THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Article 19 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1. Position and Functions
The Department of Processing, Trade in Agriculture, Forestry, Aquaculture and Salt Industry is a subordinate agency under the Ministry of Agriculture and Rural Development, performing the function of advising the Minister on specialized state management and executing state management tasks in the fields of processing, preservation, rural industry development, agricultural machinery, trade in agriculture, forestry, aquaculture, and salt industry within the scope of the Ministry's state management.
The Department of Processing, Trade in Agriculture, Forestry, Aquaculture and Salt Industry has legal personality, its own bank account and seal, and receives operational funding according to the provisions of the law.
The headquarters of the Department is located in Hanoi and it has a permanent office in Ho Chi Minh City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit draft laws, ordinances, and draft regulatory legal documents for the specialized field to the Ministry according to the annual legislative program and plan of the Ministry, and submit projects and programs assigned by the Minister to the Ministry. Submit draft decisions, directives, and other documents within the Minister’s authority to direct and manage to the Minister.
2. Submit strategies, plans, and long-term, five-year, and annual plans; regional key area strategies, inter-regional, and inter-provincial plans, and important programs, projects, and works within the specialized field managed by the Department as assigned by the Minister.
3. Issue individual documents and provide professional guidance on the specialized field and sector entrusted with management. Announce detailed implementation plans for programs, projects, and plans managed by the Ministry for each locality and unit after the overall plan for the field under the Department's management has been approved by the Ministry.
4. Submit to the Ministry for publication strategies, plans, and development programs and organize direction, guidance, inspection of the implementation of regulatory legal documents, strategies, plans, programs, projects, standards, technical regulations, procedures, norms, and economic-technical quotas in the specialized field that have been approved; direct and organize the implementation of propaganda, dissemination, and legal education in the specialized field within the Department's management scope.
5. On processing and preserving agricultural, forestry, and aquatic products:
a) Direct and guide the implementation of planning, programs, mechanisms, and policies for the development of the processing sector linked to production and markets of goods under the Department's state management;
b) Take the lead in building and submitting to the Ministry national technical standards, technical norms, conditions for processing and preserving facilities of agricultural, forestry, aquatic products, and salt to ensure quality, food safety, non-environmental pollution, and consumer rights. Propose national technical standards in processing and preserving agricultural, forestry, and aquatic products;
c) Publish a list of additives and chemicals allowed for use in preserving raw materials and products of agricultural, forestry, aquatic products, and salt; propose national technical standards in processing and preserving agricultural, forestry, and aquatic products upon authorization from the Minister;
d) Guide and review planning for the development of processing and preservation linked to market development and raw material regions of central cities and provinces;
đ) Direct the implementation and inspect the technical infrastructure conditions, application of technology, and human resource organization for production;
e) Guide the implementation and recommend the classification of recognition or revocation of recognition of facilities meeting the conditions for ensuring product quality, food safety, and environmental hygiene;
g) Summarize and evaluate the development situation of processing for goods and post-harvest preservation within the Department's management scope.
6. On agricultural machinery:
a) Direct and guide the implementation of mechanisms and policies for the development of agricultural machinery, forestry, aquaculture, and salt industries;
b) Take the lead in building and submitting to the Ministry technical standards, and propose national technical standards for production machines and equipment in the industry;
c) Inspect, supervise, and direct the implementation of registration and inspection of machines and equipment with strict requirements for labor safety in agriculture and rural development. Guide the implementation and organize inspections of labor safety in the use of machinery and equipment in the industry; organize labor safety inspections for units under the Ministry.
7. On rural industries and craft villages:
a) Direct and guide the implementation of mechanisms and policies for the development of rural industries and craft villages linked to households and cooperatives at the commune level;
b) Take the lead in reviewing, organizing implementation, and guiding localities to implement planning, programs, projects, and proposals for developing rural industries and craft villages linked to cooperatives and households;
c) Summarize and report on the implementation of policies, strategies, plans, programs, and proposals for developing rural industries nationwide;
d) Build and submit to the Ministry annual programs and plans encouraging the development of craft villages and rural industries;
đ) Serve as the focal point for coordinating with relevant agencies and localities to resolve issues related to the development of craft villages and rural industries;
e) Organize activities to transfer advanced technologies; investment consulting; provide information, exhibitions, fairs, and promote products for craft villages and rural industry establishments.
8. On salt industry:
a) Direct and guide the implementation of mechanisms and policies for the development of the salt industry;
b) Publicize and organize direction, guidance, inspection, evaluation, and reporting on the implementation of strategies, plans, and development programs for the salt industry that have been approved;
c) Take the lead in building and submitting to the Ministry national technical standards, procedures for producing, processing, and preserving salt and salt products; propose national technical standards in processing and preserving salt and salt products;
d) Direct technical production, harvesting, and summarize, evaluate the implementation of the annual production plan;
đ) Manage the national reserve, import and export of salt, and submit to the Minister for approval the use of the national reserve and circulating salt reserves.
e) Take the initiative to propose to the Ministry the policy and objectives of investment projects in the salt industry; submit to the Minister for approval the decision to establish investment projects, and take the lead in reviewing investment projects in the salt industry.
9. Regarding agricultural, forestry, fisheries, and salt trade:
a) Develop, submit to the Ministry and organize the implementation of strategies, programs, projects, and plans for the consumption of agricultural, forestry, fishery products, and handicrafts in domestic markets and exports;
b) Monitor domestic and international market trends; collect and analyze information and data related to production and consumption of agricultural, forestry, fishery products, agricultural supplies, and handicrafts. Compile reports and propose solutions for developing agricultural, forestry, fishery trade, handicrafts, and salt trade;
c) Take the lead and coordinate with relevant ministries and sectors to manage essential goods balance in agricultural, forestry, fishery, and salt products; develop and submit to the Ministry to organize guidance and direction on implementing mechanisms and policies for developing agricultural, forestry, fishery trade, handicrafts, and salt trade;
d) Uniformly manage the export and import of machinery, equipment, materials, and goods serving production in the agriculture and rural development sector;
đ) Develop, review, and organize the implementation of strategies, programs, projects, and plans for promoting trade in agricultural, forestry, fishery products, handicrafts, and salt;
e) Serve as the focal point for compiling long-term and annual trade promotion plans of the Ministry. Take the lead in organizing, inspecting, and implementing approved trade promotion plans;
g) Take the lead in submitting to the Ministry infrastructure development projects for agricultural, forestry, fishery, and salt trade;
h) Guide and implement strategies, programs, plans, and policies for developing electronic commerce in the agricultural, forestry, fishery, handicrafts, and salt sectors;
i) Take the lead in implementing programs for international economic integration and cooperation in the field of agricultural, forestry, fishery trade, and handicrafts;
k) Take the lead and coordinate in handling commercial disputes in the agricultural, forestry, fishery, handicrafts, and salt sectors;
10. Guide, direct, and inspect regulations ensuring quality and food safety during the storage and processing of agricultural, forestry, fishery products, and salt;
11. Propose to the Ministry a list of programs and investment projects in the specialized management fields of the Bureau. Take the lead in reviewing and performing the role of the main investor for programs and investment projects assigned by the Ministry to the Bureau;
12. Organize and direct the work of investigation, statistics, and database management in the Bureau's management fields according to regulations;
13. Regarding science and technology:
a) Propose and submit to the Ministry programs, plans, and research topics in scientific studies and technological advancements in specialized fields;
b) Take the lead in reviewing research outlines and topics; commission organizations and individuals to carry out these tasks; accept and manage research results and direct the application of technological advancements within the Bureau's management scope;
c) Manage scientific and technological information in specialized fields;
d) Participate in drafting national standards and technical regulations within the Ministry's management scope according to the Minister's assignment;
14. Direct the implementation of agricultural extension activities in processing, preservation, rural industry development, agricultural machinery, and agricultural, forestry, fishery trade, and salt trade;
15. Regarding international cooperation:
a) Develop and submit to the Ministry international cooperation programs and projects in specialized fields under the Bureau's management scope;
b) Organize the implementation of international cooperation and funded international programs and projects according to the Minister's classification;
16. Regarding administrative reform:
a) Develop and organize the implementation of administrative reform plans according to the Ministry's plan and the Minister's directives;
b) Direct the review, systematization, and proposal for building institutional and legal systems in the Bureau's management fields;
c) Direct the improvement of functions, tasks, and authorities of subordinate organizations under the Bureau towards delegation and decentralization; submit to the Ministry for the decentralization of state management tasks and fields to local authorities;
d) Direct the implementation of regulations on self-management, self-responsibility for tasks, organizational structure, staffing, finance, and administrative procedure reform, modernizing offices, and applying information technology to serve the Bureau's operations;
17. Regarding state management of organizations providing public services in the Bureau's management fields:
a) Submit to the Ministry mechanisms, policies, and technical standards for providing public services; regarding the socialization of public service provision activities in the Bureau's management fields;
b) Issue economic and technical norms, timeframes for providing public services in the Bureau's management fields;
c) Guide, inspect, and support organizations providing public services in the Bureau's management fields according to legal provisions;
18. Regarding state management of the activities of associations and non-governmental organizations in the Bureau's management fields according to the Minister's assignment:
a) Guide and create conditions for associations and non-governmental organizations to participate in activities in the Bureau's management fields; organize consultations and incorporate suggestions and critiques from associations and non-governmental organizations to improve state management regulations in these fields;
b) Recommend measures to address violations of laws by associations and non-governmental organizations operating in these fields;
19. Regarding organizational structure, staffing, and civil servants and public officials:
a) Draft proposals for the functions, tasks, authorities, and organizational structure of the Bureau; propose the establishment and restructuring of subordinate organizations under the Bureau;
b) Decide on the establishment of working groups of the Bureau; specify the autonomy, organizational chart, and operation rules for state-owned enterprises under the Bureau according to regulations;
c) Submit to the Ministry the annual staffing plan of the Bureau; decide on the allocation of administrative positions for agencies under the Bureau;
d) Decide on sending civil servants, public officials, and employees abroad for study and work according to the Ministry's cadre management classification;
đ) Specify the authority and responsibility of heads of organizations under the Bureau;
e) Decide and implement specific measures to strengthen administrative discipline and order; organize the prevention and combat of corruption, waste, bureaucracy, harshness, and abuse of power within units under the Bureau;
g) Organize the implementation of personnel recruitment, utilization, transfer, rotation, retirement, salary systems, rewards, and other regulations for officials, civil servants, and employees under the Bureau's management as prescribed by law and delegated by the Ministry; provide professional training according to the Minister’s assignment;
h) Establish professional standards for civil servant and employee ranks in the industry and field as assigned by the Minister;
i) Report on the implementation of organizational and personnel work and staffing as prescribed;
20. Regarding inspection and supervision:
a) Guide and inspect the implementation of policies and laws concerning the industry and field under the Bureau's jurisdiction as prescribed;
b) Resolve or participate in resolving complaints, reports, and suggestions from organizations and citizens related to the industry and field managed by the Bureau; organize citizen reception as prescribed by law;
c) Inspect and supervise the implementation of delegated management authority in the industry and field under the Bureau's jurisdiction and handle violations according to the law;
21. Regarding financial and asset management:
a) Submit the annual budget estimate and medium-term budget plan of the Bureau to the Ministry;
b) Be responsible for finalizing accounts for funds directly managed by the Bureau; manage and be accountable for state assets allocated to the Bureau according to the delegation of the Minister and the law;
22. Perform the standing tasks of industrialization and modernization programs for agriculture and rural areas; the Labor Protection Council in the agricultural and rural development sector;
23. Perform other tasks as prescribed by specialized laws and the delegation and delegation of the Minister;
Article 3. Organizational Structure
1. Leadership of the Bureau:
The Bureau leadership consists of the Director and Deputy Directors appointed and relieved of duty by the Minister of Agriculture and Rural Development as prescribed;
The Director manages the Bureau's operations, is responsible to the Minister of Agriculture and Rural Development, and the law for the Bureau's activities;

3. Public Service Units:
a) Technical Safety Testing Center for Agricultural Machinery and Equipment;
b) Other public service units established based on proposals approved by the Ministry;
The Director of the Bureau of Processing, Marketing of Agricultural, Forestry, Aquatic Products, and Salt Industry shall define the functions and responsibilities of the management structure and subordinate units, appoint cadres according to the delegation of the Ministry, and issue the Bureau's operational regulations;
Article 4. Effective date
This Decision takes effect fifteen days after its publication in the Official Gazette. Decree No. 90/2003-QĐ-BNN dated September 4, 2003, issued by the Minister of Agriculture and Rural Development regarding the functions, powers, and organizational structure of the Bureau of Processing and Marketing of Agricultural and Forestry Products and Salt Industry, and previous provisions contrary to this Decision are abolished;
Article 5. Responsibilities for Implementation
The Director of the Bureau of Processing, Marketing of Agricultural, Forestry, Aquatic Products, and Salt Industry, the Head of the Ministry's Office, Department Heads, the Inspector General of the Ministry, and heads of relevant agencies and units are responsible for implementing this Decision./.
