Regarding the establishment of the Basin Planning Management Board for the Vu Gia - Thu Bon River Basin

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Water Resources Law No. 08/1998/QH10 adopted by the National Assembly of the Socialist Republic of Vietnam on May 20, 1998;

Considering the proposal of the Director of the Department of Animal Health, the Head of the Science and Technology Division.

Pursuant to the Government Decree No. 179/1999/NĐ-CP dated December 30, 1999 on the implementation of the Water Resources Law;

Pursuant to the proposal of the People's Committee of Quang Nam Province at Official Letter No. 1601/UB-KTN dated September 8, 2004 and the People's Committee of Da Nang City at Official Letter No. 4380/UB-VP dated September 1, 2004 regarding the establishment of the Basin Planning Management Board for the Vu Gia - Thu Bon River Basin;

At the proposal of the Director of the Water Resources Department and the Head of the Cadre and Civil Servant Affairs Department,

DECISION:

Article 1. The Basin Planning Management Board for the Vu Gia - Thu Bon River Basin is established to implement the basin planning management content under Article 64 of the Water Resources Law, specifically as follows:

1. To prepare, submit for approval, and monitor the implementation of the Vu Gia - Thu Bon River Basin plan, ensuring unified basin planning management with administrative areas;

2. To coordinate with relevant agencies of ministries, sectors, and localities in basic investigations, inventory, assessment of water resources in the Vu Gia - Thu Bon River Basin, and in preparing, submitting for approval, and monitoring the implementation of branch river basin plans within the Vu Gia - Thu Bon River System;

3. To propose solutions to disputes over water resources in the Vu Gia - Thu Bon River Basin;

Article 2. The Basin Planning Management Board for the Vu Gia - Thu Bon River Basin shall consist of the following members:

1. Chairman: Deputy Minister of Agriculture and Rural Development.

2. Vice Chairmen: - The Director of the Water Resources Department serves as the Permanent Vice Chairman; - The Deputy Chairmen of the People's Committees of Quang Nam Province and Da Nang City serve as Vice Chairmen.

3. Members: - Regular members include leaders from the Departments of Agriculture and Rural Development, Fisheries - Forestry and Agriculture, Natural Resources and Environment, Health, Industry, Planning and Investment, Finance of Quang Nam Province and Da Nang City. - Non-regular members include leaders from the Departments, sectors, organizations, and individuals: Construction, Transportation, Military Command of Quang Nam Province, and related Departments, People's Committees of districts, towns, and cities within the Vu Gia - Thu Bon River Basin, invited by the Chairman when necessary to resolve related matters.

Article 3. The Basin Planning Management Board for the Vu Gia - Thu Bon River Basin has its Office located at the Department of Agriculture and Rural Development of Quang Nam Province, with the leader of the Department of Agriculture and Rural Development of Quang Nam Province concurrently serving as the Director of the Office of the Basin Planning Management Board for the Vu Gia - Thu Bon River Basin.

The Directors of the Water Resources Sub-department of Quang Nam Province and the Water Resources - Dike Management and Flood Control Sub-department of Da Nang City concurrently serve as Deputy Directors of the Office of the Basin Planning Management Board for the Vu Gia - Thu Bon River Basin. The Office of the Basin Planning Management Board for the Vu Gia - Thu Bon River Basin shall use its own seal and open an account at a Bank or State Treasury for its operations according to current regulations.

The staffing of the Office of the Basin Planning Management Board for the Vu Gia - Thu Bon River Basin shall be included in the public service staffing of the Department of Agriculture and Rural Development of Quang Nam Province and the Fisheries - Forestry and Agriculture Department of Da Nang City.

The Office of the Basin Planning Management Board for the Vu Gia - Thu Bon River Basin shall have a Branch located at the Fisheries - Forestry and Agriculture Department of Da Nang City.

The operating funds of the Basin Planning Management Board for the Vu Gia - Thu Bon River Basin and its Office shall be provided and supported by the People's Committees of Quang Nam Province and Da Nang City, and from the Ministry of Agriculture and Rural Development, and from sponsors (if any) through the Office of the Basin Planning Management Board for River Basins under the Water Resources Department.

Article 4. This Decision shall take effect fifteen days after its publication in the Official Gazette. The Chairman of the Basin Planning Management Board for the Vu Gia - Thu Bon River Basin shall organize its implementation based on Decision No. 14/2004/QĐ-BNN-TCCB dated April 9, 2004 of the Minister of Agriculture and Rural Development on the Regulations on the Organization and Operation of the Basin Planning Management Boards for River Basins.

Article 5. The Director of the Office, the Heads of the Cadre and Civil Servant Affairs Department, the Water Resources Department, the Dike Management and Flood Control Department, the Financial Department, the members specified in Article 2, the Directors of the Department of Agriculture and Rural Development of Quang Nam Province, the Fisheries - Forestry and Agriculture Department of Da Nang City, and the heads of related agencies and units under the Ministry shall be responsible for implementing this Decision./.
