Issuing the Disciplinary School Regulations

Based on Decree No. 02/2014/NĐ-CP dated January 10, 2014, stipulating the regime for applying and enforcing administrative measures involving placement in disciplinary schools and compulsory educational facilities;

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director General of the Criminal Enforcement and Judicial Assistance General Department,

The Minister of Public Security issues this Circular to issue the Disciplinary School Regulations.

Article 1. Disciplinary School Regulations

1. Attached herewith are the "Disciplinary School Regulations".

2. Visits, meetings; receipt and sending of letters, money, gifts; telephone communications of students at disciplinary schools shall be carried out in accordance with other regulations issued by the Minister of Public Security.

Article 2. Applicability

This Circular applies to management agencies of disciplinary schools; disciplinary schools; students currently serving decisions at disciplinary schools pursuant to administrative measure application decisions of People's Courts; and organizations and individuals related to the enforcement of decisions to place in disciplinary schools.

Article 3. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from June 29, 2015 and replaces Decision No. 169/QĐ-BCA(V26) dated April 5, 1999 of the Minister of Public Security promulgating the Disciplinary School Regulations.

2. Directors of General Departments, Heads of units directly under the Ministry, Provincial Police Chiefs, Provincial Fire Prevention and Fighting Chiefs, centrally-administered city chiefs, and related organizations and individuals are responsible for implementing this Circular.

During the implementation of this Circular, if there are difficulties or obstacles, local police units, organizations, and individuals related to it should report to the Ministry of Public Security (through the Criminal Enforcement and Judicial Assistance General Department) for timely guidance.

DISCIPLINARY SCHOOL

To maintain discipline and create favorable conditions for students to comply with decisions to be placed in disciplinary schools, the Minister of Public Security hereby stipulates the Disciplinary School Regulations as follows:

Article 1. Provisions on Compliance with Commands and Time Schedules

Students at disciplinary schools must:

1. Strictly comply with commands and instructions of school staff and teachers.

2. Adhere to regulations regarding commands, time schedules for study, work, living, rest, culture, arts, sports, entertainment, and leisure activities.

3. Quickly form lines according to teams when called to assemble; maintain order and strictly follow commands and instructions of school staff and teachers.

3. Amend Clause 3 Article 2 as follows:iArticle 2. Provisions on Maintaining Internal Order, Eating, Sleeping, and Living Activities

Students at disciplinary schools must comply with the following provisions:

1. Roll call and headcount regulations.

2. Eat on time; when going to eat, form lines according to teams, wear long pants and shirts, shoes or sandals, do not cause disorder; receive the correct food portion and eat in designated areas.

3. Sleep on time, lie in designated places, do not cause disorder.

4. Maintain personal hygiene; follow health prevention, examination, and treatment guidelines provided by school staff and teachers.

5. Have short hair but not bald heads, do not grow beards or mustaches for males, and keep neat appearances for females.

6. Prohibitions on organizing banquets, eating, lighting fires, cooking in dormitory rooms, residential areas, learning and working areas, medical wards, and collective living spaces; writing, drawing, hanging, pasting pictures and photos, spitting, littering indiscriminately within the disciplinary school premises.

7. Prohibitions on tattooing, piercing, attaching metal objects or other substances to oneself or others, dyeing hair, growing long fingernails or toenails, and painting them.

8. Prohibitions on storing and using alcohol, tobacco, opium, drugs, and other stimulants; weapons, toxic chemicals, explosives, chemicals, radioactive materials, flammable substances, and items that may harm oneself or others.

9. Prohibitions on storing and using communication devices, books, newspapers, documents, films, tapes, discs, electronic memory cards, unhealthy cultural products; connecting and disseminating information and images illegally outside or on the Internet, media.

10. Prohibitions on spreading doctrines, holding religious ceremonies, fortune-telling, promoting, coercing other students to participate in superstitious and unscientific activities, performing superstitious and unscientific acts, establishing or joining groups, factions.

11. Prohibitions on gambling, organizing gambling, betting on anything, in any form, among students or between students and others.

12. Prohibitions on threatening, oppressing, fighting, infringing upon one’s own or another person’s body; engaging in sexual relations, homosexual relations, and other unhealthy relationships among students or between students and others.

Article 3. Provisions on etiquette and conduct

Students at disciplinary schools must:

1. Use Vietnamese in communication (except in cases where Vietnamese is not known); address teachers and educators at the educational correctional facility as "thầy" or "cô" and refer to oneself as "em"; address visitors or other persons at the educational correctional facility as "cụ", "ông", "bà", "bác", "cô", "chú" and refer to oneself as "cháu" or "anh" or "em"; address fellow students as "mình", "bạn", "em", "anh" or "chị".

Remove hats or caps, stand at attention, maintain a distance of two to three meters, and greet "thầy" or "cô" with "em chào"; greet "cụ" or "ông", "bà", "bác", "cô", "chú" with "cháu chào"; greet "anh" or "chị" with "em chào" when encountering teachers, educators, or visitors at the educational correctional facility. The greeting must reflect a friendly attitude, and one must respond with "vâng", "dạ", "thưa", or express gratitude or apology appropriately. When called by name, students must respond with "có".

2. Remove hats or caps and hold them in the right hand, report clearly the full name, group, or team when entering or exiting the gate of the educational correctional facility. If moving in groups or teams, walk in pairs, remove hats or caps, hold them in the right hand for the right-hand row and in the left hand for the left-hand row. The Group Leader or Team Leader must report clearly the name of the group or team and the number of members in their group or team.

3. Timely and truthfully report to teachers and educators at the educational correctional facility about any violations of laws or internal regulations of the educational correctional facility committed by other students.

3. Amend Clause 3 Article 2 as follows:iArticle 4. Provisions on clothing and personal items

Students at disciplinary schools must:

1. Fold, neatly arrange, air, and store clothes, quilts, blankets, bedspreads, and personal items in designated places; do not bring into the living room any tools or personal items except those provided according to standards, such as clothes, quilts, blankets, bedspreads, and essential personal items necessary for daily life, study, recreation, and entertainment as stipulated by the Principal of the educational correctional facility.

2. Deposit valuables and documents such as gold, silver, jewelry, foreign currency, Vietnamese currency, stocks, bonds, electronic payment cards, watches, machinery, equipment, Identity Card, Citizen Identification Card, household registration book, passport, diplomas, certificates, and other valuable documents and unused clothes and personal items at the educational correctional facility.

3. Wear neat, tidy, clean long pants and shirts properly buttoned up when participating in labor, conferences, competitions, sports events, ceremonies, collective activities, meeting relatives, entering or exiting the gate of the educational correctional facility, or interacting with outsiders.

4. Keep clothes clean and do not lend, repair, write, or draw on the clothes provided.

3. Amend Clause 3 Article 2 as follows:iArticle 5. Provisions on studying

Students at disciplinary schools must:

1. Adhere well to "Five points taught by President Ho Chi Minh to young people and children".

2. Actively, conscientiously, and diligently study. Attend classes wearing school uniforms as prescribed by the Principal of the educational correctional facility, wear shoes or sandals, and carry all necessary textbooks, notebooks, and study materials. During class, maintain a serious posture and attitude; enter or leave the classroom only with permission from the teacher; do not lose or damage textbooks, notebooks.

3. Respectfully, courteously, modestly, and appropriately interact with teachers, educators, and fellow students. Be united, affectionate, and supportive of each other in studies and do not obstruct the learning of other students.

Article 6. Provisions on labor, vocational training, culture, arts, physical education, sports, entertainment, and leisure activities

Students at disciplinary schools must:

1. Actively, conscientiously, and diligently participate in labor, vocational training, and cultural, artistic, physical education, sports, entertainment, and leisure activities.

2. Strictly comply with discipline, regulations, and guidance from staff and teachers of the educational correctional facility in labor, vocational training, cultural, artistic, physical education, sports, entertainment, and leisure activities; do not resist, be lazy, evade, or obstruct other students' participation in labor, vocational training, cultural, artistic, physical education, sports, entertainment, and leisure activities; do not hire or force other students to serve or perform tasks for oneself or for other students in any form; move, intentionally damage, or destroy machinery, tools, materials, raw materials, products, or other items without permission from staff and teachers of the educational correctional facility; do not take machinery or work equipment out of the educational correctional facility or bring them into the dormitory area without the consent of staff and teachers of the educational correctional facility.

Article 7. Provisions on protecting and maintaining property

Students at disciplinary schools must:

1. Protect and maintain one's own property and that of others; trees, flowers, ornamental plants, grass in the educational correctional facility; promptly report to staff and teachers of the educational correctional facility about any acts infringing upon such properties; do not buy, sell, exchange, lend, or borrow anything between students or with others (except with the consent of staff and teachers of the educational correctional facility); do not tap into, connect to, or use the electrical grid of the educational correctional facility or elsewhere.

2. Compensate for damages according to the provisions of the law if causing damage to the property of the educational correctional facility or to the property of others./.
