Amending and supplementing some articles of Circular No. 32/2015/TT-BGTVT

dated July 24, 2015 of the Minister of Transport on

environmental protection in the development of transportation infrastructure

Pursuant to the Environmental Protection Law No. 55/2014/QH13 dated June 23, 2014;

Pursuant to the Construction Law No. 50/2014/QH13 dated June 18, 2014;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Decree No. 18/2015/NĐ-CP dated February 14, 2015 of the Government on environmental planning, strategic environmental assessment, environmental impact assessment, and environmental protection plans;

At the proposal of the Director of the Environmental Department;

The Minister of Transport issues this Circular amending and supplementing some articles of Circular No. 32/2015/TT-BGTVT dated July 24, 2015 of the Minister of Transport on environmental protection in the development of transportation infrastructure.

Article 1. Amending and supplementing some articles of Circular No. 32/2015/TT-BGTVT dated July 24, 2015 of the Minister of Transport on environmental protection in the development of transportation infrastructure

1. Supplement Clause 4 to Article 3 as follows:

"4. Costs for preparing the Strategic Environmental Assessment report from construction funds or adjustment of transport development strategies, plans, and programs."

2. Supplement Clause 5 to Article 7 as follows:

"5. Costs for preparing the Environmental Impact Assessment report and the Environmental Protection Plan from project investment funds."

3. Repeal Article 4, Article 8, Article 9, Clause 3 of Article 18, Appendix 1 and Appendix 2 of Circular No. 32/2015/TT-BGTVT dated July 24, 2015 of the Minister of Transport on environmental protection in the development of transportation infrastructure.

Article 2. Effective Date

This Circular takes effect from August 15, 2017.

Article 3. Implementation Organization

The Heads of the Ministry's Office, the Inspectorate, the Directors of Departments, the General Directors of the Road Administration General Department, the Directors of specialized agencies, the Heads of units, the Directors of Provincial Transport Departments, and related organizations and individuals are responsible for implementing this Circular./.
