WHEREAS Pursuant to the Law on Prevention and Control of AIDS dated June 29, 2006; issued by the Government on June 19, 2015;

Pursuant to Decree No. 88/2020/NĐ-CP dated July 28, 2020 of the Government detailing and guiding the implementation of some provisions of the Labor Safety and Health Law on mandatory work injury and occupational disease insurance;Pursuant to the Law on Prevention and Control of Narcotics dated December 9, 2000; the Law Amending and Supplementing Certain Provisions of the Law on Prevention and Control of Narcotics dated June 3, 2008;Pursuant to the Law on Handling Administrative Violations dated July 1, 2012;Pursuant to the Ordinance on Prevention and Control of Prostitution dated March 17, 2003;

Pursuant to Decree No. 78/2002/NĐ-CP dated October 4, 2002 of the Government on credit for poor people and other policy beneficiaries;The Prime Minister promulgates this Decision amending and supplementing certain provisions of Decision No. 29/2014/QĐ-TTg dated April 26, 2014 on credit for households and people living with HIV, former drug addicts, people undergoing methadone maintenance treatment, and reformed sex workers.Amending and supplementing certain provisions of Decision No. 29/2014/QĐ-TTg dated April 26, 2014 on credit for households and people living with HIV, former drug addicts, people undergoing methadone maintenance treatment, and reformed sex workers, as follows:

1. Amending and supplementing Clause 4 of Article 4 as follows:"4. For borrowing through a household, members of the household who are not subjects participating in the borrowing must authorize in writing the representative to borrow on their behalf."

2. Amending Article 6 as follows:Remove the time period "2014 - 2016".

Decree No. "1. The source of funds for lending shall be provided by the State Budget at 50% of the total annual funding plan, the Vietnam Bank for Social Policies shall mobilize the remaining 50%, and the State Budget shall subsidize the interest rate differential and management fees according to regulations.2. From other legitimate sources of mobilization""1. Continue to implement the pilot program in 15 provinces and cities until December 31, 2020."2. In 2021, the Ministry of Labor, Invalids and Social Affairs shall take the lead, in coordination with relevant ministries and sectors, to evaluate the results achieved and the impact of the policy, and report to the Prime Minister for consideration and decision on expanding the implementation of this Decision nationwide.”This Decision takes effect from March 1, 2020.

Article 1. SỬA ĐỔI, BỔ SUNG MỘT SỐ ĐIỀU CỦA QUYẾT ĐỊNH SỐ 29/2014/QĐ-TTG NGÀY 26 THÁNG 4 NĂM 2014 VỀ TÍN DỤNG ĐỐI VỚI HỘ GIA ĐÌNH VÀ NGƯỜI NHIỄM HIV, NGƯỜI SAU CAI NGHIỆN MA TÚY, NGƯỜI ĐIỀU TRỊ NGHIỆN CÁC CHẤT DẠNG THUỐC PHIỆN BẰNG THUỐC THAY THẾ, NGƯỜI BÁN DÂM HOÀN LUÂN, NHƯ SAU:

1. SỬA ĐỔI, BỔ SUNG KHOẢN 4 ĐIỀU 4 NHƯ SAU:

"4. ĐỐI VỚI VIỆC VAY VỐN THÔNG QUA HỘ GIA ĐÌNH, CÁC THÀNH VIÊN CỦA HỘ GIA ĐÌNH KHÔNG LÀ CHỦ THỂ THAM GIA VIỆC VAY VỐN THÌ PHẢI ỦY QUYỀN BẰNG VĂN BẢN CHO NGƯỜI ĐẠI DIỆN ĐỨNG RA VAY VỐN".

2. SỬA ĐỔI ĐIỀU 6 NHƯ SAU:

 BO MỐC THỜI GIAN "2014 - 2016".

3. Amend and supplement Article 9 as follows:

"1. NGUỒN VỐN CHO VAY DO NGÂN SÁCH NHÀ NƯỚC CẤP 50% TRÊN TỔNG SỐ KẾ HOẠCH NGUỒN VỐN HÀNG NĂM, NGÂN HÀNG CHÍNH SÁCH XÃ HỘI HUY ĐỘNG 50% CÒN LẠI, NGÂN SÁCH NHÀ NƯỚC CẤP BÙ CHÊNH LỆCH LÃI SUẤT VÀ PHÍ QUẢN LÝ THEO QUY ĐỊNH.

2. TỪ CÁC NGUỒN HUY ĐỘNG HỢP PHÁP KHÁC"

4. Amend and supplement Article 10 as follows:

"1. TIẾP TỤC THỰC HIỆN THÍ ĐIỂM TẠI 15 TỈNH, THÀNH PHỐ ĐẾN HẾT 31 THÁNG 12 NĂM 2020".

2. NĂM 2021, BỘ LAO ĐỘNG - THƯƠNG BINH VÀ XÃ HỘI CHỦ TRÌ, PHỐI HỢP VỚI CÁC BỘ, NGÀNH CÓ LIÊN QUAN ĐÁNH GIÁ KẾT QUẢ ĐẠT ĐƯỢC VÀ TÁC ĐỘNG CỦA CHÍNH SÁCH, BÁO CÁO THỦ TƯỚNG CHÍNH PHỦ XEM XÉT QUYẾT ĐỊNH VIỆC MỞ RỘNG THỰC HIỆN QUYẾT ĐỊNH TRÊN PHẠM VI CẢ NƯỚC”.

Article 2. QUYẾT ĐỊNH NÀY CÓ HIỆU LỰC TỪ NGÀY 01 THÁNG 3 NĂM 2020.

Article 3. BỘ TRƯỞNG, THỦ TRƯỞNG CƠ QUAN NGANG BỘ, THỦ TRƯỞNG CƠ QUAN THUỘC CHÍNH PHỦ, CHỦ TỊCH ỦY BAN NHÂN DÂN TỈNH, THÀNH PHỐ TRỰC THUỘC TRUNG ƯƠNG, CHỦ TỊCH HỘI ĐỒNG QUẢN TRỊ VÀ TỔNG GIÁM ĐỐC NGÂN HÀNG CHÍNH SÁCH XÃ HỘI CHỊU TRÁCH NHIỆM THI HÀNH QUYẾT ĐỊNH NÀY./.
