Pursuant to the Law on Government Organization on June 19, 2015; the Law amending and supplementing certain articles of the Law on Government Organization and the Law on Local Administration Organizationonon December 22, 11 Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on the Organization of the Government and the Law on the Organization of Local Administration dated January 22, 2019;

Pursuant to the Law on Management and Use of State Assets dated June 21, 2017;
At the proposal of the Minister of Agriculture and Rural Development;
The Prime Minister issues this Decision on the List and regulations on management and use of special materials, equipment, and devices for natural disaster prevention and control.
Article 1. Scope of Regulation
1. This Decision stipulates the List and the management and use of special materials, equipment, and devices for natural disaster prevention and control by the State.
2. Materials, equipment, and devices for natural disaster prevention and control not specified in this Decision shall be managed and used in accordance with current laws.
Article 2. Applicability
This Decision applies to agencies, organizations, and individuals related to the management and use of special materials, equipment, and devices for natural disaster prevention and control by the State.
Article 3. List of Special Materials, Equipment, and Devices for Natural Disaster Prevention and Control
1. Special materials, equipment, and devices for natural disaster prevention and control are materials, equipment, and devices with special construction, characteristics, and functions that are directly used to perform natural disaster prevention and control tasks of agencies and organizations.
2. The List of special materials, equipment, and devices for natural disaster prevention and control is detailed in the Appendix attached to this Decision.
Article 4. Sources of Formation of Special Materials, Equipment, and Devices for Natural Disaster Prevention and Control
The sources of formation of special materials, equipment, and devices for natural disaster prevention and control include state budget funds and other lawful sources as prescribed by law.
Article 5. Management and Use of Special Materials, Equipment, and Devices for Natural Disaster Prevention and Control
1. Special materials, equipment, and devices for natural disaster prevention and control must be managed and used in accordance with the provisions of the law on the management and use of public assets. Agencies, organizations, and individuals entrusted with the task of managing and using special materials, equipment, and devices for natural disaster prevention and control have the responsibility to use them for natural disaster prevention and control tasks according to their assigned functions and responsibilities, in compliance with the law.
2. Special materials, equipment, and devices for natural disaster prevention and control can be used for preventive activities, emergency response, and post-disaster recovery; they may also be used for other tasks of agencies and organizations under the management and usage regulations issued by authorized persons but must ensure readiness when natural disasters occur.
3. Based on actual circumstances, agencies and organizations organize training, instruction, and guidance on the use of special materials, equipment, and devices for natural disaster prevention and control in accordance with technical requirements and intended purposes.
4. During the process of using, preserving, and storing special materials, equipment, and devices for natural disaster prevention and control, agencies, organizations, and individuals entrusted with management and use must inspect technical conditions, maintain, repair, and report to competent authorities for review and decision-making in cases where special materials, equipment, and devices for natural disaster prevention and control are lost, damaged, or consumed during task execution.
5. Special equipment and devices for natural disaster prevention and control used to perform natural disaster prevention and control tasks are granted priority rights in accordance with the law.
6. The Command for Natural Disaster Prevention and Control and Search and Rescue at all levels direct or advise authorized persons to direct and mobilize special materials, equipment, and devices for natural disaster prevention and control within their authority and in accordance with various disaster scenarios.
7. Annually, the Command for Natural Disaster Prevention and Control and Search and Rescue at all levels direct the monitoring and summarizing of the status of special materials, equipment, and devices for natural disaster prevention and control of agencies and organizations within their jurisdiction to serve command and control of natural disaster prevention and control and report to higher-level Commands for Natural Disaster Prevention and Control and Search and Rescue.
8. Annually, the Office of the National Steering Committee for Natural Disaster Prevention and Control takes the lead and coordinates with the Office of the National Committee for Disaster Response and Search and Rescue to monitor and summarize the status of special materials, equipment, and devices for natural disaster prevention and control from provincial-level Commands for Natural Disaster Prevention and Control and Search and Rescue, ministries, and sectors to serve national-level command and control of natural disaster prevention and control and report to the Chairman of the National Steering Committee for Natural Disaster Prevention and Control.
9. The heads of agencies and organizations entrusted with the management and use of special materials, equipment, and devices for natural disaster prevention and control are responsible for issuing regulations and organizing the implementation of the management and use of such materials, equipment, and devices in accordance with the law.
Article 6. Responsibilities of agencies and organizations
1. Ministries, central agencies, and localities:
a) Issue standards and usage quotas for special materials, equipment, and devices for natural disaster prevention and control of agencies and organizations under their management in accordance with the law on the management and use of public assets;
b) Proactively allocate budgets, approve, and organize the implementation of plans for purchasing special materials, equipment, and devices for natural disaster prevention and control of agencies and organizations under their management in accordance with their functions and assigned tasks, in compliance with the law;
c) Direct the monitoring and summarizing of the status of special materials, equipment, and devices for natural disaster prevention and control of agencies and organizations under their management annually to serve command and control of natural disaster prevention and control and report to higher-level Commands for Natural Disaster Prevention and Control and Search and Rescue.
d) Annually, the Provincial Steering Committee for Natural Disaster Prevention and Control and Search and Rescue, and relevant ministries and sectors shall report the consolidated status of materials, equipment, and specialized tools for natural disaster prevention and control under their management to the National Steering Committee for Natural Disaster Prevention and Control and the National Committee for Disaster Response and Search and Rescue for consolidation.
2. The Office of the National Steering Committee for Natural Disaster Prevention and Control shall consolidate the status of materials, equipment, and specialized tools for natural disaster prevention and control of ministries, sectors, and localities before March 31 each year to serve the steering and management work of the National Steering Committee for Natural Disaster Prevention and Control.
3. The Ministry of Agriculture and Rural Development, which serves as the permanent office of the National Steering Committee for Natural Disaster Prevention and Control:
a) Shall compile proposals from ministries, sectors, and localities, and report to the Prime Minister for adjustment and supplementation of the List of materials, equipment, and specialized tools for natural disaster prevention and control;
b) Shall issue standards and usage quotas, allocate funds, approve, and organize the implementation of plans for purchasing materials, equipment, and specialized tools for natural disaster prevention and control to serve the steering and management work of the National Steering Committee for Natural Disaster Prevention and Control, in accordance with the functions and responsibilities of the Committee and in compliance with the provisions of the law.
4. The agencies assigned the task of permanent management of natural disaster prevention and control and search and rescue at ministries, sectors, localities, and organizations shall develop plans for purchasing materials, equipment, and specialized tools for natural disaster prevention and control to serve disaster prevention activities, submit these plans to the competent authority for approval in accordance with the provisions of the law.
Article 7. Effective Date
This Decision takes effect from July 20, 2021.
Article 8. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of provincial People's Committees directly under the central government, and the Head of the National Steering Committee for Natural Disaster Prevention and Control are responsible for implementing this Decision.
