DIRECTIVE OF THE PRIME MINISTER

On the Implementation of the Law on People's Police

 

The eighth session of the Eleventh National Assembly passed the Law on People's Police, which took effect from July 1, 2006. The Law on People's Police is an important statute regulating principles of organization and operation; functions, tasks, powers, and policies for the People's Police.

 

To enhance awareness and legal consciousness among the People's Police force, officials, and citizens; to ensure that the Law on People's Police is effectively implemented in practice, creating changes in the activities of the People's Police force and security and public order work generally, the Prime Minister directs the Ministries, ministerial-level agencies, agencies under the Government, Provincial People's Committees, and Municipal People's Committees directly under the Central Government to implement the following tasks:

1. Ministry of Public Security

a) Urgently organize specialized training on the Law on People's Police, enhancing legal awareness about national security protection and maintaining social order and safety for officers and soldiers in units under the Ministry of Public Security and local police forces, focusing on the leadership cadre of the People's Police at all levels and officers and soldiers in units responsible for building the force;

b) Take the lead and coordinate with the Ministry of Justice to compile publicity materials, disseminate, and guide the implementation of the Law on People's Police for civil servants and citizens to ensure clarity, ease of understanding, and uniformity in its execution;

c) Take the lead and coordinate with the Ministry of Justice, the Ministry of Home Affairs, the Ministry of Labor, Invalids and Social Affairs, and related ministries and sectors to promptly draft and submit to the Government for promulgation Decrees detailing and guiding the implementation of certain provisions of the Law on People's Police; Decree on ranks and grades of officers and non-commissioned officers of the People's Police; Decree on citizens serving in the People's Police for a limited period;

d) Take the lead and coordinate with relevant ministries and sectors to inspect and review to adjust, supplement, or draft and promulgate normative legal documents and regulations defining the scope of responsibility and coordination in activities between the Ministry of Public Security and other ministries and sectors in the field of national security protection and maintaining social order and safety.

Directing and guiding functional agencies to coordinate with the Environmental Crime Prevention Police Force

Coordinate with the Ministry of Public Security and related agencies to review and draft, promulgate, or submit to competent authorities for promulgation normative legal documents defining the scope of responsibility and coordination in activities between the People's Army, Self-Defense Forces, and the People's Police in national security protection and maintaining social order and safety.

3. Ministry of Culture and Information

Coordinate with the Ministry of Public Security, the Ministry of Justice, and the Government's Council for Popularizing and Promoting Legal Education to direct and guide news agencies, radio, and television stations at central and provincial levels to publicize the Law on People's Police and guiding documents for its implementation among cadres and citizens.

4. The Ministry of Education and Training

Take the lead and coordinate with the Ministry of Public Security to develop and implement plans to incorporate content introducing the Law on People's Police into national education curricula on national security protection and maintaining social order and safety according to each educational level.

5. The Ministry of Finance

Take the lead and coordinate with the Ministry of Public Security, the Ministry of Planning and Investment, and Provincial People's Committees directly under the Central Government to aggregate and submit to competent authorities for decision the annual regular security budget estimate for the Ministry of Public Security and localities, including funds for training and implementing the Law on People's Police as stipulated by the State Budget Law.

6. Ministries, ministerial-level agencies, agencies under the Government, Provincial People's Committees, and Municipal People's Committees directly under the Central Government

a) Organize publicity and dissemination of the Law on People's Police, linking the implementation of the Law on People's Police with the implementation of Party policies and state laws in new circumstances to enhance legal awareness and responsibility of cadres and citizens in national security protection and maintaining social order and safety;

b) Direct and guide subordinate agencies and organizations to effectively perform tasks and measures to support the People's Police force in carrying out national security protection and maintaining social order and safety duties; incorporate national security protection and maintaining social order and safety into programs, plans, and professional activities of agencies and organizations;

c) Within their respective responsibilities and authorities, plan to meet requirements for material infrastructure, apply modern scientific and technological achievements, mobilize human resources to serve national security protection and maintaining social order and safety according to the Prime Minister's directives and the Ministry of Public Security's proposals.

This Directive takes effect from July 1, 2006.

The Minister of Public Security shall be responsible for assisting the Prime Minister in monitoring, guiding, urging, inspecting, and reporting to the Prime Minister on the implementation of this Directive./.
