DECISION OF THE MINISTER OF SCIENCE AND TECHNOLOGY

Amending and supplementing Articles 6, Article 7, Article 9, Article 11, and Article 13 of the Regulations on the Selection of Organizations and Individuals to Lead the Implementation of Scientific and Technological Research Projects and National Pilot Production Projects

Issued together with Decision No. 16/2003/QĐ-BKHCN dated July 18, 2003 of the Minister of Science and Technology

On the basis of Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;

On the basis of Decision No. 16/2003/QĐ-BKHCN dated July 18, 2003 of the Minister of Science and Technology promulgating the "Regulations on the Selection of Organizations and Individuals to Lead the Implementation of Scientific and Technological Research Projects and National Pilot Production Projects;"

THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to Decree No. 81/2002/NĐ-CP dated October 17, 2002 of the Government detailing the implementation of certain provisions of the Law on Science and Technology;

Pursuant to the proposals of the Heads of the Departments of Economic and Technical Sciences, Social Sciences and Natural Sciences, and Planning and Finance under the Department of Science and Technology;

Amending and supplementing Articles 6, Article 7, Article 9, Article 11, and Article 13 of the Regulations on the Selection of Organizations and Individuals to Lead the Implementation of Scientific and Technological Research Projects and National Pilot Production Projects issued together with Decision No. 16/2003/QĐ-BKHCN dated July 18, 2003 of the Minister of Science and Technology as follows:

Article 6. The application dossier for selection (referred to as the Dossier) shall include the following documents:

DECISION:

Article 1.  Application form for leading the implementation of research projects and pilot production projects according to the prescribed format (form B1-1-ĐONTC.SĐ);

Detailed description of social science and humanities research projects, scientific research and technology development projects (referred to as social science research projects and scientific research projects), and pilot production projects according to the prescribed format (forms B1-2-TMKHXH, B1-2-TMKHCN, and B1-2-TMDA.SĐ respectively);

Summary of scientific and technological activities of the organization applying to lead the research project and pilot production project (form B1-3-LLTC);

Scientific curriculum vitae of individuals applying to implement the main research project and pilot production project (form B1-4-LLCN.SĐ);

Confirmation document from organizations applying to cooperate in research (form B1-5-PHNC.SĐ) - if there is cooperation in research.

Legal documents proving the ability to mobilize funds from other sources (in cases where organizations and individuals have declared the mobilization of funds from other sources).

Organizations and individuals participating in the selection must submit one set of Dossiers (including one original copy and fifteen copies) to the Ministry of Science and Technology at 39 Tran Hung Dao Street, Hanoi (through the Post Office or directly) within the specified time limit.

The Dossier must be sealed and clearly marked on the outside as follows:

Article 7.

1. Name of the research project and pilot production project being selected for organization and individual leadership;

2. Name and code number of the Science and Technology Program (if applicable); field of science and technology;

3. Name and address of the organization applying to lead the research project and pilot production project;

4. Full name of the individual applying to be the head of the research project and pilot production project and list of those participating in the main implementation of the research project and pilot production project:

- For applications to select social science research projects: fully complete as declared in item 22 of form B1-2-TMKHXH Detailed Description of Social Science Research Project or form B1-2-TMKHCN Detailed Description of Scientific Research and Technology Development Project accordingly;

- For applications to select pilot production projects: fully complete as declared in item 11 of form B1-2-TMDA.SĐ Detailed Description of Pilot Production Project.

5. List of documents and papers included in the Dossier.

The Dossier must be submitted on time. The submission date is determined by the postmark of the Hanoi Post Office (for submissions through the Post Office) or the stamp of the Ministry of Science and Technology's Reception Office (for direct submissions).

The Ministry of Science and Technology will take the lead in opening the Dossier. Representatives of the Advisory Council for Selection, relevant agencies, and representatives of organizations and individuals applying for selection will be invited to attend.

The process of opening the Dossier will be recorded in a protocol signed and stamped by the Ministry of Science and Technology, the representative of the Advisory Council for Selection, and the representative of the organization and individual applying for selection (if present).

Article 9.

Dossiers that meet the conditions stipulated in Articles 5 and 8 of the Regulations on the Selection of Organizations and Individuals to Lead the Implementation of Scientific and Technological Research Projects and National Pilot Production Projects issued together with Decision No. 16/2003/QĐ-BKHCN dated July 18, 2003 of the Minister of Science and Technology (referred to as Decision 16) and Articles 6 and 7 of this Decision will be considered for evaluation. At the same time, it must ensure that at least two-thirds of the individuals applying to participate in the main implementation of the research project and pilot production project are confirmed by their respective organizations. In cases where the Dossier lacks legal documents proving the ability to mobilize funds from other sources as stipulated in item 6 of Article 6 of Decision 16, it will still be considered valid but will not be credited for mobilizing other funds.

The evaluation of the Dossier will be conducted using a scoring method based on specific criteria corresponding to social science research projects, scientific research and technology development projects, and pilot production projects; a scale of 5 points will be used to quantify each criterion (1 point: poor; 2 points: weak; 3 points: average; 4 points: good; 5 points: excellent); coefficients will be used to indicate the importance of each criterion.

Article 13:

The Council assigns two experts with deep knowledge in the research field of the Research Topic and the Science and Technology Project to review and comment on all applications for selecting the principal implementer of one (01) Research Topic or Science and Technology Project. When necessary, the Council may recommend that the Ministry of Science and Technology invite external experts with deep knowledge in the research field of the Research Topic and Science and Technology Project to review and comment on the applications (these experts will not vote on the applications).

The reviewing expert is responsible for researching, analyzing, and comparing the applications for selecting the principal implementer of one (01) Research Topic or Science and Technology Project, conducting reviews and evaluations of each application according to the criteria set forth in Article 11 of this Regulation as amended, writing comments and evaluations for each application.

The Council organizes meetings to discuss and evaluate by voting scores.

In cases where only one (01) application participates in the selection process for the principal implementer of one (01) Research Topic or Science and Technology Project, the Council still conducts evaluations according to the standards and procedures specified in this Regulation.

The organization or individual proposed as the winner for the principal implementer of the Social Sciences Research Topic or Natural Sciences Research Topic is the organization or individual whose application has the highest ranking, but must achieve an average score of at least 70 out of 100 points, with no less than 3 points for each criterion.

The organization or individual proposed as the winner for the principal implementer of the Science and Technology Project is the organization or individual whose application has the highest ranking, but must achieve an average score of at least 65 out of 100 points, with no less than 3 points for each criterion.

The Council ranks applications for selecting the principal implementer of one (01) Research Topic with an average total score of 70 out of 100 points or higher, with no less than 3 points for each criterion (or applications for selecting the principal implementer of one (01) Science and Technology Project with an average total score of 65 out of 100 points or higher, with no less than 3 points for each criterion), according to the following principles:

- Average total scores in descending order;

- Priority given to the Chairman's score (or Deputy Chairman's score, in the absence of the Chairman) for applications with the same average total score;

For applications with the same average total score, the Chairman's score (or Deputy Chairman's score, in the absence of the Chairman), the Council recommends that the Ministry of Science and Technology consider and decide.

If there is no application achieving an average total score of 70 out of 100 points or higher for a Research Topic (or 65 out of 100 points or higher for a Science and Technology Project), the Research Topic or Science and Technology Project will not be implemented in the annual plan.

The Council discusses and proposes additional or necessary amendments to the contents described in the Research Topic and Science and Technology Project Description and recommendations regarding funding for the implementation of the Research Topic and Science and Technology Project, or highlights points to note during the completion of the application by the selected organization and individual.

The Council records the evaluation of the applications registered for selection and recommends the winning organizations and individuals.

The working method of the Scientific and Technological Council for selecting organizations and individuals as the principal implementers of National-level Research Topics and Science and Technology Projects is stipulated in the Decision of the Minister of Science and Technology.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Heads of the Departments of Science and Technology in economic and technical sectors, the Department of Social Sciences and Natural Sciences, the Department of Planning and Finance, the Director of the Office, the Heads of units under the Ministry, and the Heads of related agencies and organizations are responsible for implementing this Decision.
