GUIDELINES ON IMPLEMENTATION OF TRANSFER OF STATE MANAGEMENT FUNCTIONS IN HEALTH CARE FROM DISTRICT, COUNTY, CITY-DISTRICT AND PROVINCE-CITY CENTERS TO THE SAME LEVEL PEOPLE'S COMMITTEES ISSUED BY THE STAFFING AND CIVIL SERVICE BOARD OF THE GOVERNMENT AND THE MINISTRY OF HEALTH NUMBER 20/2001/TTLT-BTCCBCP-BYT ON APRIL 27, 2001
Pursuant to Clause 2, Article 2 of the Decree No. 12/2001/NĐ-CP dated March 27, 2001 of the Government on "Reorganizing some specialized agencies under provincial people's committees and municipal people's committees directly under the central government and district, county, city-district and province-city people's committees", the Staffing and Civil Service Board of the Government and the Ministry of Health issue guidelines for implementing Clause 4, Article 1 regarding the content: "Transfer of state management functions in health care from district, county, city-district and province-city centers to the same level people's committees" as follows:
I. TASKS AND RESPONSIBILITIES OF DISTRICT, COUNTY, CITY-DISTRICT AND PROVINCE-CITY PEOPLE'S COMMITTEES (HEREINAFTER REFERRED TO AS DISTRICT) FOR STATE MANAGEMENT FUNCTIONS IN HEALTH CARE ON THE DISTRICT TERRITORY
1. Tasks
a. Develop plans, programs, and solutions to implement health care services for the population on the district territory;
b. Direct the implementation of plans, programs, and solutions for health care services on the district territory after approval;
c. Decide on inspection and supervision plans for health care on the district territory and direct the implementation of these plans;
d. Direct and guide sectors and mass organizations within the district on public health work, disease prevention, promoting socialization, and educating the population to enhance their understanding of hygiene practices for self-care in the community.
2. Responsibilities
Be responsible before the provincial people's committee for the content of state management functions in health care on the district territory.
II. TASKS AND RESPONSIBILITIES OF THE ORGANIZATION FOR STATE MANAGEMENT FUNCTIONS IN HEALTH CARE ON THE DISTRICT TERRITORY
1. Organization
a. Depending on the characteristics of the district, the Chairman of the District People's Committee decides to arrange cadres and civil servants in the Office of the People's Council and People's Committee of the district to work as specialists (not organized into separate departments), directly advising the Chairman or Vice-Chairman of the District People's Committee on state management functions in health care on the district territory. The staffing for state management functions in health care of the district is included in the staffing of the Office of the People's Council and People's Committee of the district and is adjusted within the total staffing for state management functions of the province and district;
b. The professional qualifications of specialists in state management functions in health care must have a bachelor's degree in Medicine or Pharmacy or higher. Other qualifications must meet the standards prescribed for specialist positions.
2. Tasks
a. Advise the Chairman of the District People's Committee to approve plans, programs, and solutions to implement health care services for the population on the district territory proposed by the Health Center;
b. Monitor activities in the implementation of plans and programs of the Health Center on the district territory, promptly identify and report to the Chairman of the District People's Committee so that the Chairman can coordinate with the Director of the Provincial Department of Health to direct and adjust the activities of the District Health Center. Participate in meetings and conferences organized by the District Health Center or by the Provincial Department of Health discussing health care services on the district territory;
c. Based on the inspection and supervision plan of the Provincial Department of Health's Inspectorate, develop and submit to the Chairman of the District People's Committee a plan for inspection and supervision of health care on the district territory and organize its implementation after approval. Propose and recommend measures for handling after inspection and supervision to the Chairman of the District People's Committee and the Director of the Provincial Department of Health; In case of necessity, propose to the Chairman of the District People's Committee to issue a decision for sudden inspections of health care activities on the district territory. Report the results to the Chairman of the District People's Committee and the Director of the Provincial Department of Health after implementation;
d. Submit to the Chairman of the District People's Committee a plan to cooperate with related sectors and mass organizations to promote socialization in health care services and educate the population to enhance their awareness about hygiene practices for self-care in the community.
3. Responsibilities.
Be responsible before the Chairman of the District People's Committee for the implementation of tasks stipulated in Point 2, Section II above.
III. TASKS AND RESPONSIBILITIES OF THE PROVINCIAL DEPARTMENT OF HEALTH FOR STATE MANAGEMENT FUNCTIONS IN HEALTH CARE ON THE DISTRICT TERRITORY
1. Tasks
a. Submit to the Provincial People's Committee for approval plans, programs, and solutions to implement health care services for the population on the district territory proposed by the District People's Committee;
b. Direct and guide the District Health Center to implement approved plans, programs, and solutions;
c. Direct the Provincial Department of Health's Inspectorate to cooperate with the specialist in state management functions in health care of the district to develop an inspection and supervision plan for health care on the district territory to be submitted to the Director of the Provincial Department of Health and the Chairman of the District People's Committee and organize its implementation after approval.
2. Responsibilities
Be responsible before the Provincial People's Committee for directing, guiding, inspecting, and supervising the implementation of health care service targets, plans, programs, and solutions.
IV. IMPLEMENTATION
1. Chairmen of provincial and centrally governed city people's committees are responsible for organizing the implementation of this Circular;
2. This Circular takes effect from the date of issuance and replaces Sections 2.4 and 2.8 of Point 2, Section IV of the Joint Circular No. 02/1998/TTLT-BYT-BTCCBCP dated June 27, 1998 of the Ministry of Health and the Staffing and Civil Service Board of the Government;
3. During the implementation process, if there are difficulties or obstacles, please reflect them to the Staffing and Civil Service Board of the Government and the Ministry of Health for research and resolution.
