Pursuant to the Inspection Law dated June 15, 2004;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decision No. 179/QĐ-BVHTTDL dated January 16, 2008 of the Minister of the Ministry of Culture, Sports and Tourism on the establishment of the Inspectorate of the Ministry of Culture, Sports and Tourism;

Considering the proposal of the Inspector General and the Director of the Department of Organization and Cadres,

DECISION:

Article 1. Position and Functions

The Inspectorate of the Ministry of Culture, Sports and Tourism (hereinafter referred to as the Inspectorate) is an agency of the Ministry of Culture, Sports and Tourism with the function of assisting the Minister in state management of inspection work, performing administrative inspection and specialized inspection tasks in the fields of culture, family, sports, and tourism as prescribed by law.

The Inspectorate is subject to management and direction by the Minister, while also being subject to guidance and direction regarding work, organization, and business procedures from the Government Inspectorate.

The Inspectorate has its own seal and bank account at the State Treasury.

Article 2. Tasks and Powers

The Inspectorate performs its tasks and powers as prescribed in the Inspection Law dated June 15, 2004, and the following specific tasks and powers:

1. Drafting legal documents, regulations, and policies on cultural, family, sports, and tourism inspections for submission to the Minister. Organizing information dissemination, propaganda, popularization, and legal education related to the inspection fields of culture, family, sports, and tourism.

2. Developing annual programs and plans for inspection work; handling complaints and reports; preventing and combating corruption and promoting thrift and curbing waste within the scope of the Ministry's state management.

3. Inspecting and supervising the implementation of policies, laws, plans, and work programs approved by the Minister, and handling complaints and reports, preventing and combating corruption in subordinate agencies and units of the Ministry.

4. Inspecting and supervising compliance with laws by agencies, organizations, and Vietnamese citizens; and foreign organizations and individuals operating within the scope of the Ministry of Culture, Sports and Tourism's state management.

5. Implementing administrative penalty powers in the fields of culture, family, sports, and tourism according to the provisions of law.

6. Inspecting and supervising cases assigned by the Minister or the Chief Inspector.

7. Investigating, concluding, and recommending solutions to the Minister for handling complaints and reports when assigned by the Minister.

8. Handling complaints and reports in accordance with the law.

9. Inspecting and supervising the responsibility of heads of agencies and units under the Ministry in receiving citizens, handling complaints, and reports. Recommending solutions to the Minister for handling complaints and reports that have been resolved by the heads of subordinate agencies and units but still have complaints.

10. Investigating and recommending solutions to complaints in the fields of culture, family, sports, and tourism that have been initially resolved by the Chairman of the Provincial People's Committee or the Director of the Department of Culture, Sports and Tourism but still have complaints, when assigned by the Minister.

11. Receiving and processing complaints and reports within its jurisdiction; serving as the permanent office for citizen reception of the Ministry.

12. Monitoring and supervising the implementation of decisions resolving complaints and reports and post-inspection decisions that have become legally binding by the Minister and competent authorities as prescribed by law.

13. Serving as the permanent office of the Anti-Corruption Steering Committee; assisting the Minister in guiding and supervising subordinate agencies and units in implementing anti-corruption prevention and combat tasks; periodically reporting to the Minister, the Chief Inspector, and the Central Anti-Corruption Steering Committee on anti-corruption and anti-criminal activities in subordinate agencies and units.

14. Implementing administrative reform contents according to the Ministry's program and plan.

15. Providing guidance and training in inspection procedures for provincial inspectors of culture, sports, and tourism; providing training in inspection and complaint resolution procedures for heads and people's inspectors of subordinate agencies and units.

16. Assisting the Minister in organizing coordination with relevant departments, levels, and agencies during inspection, supervision, complaint resolution, and anti-corruption efforts; inspecting and supervising the implementation of policies and laws by provincial departments of culture, sports, and tourism within the scope of the industry's state management.

17. Managing organizational structures, staffing; implementing salary systems and other policies, incentives; training, development, commendation, and disciplinary actions for officers and civil servants under the Inspectorate's management according to the law and the Minister's delegation.

18. Manage finances and assets assigned and organize the implementation of allocated budgets in accordance with the provisions of the law;

19. Performing other tasks assigned by the Minister.

Article 3. Organizational Structure

1. The Inspectorate of the Ministry of Culture, Sports and Tourism includes the Inspector General, Deputy Inspector Generals, inspectors, and other officers and civil servants.

2. Functional Departments:

a. Administrative and General Affairs Office;

b. Cultural Inspection Office;

c. Sports Inspection Office;

d. Tourism Inspection Office;

đ. Administrative Inspection and Anti-Corruption Office.

The Inspector General is responsible for arranging and assigning inspectors, officers, and civil servants according to the organizational structure and professional standards; developing and promulgating the operational regulations of the Inspectorate.

Article 4. Effectiveness

This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 64/2003/QĐ-BVHTT dated December 16, 2003 of the Minister of the Ministry of Culture and Information on the functions, tasks, powers, and organizational structure of the Inspectorate of the Ministry of Culture and Information, Decision No. 1070/2005/QĐ-UBTDTT dated May 24, 2005 of the Minister and Head of the Sports Management Committee on the organizational structure and operation regulations of the Inspectorate of the Sports Management Committee, and Decision No. 390/QĐ-TCDL dated October 28, 2003 of the Director-General of the Tourism Administration on the functions, tasks, powers, and organizational structure of the Inspectorate of the Tourism Administration.

Article 5. Responsibility for Implementation

The Head of the Office, the Director of the Cadre Organization Department, the Director of the Planning and Finance Department, the Inspector General, the Heads of agencies and units under the Ministry, and the Heads of related agencies and units are responsible for implementing this Decision./.
