DECISION
Establish the Technical Service Center for Fisheries Exploitation and Protection under the Fisheries Exploitation and Protection Department.
UNDER THE FISHERIES EXPLOITATION AND PROTECTION DEPARTMENT
Pursuant to Decree No. 43/2003/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Fisheries; 2/5/2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Fisheries;
Pursuant to Decision No. 08/2003/QĐ-BTS of the Minister of Fisheries dated August 5, 2003 stipulating the functions, tasks, powers, and organizational structure of the Fisheries Exploitation and Protection Department;
Considering the proposal of the Director of the Personnel and Organization Department and the Director of the Fisheries Exploitation and Protection Department.
DECISION:
Article 1. Establish the Technical Service Center for Fisheries Exploitation and Protection (hereinafter referred to as the Center) under the Fisheries Exploitation and Protection Department.
The Center is a self-financing public service unit; it has legal personality, its own seal, and is allowed to open an account at the Treasury for transactions.
The operational regulations of the Center shall be approved by the Director of the Fisheries Exploitation and Protection Department.
The Center's headquarters is located at No. 10 Nguyen Cong Hoan Street, Ba Dinh District, Hanoi.
Article 2. The Center operates in the following fields:
1. Inspection of fishing vessels within the jurisdiction of the Ministry of Fisheries; testing equipment that requires strict safety standards such as boilers, pressure vessels, refrigeration systems in the fisheries sector according to the division and classification of the Ministry of Fisheries and the provisions of the law.
- Cooperating with local fisheries inspection agencies to carry out technical safety inspections of fishing vessels in localities according to the annual work plan approved by the Director of the Fisheries Exploitation and Protection Department.
2. Training services:
a) Organizing training, seminars, and issuing certificates for crew members of fishing vessels, workers operating, manufacturing, and repairing equipment that requires strict safety standards in accordance with the regulations of the Ministry of Fisheries and the law.
b) Cooperating with schools and district agencies to train captains and chief engineers of fishing vessels in accordance with the law and the regulations of the Ministry of Fisheries.
3. Consulting, technical, and technological services:
a) Providing consulting services to all economic sectors when needed, ensuring compliance with national and Ministry of Fisheries regulations on vessel inspection, registration, testing of equipment requiring strict safety standards, and fisheries exploitation and protection, as well as environmental protection for aquatic species.
b) Implementing design work for fishing vessels, preparing completion documents for fishing vessels with a designed waterline length of twenty meters or more (L >= 20m); collaborating with district agencies and business owners to prepare completion documents for fishing vessels and equipment in accordance with regulations.TK c) Supplying equipment and tools for fishing activities such as lifebuoys, navigation equipment, net materials, and other supplies and equipment for fisheries exploitation and protection.
4. Performing service activities within the scope permitted by law.
The Center has rights and obligations:
Article 3. Directly engaging in transactions and signing service contracts in the fields of operation specified in Article 2.
Fulfilling all legal obligations to the State and the Fisheries Exploitation and Protection Department.
The Center has a Director appointed by the Minister of Fisheries upon the recommendation of the Director of the Fisheries Exploitation and Protection Department and the Personnel and Organization Department. The Director is assisted by one or two Deputy Directors, a Chief Accountant, and a number of specialized staff.
Adhering to laws, regulations, and guidelines of relevant state management agencies concerning the permitted fields of operation of the Centre.
Article 4. The Deputy Directors and Chief Accountant of the Center are selected and appointed by the Director of the Fisheries Exploitation and Protection Department with the approval of the Ministry of Fisheries. The Center's public service staff quota includes five people receiving state budget salaries: the Director, Deputy Directors, Chief Accountant, and one to two inspectors. Other specialized staff work under labor contracts.
Initial investment funds for the Center's equipment are provided by the Fisheries Exploitation and Protection Department after approval by the Ministry of Fisheries.
Article 5. The Center's operating funds are derived from service activity fees as prescribed by law and the Ministry of Fisheries.
The Heads of the Office, Heads of Departments, Inspectors General, and the Director of the Fisheries Exploitation and Protection Department are responsible for implementing this decision.
Article 6. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
