PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 2. Code Numbers and Classification of Job Titles and Professions for Public Officials Who Are Kindergarten Teachers

The job titles and professions of kindergarten teachers in public preschool education institutions within the national education system include:

1. Kindergarten Teacher Grade II      Code Number: V.07.02.04

2. Kindergarten Teacher Grade III     Code Number: V.07.02.05

3. Kindergarten Teacher Grade IV      Code Number: V.07.02.06

1. Adhering to the policies and laws of the Party and State, regulations of the education sector, and local authorities regarding preschool education.

2. Loving children, loving the profession; patient, able to control oneself; having a high sense of responsibility; possessing necessary knowledge and skills; being skilled in pedagogy.

Article 3. Ethical Standards for Professional Conduct

3. Cultivating morality, maintaining integrity, honor, and reputation as a teacher; setting a good example, treating children fairly and respecting their dignity; protecting the legitimate rights and interests of children; fostering unity, mutual assistance, and support among colleagues.

4. Other professional ethics standards for teachers as prescribed in the Law on Education and the Law on Public Officials.

Article 4. Kindergarten Teacher Grade II - Code Number: V.07.02.04

In addition to the duties of kindergarten teachers at Grade III, kindergarten teachers at Grade II must also perform the following duties:

Chapter II

OCCUPATIONAL STANDARDS

b) Participating in professional development training for teachers at the school level and above;

1. Duties:

c) Participating in examination boards for competitions and evaluations of innovative experiences at the preschool level and above at the district level;

a) Participate in editing or compiling content for early childhood education teacher training materials at district level or higher;

d) Participating in external evaluation teams, inspections, and professional supervision from the district level and above.

a) Holding a bachelor's degree in early childhood education or higher;

b) Having a foreign language proficiency level of Level 2 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training promulgating the six-level foreign language proficiency framework for Vietnam, or holding a certificate in ethnic languages for positions requiring the use of ethnic languages;

2. Qualifications regarding education and training:

c) Having basic computer skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications stipulating the basic standard for using information technology;

d) Holding a certificate for training kindergarten teachers at Grade II.

a) Proactively promoting and mobilizing colleagues to implement policies, guidelines, laws, and requirements of the Party, State, sector, and locality regarding preschool education;

b) Creatively and flexibly implementing the preschool education curriculum; guiding colleagues to implement the curriculum and educational plans;

3. Qualifications regarding professional expertise and skills:

c) Actively and proactively coordinating effectively with colleagues, parents, and the community in childcare, nurturing, and education;

d) Being recognized as a model worker at the grassroots level or an excellent kindergarten teacher at the district level or above;

đ) A public official promoted from the position of kindergarten teacher at Grade III to kindergarten teacher at Grade II must have worked in the position of kindergarten teacher at Grade III or equivalent for at least 6 (six) years, including at least 1 (one) year in the position of kindergarten teacher at Grade III and at least 1 (one) year since graduating from a bachelor's degree in early childhood education before taking the promotion exam or review.

d) Being recognized as a grassroots laborer model or a teacher of excellence at the district level or higher;

đ) A civil servant who is promoted from the title of kindergarten teacher grade III to kindergarten teacher grade II must have worked in the title of kindergarten teacher grade III or equivalent for at least 6 (six) years, including at least 01 (one) year in the title of kindergarten teacher grade III and at least 01 (one) year since graduating from a kindergarten education bachelor's degree before taking the examination or being reviewed for promotion.

Article 5. Kindergarten Teacher Grade III - Code: V.07.02.05

1. Duties:

In addition to the duties of Kindergarten Teacher Grade IV, Kindergarten Teacher Grade III must also perform the following tasks:

a) Serve as a lecturer or demonstrator in kindergarten teacher training classes at the school level or higher; guide colleagues in implementing the program and activities related to child care, nurturing, and education;

b) Propose contents for professional development and specialized topic discussions within the department (specialized group);

c) Participate in the examination board for kindergarten competitions, evaluate initiatives and experiences at the kindergarten school level or higher;

d) Participate in external evaluation teams, professional inspections, and reviews at the school level or higher; participate in guiding and evaluating student teaching internships (if applicable).

2. Qualifications regarding education and training:

a) Hold a college degree in early childhood education or higher;

d) Holding a certificate for training kindergarten teachers at Grade II.

a) Proactively promoting and mobilizing colleagues to implement policies, guidelines, laws, and requirements of the Party, State, sector, and locality regarding preschool education;

d) Hold a certificate for kindergarten teacher training at Grade III level.

3. Qualifications regarding professional expertise and skills:

a) Be thoroughly familiar with the policies, laws, regulations, and requirements of the Party, State, sector, and locality regarding early childhood education;

b) Effectively implement the early childhood education curriculum;

c) Proactively organize and coordinate with colleagues, parents, and the community in childcare, nurturing, and education work;

d) Be recognized as a grassroots labor model or excellent kindergarten teacher at the school level or higher;

đ) A staff member promoted from the title of Kindergarten Teacher Grade IV to Kindergarten Teacher Grade III must have worked in the position of Kindergarten Teacher Grade IV or equivalent for at least 3 (three) years, including at least 1 (one) year in the position of Kindergarten Teacher Grade IV and having graduated from a college of early childhood education before taking the promotion exam or review for at least 1 (one) year.

Article 6. Kindergarten Teacher Grade IV - Code: V.07.02.06

1. Duties:

a) Ensure absolute safety for children's health and lives during their time in the assigned group (class);

b) Directly nurture, care for, and educate children and be responsible for the quality of childcare and education in the assigned group or class; Implement childcare, nurturing, and education activities according to the Early Childhood Education Curriculum;

c) Enhance physical health; complete training programs; self-improve moral character, expertise, and vocational skills to improve the quality of childcare and education; participate in professional activities; manage and use educational equipment assigned;

d) Coordinate with families and the community in nurturing, caring for, and educating children;

e) Fulfill civic duties, comply with laws and regulations of the sector, and decisions made by the Principal;

2. Qualifications in education and training:

a) Hold a diploma in early childhood education or higher;

b) Have a foreign language proficiency level 1 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam or hold a certificate in ethnic languages for positions requiring the use of ethnic languages;

c) Have basic information technology skills as specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on the standards for information technology skills;

3. Qualifications regarding professional expertise and skills:

a) Understand the policies, laws, regulations, and requirements of the Party, State, sector, and locality regarding early childhood education;

b) Correctly implement the preschool education program;

c) Know how to collaborate with colleagues, parents, and the community in childcare, nurturing, and education work;

d) Know how to manage, use, maintain, and effectively utilize the assets and equipment of the group/class and school.

Chapter III

GUIDELINES FOR PROMOTION AND SALARY GRADING BY TITLE PROFESSIONS

Article 7. Principles for Appointment and Salary Classification According to Professional Titles for Civil Servants

1. The appointment to professional titles for civil servants as stipulated in this Joint Circular must be based on the job positions, responsibilities, and specialized vocational qualifications currently held by the civil servant, in accordance with Article 8 of this Joint Circular.

2. When appointing from the current civil service rank to the corresponding professional title of kindergarten teacher, it shall not combine with salary grade promotion or professional title advancement for civil servants.

Article 8. Cases of Appointment to the Professional Title of Kindergarten Teacher

Civil servants who have been appointed to the ranks of kindergarten teachers according to Decision No. 202/TCCP-VC dated June 8, 1994, issued by the Minister, Head of the Government’s Organization and Cadre Department regarding the issuance of vocational standards for ranks of civil servants in the education and training sector; Decision No. 61/2005/QĐ-BNV dated June 15, 2005, issued by the Minister of Home Affairs regarding the temporary issuance of professional titles and rank codes for some ranks of civil servants in the education and training, culture and information sectors, are now eligible for appointment to the professional title of kindergarten teacher as stipulated in this Joint Circular, as follows:

1. Appointment to the professional title of kindergarten teacher, Class II (code V.07.02.04) for civil servants currently holding the rank of senior kindergarten teacher (code 15a.205);

2. Appointment to the professional title of kindergarten teacher, Class III (code V.07.02.05) for civil servants currently holding the rank of principal kindergarten teacher (code 15a.206);

3. Appointment to the professional title of kindergarten teacher, Class IV (code V.07.02.06) for civil servants currently holding the rank of kindergarten teacher (code 15.115).

Article 9. Salary Grading Method

1. The professional titles of civil servants as kindergarten teachers shall apply the Specialized Vocational Pay Scale for State Public Service Units (Table 3) promulgated together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, issued by the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel, as follows:

a) The professional title of kindergarten teacher, Class II shall apply the salary coefficient of civil servants type A1 (from coefficient 2.34 to coefficient 4.98);

b) The professional title of kindergarten teacher, Class III shall apply the salary coefficient of civil servants type A0 (from coefficient 2.10 to coefficient 4.89);

c) The professional title of kindergarten teacher, Class IV shall apply the salary coefficient of civil servants type B (from coefficient 1.86 to coefficient 4.06).

2. The salary classification into professional titles for civil servants as stipulated in Clause 1 of this Article for civil servants who have been classified into the ranks of kindergarten teachers according to Decision No. 202/TCCP-VC dated June 8, 1994, issued by the Minister, Head of the Government’s Organization and Cadre Department regarding the issuance of vocational standards for ranks of civil servants in the education and training sector; Decision No. 61/2005/QĐ-BNV dated June 15, 2005, issued by the Minister of Home Affairs regarding the temporary issuance of professional titles and rank codes for some ranks of civil servants in the education and training, culture and information sectors; Decree No. 204/2004/NĐ-CP dated December 14, 2004, issued by the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel; and Clause 5 Section II of Circular Joint No. 81/2005/TTLT-BNV-BTC dated August 10, 2005, issued by the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the transition from old salary scales to new ones for certain ranks of civil servants and public officials newly added or changed in classification within the water resources, education and training, culture and information, health, and market management sectors shall be carried out as follows:

Civil servants appointed to the professional title of kindergarten teacher whose salary grade coefficient is the same as in the previous rank shall be classified at the same salary grade and percentage (%) of seniority allowance exceeding the ceiling (if any) currently enjoyed in the previous rank (including the time for the next salary grade review or the enjoyment of seniority allowance exceeding the ceiling if any in the previous rank) into the newly appointed professional title.

Example: Ms. Nguyen Thi A, who was classified in the rank of senior kindergarten teacher (code 15a.205), Grade 4, salary coefficient 3.33 since February 1, 2013, is now appointed by the competent authority to the professional title of kindergarten teacher, Class II (code V.07.02.04). She will be classified at Grade 4, salary coefficient 3.33 of the professional title of kindergarten teacher, Class II from the date of signing the decision; the time for the next salary grade review will be calculated from February 1, 2013.

3. Advancement in rank for civil servants as kindergarten teachers shall be implemented after being appointed to the professional title of kindergarten teacher as stipulated in this Joint Circular and implementing salary classification according to the guidance in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs guiding salary classification when upgrading ranks, transferring ranks, or changing types of civil servants and public officials.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Joint Circular takes effect from November 1, 2015.

2. Abolish the vocational standards for ranks of civil servants in the education and training sector for kindergarten teachers as stipulated in Decision No. 202/TCCP-VC dated June 8, 1994, issued by the Minister, Head of the Government’s Organization and Cadre Department regarding the issuance of vocational standards for ranks of civil servants in the education and training sector.

3. Abolish the provisions on professional titles and rank codes for civil servants as kindergarten teachers in Decision No. 61/2005/QĐ-BNV dated June 15, 2005, issued by the Minister of Home Affairs regarding the temporary issuance of professional titles and rank codes for some ranks of civil servants in the education and training, culture and information sectors.

4. Abolish the provisions on the list of ranks of civil servants as kindergarten teachers in the List of Ranks of Civil Servants and Ranks of Civil Servants promulgated together with Decision No. 78/2004/QĐ-BNV dated November 3, 2004, issued by the Minister of Home Affairs.

Article 11. Application Provisions

1. Civil servants who have been appointed to the ranks of kindergarten teachers according to Decision No. 202/TCCP-VC dated June 8, 1994, of the Minister, Head of the Organization - Cadre Department of the Government on issuing the vocational standards for the ranks of civil servants in the education and training sector; Decision No. 61/2005/QĐ-BNV dated June 15, 2005, of the Minister of Home Affairs on temporarily issuing the titles and rank codes for some ranks of civil servants in the education and training sector, culture - information sectors, shall now be appointed to the profession title of kindergarten teacher as stipulated in this Joint Circular. The competent authority managing and using civil servants shall be responsible for creating conditions for civil servants to supplement the remaining criteria of the profession title of kindergarten teacher to which they have been appointed.

2. Civil servants who have been appointed to the kindergarten teacher rank but not yet up to standard (code 15c.210) according to Decision No. 61/2005/QĐ-BNV dated June 15, 2005, of the Minister of Home Affairs on temporarily issuing the titles and rank codes for some ranks of civil servants in the education and training sector, culture - information sectors, as of the effective date of this Joint Circular, if they do not meet the conditions and criteria for appointment to the profession title of kindergarten teacher grade IV, shall be retained and continue to enjoy the benefits and policies of the current rank for no more than five years from the effective date of this Joint Circular. For kindergarten teachers currently holding the kindergarten teacher rank but not yet up to standard (not having reached the college level), code 15c.210, as of the effective date of this Joint Circular, who are under 55 years old for males and under 50 years old for females, the competent authority managing and using civil servants must arrange for them to study to improve their qualifications to meet the criteria of the profession title of kindergarten teacher. If the civil servant meets the criteria and conditions for the kindergarten teacher grade IV profession title, the unit using the civil servant shall report to the management unit for consideration and decision on appointment to the kindergarten teacher grade IV profession title. In case the civil servant is assigned to study to improve their qualifications but does not participate in the study or fails to meet the requirements, the unit using the civil servant shall report to the management unit for consideration and reassignment to another position or implementation of reduction in staff establishment.

Article 12. Implementation Organization

1. This Joint Circular serves as the basis for implementing the recruitment, use, and management of the cadre of civil servants who are kindergarten teachers in public kindergartens within the national education system.

2. Private kindergartens may apply the provisions of this Joint Circular to recruit, use, and manage the cadre of kindergarten teachers at their facilities.

1. The heads of public kindergartens directly managing and using civil servants shall be responsible for:

a) Reviewing job positions in the unit, formulating plans for appointing the profession title of kindergarten teacher corresponding to the kindergarten within their management authority, submitting to the competent authority for examination and decision or deciding according to the delegated authority;

b) Deciding on the appointment of the profession title for kindergarten teachers under their management to the corresponding profession title of kindergarten teacher in public kindergartens according to their authority or delegated authority after the appointment plan has been approved by the competent authority;

4. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities are responsible for:

a) Directing subordinate units within their management scope to formulate plans for appointing the profession title of kindergarten teacher corresponding to the kindergarten within their management authority; implementing the appointment of the profession title and salary grading for civil servants who are kindergarten teachers in public kindergartens according to the prescribed authority;

b) Approving plans for appointing the profession title and salary grading for civil servants who are kindergarten teachers in public kindergartens within their management scope, transitioning from the current civil servant rank to the corresponding profession title of kindergarten teacher in public kindergartens as stipulated in this Joint Circular; resolving issues arising during the process of appointing the profession title and salary grading according to their authority;

c) Deciding on the appointment of the profession title and salary grading for kindergarten teachers under their management to the corresponding profession titles of kindergarten teachers in public kindergartens according to their authority;

d) Reporting the results of the appointment of the profession title and salary grading for kindergarten teachers in public kindergartens within their management scope to the Ministry of Education and Training, the Ministry of Home Affairs;

Article 13. Responsibility for Implementation

1. The Ministers, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, Chairpersons of Provincial People's Committees, and Municipal People's Committees directly under the Central Government shall be responsible for implementing this Joint Circular.

2. Any difficulties encountered during implementation should be reported to the Ministry of Education and Training for consolidation and coordination with the Ministry of Home Affairs to examine and resolve./.
