Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to Decision No. 432/QĐ-TTg dated May 20, 2005 of the Prime Minister on the establishment of the National AIDS Control Center under the Ministry of Health and the renaming of the Preventive Medicine and AIDS Prevention Center to the Vietnam Preventive Medicine Department;
At the proposal of the Director of the Vietnam Preventive Medicine Department and the Director of the Personnel Department - Ministry of Health,
DECISION:
Article 1. Issued herewith with this Decision the "Regulations on Functions, Tasks, Powers, and Organizational Structure of the Vietnam Preventive Medicine Department".
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Abolish Section Regulations on Functions, Tasks, and Powers of the Preventive Medicine and AIDS Prevention Center issued together with Decision No. 2964/2004/QĐ-BYT dated August 27, 2004 of the Minister of Health.
Article 3. The following officials are responsible for implementing this Decision: Head of the Office, Director of the Personnel Department - Ministry of Health, Director of the Vietnam Preventive Medicine Department, Heads of related units.

REGULATIONS ON FUNCTIONS, TASKS, POWERS
AND ORGANIZATIONAL STRUCTURE OF THE VIETNAM PREVENTIVE MEDICINE DEPARTMENT
(Issued together with Decision No.: 20/2005/QĐ-BYT
dated July 26, 2005)
I. Functions
1. The Vietnam Preventive Medicine Department is a specialized management department under the Ministry of Health, assisting the Minister of Health in performing state management functions and enforcing laws, directing and managing professional activities in the field of preventive medicine throughout the country.
2. The Vietnam Preventive Medicine Department has legal personality, its own seal and bank account, and its headquarters is located in Hanoi. The operating budget of the Department is funded from the state budget and other legitimate sources.
II. Tasks and Powers
1. To take the lead in developing strategies, plans, and programs in the field of preventive medicine, including the following contents: controlling infectious diseases causing epidemics, border health quarantine, preventing social diseases, environmental health, occupational health, school health, community nutrition, preventing accidents and injuries, managing vaccines, medical products, and chemicals for pest control and disinfection used in household and medical fields, and submit them to the Minister of Health for approval or for the Minister to submit them to competent authorities for approval.
2. To take the lead in drafting, amending, supplementing, or establishing new regulatory documents, systems, and policies in the field of preventive medicine, and submit them to the Minister of Health for issuance or for the Minister to submit them to competent authorities for issuance.
3. To take the lead or coordinate in drafting professional regulations, technical procedures, technical tiering, professional and technical standards, and lists within the following areas: preventing infectious diseases causing epidemics; border health quarantine; preventing social diseases; environmental health; occupational health; school health; community nutrition; preventing accidents and injuries; vaccines and medical products; chemicals for pest control and disinfection used in household and medical fields, and submit them to competent authorities for issuance.
4. To manage and direct specialized activities of the preventive medicine system throughout the country; manage and direct the professional activities of Institutes under the preventive medicine system; act as the focal point for managing and directing preventive medicine activities of Ministries and sectors.
5. To manage, direct, and organize the implementation of the following contents:
a) Measures to prevent and control epidemics, prevent social diseases, and conduct border health quarantine throughout the country. Submit special measures to the Minister of Health for approval or for the Minister to submit them to the Government for approval to extinguish epidemics according to the law. Develop national reserves annually and usage quotas for epidemic prevention medicines, chemicals, and equipment for localities, sectors, and units;
b) Environmental health, school health, and community nutrition; monitor water quality for drinking and domestic use, sanitation facilities; protect the environment in the healthcare sector; build, direct, and promote disease prevention, environmental hygiene, and public health improvement campaigns;
c) Inspect and monitor working environments, care for workers' health, prevent occupational diseases, prevent accidents and injuries, and build safe communities;
d) Inspect production, use, import, export, and distribution of vaccines, medical products; chemicals, preparations, and pest control and disinfection agents used in household and medical fields.
6. To develop content and direct the implementation of information, education, and communication activities on preventive medicine health, and provide professional training in the field of preventive medicine for preventive medicine staff.
7. To take the lead or coordinate with relevant units to organize inspections and propose measures to handle violations in specialized preventive medicine activities according to the law; participate in inspection teams regarding specialized preventive medicine activities.
8. To decide within its authority on issuing, suspending, or revoking registration certificates and various types of licenses and practice certificates for vaccines, medical products, chemicals for pest control and disinfection used in household and medical fields; organize fee collection according to the law.
9. To carry out scientific research and international cooperation in the field of preventive medicine.
10. To manage personnel, civil servants, assets, and funds allocated according to the law and the delegation of the Minister of Health.
11. To take the lead or coordinate with the National AIDS Control Center, the Food Safety and Control Department, and other Departments, Bureaus, Offices, and Inspection Units of the Ministry of Health in directing specialized activities for lower-level preventive medicine networks.
12. To perform other tasks assigned by the Minister of Health.
III. Organization and Operation Mechanism
1. Leadership of the Bureau
The leadership of the Vietnam Preventive Medicine Department consists of the Director and Deputy Directors appointed by the Minister of Health. The Director is responsible before the Minister of Health and the law for all activities of the Department.
Deputy Directors assist the Director, and are responsible before the Director and the law for the tasks assigned to them.
2. Organization of the Department
a) Office of the Department;
b) Planning and Finance Department;
c) Infectious Disease Control - Vaccine Division;
d) Quarantine - Chemical Management Division;
đ) Environmental and Community Health Division;
e) Occupational Health - Accident and Injury Division.
3. Operation Mechanism
a) The Vietnam Preventive Medicine Agency operates under the head system;
b) The functions, tasks, powers of the Office and the Departments under the Agency shall be stipulated by the Director of the Agency based on the functions, tasks, and powers assigned to the Agency by the Minister of Health. The relationship between the Office and the Departments within the Agency shall be regulated by the Director of the Agency;
c) The appointment and removal of leadership positions in the Office and the Departments under the Agency shall be carried out in accordance with the provisions of the law;
d) Leadership positions in the Agency, the Office, and the Departments under the Agency shall enjoy allowances as prescribed by law.
4. Establishment
The establishment of the Vietnam Preventive Medicine Agency shall be determined by the Decision of the Minister of Health and adjusted annually based on work needs proposed by the Director of the Agency./.
