Pursuant to the Law on Electronic Transactions dated November 29, 2005;
Pursuant to Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government on the application of information technology in state agency activities;
Pursuant to Decree No. 47/2020/NĐ-CP dated April 9, 2020, issued by the Government, on the management, connection, and sharing of digital data of state agencies;
At the proposal of the Minister of Information and Communications;
The Prime Minister issues this Decision on electronic identification codes for organizations and organizations to facilitate data connection and sharing with ministries, sectors, and localities.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decision stipulates electronic identification codes for organizations and organizations to facilitate data connection and sharing with information systems and databases of ministries, sectors, and localities.
Article 2. Applicability
1. This Decision applies to ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities, and units subordinate to or directly under them (hereinafter referred to as ministries, sectors, and localities).
2. Organizations and organizations not covered by Clause 1 of Article 6 of this Decision shall implement this Decision when they proactively connect and share data with ministries, sectors, and localities.
Article 3. Explanation of Terms
In this Decision, the following terms shall be understood as follows:
1. Electronic identification code for organizations and organizations is a string of characters used to distinguish and uniquely identify organizations and organizations when connecting and sharing data with information systems and databases of ministries, sectors, and localities.
2. Electronic identification code system is a collection of electronic identification codes and related information of a specific group of organizations and organizations.
3. Identification schema diagram is a data table describing the electronic identification code system of a specific group of organizations and organizations.
4. Identification schema determination code is a group of characters used to distinguish and uniquely identify the identification schema of a specific group of organizations and organizations.
5. Organization and organization determination code in the identification schema is a group of characters used to distinguish and uniquely identify that organization and organization within an electronic identification code system described by the corresponding identification schema.
6. Organization and organization issuing the identification schema is the organization and organization responsible for building and managing the corresponding identification schema.
7. Information management system for common electronic catalogues of state agencies serving the development of Vietnam's e-Government is a system for collecting, storing, managing, and sharing data on common catalogues, classification tables, and electronic identification codes issued by organizations and organizations; facilitating integration, exchange, and sharing of data with ministries, sectors, and localities.
Chapter II
ELECTRONIC IDENTIFICATION CODES FOR ORGANIZATIONS AND ORGANIZATIONS
Article 4. Electronic identification codes for ministries, sectors, and localities
1. Electronic identification codes for ministries, sectors, and localities are strings of characters with a maximum length of 35 characters and are divided into groups of characters. Characters include: period (. ), digits from 0 to 9, and letters from A to Z (uppercase in the English alphabet). Each group of characters is used to identify organizations and organizations at the corresponding level; groups of characters are developed from left to right and separated from each other by a period.
2. The first group of characters, located at the far left position in the electronic identification code for ministries, sectors, and localities as specified in Clause 1 of this Article, is used to identify organizations and organizations at Level 1 (referred to as Level 1 Code). Level 1 Code has the format MX1X2, where: M is a letter within the range from A to Y; X1, X2 take values as one of the digits from 0 to 9. Detailed regulations on Level 1 organizations and organizations and their Level 1 Codes for ministries, sectors, and localities and special organizations are set out in Appendix I attached to this Decision.
3. Subsequent groups of characters following the Level 1 Code in the electronic identification code for organizations and organizations as specified in Clause 2 of this Article successively identify organizations and organizations from Level 2 onwards; organizations and organizations at a certain level, excluding Level 1, are units subordinate to or directly under the preceding level organization and organization.
Article 5. Electronic identification code of enterprises, cooperatives, and individual households
The electronic identification code of enterprises, cooperatives, and individual households is a string of characters representing the corresponding enterprise number, cooperative number, and individual household number as prescribed by current laws on enterprise numbers, cooperative numbers, and individual household numbers.
Article 6. Electronic identification code of other agencies and organizations
1. The electronic identification code of agencies and organizations not covered under Articles 4 and 5 of this Decision shall be a string of characters consisting of two consecutive components without any character to separate them; the first component, located at the far left position, is the code identifying the identification schema, followed by the code identifying the agency or organization within the identification schema.
2. The code identifying the identification schema as stipulated in Clause 1 of this Article shall be constructed according to the following principles:
a) It includes three characters in the form of Zxy; starting with the uppercase letter "Z"; x, y take values from among the digits 0 to 9;
b) The codes identifying the identification schema are used sequentially, starting from Z01 to Z99;
c) The code identifying the identification schema for each identification schema of agencies and organizations is unique and can only be used once.
3. The code identifying the agency or organization within the identification schema as stipulated in Clause 1 of this Article has a maximum length of 32 characters and has a structure defined in the identification schema.
Article 7. Construction of Identification Schema
1. Groups of agencies and organizations covered under Article 6 of this Decision when connecting, interlinking, and sharing data with ministries, sectors, and localities must construct an identification schema for their group of agencies and organizations including the components specified in Clause 2 of this Article and submit it to the Ministry of Information and Communications for consolidation, publication, ensuring that the identification schema code does not overlap.
2. The components of the identification schema include:
a) The code identifying the identification schema;
b) The name of the electronic identification code system;
c) Purpose and scope of application;
d) Issuing agency or organization;
đ) Structure of the code identifying the agency or organization within the identification schema;
e) Description of agencies and organizations within the identification schema;
g) Notes on using the electronic identification code;
h) Date of issuance of the identification schema code;
i) Other notes (if any) for cases where the agency or organization constructing the identification schema needs to describe additional information beyond the contents specified from point a to h of this clause.
3. New identification schemas must meet the following requirements:
a) Use the next identification schema code following the latest identification schema code published by the Ministry of Information and Communications;
b) Information about the issuing agency or organization must include name, postal address, email address, contact phone number;
c) Content regarding the structure of the code identifying the agency or organization within the identification schema must specify the number of characters and their meanings, check characters (if any), and display requirements (if any);
d) Content describing agencies and organizations within the identification schema should not exceed 100 words.
4. A template of the identification schema is described in Appendix II of this Decision.
Article 8. Modification, Discontinuation of Use of Identification Schema
1. An identification schema that has been constructed and published as stipulated in Article 7 may be modified and must comply with the following requirements:
a) The code identifying the identification schema, issuing agency or organization, and the structure of the code identifying the agency or organization within the identification schema cannot be modified. If these information need to be changed, a new identification schema must be constructed;
b) The issuing agency or organization of the identification schema must submit the modified identification schema to the Ministry of Information and Communications for management and clearly state the reason for modification.
2. When the issuing agency or organization of the identification schema no longer uses it, they must notify the Ministry of Information and Communications of the discontinuation of use. The notification information shall include the identification schema code being discontinued and the reason for discontinuation.
Chapter III
IMPLEMENTATION
Article 9. Responsibilities of the Ministry of Information and Communications
1. Uniformly manage, supplement, and amend Level 1 Codes of ministries, sectors, localities, and certain special agencies as specified in Clause 2, Article 4 of this Decision to meet practical needs during usage.
2. Develop guiding documents for ministries, sectors, localities, and special agencies as specified in Clause 2, Article 4 of this Decision to build remaining components of electronic identity codes after having Level 1 Codes.
3. Uniformly manage the code defining the electronic identity schema as specified in Clause 2, Article 6 of this Decision; ensure that the code defining the electronic identity schema does not overlap; promptly announce electronic identity schemas on websites or e-Government portals.
4. Develop the Information System for Managing Common Electronic Catalogues used by state agencies to serve the development of Vietnam's e-Government, meeting requirements for storage, synchronized and unified management, and sharing of agency and organization electronic identity codes.
5. Guide agencies and organizations to timely update electronic identity schemas, electronic identity codes, and related information as stipulated in Chapter II of this Decision into the Information System for Managing Common Electronic Catalogues used by state agencies to serve the development of Vietnam's e-Government; implement sharing of these information to facilitate data connection and sharing with ministries, sectors, and localities.
Article 10. Responsibilities of Agencies and Organizations
1. Level 1 agencies as specified in Article 4 of this Decision shall be responsible for building, storing, managing their own electronic identity code systems according to the law and updating, sharing data with the Ministry of Information and Communications.
2. The Ministry of Planning and Investment shall be responsible for building, storing, managing the electronic identity codes of enterprises, cooperatives, and individual households, ensuring no overlap among these entities; updating, sharing data with the Ministry of Information and Communications.
3. Agencies and organizations issuing electronic identity schemas as specified in Article 7 of this Decision must build, store, manage electronic identity schemas and electronic identity codes of units within the electronic identity schema and update, share data with the Ministry of Information and Communications.
4. Updating and sharing data about electronic identity codes and related information with the Ministry of Information and Communications as stipulated in Clauses 1, 2, and 3 of this Article shall be carried out through the Information System for Managing Common Electronic Catalogues used by state agencies to serve the development of Vietnam's e-Government.
Chapter IV
IMPLEMENTING PROVISIONS
Article 11. Transitional Provisions
1. Within twenty-four months from the date this Decision takes effect, ministries, sectors, and localities shall upgrade and adjust their information systems to comply with regulations on electronic identity codes serving data connection and sharing as stated in this Decision.
2. Information systems that only connect and share data internally within a sector are not required to apply the regulations on electronic identity codes as stated in this Decision.
3. Within twenty-four months from the date this Decision takes effect, agencies and organizations shall review and adjust previous regulations (if any) on electronic identity codes to comply with this Decision.
Article 12. Effective Date
1. This Decision takes effect from September 15, 2020.
2. The Minister, Head of a ministry equivalent to a ministry, Head of a government agency, Chairman of the People's Councils of provinces and centrally-administered cities, and relevant agencies, organizations, and individuals shall be responsible for implementing this Decision.
3. The Ministry of Information and Communications shall be responsible for guiding, urging, and inspecting the implementation of this Decision./.
