. Deciding on the establishment of the Examination Board (marking the examination) and approving the examination questions for each examination session.

e. Inspecting and directing the organization of final examinations in accordance with examination rules and regulations.

f. Determining the examination results and recommending the issuance of the Director of Highway Development and Construction Certificate to successful course participants.

Article 9: Regulations on the Examination Board:

1. The Chairman of the Council for issuing the "Director of Highway Development and Construction" Certificate issues a decision to establish the Examination Board for each examination session. Members of the Examination Board include:

a. Chairperson: One member of the Council for issuing the "Director of Highway Development and Construction" Certificate;

b. Commissioners: From 3 to 5 people who are experts in project management and administration.

2. The Examination Board has the following functions and duties:

a. Directly organizing the examination, supervising the examination process, and ensuring strict adherence to examination rules and regulations;

b. Preparing minutes to report to the Council for issuing the "Director of Highway Development and Construction" Certificate for handling violations of examination rules and regulations (if any);

c. Organizing the marking of examinations, compiling results, reporting to the Council for issuing the "Director of Highway Development and Construction" Certificate, and being responsible for the accuracy of the examination results.

3. Upon completion of examination-related tasks, the Examination Board will automatically dissolve itself.

REGULATIONS ON THE DIRECTOR OF HIGHWAY DEVELOPMENT AND CONSTRUCTION CERTIFICATE

Article 10: Certificate Model, Issuance, and Management:

1. The Minister of Transport assigns the Personnel and Labor Affairs Department Head to issue the Director of Highway Development and Construction Certificate.

2. The Highway Technical College is responsible for drafting the model of the Director of Highway Development and Construction Certificate and submitting it for approval by the Minister.

3. The Highway Technical College is responsible for organizing the printing, managing the Director of Highway Development and Construction Certificate within the transport industry.

Article 11: Validity Period and Usage Effectiveness of the Director of Highway Development and Construction Certificate

1. The Director of Highway Development and Construction Certificate is valid for use for five years from the date of issuance.

2. Individuals wishing to have their Director of Highway Development and Construction Certificate renewed, when the previously issued certificate has expired, must participate in a supplementary course and pass the examination organized by the Council for issuing the Director of Highway Development and Construction Certificate.

3. Individuals holding the Director of Highway Development and Construction Certificate must attend annual refresher courses to update necessary information. The time and content of the refresher course are drafted by the President of the Highway Technical College and submitted for approval by the Minister.

4. Individuals who have been issued the Director of Highway Development and Construction Certificate but have not continuously performed the duties of a Director of Highway Development and Construction for three years will lose the validity of the certificate. To perform the duties of a Director of Highway Development and Construction again, they must undergo a training course as if obtaining the certificate for the first time. In cases where the certificate is lost, a declaration must be made, confirmed by the head of the unit, and the Personnel and Labor Affairs Department will consider reissuing it according to a separate regulation.

5. Individuals who are disciplined with a warning or higher during the performance of Director of Highway Development and Construction duties will have their Director of Highway Development and Construction Certificate revoked. The managing unit is responsible for recovering and returning the certificate to the Highway Technical College.

Article 12: The President of the Highway Technical College and the Personnel and Labor Affairs Department Head of the Ministry of Transport are responsible for coordinating, directing implementation, and organizing inspections of the enforcement of this regulation.

Article 13: This Regulation takes effect fifteen days after the date of signature.
