Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Notification No. 60/TB-TW dated April 9, 2002 of the Politburo on the settlement of some issues regarding the border between Vietnam and Laos;
Pursuant to the Agreement on economic, cultural, scientific and technical cooperation between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic signed on January 16, 2004;
At the request of the Minister of Foreign Affairs,
DECISION:
Article 1. Establishing the Steering Committee of the Government for the Project to Reinforce and Restore the Vietnam-Laos Border Marker System (hereinafter referred to as the Steering Committee for the Project) based on the division of responsibilities at the central level among the members of the Steering Committee of the Government for delimitation and setting up border markers between Vietnam and China. Each of the provinces of Dien Bien, Son La, Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Quang Nam, and Kon Tum shall appoint one (01) member of the provincial People's Council to join the Steering Committee for the Project and report the name of the appointed person to the Chairman of the Steering Committee within ten days from the date this Decision takes effect.
Article 2. The Steering Committee for the Project shall have the following tasks and powers:
1. Directing the construction and implementation of the Project to Reinforce and Restore the Vietnam-Laos Border Marker System; proposing to the competent agencies of the Party and State appropriate policies and measures to handle issues arising during the process of setting up border markers.
2. Directing and resolving inter-ministerial and important matters in the implementation of the project to ensure territorial sovereignty, security, defense, and socio-economic development in border areas; guiding, inspecting, and organizing contracts between ministries, sectors, and localities to fully implement the contents of the project.
3. Directing the organization of forces to cooperate with Laos in implementing the project to set up border markers, including officers and soldiers from relevant ministries, sectors, and localities who have high discipline, good professional qualifications, and sufficient strength to complete the assigned tasks. For the construction work of setting up markers on-site, directing the implementation according to the current investment and construction management regulations.
4. Directing bilateral negotiations to draft legal and technical documents recording the results of the project to be included in the legal documents on the border between the two countries, including the recording of the results of the acceptance of the project to establish the national boundary map of Vietnam-Laos which has been approved by the Prime Ministers of both countries. The Prime Ministers of the two countries shall approve.
5. Requesting relevant ministries, sectors, and localities to report on the situation and results of the implementation of the construction and implementation tasks of the project; reporting quarterly and annually on the progress of work and urgent, important issues exceeding the authority of the Steering Committee to the Prime Minister and the Central Committee Secretariat.The Boundary Commission under the Ministry of Foreign Affairs is the permanent body of the Steering Committee for the Project to Reinforce and Restore the Vietnam-Laos Border Marker System.
Article 3. The Steering Committee for the Project may use the seals of the Government and the Ministry of Foreign Affairs. The operating budget of the Steering Committee for the Project is within the project management budget. The Chairman of the Steering Committee shall issue the operational regulations of the Steering Committee.
Article 4. The Chairman of the Steering Committee for the Project shall guide the establishment and direct the operation of the Steering Committee for the Project at the local level.
Article 5. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairmen of the People's Councils of the provinces of Dien Bien, Son La, Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Quang Nam, and Kon Tum are responsible for implementing this Decision.
Article 6. This Decision shall take effect fifteen days after its publication in the Official Gazette. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of People's Committees of the provinces of Dien Bien, Son La, Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Quang Nam, and Kon Tum are responsible for implementing this Decision.
