DECISION OF THE MINISTER OF FINANCE
Issuing the schedule of fees and charges for
fishery resource protection work

THE MINISTER OF FINANCE
- Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on tasks, powers, and responsibilities for state management of ministries and agencies at the ministerial level;
- Pursuant to Decree No. 178/CP dated October 28, 1994 of the Government on the tasks, powers, and organizational structure of the Ministry of Finance;
- Pursuant to Clause 3, Article 5 of Decree No. 93/CP and Articles 18, 19, and 20 of the implementation regulations of the Animal Health Ordinance issued together with Decree No. 93 dated November 27, 1993 of the Government;
- Pursuant to Clause 6 and Clause 7, Article 2 of Decree No. 50/CP dated June 21, 1994 of the Government on tasks, powers, and organizational structure of the Ministry of Fisheries;
- Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget;
After receiving comments from the Ministry of Fisheries and upon the proposal of the Director General of the General Department of Taxation.
DECISION:
Article 1. Attached herewith is the Schedule of Fees and Charges for Fishery Resource Protection Work.
1. The subjects required to pay fees and charges according to the rates prescribed herein are domestic organizations and individuals, and foreign organizations and individuals engaged in production and business activities in the fisheries sector when they obtain permits for operation, safety inspections of fishing vessels and equipment, and quality and aquatic animal health inspections from fishery resource protection authorities in accordance with the provisions of the law.
2. In cases where permits are reissued or extended, fifty percent (50%) of the prescribed rate shall be collected for the corresponding fee or charge; in cases requiring verification or following the new issuance process, the charge shall be collected at the rate applicable for new issuance.
3. If customers request inspections outside regular working hours to ensure timely completion, the fees and charges shall be increased by fifty percent (50%) over the rates specified in the appendices attached to this Decision.
4. Fees and charges shall be paid in Vietnamese Dong. Where the prescribed rate is in United States Dollars (USD), it shall be converted to Vietnamese Dong based on the exchange rate announced by the State Bank of Vietnam at the time of payment.
Article 2. The Fisheries Resource Protection Agency under the Ministry of Fisheries, local Fisheries Resource Protection Agencies, and Fisheries Centers (collectively referred to as the fishery resource protection agencies) shall retain forty percent (40%) of the total amount of fees and charges collected before remitting them to the State budget for expenses related to the collection of fees and charges, while the remaining sixty percent (60%) must be remitted to the State budget.
The Fisheries Resource Protection Agency under the Ministry of Fisheries shall be responsible for directing and guiding fishery resource protection agencies to implement the collection, remittance, and management of fees and charges for fishery resource protection uniformly throughout the country in accordance with Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance, which provides guidance on implementing Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget.
Article 3. This Decision shall take effect fifteen days from the date of signature; all provisions regarding the collection, remittance, and management of fees and charges for fishery resource protection that conflict with this Decision are hereby abolished.
Article 4. Organizations and individuals subject to the obligation to pay fees and charges for fishery resource protection, the Fisheries Resource Protection Agency, units collecting fees and charges, and relevant agencies shall be responsible for implementing this Decision.
