CIRCULAR

Regulations on updating, exploiting, and managing the national livestock database

_______________________

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

 Pursuant to the Livestock Breeding Law on November 19, 2018;

 At the proposal of the Director of the Livestock Production Department;

 The Minister of Agriculture and Rural Development issues this Circular to regulate the updating, exploitation, and management of the national livestock database.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular provides detailed regulations on the updating, exploitation, and management of the national livestock database as stipulated in Clause 4, Article 11 of the Livestock Law.

Article 2. Applicability

This Circular applies to organizations and individuals related to the updating, exploitation, and management of the national livestock database.

Chapter II
NATIONAL LIVESTOCK DATABASE

Article 3. Database of legal normative documents related to livestock

The database of legal normative documents related to livestock includes legal normative documents prescribed in Article 4 of the Law on Enactment of Legal Normative Documents that are relevant to livestock.

Article 4. Database on livestock breeds, livestock genetic resources, livestock feed, and livestock waste treatment products

1. Data on livestock breeds include:

a) Organizations and individuals producing livestock breeding stock: Name, telephone number, email (if available); address of production facility: scale of production; origin of breed, breed name, breed level, quantity at each breed level, economic-technical indicators, standards applied for the breed;

b) Organizations and individuals producing semen, embryos, larvae, and egg incubation facilities: Name, telephone number, email (if available); address of production facility; breed name for semen, embryos, larvae, and breeding eggs; scale of production, quantity produced;

c) Individuals providing artificial insemination services and embryo transfer for livestock breeds: Name, telephone number, email (if available), address; number of doses of semen mated in a year or number of embryos transferred in a year;

d) Organizations and individuals owning male breeding pigs, cattle, buffalo for direct mating for commercial purposes: Name, telephone number, email (if available), address; scale, type of male breeding stock, quantity, annual mating results (if available);

đ) Organizations and individuals buying and selling breeding stock, semen, embryos, breeding eggs, larvae: Name, telephone number, email (if available), address; type of breed, quantity in a year; breeding stock, semen, embryos, breeding eggs, larvae that have been quarantined, inspected, and quality assessed;

e) Facilities testing livestock breeds and strains: Facility name, telephone number, email (if available), address; scale of livestock farming, testing capacity (type of strain, breed, maximum number of animals tested); assigned to conduct breed and strain certification;

g) List of livestock breeds requiring conservation;

h) List of livestock breeds prohibited from export.

2. Data on livestock genetic resources include:

a) Organizations and individuals collecting livestock genetic resources: Name, telephone number, email (if available), address; name of genetic resource, quantity, collection location, biological criteria, usage value;

b) Organizations and individuals conserving livestock genetic resources: Name, telephone number, email (if available), address; name of genetic resource, quantity, conservation location, conservation method;

c) Organizations and individuals utilizing and developing livestock genetic resources: Name, telephone number, email (if available), address; name of genetic resource, quantity, utilization and development location.

3. Data on livestock feed include:

a) Commercial livestock feed production facilities certified by the Department of Agriculture and Rural Development with a Certificate of Eligibility for Livestock Feed Production: Facility name, telephone number, email (if available), production facility address, designed capacity; Certificate of Eligibility for Livestock Feed Production number, date of issuance, issuing authority;

b) Commercial livestock feed production facilities certified by the Livestock Service with a Certificate of Eligibility for Livestock Feed Production: Facility name, telephone number, email (if available), production facility address, designed capacity; Certificate of Eligibility for Livestock Feed Production number, date of issuance;

c) Organizations and individuals importing livestock feed: Name, telephone number, email (if available), address;

d) Facilities trading livestock feed: Facility name, telephone number, email (if available), address;

đ) Facilities testing livestock feed: Facility name, telephone number, email (if available), address; scale;

e) Commercial livestock feed production volume: Product name, quantity, animal species using the feed;

g) Imported livestock feed: Product name, import volume, import value, country of origin;

h) List of chemicals, biological products, microorganisms prohibited from use in livestock feed;

i) List of raw materials permitted for use in livestock feed;

k) Testing laboratories designated in the field of livestock feed: Laboratory name, telephone number, email (if available), address; designated tests, designation date, expiration date, designating authority;

l) Certification organizations designated in the field of livestock feed: Organization name, telephone number, email (if available), address; designated scope, designation date, expiration date, designating authority.

4. Data on livestock waste treatment products include:

a) Facilities producing livestock waste treatment products: Facility name, telephone number, email (if available), production facility address, designed capacity;

b) Facilities testing livestock waste treatment products: Facility name, telephone number, email (if available), address;

c) Name of livestock waste treatment product, quantity, published standard.

Article 5. Database on livestock breeding facilities, processing facilities, and livestock product markets

1. Data on livestock breeding facilities include:

a) Data on organizations and individuals engaged in livestock breeding: Name, livestock facility code, telephone number, email (if available), address; type of animals, number of animals, breed name, breeding method, production volume;

b) Data on breeding conditions: Scale of breeding, density of breeding; declaration of breeding activities; safe distance for farm breeding; diseases (epidemics) under surveillance, measures to ensure biosecurity;

c) Certificates of livestock breeding facilities: Livestock breeding facility permit number, date of issuance, issuing authority; Good Livestock Breeding Practices certificate number, date of issuance, issuing authority; Biosecure Breeding Farm certificate number, date of issuance, issuing authority;

d) Designated certification organization: Name of organization, telephone number, email (if available), address; designation date, expiration date, designating authority.

2. Data on livestock product processing facilities include: Facility name, facility code, telephone number, email (if available), address; Food Safety Certificate number, date of issuance, issuing authority; capacity, product types, processing categories, origin of raw materials for processed products; quantity of raw materials purchased (domestic, imported), processing volume, export value, consumption market (domestic, export).

3. Data on livestock product markets include:

a) Information on prices: Breeding animals, livestock breeding products; complete mixed feed for pigs and broilers during fattening; major feed ingredients; main livestock products;

b) Data on export and import markets for livestock products: Exporting and importing countries; quantity, types of products; specifications, export value, import value;

c) Data on international agreements: Agreement on the application of animal quarantine measures (SPS) and trade commitments (tariffs, non-tariff barriers), agreement on the application of technical barriers to trade (TBT); regulations on animal quarantine measures (SPS) and technical barriers to trade (TBT) of importing countries.

Article 6. Database on disease-safe livestock breeding zones

Data on disease-safe livestock breeding zones: Zone name, zone address, animal species, scale of breeding; certified diseases (epidemics), biosecurity control measures; Disease-Safe Zone Certificate number, date of issuance.

Article 7. Other databases related to livestock breeding

1. Data on science and technology in livestock breeding include:

a) Scientific research results in livestock breeding;

b) Technologies applied in livestock breeding;

c) List of National Standards, National Technical Regulations in livestock breeding; technical procedures; economic-technical norms; technological advancements.

2. Data on prevention and control of animal epidemics according to veterinary laws: Type of epidemic, affected animal species, location of epidemic, number of animals lost.

3. Data on facilities whose Livestock Breeding Permit, Disease-Safe Zone Certificate, Good Livestock Breeding Practices Certificate, Biosecure Breeding Farm Certificate, and Feed Production Permit have been revoked.

4. Data on facilities whose Certification Organization Designation Decision, Feed Testing Laboratory Designation Decision have been revoked or suspended.

Chapter III
UPDATE AND EXPLOITATION OF THE NATIONAL DATABASE ON LIVESTOCK BREEDING

Article 8. Frequency of updating the national database on animal husbandry

1. Update monthly (before the 30th day of each month) for the contents prescribed in Article 3; Point a Clause 3 Article 5 of this Circular.

2. Update quarterly (before the 30th day of the last month of each quarter) for the contents prescribed in Points a and b Clause 1; Point a Clause 2; Points a, b, c and d Clause 3; Points a and c Clause 4 Article 4; Clause 1 Article 5 and Article 6 of this Circular.

3. Update annually (before December 30 each year) for the contents prescribed in Points c, d, đ, e, g and h Clause 1; Points b and c Clause 2; Points đ, e, g, h, i, k and l Clause 3; Point b Clause 4 Article 4; Clause 2, Point b and Point c Clause 3 Article 5 and Article 7 of this Circular.

Article 9. Exploitation of the national database on animal husbandry

1. Organizations implementing the central role in building and updating the national data on animal husbandry at the central and provincial levels have the right to exploit the national data on animal husbandry according to their level of authority.

2. Organizations and individuals are entitled to exploit and use the national database on animal husbandry as prescribed in Articles 3, 4, 5, 6 and 7 of this Circular.

Chapter IV
MANAGEMENT OF THE NATIONAL DATABASE ON ANIMAL HUSBANDRY

Article 10. Management of accounts for updating the national database on animal husbandry

1. Accounts for updating the national database on animal husbandry are classified and authorized from the central level to local levels.

2. Issuance and locking of accounts for updating: The Livestock Breeding Department shall issue and lock accounts for updating for individuals (civil servants, public officials, employees) and organizations (state administrative agencies).

3. Management of accounts for updating:

a) Organizations that are granted accounts assign individuals within their organization to manage, update, exploit, and manage the national database on animal husbandry in accordance with the law;

b) Individuals granted accounts shall ensure confidentiality, manage, update, exploit, and use the granted account in accordance with the law.

4. An account for updating will be locked if it falls under any of the following circumstances:

a) The organization granted the account is divided, merged, dissolved, or ceases operations, or transfers;

b) The individual granted the account changes work units, retires, or leaves the job.

Article 11. Content of management of the national database on animal husbandry

1. Building and operating technical infrastructure, software for the national database, ensuring connectivity and unified data sharing throughout the system. Resources for building and operating technical infrastructure, software for the national database come from state budget and socialization.

2. Collecting, processing, and updating information into the national database on animal husbandry through automation via digitizing processes from declaration, data entry, storage, processing, analysis, report generation.

3. Managing access rights and update rights to information in the database.

4. Monitoring and supervising the use of the database.

5. Training personnel, supporting operation and exploitation of the database.

Article 12. Ensuring security of the national database on animal husbandry

1. Using licensed security software and applying technologies to detect and prevent unauthorized network intrusions.

2. Using encrypted channels and user authentication in the following activities: System administration login; application login; sending and receiving automated data between servers; entering and editing data.

3. Encrypting database transmission paths.

4. Applying measures to ensure data authenticity and integrity in the database.

5. Operational activities ensuring system security management include: Logging access, creation, modification, deletion of data information for system management and monitoring purposes.

6. Establishing and maintaining backup systems to ensure continuous system operation.

7. Implementing regular data backup measures and protecting backup recovery using data hiding and encryption solutions.

8. Implementing other necessary measures to ensure database security.

Chapter V
RESPONSIBILITIES OF RELATED ORGANIZATIONS AND INDIVIDUALS

Article 13. Responsibilities of the Livestock Breeding Department

1. Lead the establishment of the national livestock database system.

2. Lead and guide organizations and individuals related to report data for updating, exploiting, managing the national livestock database and compile information nationwide.

3. Lead the operation, maintenance, monitoring, upgrading of technical infrastructure, software, and measures to ensure the safety of the national livestock database.

4. Manage administrative accounts, grant permissions for updating, exploiting the national livestock database.

5. Direct, guide, periodically or randomly inspect the updating, exploitation, and management of livestock databases at localities. Organize training on the work of updating, exploiting, and managing the national livestock database.

6. Evaluate and rank the capacity of organizations in updating, exploiting, and managing the livestock database and publicly announce annually.

7. Coordinate with relevant organizations and individuals to handle issues arising during the updating, exploitation, and management of the national livestock database.

8. Invest in building infrastructure to serve the updating, exploitation, and management of the national livestock database.

9. Organize the implementation of data updates as stipulated in Article 3; point e, g and h Clause 1; point b and point c Clause 2; point b, c, đ, e, g, h, i, k and l Clause 3; point b and point c Clause 4 Article 4; point d Clause 1 Article 5; point c Clause 1 and Clause 4 Article 7 of this Circular; be responsible for the timeliness, completeness, and accuracy of the information updated into the national livestock database.

Article 14. Responsibilities of Relevant Units under the Ministry of Agriculture and Rural Development

1. Science, Technology and Environment Department

a) Direct and guide organizations and individuals related to report data for updating, exploiting, and managing the national database on science and technology in livestock breeding;

b) Coordinate with the Livestock Breeding Department to update, exploit, and manage the national livestock database according to assigned functions and tasks;

c) Inspect the implementation of regulations in this Circular regarding the updating, exploitation, and management of the national database on science and technology in livestock breeding;

d) Implement the data updates specified in point a and point b Clause 1 Article 7 of this Circular; be responsible for the timeliness, completeness, and accuracy of the information updated into the national livestock database.

2. Animal Health Department

a) Direct and guide organizations and individuals related to report data for updating, exploiting, and managing the national database on disease prevention and control in livestock breeding; disease-safe breeding zones, imported livestock feed from animal sources;

b) Coordinate with the Livestock Breeding Department to update, exploit, and manage the national livestock database according to assigned functions and tasks;

c) Inspect the implementation of regulations in this Circular regarding the updating, exploitation, and management of the national database on disease prevention and control in livestock breeding; disease-safe breeding zones, imported livestock feed from animal sources;

d) Organize the implementation of data updates specified in point c and point g Clause 3 Article 4 (for imported livestock feed from animal sources); Article 6 and Clause 2 Article 7 of this Circular; be responsible for the timeliness, completeness, and accuracy of the information updated into the national livestock database.

3. Processing and Market Development Department for Agricultural Products

a) Direct and guide organizations and individuals related to report data for updating, exploiting, and managing the national database on livestock product processing;

b) Coordinate with the Livestock Breeding Department to update, exploit, and manage the national livestock database according to assigned functions and tasks;

c) Inspect the implementation of regulations in this Circular regarding the updating, exploitation, and management of the national database on livestock product processing; domestic and foreign markets;

d) Organize the implementation of data updates specified in Clause 2 Article 5 of this Circular; be responsible for the timeliness, completeness, and accuracy of the information updated into the national livestock database.

4. Plant Protection Department

a) Direct and guide organizations and individuals related to report data for updating, exploiting, and managing the national database on imported livestock feed from plant sources;

b) Coordinate with the Livestock Breeding Department to update, exploit, and manage the national livestock database according to assigned functions and tasks;

c) Inspect the implementation of regulations in this Circular regarding the updating, exploitation, and management of the national database on imported livestock feed from plant sources;

d) Organize the implementation of data updates specified in point c and point g Clause 3 Article 4 of this Circular (for imported livestock feed from plant sources); be responsible for the timeliness, completeness, and accuracy of the information updated into the national livestock database.

5. Information and Statistics Center

a) Lead the implementation and guide organizations and individuals related to report data for updating, exploiting, and managing the national database on domestic and foreign markets;

b) Coordinate with the Livestock Breeding Department to update, exploit, and manage the national livestock database according to assigned functions and tasks;

c) Organize the implementation of data updates specified in Clause 3 Article 5 of this Circular; be responsible for the timeliness, completeness, and accuracy of the information updated into the national livestock database.

Article 15. Responsibilities of the Department of Agriculture and Rural Development of provinces and centrally governed cities.

1. Direct and guide the training for organizations and individuals

Organize the implementation of data updates as stipulated in points a, b, c, d, and đ Clause 1; point a Clause 2; points a, d, and e Clause 3; point a Clause 4 Article 4; points a, b, and c Clause 1 Article 5; Clause 3 Article 7 of this Circular; be responsible for the timeliness, completeness, and accuracy of the information updated into the national livestock database.

Article 16. Responsibilities of related organizations and individuals

1. Comply with the provisions of this Circular and relevant laws in the updating, utilization, and use of information on the national livestock database.

2. Organizations designated to certify compliance shall implement data updates for certificates of good livestock farming practices; biosafety livestock farms as stipulated in point c Clause 1 Article 5 of this Circular.

3. Organizations and individuals collecting animal genetic resources shall implement data updates as stipulated in point a Clause 2 Article 4 of this Circular.

4. Be responsible for the timeliness, completeness, and accuracy of the information updated into the national livestock database.

Chapter VI
IMPLEMENTATION

Article 17. Effective Date

This Circular takes effect from January 7, 2020.

Article 18. Responsibility for Implementation

During implementation, if there are difficulties or obstacles, organizations and individuals are advised to report in writing to the Ministry of Agriculture and Rural Development for review, amendment, and supplementation./.
