Circular No. 20/2023/TT-BGTVT stipulates the standards for professional qualifications, professional certificates, training, and crew member instruction, as well as the minimum safety manning requirements for Vietnamese merchant ships.

Pursuant to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended, to which Vietnam is a party;

Pursuant to the International Convention for the Safety of Life at Sea, 1974, as amended, to which Vietnam is a party;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

At the proposal of the Director of the Transport Department and the Director of the Vietnam Maritime Administration;

The Minister of Transport issues this Circular regulating professional standards, professional certificates, training, and crew instruction for seafarers and minimum safety manning requirements for Vietnamese ships registered in the National Ship Register of Vietnam.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular regulates professional standards, professional certificates for seafarers, training and crew instruction for seafarers, minimum safety manning requirements for ships, and ships of public service registered in the National Ship Register of Vietnam.

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals related to professional standards, professional certificates for seafarers, training and crew instruction for seafarers, minimum safety manning requirements for ships, and ships of public service registered in the National Ship Register of Vietnam.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. STCW Convention means the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended (STCW Convention).

2. STCW Code means the Code accompanying the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended.

3. HSC Code means the International Code for High Speed Craft.

4. IGF Code means the International Code for the Safe Carriage of Liquefied Gases in Ships.

5. Master means the person having command authority on board a ship.

6. Officer means a member of the crew other than the Master who has the qualifications and meets the requirements to hold a position on board.

7. Chief Officer means the deck officer next in rank to the Master and is the person commanding the ship when the Master is unable to command.

8. Deck Officer means an officer with the professional qualifications specified in Chapter II of the STCW Convention.

9. Ordinary Seaman on Watch (OS) means a seafarer with the professional qualifications specified in Regulation II/4 of the STCW Convention and who has completed specialized training as prescribed by the Minister of Transport.

10. Able Seaman on Watch (AB) means a seafarer with the professional qualifications specified in Regulation II/5 of the STCW Convention and who has completed specialized training as prescribed by the Minister of Transport.

11. Chief Engineer means the highest-ranking engineer officer responsible for the ship's main propulsion plant; operation and maintenance of electrical and mechanical equipment on board.

12. Second Engineer means the engineer officer next in rank to the Chief Engineer, responsible for the ship's main propulsion plant; operation and maintenance of electrical and mechanical equipment on board when the Chief Engineer is unable to perform.

13. Engineering Officer means an officer with the professional qualifications specified in Regulations III/1, III/2, and III/3 of the STCW Convention.

14. Oilman on Watch (Oiler) means a seafarer with the professional qualifications specified in Regulation III/4 of the STCW Convention and who has completed specialized training as prescribed by the Minister of Transport.

15. Able Seaman on Watch (AB) means a seafarer with the professional qualifications specified in Regulation III/5 of the STCW Convention and who has completed specialized training as prescribed by the Minister of Transport.

16. Electrical Engineering Officer means an officer with the professional qualifications specified in Regulation III/6 of the STCW Convention.

17. Electrician means a seafarer with the professional qualifications specified in Regulation III/7 of the STCW Convention.

18. GMDSS Radio Officer means an officer with the professional qualifications specified in Chapter IV of the STCW Convention.

19. Ship Security Officer means a person working on board the ship responsible to the Master, appointed by the company to ensure ship security including the implementation and maintenance of the ship security plan; communication with the company’s ship security officer and port facility security officer.

20. Security duties include all tasks related to ship security as defined in Chapter XI-2 of the International Convention for the Safety of Life at Sea, 1974, as amended (SOLAS 74 and amendments) and the International Ship and Port Facility Security Code (ISPS Code).

21. Oil Tanker means a ship constructed or converted and used for the carriage of crude oil and petroleum products in bulk.

22. Chemical Tanker means a ship constructed or converted and used for the carriage of bulk liquid chemicals listed in Chapter 17 of the International Code for the Construction and Equipment of Ships Carrying Dangerous Chemicals in Bulk (IBC Code).

23. Gas Carrier means a ship constructed or converted and used for the carriage of bulk liquefied gases as defined in Chapter 19 of the International Code for the Construction and Equipment of Ships Carrying Liquefied Gases in Bulk (IGC Code).

24. Passenger Ship means a ship as defined in the International Convention for the Safety of Life at Sea, 1974, as amended (SOLAS 74 and amendments).

25. Ro-Ro Passenger Ship means a passenger ship with Ro-Ro spaces or special spaces as defined in the International Convention for the Safety of Life at Sea, 1974, as amended (SOLAS 74 and amendments).

26. Near Coastal Voyage for ships with gross tonnage (GT) under 500 means a voyage within a limit of 50 nautical miles from the coast or within an area agreed upon between Vietnam and relevant countries as a near coastal voyage.

27. Logbook of Training means a logbook issued to seafarers with university-level training as deck cadets on ships of 500 GT and above, engine cadets on ships with total main engine power of 750 kW and above, or issued to students training as deck cadets on ships of 500 GT and above, engine cadets on ships with total main engine power of 750 kW and above according to the approved maritime officer training program by the Ministry of Transport; seafarers with college-level training as electrical engineering cadets as required in Table A-III/6 of the STCW Code.

28. Period of Training means the time during which trainees work on board a ship in accordance with a training program consistent with the STCW Convention.

29. The probation period is the time during which seafarers undergo practical training for their position on ships corresponding to their certificate of competency under the supervision of an officer.

30. The period of holding a position is the time during which seafarers work in a position consistent with their issued certificate of competency.

31. Sea service time is the time during which trainees undergo practical training, seafarers serve their probation period, or hold a position on board a ship.

32. Month means a calendar month or thirty days, composed of periods smaller than a month.

33. Function is a group of tasks, duties, and responsibilities prescribed in the STCW Code necessary for the operation of a ship, safety of life at sea, or protection of the marine environment.

34. Seafarer management organization includes seafarer training institutions, ship owners, seafarer supply organizations, or any other organization or individual such as managers or bareboat charterers who accept responsibility for ship operations from the ship owner and agree to undertake all such tasks and responsibilities for the company in accordance with those provisions.

35. Certificate of Competency (hereinafter referred to as CoC) is a certificate issued to seafarers in accordance with the STCW Convention.

36. Proficiency in Voyage Safety and Security Certificate (hereinafter referred to as PSSP) is a certificate issued to seafarers in accordance with the STCW Convention.

37. Recognition of Certificate of Competency is a document issued by the Vietnam Maritime Administration or its authorized branch or port maritime administration to seafarers holding a professional certificate issued by a competent authority of a country or territory with which Vietnam has agreed to recognize such certificates, allowing them to work on Vietnamese ships.

38. Confirmation of issuance of a certificate is a document issued by the Vietnam Maritime Administration or its authorized branch or port maritime administration to seafarers who have been issued a certificate upon completion of training courses in Vietnam as stipulated in: Rule IV/2, Rule V/1-1, Rule V/1-2 of the STCW Convention; high-speed craft as provided for in the HSC Code; gas-fueled ships as provided for in the IGF Code.

39. High-speed craft is a vessel that has been issued a high-speed craft safety certificate by the ship registration authority in compliance with the HSC International Code and the National Technical Regulations on classification and construction of high-speed vessels.

40. The Vietnamese Ship Registration Authority consists of the Vietnam Maritime Administration or its authorized branch or port maritime administration responsible for ship registration activities.

41. Gas-fueled ship as defined in the IGF Code is a ship using gas fuel or low flashpoint liquid fuel.

Chapter II

PROFESSIONAL STANDARDS OF SEAFARERS

Article 4. Professional standards for masters and chief officers of ships of 500 GT and above

Masters and chief officers of ships of 500 GT and above must meet the professional standards set out in Sections A-II/1, A-II/2, A-IV/2, and A-VIII/2 of the STCW Code concerning the following functions:

1. Navigation at the management level.

2. Cargo handling and stowage at the management level.

3. Control of ship operations and care of persons on board at the management level.

4. Communication at the operational level.

Article 5. Professional standards for captains and chief officers of vessels under 500 GT on off-shore voyages

Captains and chief officers of vessels under 500 GT on off-shore voyages must hold a Certificate of Competency for vessels from 500 GT to under 3000 GT.

Article 6. Professional standards for captains and chief officers of vessels under 500 GT on near-shore voyages

Captains and chief officers of vessels under 500 GT on near-shore voyages must meet the professional standards set out in Sections A-II/3, A-IV/2, and A-VIII/2 of the STCW Convention regarding the following functions:

1. Navigation at the management level.

2. Cargo handling and stowage at the management level.

3. Control of ship operations and care of persons on board at the management level.

4. Communication at the operational level.

Article 7. Professional standards for deck officers of vessels 500 GT and above

Deck officers of vessels 500 GT and above must meet the professional standards set out in Sections A-II/1, A-IV/2, and A-VIII/2 of the STCW Convention regarding the following functions:

1. Navigation at operational level.

2. Cargo handling and stowage at operational level.

3. Vessel operation control and crew care at operational level.

4. Communication at the operational level.

Article 8. Professional standards for deck officers of vessels under 500 GT on off-shore voyages

Deck officers of vessels under 500 GT on off-shore voyages must hold a Certificate of Competency for deck officers of vessels 500 GT and above.

Article 9. Professional standards for deck officers of vessels under 500 GT on near-shore voyages

Deck officers of vessels under 500 GT on near-shore voyages must meet the professional standards set out in Sections A-II/3, A-IV/2, and A-VIII/2 of the STCW Convention regarding the following functions:

1. Navigation at operational level.

2. Cargo handling and stowage at operational level.

3. Vessel operation control and crew care at operational level.

4. Communication at the operational level.

Article 10. Professional standards for watchkeeping ratings

1. Professional standards for watchkeeping rating OS: Watchkeeping rating OS must meet the professional standards set out in Section A-II/4 of the STCW Convention regarding navigation at assistance level.

2. Professional standards for watchkeeping rating AB: Watchkeeping rating AB must meet the professional standards set out in Section A-II/5 of the STCW Convention regarding the following functions:

a) Navigation at assistance level;

b) Cargo handling and stowage at assistance level;

c) Vessel operation control and crew care at assistance level;

d) Maintenance and repair at assistance level.

Article 11. Professional standards for chief engineers and second engineers of vessels with main engine power of 750 kW and above

Chief engineers and second engineers of vessels with main engine power of 750 kW and above must meet the professional standards set out in Sections A-III/1, A-III/2, and A-VIII/2 of the STCW Convention regarding the following functions:

1. Marine engineering technology at management level.

2. Electrical, electronic, and machinery control technology at management level.

3. Maintenance and repair at management level.

4. Vessel operation control and crew care at management level.

Article 12. Professional standards for chief engineers and second engineers of vessels with main engine power below 750 kW

Chief engineers and second engineers of vessels with main engine power below 750 kW must meet the professional standards according to the training program prescribed by the Minister of Transport regarding the following functions:

1. Marine engineering technology at management level.

2. Electrical, electronic, and machinery control technology at management level.

3. Maintenance and repair at management level.

4. Vessel operation control and crew care at management level.

Article 13. Professional standards for engineering officers of vessels with main engine power of 750 kW and above

Engineering officers of vessels with main engine power of 750 kW and above must meet the professional standards set out in Section A-III/1 and Section A-VIII/2 of the STCW Convention regarding the following functions:

1. Marine engineering technology at operational level.

2. Electrical, electronic, and machinery control technology at operational level.

3. Maintenance and repair at operational level.

4. Vessel operation control and crew care at operational level.

Article 14. Professional standards for officers of vessels with main engine power under 750 kW

Officers of vessels with main engine power under 750 kW must meet the professional standards set out in the training program prescribed by the Minister of Transport regarding the following functions:

1. Marine engineering technology at operational level.

2. Electrical, electronic, and machinery control technology at operational level.

3. Maintenance and repair at operational level.

4. Vessel operation control and crew care at operational level.

Article 15. Professional standards for watch engineers

1. Professional standards for watch engineer Oiler: The watch engineer Oiler must meet the professional standards specified in Section A-III/4 of the STCW Convention concerning the technical function of marine machinery at the assistance level.

2. Professional standards for watch engineer AB: The watch engineer AB must meet the professional standards specified in Section A-III/5 of the STCW Convention concerning the following functions:

a) Marine machinery technology at the assistance level;

b) Electrical, electronic, and machinery control technology at the assistance level;

c) Maintenance and repair at the assistance level;

d) Control of vessel operations and care for persons on board at the assistance level.

Article 16. Professional standards for electrical engineering officers

Electrical engineering officers must meet the professional standards specified in Section A-III/6 of the STCW Convention concerning the following functions:

1. Electrical, electronic, and control technology at the operational level.

2. Maintenance and repair at the operational level.

3. Vessel operation control and crew care at operational level.

Article 17. Professional standards for electrical engineers

Electrical engineers must meet the professional standards specified in Section A-III/7 of the STCW Convention concerning the following functions:

1. Electrical, electronic, and control technology at the assistance level.

2. Maintenance and repair at the assistance level.

3. Control of vessel operations and care for persons on board at the assistance level.

Chapter III

SEAFARER SPECIALIST CERTIFICATES

Section 1

TYPES OF SPECIALIST CERTIFICATES

Article 18. Classification of professional certificates

The professional certificates for seafarers on Vietnamese vessels include the following types:

1. GCNKNCM.

2. GCNHLNV:

a) Certificate of Basic Vocational Training (hereinafter referred to as GCNHLNVCB);

b) Certificate of Specialized Vocational Training (hereinafter referred to as GCNHLNVĐB);

c) Certificate of Professional Vocational Training (hereinafter referred to as GCNHLNVCM).

3. Sample of professional certificate as stipulated in Appendix I issued together with this Circular.

Article 19. Certificate of Professional Competency

1. GCNKNCM is issued by the Vietnam Maritime Administration or its branch offices authorized by the Vietnam Maritime Administration to seafarers to undertake positions as prescribed in this Circular, other relevant regulations of Vietnamese law, and in accordance with the provisions of the STCW Convention.

2. GCNKNCM has a validity period of five years from the date of issuance.

Article 20. Certificate of Basic Vocational Training

1. GCNHLNVCB is issued by training institutions to seafarers who have completed the basic vocational training program on survival techniques, fire prevention and extinguishing, basic first aid, safety of life at sea, social responsibility, and awareness of maritime security in compliance with the STCW Convention.

2. GCNHLNVCB has a validity period of five years from the date of issuance.

Article 21. Certificate of Specialized Vocational Training

1. GCNHLNVĐB is issued by training institutions to seafarers who have successfully completed one of the specialized vocational training programs in compliance with the STCW Convention, as follows:

a) Basic: oil tankers and chemical carriers; liquefied gas carriers; polar water operation vessels; high-speed vessels as defined in the HSC Code; vessels using low flashpoint fuels as defined in the IGF Code;

b) Advanced: oil tankers; chemical carriers; liquefied gas carriers; polar water operation vessels; high-speed vessels as defined in the HSC Code; vessels using low flashpoint fuels as defined in the IGF Code;

c) Crowd management for passenger ships and Ro-Ro passenger ships;

d) Safety training for direct service personnel on passenger ship and Ro-Ro passenger ship passenger decks;

đ) Passenger safety, cargo safety, and hull integrity training for passenger ships and Ro-Ro passenger ships;

e) Crisis management and human response on passenger ships and Ro-Ro passenger ships.

2. GCNHLNVĐB has a validity period of five years from the date of issuance.

Article 22. Certificate of Professional Training

1. The Certificate of Professional Training (CPT) shall be issued by training institutions to seafarers who have completed one of the following professional training programs in accordance with the provisions of the STCW Convention as follows:

a) Marine Radar and ARPA Operation level;

b) Marine Radar and ARPA Management level;

c) Global Maritime Distress and Safety System (GMDSS): General Operator's Certificate (GOC), Restricted Operator's Certificate (ROC);

e) Medical care;

g) Lifeboat, rescue boat;

h) High-speed rescue boat.

2. The GOC and ROC Proficiency Training Certificates are valid for use for five years from the date of issuance; other Proficiency Training Certificates have no time limit for use.

h) High-speed Rescue Boats;

i) Seafarer with specific security duties on board ships;

k) Ship Security Officer;

l) Management of Deck Crew and Resources;

m) Management of Engine Room Crew and Resources;

n) Marine English;

o) Electronic Navigation Charts;

p) Marine Safety Officer;

q) Chief Cook and Steward;

r) Other CPTs prescribed by the IMO.

2. The validity period of the CPT is five years from the date of issuance.

Section 2

CONDITIONS FOR ISSUING AND RENEWING THE CERTIFICATE OF PROFESSIONAL COMPETENCE

Article 23. General Conditions

1. Meeting the age requirement for labor and health standards as prescribed.

2. Graduating or completing one of the following programs:

a) Graduating from a major or specialty in ship navigation, marine engine operation, or marine electrical engineering according to a training program in compliance with the regulations of the Ministry of Education and Training or the Ministry of Labor, Invalids and Social Affairs;

b) Graduating from majors or specialties specified in point a of this clause at foreign training institutions recognized by the Ministry of Education and Training;

c) Completing a training program for marine officers as stipulated by the Minister of Transport;

d) Completing the relevant courses in the watchkeeping officer (OS) and watchkeeping engineer (Oiler) programs at higher vocational schools specializing in maritime training and meeting the requirements set out in Sections A-II/4; A-III/4; A-III/7 of the STCW Code.

3. In the following cases, additional courses must be supplemented:

a) Graduating from majors or specialties specified in Clause 2 of this Article at non-maritime specialized training institutions;

b) Graduating from a repair engineering specialty at maritime specialized training institutions;

c) Graduating from a specialty in inland waterway vessel control, inland waterway vessel engine operation, or inland waterway vessel electrical engineering at inland waterway specialized training institutions.

4. In the following case, no additional supplementation is required: Graduating from a major or specialty with a different name but having studied all subjects in the training program of the major or specialty specified in Clause 2 of this Article at maritime specialized training institutions.

5. Meeting the professional conditions and time requirements corresponding to each position as stipulated in Articles 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, and 41 of this Circular.

Article 24. Conditions for Issuing the Certificate of Professional Competence for Master and Chief Officer of Ships of 3,000 GT and Above

1. Professional conditions:

a) Graduating from a major in ship navigation at the bachelor’s degree level; in the case of graduating from a major in ship navigation at the associate degree level, it is necessary to complete the advanced training program prescribed by the Minister of Transport;

b) Having a level 3 proficiency in Marine English;

c) Completing the professional development program prescribed by the Minister of Transport;

d) Passing the examination for Master and Chief Officer of Ships of 3,000 GT and Above.

2. Conditions for holding the position:

a) For Chief Officer: having at least 24 months of experience in the position of Deck Officer on ships of 500 GT and above;

b) For Master: having at least 24 months of experience in the position of Chief Officer on ships of 3,000 GT and above, or having at least 12 months of experience in the position of Master on ships of 500 GT to less than 3,000 GT and at least 12 months of experience in the position of Chief Officer on ships of 3,000 GT and above.

Article 25. Conditions for issuing the Certificate of Professional Competence for Master and Chief Officer of vessels from 500 GT to less than 3000 GT

1. Professional conditions:

a) Graduated from a higher college-level nautical control major. In case of graduating from a secondary college-level nautical control major, must complete the advanced training program prescribed by the Minister of Transport;

b) Possess a minimum level 2 proficiency in maritime English;

c) Completing the professional development program prescribed by the Minister of Transport;

d) Pass the examination for Master and Chief Officer of vessels from 500 GT to less than 3000 GT.

2. Conditions for holding the position:

a) For Chief Officer: having at least 24 months of experience in the position of Deck Officer on ships of 500 GT and above;

b) For Master: have at least 24 months of experience serving as Chief Officer on vessels from 500 GT to less than 3000 GT, or at least 12 months of experience serving as Master on vessels from 50 GT to less than 500 GT in near-coastal routes, and at least 12 months of experience serving as Chief Officer on vessels from 500 GT to less than 3000 GT.

Article 26. Conditions for issuing the Certificate of Professional Competence for Master and Chief Officer of vessels from 50 GT to less than 500 GT (near-coastal route)

1. Professional conditions:

a) Graduated from a secondary college-level nautical control major or higher;

b) Possess a minimum level 1 proficiency in maritime English;

c) Completing the professional development program prescribed by the Minister of Transport;

d) Pass the examination for Master and Chief Officer of vessels from 50 GT to less than 500 GT.

2. Conditions for holding the position:

a) For Chief Officer: have at least 24 months of experience serving as Deck Cadet on vessels under 500 GT in near-coastal routes;

b) For Master: have at least 24 months of experience serving as Chief Officer on vessels under 500 GT in near-coastal routes.

Article 27. Conditions for issuing the Certificate of Professional Competence for Master of vessels under 50 GT in near-coastal routes

1. Professional conditions:

a) Completion of secondary education;

b) Complete the short-term specialized training program in nautical control and pass the examination according to the regulations of the Minister of Transport. In case of graduating from a primary-level nautical control major, only passing the examination is required.

2. Sea service time requirement: have at least 12 months of sea service.

Article 28. Conditions for issuing the Certificate of Professional Competence for Deck Officer of vessels from 500 GT and above

1. Professional conditions:

a) Graduated from a higher college-level nautical control major or completed the training program for Marine Deck Officer in nautical control prescribed by the Minister of Transport. In case of graduating from a secondary college-level nautical control major, must complete the advanced training program prescribed by the Minister of Transport;

b) Possess a minimum level 2 proficiency in maritime English;

c) Pass the examination for Deck Officer of vessels from 500 GT and above.

2. Time requirements for holding the position:

a) Have at least 12 months of recorded sea service in the "Training Record Book" according to the training program meeting the requirements of Section A-II/1 of the STCW Convention, or have at least 36 months of sea service, including at least 18 months on vessels from 500 GT and above, with at least 6 months serving as Able Seaman watchkeeping;

b) If already served as Deck Officer on vessels under 500 GT in near-coastal routes, must have at least 6 months of sea service on vessels from 500 GT and above.

Article 29. Conditions for issuing the Certificate of Professional Competence for Deck Officer of vessels under 500 GT in near-coastal routes

1. Professional conditions:

a) Graduated from a secondary college-level nautical control major or higher;

b) Possess a minimum level 1 proficiency in maritime English;

c) Pass the examination for Deck Officer of vessels under 500 GT.

2. Experience requirement: have at least 36 months of sea service.

Article 30. Conditions for issuing the Certificate of Professional Competence for Chief Engineer and Second Engineer of vessels with main engine power of 3000 kW and above

1. Professional conditions:

a) Graduated from a bachelor's degree in marine machinery operation; in case of graduating from a higher college-level marine machinery operation major, must complete the advanced training program prescribed by the Minister of Transport;

b) Having a level 3 proficiency in Marine English;

c) Complete the vocational enhancement program prescribed by the Ministry of Transport;

d) Pass the examination for Chief Engineer and Second Engineer of vessels with main engine power of 3000 kW and above.

2. Conditions for holding the position:

a) For Second Engineer: have at least 24 months of experience serving as Marine Machinery Officer on vessels with main engine power of 750 kW and above;

b) For Chief Engineer: have at least 24 months of experience serving as Second Engineer on vessels with main engine power of 3000 kW and above, or at least 12 months of experience serving as Chief Engineer on vessels with main engine power from 750 kW to less than 3000 kW, and at least 12 months of experience serving as Second Engineer on vessels with main engine power of 3000 kW and above.

Article 31. Conditions for issuing a Certificate of Professional Competence for Chief Engineer and Second Engineer on vessels with main engine power from 750 kW to less than 3,000 kW

1. Professional conditions:

a) Graduated in marine engineering operation major at college level or higher. In case of graduating in marine engineering operation major at secondary technical school level, must complete the advanced training program prescribed by the Minister of Transport;

b) Possess a minimum level 2 proficiency in maritime English;

c) Completing the professional development program prescribed by the Minister of Transport;

d) Achieve the results of the examination for Chief Engineer and Second Engineer on vessels with main engine power from 750 kW to less than 3,000 kW.

2. Conditions for holding the position:

a) For Second Engineer: have at least 24 months of experience serving as Marine Machinery Officer on vessels with main engine power of 750 kW and above;

b) For Chief Engineer: have at least 24 months of experience in the position of Second Engineer on vessels with main engine power from 750 kW to less than 3,000 kW, or at least 12 months of experience in the position of Chief Engineer on vessels with main engine power from 75 kW to less than 750 kW and at least 12 months of experience in the position of Second Engineer on vessels with main engine power from 750 kW to less than 3,000 kW.

Article 32. Conditions for issuing a Certificate of Professional Competence for Chief Engineer on vessels with main engine power from 75 kW to less than 750 kW and Second Engineer on vessels with main engine power under 750 kW

1. Professional conditions:

a) Graduated in marine engineering operation major at secondary technical school level or higher;

b) Possess a minimum level 1 proficiency in maritime English;

c) Completing the professional development program prescribed by the Minister of Transport;

d) Achieve the results of the examination for Chief Engineer and Second Engineer on vessels with main engine power from 75 kW to less than 750 kW.

2. Time requirements for holding the position:

a) For Second Engineer: have at least 24 months of experience in the position of Marine Engineering Officer on vessels with main engine power under 750 kW;

b) For Chief Engineer: have at least 24 months of experience in the position of Second Engineer on vessels with main engine power under 750 kW, or at least 36 months of experience in the position of Marine Engineering Officer on vessels with main engine power under 750 kW.

Article 33. Conditions for issuing a Certificate of Professional Competence for Chief Engineer on vessels with main engine power under 75 kW

1. Professional conditions:

a) Completion of secondary education;

b) Complete a short-term specialized training program in marine engineering operation and achieve the examination results prescribed by the Minister of Transport. In case of having graduated in marine engineering operation major at vocational level, only need to achieve the examination results.

2. Sea service time requirement: Have at least 12 months of sea service time.

Article 34. Conditions for issuing a Certificate of Professional Competence for Marine Engineering Officer on vessels with main engine power from 750 kW or higher

1. Professional conditions:

a) Graduated in marine engineering operation major at college level or higher, or graduated from the Marine Officer Training Program in marine engineering operation prescribed by the Minister of Transport. In case of graduating in marine engineering operation major at secondary technical school level, must complete the advanced training program prescribed by the Minister of Transport;

b) Possess a minimum level 2 proficiency in maritime English;

c) Achieve the results of the examination for Marine Engineering Officer on vessels with main engine power from 750 kW or higher.

2. Time requirements for holding the position:

a) Have at least 12 months of recorded practical training in the "Training Record Book" according to the training program meeting the requirements of Section A-III/1 of the STCW Convention, or have at least 36 months of sea service time, including at least 18 months on vessels with main engine power from 750 kW or higher, including 6 months in the position of duty engineer AB;

b) In case of having served in the position of Marine Engineering Officer on vessels with main engine power under 750 kW, must have at least 6 months of sea service time on vessels with main engine power from 750 kW or higher.

Article 35. Conditions for issuing the Certificate of Professional Competence for Officers of Ships with Main Engine Power under 750 kW

1. Professional conditions:

a) Graduated in marine engineering operation major at secondary technical school level or higher;

b) Possess a minimum level 1 proficiency in maritime English;

c) Pass the examination for Officers of Ships with Main Engine Power under 750 kW.

2. Time condition for holding the position: have at least 36 months of sea service on ships with main engine power of 75 kW or more.

Article 36. Conditions for issuing the Certificate of Professional Competence for Watchkeeping Ratings on Navigation

1. Watchkeeping Rating on Navigation OS:

a) Graduated from a marine engineering control program at the intermediate level or higher, or completed theoretical courses according to the training program for Marine Officers in the navigation control field as prescribed by the Minister of Transport, or completed theoretical courses for Watchkeeping Rating on Navigation OS in a maritime vocational training program at the college level or higher. In case of graduation from a marine engineering control program at the basic level, must complete the advanced training program as prescribed by the Minister of Transport;

b) Hold a certificate of basic vocational training;

c) Have at least 6 months of sea service or 2 months of practical training as Watchkeeping Rating on Navigation OS.

2. Watchkeeping Rating on Navigation AB:

a) Hold a Certificate of Professional Competence for Watchkeeping Rating on Navigation OS (in cases where there is no such certificate, must graduate from a marine engineering control program at the college level or higher);

b) Hold a certificate of basic vocational training;

c) Have at least 18 months of sea service or 12 months of practical training as Watchkeeping Rating on Navigation AB.

Article 37. Conditions for issuing the Certificate of Professional Competence for Watchkeeping Ratings on Engineering

1. Watchkeeping Rating on Engineering Oiler:

a) Graduated from a marine machinery operation program at the intermediate level or higher, or completed theoretical courses according to the training program for Marine Officers in the marine machinery operation field as prescribed by the Minister of Transport, or completed theoretical courses for Watchkeeping Rating on Engineering Oiler in a maritime vocational training program at the college level or higher. In case of graduation from a marine machinery operation program at the basic level, must complete the advanced training program as prescribed by the Minister of Transport;

b) Hold a certificate of basic vocational training;

c) Have at least 6 months of sea service or 2 months of practical training as Watchkeeping Rating on Engineering Oiler.

2. Watchkeeping Rating on Engineering AB:

a) Hold a Certificate of Professional Competence for Watchkeeping Rating on Engineering Oiler (in cases where there is no such certificate, must graduate from a marine machinery operation program at the college level or higher);

b) Hold a certificate of basic vocational training;

c) Have at least 12 months of sea service or 6 months of practical training as Watchkeeping Rating on Engineering AB.

Article 38. Conditions for issuing the Certificate of Professional Competence for Electrical Officers

1. Professional conditions:

a) Graduated from a marine electrical engineering program at the college level or higher. In case of graduation from a marine electrical engineering program at the intermediate level, must complete the advanced training program as prescribed by the Minister of Transport;

b) Possess a minimum level 2 proficiency in maritime English;

c) Completed the vocational enhancement program as prescribed by the Minister of Transport and passed the examination for Electrical Officers of Ships.

2. Time condition for holding the position: have at least 12 months of practical training recorded in the "Training Record Book" according to the training program meeting the requirements set out in Table A-III/6 of the STCW Convention or have at least 36 months of sea service.

Article 39. Conditions for Issuing the Certificate of Professional Competence for Marine Electrical Technicians

1. Graduating from a marine electrical engineering program at the intermediate level or higher, or completing the training modules for marine electrical technicians under programs at the college level or higher at specialized maritime education institutions. In cases where a person graduates from a marine electrical engineering program at the basic level, they must complete the advanced training program prescribed by the Minister of Transport.

2. Holding a Basic Vocational Training Certificate.

3. Having a minimum of six months at sea or three months of practical training as a marine electrical technician.

Article 40. Conditions for Issuing the Certificate of Professional Competence for Vietnamese Citizens Who Already Hold a Certificate of Professional Competence Issued by an Authorized Foreign Authority

1. Graduating from a marine navigation control, marine machinery operation, or marine electrical engineering program at the intermediate level or higher at foreign specialized maritime educational institutions, with the graduation certificate being recognized according to the regulations of the Ministry of Education and Training of Vietnam.

2. Possessing a Certificate of Professional Competence issued by the authorized authority of a country or territory that has reached an agreement with Vietnam on the recognition of professional certificates.

Article 41. Conditions for Reissuing the Certificate of Professional Competence

1. The Certificate of Professional Competence will be reissued in cases of loss, damage, information change, expiration, or nearing expiration.

2. For Certificates of Professional Competence that have expired not more than five years or are nearing expiration, the following conditions must be met:

a) Seafarers must have a cumulative total of twelve months or more of experience in their respective positions within the five years immediately preceding the application for reissue, or three months within the six months immediately preceding the application for reissue.

b) If the condition specified in point a of this clause is not met, seafarers must undergo a three-month probation period in their respective positions within the six months immediately preceding the application for reissue, or achieve satisfactory results in the corresponding officer, master, or chief engineer examination as prescribed by the Minister of Transport.

c) If seafarers have had experience in similar positions as specified in point a of this clause but on ships with lower position restrictions than those indicated on the Certificate of Professional Competence being applied for, they may apply for a Certificate of Professional Competence with equivalent position restrictions to the type of ship they have worked on.

d) Relevant vocational certificates must still be valid as required by the STCW Convention.

3. For Certificates of Professional Competence that have been expired for five years or longer:

a) For watchkeeping ratings, watchkeeping engineers, and marine electrical technicians, a three-month probation period in their respective positions within the six months immediately preceding the application for reissue is required.

b) For officers and above, satisfactory results in the corresponding officer, master, or chief engineer examination as prescribed by the Minister of Transport must be achieved.

Article 42. Conditions for Reissuing the Certificate of Vocational Training

1. The Certificate of Vocational Training will be reissued in cases of loss, damage, information change, expiration, or nearing expiration.

2. For Certificates of Vocational Training that have expired or are nearing expiration, the following conditions must be met:

a) Seafarers must have a cumulative total of twelve months or more of sea service time relevant to the Certificate of Vocational Training within the five years immediately preceding the application for reissue.

b) If the required period specified in point a of this clause is not met, seafarers must pass a competency assessment test relevant to the Certificate of Vocational Training.

1. Having completed the course on chief trainer training.

2. Being trained to use simulation equipment and evaluate simulations in cases where they are trainers in simulation rooms.

Article 46. Conditions for Reissuing the Certificate of Professional Competence Recognition, Certificate of Issuance of Certificates, and Certificate of Chief Trainer

The Certificate of Professional Competence Recognition (GCNKNCM), Certificate of Issuance of Certificates (still valid), and Certificate of Chief Trainer will be reissued in the following cases: loss, change of information, damage.

Section 4

MARINE OFFICER EXAMINATION ORGANIZATION

Article 47. Marine Officer Examination Board

1. The Marine Officer Examination Board (hereinafter referred to as the Examination Board) shall be established by the Director of the Vietnam Maritime Administration, consisting of five members: the Chairman of the Examination Board is the leadership of the Vietnam Maritime Administration; one Secretary of the Examination Board; two members from the leadership of departments within the Vietnam Maritime Administration (Human Resources Department and Vessels and Crew Department); one member from the leadership of training institutions.

2. The Examination Board has the following tasks:

a) Advising the Director of the Vietnam Maritime Administration to decide: the list of candidates; the establishment of the Examination Committee (hereinafter referred to as the Committee) to organize and grade the examination; the form of examination; selection of examination questions for each rank; recognition of examination results;

b) Organizing, inspecting, and supervising the conduct of examinations.

c) Compiling and reporting the examination results;

d) Handling violations of examination regulations.

Article 48. Examination Committee

1. The Examination Committee shall be established by the Director of the Vietnam Maritime Administration based on the proposal of the Chairman of the Examination Board.

2. The number of members of the Examination Committee depends on the number of candidates but must have at least three members, of which at least one-third of the committee members do not directly participate in teaching. Members of the Examination Committee are captains, chief engineers, experts in maritime fields, management fields; teachers with pedagogical skills, capabilities, experience, and professional qualifications corresponding to the requirements of each examination course.

3. Duties of the Examination Committee:

a) Strictly, fairly, accurately, and correctly asking and grading exams to assess the candidates' level;

b) Detecting errors in the exam questions and promptly proposing adjustments to the Examination Board;

c) Detecting and recommending to the Chairman of the Examination Board to promptly address negative phenomena during the examination period.

Section 5

TRAINING AND TRAINING OF CREWS

Article 49. Chief Instructor

1. Chief Instructors are those individuals trained in training operations according to a program prescribed by the Minister of Transport and issued with a Chief Instructor Certificate.

2. Chief Instructors must have experience, professional qualifications, and appropriate training certificates corresponding to the course they teach; in cases where simulation is used in the course, they must hold certificates corresponding to the simulation program they instruct.

3. Chief Instructors or persons holding a Chief Instructor Certificate issued by a foreign country in accordance with the STCW Convention 1978 and its amendments shall be assigned to train for corresponding courses; training seafarers and recording practical training logs on board ships.

Article 50. Basic Vocational Training

1. Graduates from maritime vocational training institutions shall be issued a Basic Vocational Training Certificate by such institutions.

2. In cases where seafarers have not undergone basic vocational training, they must complete the basic vocational training program as prescribed and obtain a certificate from the training institution.

Article 51. Specialized Vocational Training

1. Specialized vocational training applies to seafarers working on oil tankers, chemical carriers, liquefied gas carriers, passenger ships, Ro-Ro passenger ships, vessels operating in polar waters, and high-speed craft.

2. Specialized vocational training for seafarers working on oil tankers, chemical carriers, liquefied gas carriers, and vessels operating in polar waters includes basic vocational training and advanced vocational training.

3. Specialized vocational training for seafarers working on passenger ships and Ro-Ro passenger ships includes safety training for direct service staff on passenger decks; passenger safety, cargo safety, and hull integrity training; crowd management and crisis response and human behavior reaction training.

4. For oil tankers, chemical carriers, and liquefied gas carriers, a Basic Vocational Training Certificate will be issued to seafarers who have completed the basic vocational training program.

5. For oil tankers, chemical carriers, and liquefied gas carriers, an Advanced Vocational Training Certificate will be issued to masters, chief engineers, first officers, second engineers, officers, and other crew members responsible for cargo handling and care who have completed the advanced vocational training program.

6. For vessels operating in polar waters, a Basic Vocational Training Certificate will be issued to masters, first officers, and deck officers who have completed the basic vocational training program and meet the professional standards specified in Section A-V/4 paragraph 1 of the STCW Code.

7. For vessels operating in polar waters, an Advanced Vocational Training Certificate will be issued to masters and first officers who have at least two months of experience working in polar waters or equivalent recognition, have completed the advanced vocational training program, and meet the professional standards specified in Section A-V/4 paragraph 2 of the STCW Code.

8. For passenger ships and Ro-Ro passenger ships, a Specialized Vocational Training Certificate will be issued to individuals who have completed one or all of the following training programs:

a) Masters, first officers, officers, and other crew members tasked with assisting passengers in emergency situations have completed crowd management vocational training programs.

b) Masters, first officers, chief engineers, second engineers, and other crew members responsible for passenger embarkation and disembarkation, cargo handling, securing, and opening and closing side doors, bow, and stern doors have completed passenger safety, cargo safety, and hull integrity vocational training programs.

c) Masters, first officers, chief engineers, second engineers, and other crew members responsible for passenger safety in emergency situations have completed crisis management and human behavior reaction vocational training programs, and emergency situation response procedures.

d) Crew members directly serving passengers in passenger areas have completed safety vocational training programs.

9. For high-speed craft as stipulated in the HSC Code, a Vocational Training Certificate will be issued to crew members who have completed the vocational training program for working on high-speed craft.

10. Specialized vocational training for seafarers working on vessels using low flashpoint fuels as stipulated in the IGF Code includes basic vocational training and advanced vocational training.

Article 52. Professional Vocational Training

1. Radar and Marine ARPA Operation Level Training shall be provided to deck officers who have completed the relevant course.

2. Radar and Marine ARPA Management Level Training shall be provided to captains and chief mates who have completed the relevant course.

3. GMDSS:

a) General Operator's Certificate for GMDSS (GOC) shall be issued to captains, chief mates, and deck officers working on ships equipped with GMDSS operating in Sea Area A2, A3, and A4 who have completed the GOC training course;

b) Restricted Operator's Certificate for GMDSS (ROC) shall be issued to captains, chief mates, and deck officers working on ships equipped with GMDSS operating in Sea Area A1 who have completed the ROC training course.

4. Electronic Chart Display and Information System (ECDIS): A certificate of professional vocational training on ECDIS shall be issued to captains, chief mates, and deck officers who have completed the ECDIS training course.

5. Crew and Bridge Resource Management: A certificate of professional vocational training on crew and bridge resource management shall be issued to captains, chief mates, and deck officers who have completed the crew and bridge resource management training course.

6. Engine Room Crew and Resource Management: A certificate of professional vocational training on engine room crew and resource management shall be issued to chief engineers, second engineers, and engine officers who have completed the engine room crew and resource management training course.

7. Specific Security Duties Seafarers: A certificate of professional vocational training on specific security duties seafarers shall be issued to seafarers who have completed the specific security duties seafarer training course.

8. Marine Security Officer: A certificate of professional vocational training on marine security officer shall be issued to captains, chief mates, and deck officers who have completed the marine security officer training course.

9. Advanced Firefighting: A certificate of professional vocational training on advanced firefighting shall be issued to deck officers, engine officers who have completed the advanced firefighting training program.

10. Basic First Aid: A certificate of professional vocational training on basic first aid shall be issued to deck officers, engine officers who have completed the basic first aid training program.

11. Medical Care: A certificate of professional vocational training on medical care shall be issued to captains, chief mates, and seafarers responsible for medical care on board who have completed the medical care training program.

12. Life Rafts and Rescue Boats: A certificate of professional vocational training on life rafts and rescue boats shall be issued to deck officers, engine officers, sailors, and machinists who have completed the life raft and rescue boat training program.

13. High-Speed Rescue Boats: A certificate of professional vocational training on high-speed rescue boats shall be issued to deck officers, engine officers, sailors, and machinists working on ships equipped with high-speed rescue boats who have completed the high-speed rescue boat training program. Seafarers wishing to participate in the high-speed rescue boat training program and obtain the certificate of professional vocational training on high-speed rescue boats must hold a certificate of professional vocational training on life rafts and rescue boats.

14. Maritime English: A maritime English certificate shall be issued to students and seafarers who have passed the maritime English examination at level 1, level 2, or level 3.

Article 53. Training and training institutions for seafarers

1. Training and training institutions for seafarers must ensure material conditions and lecturers in accordance with the regulations of the Government.

2. Training and training institutions for seafarers must establish electronic databases for managing students, managing examinations, scheduling courses for training and training; electronic databases for managing vocational certificates for reference in accordance with the STCW Convention. The electronic database for managing vocational certificates of training and training institutions for seafarers must be linked to the seafarer database of the Vietnam Maritime Administration.

Article 54. Programs for training and training seafarers

1. The maritime training and training program includes:

a) A program for specialized vocational training and training to issue the Certificate of Competency (CoC);

b) A program for vocational training and upgrading to issue the Certificate of Proficiency (CoP).

2. Based on the issued training and training programs, training and training institutions shall develop and approve detailed programs, textbooks, and teaching materials.

Chapter 6

ISSUING, REISSUING, RECOGNIZING, AND CONFIRMING THE SEAFARER'S VOCATIONAL CERTIFICATE AND TRAINING CERTIFICATE

Article 55. Procedures for issuing the Certificate of Recognition for the Certificate of Seafarer's Vocational Competency

1. The subject of issuance is seafarers who meet the conditions for issuing the Certificate of Recognition for the Certificate of Seafarer's Vocational Competency as stipulated in this Circular and the STCW Convention.

2. The seafarer management organization submits one set of application documents for recognizing the Certificate of Seafarer's Vocational Competency directly, through postal services, or via online public service systems to the Vietnam Maritime Administration, Branch Maritime Administration, or Port Maritime Office authorized by the Vietnam Maritime Administration. The application package includes:

a) A request letter from the seafarer management organization according to the model prescribed in Appendix II of this Circular;

b) A copy or an electronic copy of the vocational certificate issued by the competent authority of the country or territory that has been recognized by Vietnam regarding the issuance of vocational certificates;

c) An original or certified copy or an electronic copy issued from the original book or an electronically certified copy from the original: Health Certificate in accordance with the STCW Convention and the Maritime Labor Convention (MLC) 2006; Passport; Seaman’s Book or proof of sea service time issued by maritime authorities;

d) Two color photographs for cases where the application is submitted directly or through postal services, one file (file) photograph for cases where the application is submitted via an electronic environment, size 3cm x 4cm, white background, taken within the last six months.

3. The Vietnam Maritime Administration, Branch Maritime Administration, or Port Maritime Office authorized by the Vietnam Maritime Administration receives the application, checks the components and quantity of the application in accordance with the regulations, registers it in the logbook, and schedules the return of results within the prescribed timeframe, and conducts verification with the foreign competent authority that issued the vocational certificate.

a) In cases of direct submission, if the application is incomplete according to the regulations, the application will be returned immediately along with instructions for the organization or individual to complete the application according to the regulations;

b) In cases of receiving applications through postal services or via online public service systems, if the application is incomplete according to the regulations, the Vietnam Maritime Administration, Branch Maritime Administration, or Port Maritime Office authorized by the Vietnam Maritime Administration will notify in writing no later than two working days from the date of receipt of the application;

c) Within two working days from the date of receiving a complete and valid application, the Vietnam Maritime Administration, Branch Maritime Administration, or Port Maritime Office authorized by the Vietnam Maritime Administration will issue the Certificate of Recognition for the Certificate of Seafarer's Vocational Competency according to the model prescribed in Appendix I of this Circular; in cases where it is not issued, a written response must be provided with the reasons stated;

d) In cases where the administrative procedure result is delivered electronically, the electronic administrative procedure result of the competent authority has the same legal effect as the paper-based administrative procedure result.

4. The Certificate of Recognition for the Certificate of Seafarer's Vocational Competency is valid for use during the validity period of the Certificate of Seafarer's Vocational Competency or the term of the anticipated labor contract but not exceeding two years.

5. Fees for issuing the Certificate of Recognition for the Certificate of Seafarer's Vocational Competency shall be implemented in accordance with the regulations of the Ministry of Finance.

Article 56. Procedures for Issuing Certificates of Competency for Watch Ratings (Deck), Watch Ratings (Engine), and Electrical Technicians; Certificates of Competency for Vietnamese Seafarers Already Holding Certificates of Competency Issued by Foreign Competent Authorities

1. Recipients:

a) Seafarers who meet the conditions for issuing Certificates of Competency for Watch Ratings (Deck) OS, Watch Ratings (Deck) AB, Watch Ratings (Engine) Oiler, Watch Ratings (Engine) AB, and Electrical Technicians as stipulated in this Circular and the STCW Convention;

b) Vietnamese seafarers who meet the conditions specified in Article 40 of this Circular shall be issued Certificates of Competency equivalent to their current positions and limitations on Certificates of Competency issued by foreign competent authorities.

2. Seafarer management organizations or individuals may submit directly, send via postal service, or through the online public service system one set of application files for issuing Certificates of Competency for Watch Ratings (Deck), Watch Ratings (Engine), and Electrical Technicians, and Certificates of Competency for Vietnamese seafarers already holding Certificates of Competency issued by foreign competent authorities to the Vietnam Maritime Administration.

3. Application file components for Watch Ratings (Deck) OS, Watch Ratings (Engine) Oiler, and Electrical Technicians include:

a) An application form of the seafarer according to the model prescribed in Appendix III or a request document of the seafarer management organization according to the model prescribed in Appendix IV of this Circular;

b) Certified copies or copies made from original records or copies with the original for comparison or electronic copies certified from original records or electronic copies certified from the original: Graduation certificates or Graduation Certificates or Graduation Decisions or Certificates of Completion of Theoretical Training Parts of the Officer Training Program or Certificates of Completion of All Required Training Parts for Watch Ratings (Deck) OS or Certificates of Completion of All Required Training Parts for Watch Ratings (Engine) Oiler or Certificates of Completion of All Required Training Parts for Electrical Technicians; Certificates of Refresher Training and Advanced Training (if applicable); Basic Training Certificates. For graduation certificates issued by foreign educational institutions, an additional certified copy or copy with the original for comparison or electronic copy certified from the original Certificate of Recognition of Academic Credentials according to the regulations of the Ministry of Education and Training must also be submitted;

c) Originals or certified copies or electronic copies certified from the original Health Certificates according to the regulations of the Ministry of Health;

d) Two color photographs measuring 3cm x 4cm on a white background taken within the last six months for direct submission or submission via postal service, or one electronic file photograph for submission via an electronic environment;

đ) Certified copies or copies with the original for comparison or electronic copies certified from the original Seafarer’s Logbook (for cases of refresher training, advanced training, or only having intermediate-level vocational qualifications);

4. Application file components for Watch Ratings (Deck) AB and Watch Ratings (Engine) AB include the components prescribed in points a, b, c, and d of Clause 3 of this Article and certified copies or copies with the original for comparison or electronic copies certified from the original Seafarer’s Logbook and Passport (for seafarers working on ships flying flags of other countries);

5. Application file components for Watch Ratings (Deck) AB and Watch Ratings (Engine) AB when already holding Certificates of Competency for Watch Ratings (Deck) OS and Watch Ratings (Engine) Oiler include the components prescribed in points a, c, and d of Clause 3 of this Article and certified copies or copies with the original for comparison or electronic copies certified from the original Seafarer’s Logbook and Passport (for seafarers working on ships flying flags of other countries);

6. Application file components for issuing Certificates of Competency for Vietnamese seafarers already holding Certificates of Competency issued by foreign competent authorities include the components prescribed in points a, b, c, and d of Clause 3 of this Article and certified copies or copies with the original for comparison or electronic copies certified from the original Certificates of Competency issued by foreign competent authorities and Seafarer’s Logbook (for seafarers working on ships flying flags of other countries);

7. The Vietnam Maritime Administration receives applications, checks the components and quantity of the application files according to the regulations, registers them in the logbook, and sets a deadline for returning results as stipulated:

a) In cases of direct submission, if the application is incomplete according to the regulations, the application will be returned immediately along with instructions for the organization or individual to complete the application according to the regulations;

b) In cases where applications are received via the postal system or through the online public service system, if the application files are incomplete according to the regulations, the Vietnam Maritime Administration will notify in writing within two working days from the date of receipt of the application files;

c) Within two working days from the date of receiving complete and valid application files according to the regulations, the Vietnam Maritime Administration issues Certificates of Competency according to the model prescribed in Appendix I of this Circular. If issuance is not granted, a written response must be provided with clear reasons stated;

d) In cases where the results of administrative procedures are returned electronically, the electronic results of administrative procedures issued by the competent authority have the same legal effect as those issued on paper;

8. Fees for issuing Certificates of Competency are implemented according to the regulations of the Ministry of Finance.

Article 57. Procedures for Issuing the Certificate of Issuance of the Certificate

1. The issuance targets are seafarers who meet the conditions for issuing the Certificate of Issuance of the Certificate as stipulated in this Circular and the STCW Convention.

2. Seafarer management organizations or individuals submit one set of application files to request confirmation of the issuance of the Certificate directly, via postal service, or through the online public service system to the Vietnam Maritime Administration or the Branch Maritime Administration or the Port Maritime Office authorized by the Vietnam Maritime Administration. The file includes:

a) A seafarer's application form according to the model prescribed in Appendix V or a request document from the seafarer management organization according to the model at Appendix VI of this Circular;

b) Certified copy or copy with original for comparison or electronic copy issued from the original book or certified electronic copy from the original: GOC, ROC, GCNHLNVĐB certificates;

c) Two color photographs for cases submitting files directly or via postal service, one file (file) photograph for cases submitting files on an electronic environment, size 3cm x 4cm, white background, taken within the last six months.

3. The Vietnam Maritime Administration or the Branch Maritime Administration or the Port Maritime Office authorized by the Vietnam Maritime Administration receives the file, checks the components and quantity of the file according to regulations, registers it in the logbook, and schedules the result delivery within the specified time limit.

a) In cases of direct submission, if the application is incomplete according to the regulations, the application will be returned immediately along with instructions for the organization or individual to complete the application according to the regulations;

b) In cases of receiving applications through postal services or via online public service systems, if the application is incomplete according to the regulations, the Vietnam Maritime Administration, Branch Maritime Administration, or Port Maritime Office authorized by the Vietnam Maritime Administration will notify in writing no later than two working days from the date of receipt of the application;

c) Within two working days from the date of receiving complete and valid files as stipulated, the Vietnam Maritime Administration or the Branch Maritime Administration or the Port Maritime Office authorized by the Vietnam Maritime Administration issues the Certificate of Issuance according to the model prescribed in Appendix I of this Circular. In case of non-issuance, a written response must be provided with clear reasons stated.

d) In cases where the administrative procedure result is delivered electronically, the electronic administrative procedure result of the competent authority has the same legal effect as the paper-based administrative procedure result.

4. The Certificate of Issuance of the Certificate is valid for use according to the validity period of the GOC, ROC, GCNHLNVĐB certificates.

5. Fees and charges for issuing the Certificate of Issuance of the Certificate are implemented according to the regulations of the Ministry of Finance.

Article 58. Procedures for Issuing the Chief Trainer Certificate

1. The issuance targets are trainers and seafarers who meet the conditions stipulated in this Circular and the STCW Convention.

2. Seafarer management organizations or individuals submit one set of application files to request issuance of the Chief Trainer Certificate directly, via postal service, or through the online public service system to the Vietnam Maritime Administration or the Branch Maritime Administration or the Port Maritime Office authorized by the Vietnam Maritime Administration. The file includes:

a) An application form for issuance of the Chief Trainer Certificate from the trainer according to the model prescribed in Appendix VII of this Circular or a request document from the seafarer management organization according to the model prescribed in Appendix VIII of this Circular;

b) Certified copy or copy with original for comparison or electronic copy issued from the original book or certified electronic copy from the original: Confirmation of completion of training course or Graduation Decision of the training course for Chief Trainers;

c) Two color photographs for cases submitting files directly or via postal service, one file (file) photograph for cases submitting files on an electronic environment, size 3cm x 4cm, white background, taken within the last six months;

d) Certified copy or copy with original for comparison or electronic copy issued from the original book or certified electronic copy from the original certificate of simulation usage and simulation assessment (for cases of Chief Trainers in simulation rooms).

3. The Vietnam Maritime Administration or the Branch Maritime Administration or the Port Maritime Office authorized by the Vietnam Maritime Administration receives the file, checks the components and quantity of the file according to regulations, registers it in the logbook, and schedules the result delivery within the specified time limit.

a) In cases of direct submission, if the application is incomplete according to the regulations, the application will be returned immediately along with instructions for the organization or individual to complete the application according to the regulations;

b) In cases of receiving applications through postal services or via online public service systems, if the application is incomplete according to the regulations, the Vietnam Maritime Administration, Branch Maritime Administration, or Port Maritime Office authorized by the Vietnam Maritime Administration will notify in writing no later than two working days from the date of receipt of the application;

c) Within two working days from the date of receiving complete and valid files as stipulated, the Vietnam Maritime Administration or the Branch Maritime Administration or the Port Maritime Office authorized by the Vietnam Maritime Administration issues the Chief Trainer Certificate according to the model prescribed in Appendix I of this Circular. In case of non-issuance, a written response must be provided with clear reasons stated.

d) In cases where the results of administrative procedures are returned electronically, the electronic results of administrative procedures issued by the competent authority have the same legal effect as those issued on paper;

4. Fees and charges for issuing the Chief Trainer Certificate are implemented according to the regulations of the Ministry of Finance.

Article 59. Procedures for Reissuing the Certificate of Professional Competence, Certificate of Issuance of the Certificate, Certificate of Recognition of the Certificate of Professional Competence, and Certificate of Chief Trainer

1. The reissuance targets are seafarers holding the Certificate of Professional Competence (CPC), Certificate of Issuance of the Certificate, Certificate of Recognition of the CPC, and Certificate of Chief Trainer who meet the conditions for reissuance as stipulated in this Circular.

2. Seafarer management organizations or individuals shall submit one set of application dossier directly or through postal service or online public service system to the Vietnam Maritime Administration or Branch Maritime Administration or Port Maritime Office authorized by the Vietnam Maritime Administration. The dossier includes:

a) Application form prescribed in Appendix IX or request letter of seafarer management organization according to the model in Appendix X of this Circular;

b) Legal documents proving the adjustment for cases of information change;

c) Two color photographs for cases submitting files directly or via postal service, one file (file) photograph for cases submitting files on an electronic environment, size 3cm x 4cm, white background, taken within the last six months;

d) Original or certified copy or certified electronic copy from the original Health Certificate in accordance with the Ministry of Health's regulations (in case of reissuing the CPC);

đ) Certified copy or copy with original for comparison or certified electronic copy from the original: Seafarer’s Logbook or Decision on Recognition of Officer Examination Results, Master Examination Results, Engineer Examination Results (in case of reissuing the CPC that has expired or will soon expire); Passport for seafarers working on foreign-flagged vessels;

e) In case seafarers working on international routes cannot submit the dossier components under points d and đ of this clause: seafarer management organizations must submit a request letter according to the model in Appendix X along with a certified copy or digitally signed copy by the seafarer management organization: Seafarer’s Logbook; Health Certificate and bear responsibility for the information requested;

3. The Vietnam Maritime Administration or the Branch Maritime Administration or the Port Maritime Office authorized by the Vietnam Maritime Administration receives the file, checks the components and quantity of the file according to regulations, registers it in the logbook, and schedules the result delivery within the specified time limit.

a) In cases of direct submission, if the application is incomplete according to the regulations, the application will be returned immediately along with instructions for the organization or individual to complete the application according to the regulations;

b) In cases of receiving applications through postal services or via online public service systems, if the application is incomplete according to the regulations, the Vietnam Maritime Administration, Branch Maritime Administration, or Port Maritime Office authorized by the Vietnam Maritime Administration will notify in writing no later than two working days from the date of receipt of the application;

c) Within two working days from the date of receiving complete and valid dossiers, the Vietnam Maritime Administration or Branch Maritime Administration or Port Maritime Office authorized by the Vietnam Maritime Administration shall issue the Certificate according to the model prescribed in Appendix I of this Circular. If not issued, a written response with detailed reasons must be provided;

d) In cases where the administrative procedure result is delivered electronically, the electronic administrative procedure result of the competent authority has the same legal effect as the paper-based administrative procedure result.

4. The CPC, Certificate of Issuance of the Certificate, Certificate of Recognition of the CPC, and Certificate of Chief Trainer may be reissued in cases of loss, damage, or information changes, with validity based on the previously issued certificate;

5. Fees for reissuing the CPC, Certificate of Issuance of the Certificate, Certificate of Recognition of the CPC, and Certificate of Chief Trainer shall be implemented in accordance with the regulations of the Ministry of Finance.

Article 60. Procedures for Opening Training Courses and Issuing Certificates of Professional Competence for Officers, Masters, and Engineers

1. Organizations or individuals shall submit one set of application dossier for each trainee participating in the training course or officer examination directly or through postal service or online public service system to the training institution. The dossier includes:

a) Application form according to the model prescribed in Appendix XI of this Circular;

b) Certified copy or copy with original for comparison or certified electronic copy from the original or certified electronic copy from the original: Graduation Certificate or Certificate of Completion of Officer Maritime Education Program, Advanced Training Certificate (if applicable); for Graduation Certificates issued by foreign educational institutions, a certified copy or copy with original for comparison of the Recognition of Academic Credentials according to the regulations of the Ministry of Education and Training;

c) Certified copy or certified electronic copy of the Certificate of Professional Competence, English Language Certificate;

d) Original or certified copy or certified electronic copy from the original Health Certificate in accordance with the Ministry of Health's regulations;

đ) Declaration of sea service time (no confirmation required from seafarer management organizations) according to the model prescribed in Appendix XII of this Circular;

e) Certified copy or copy with original for comparison or certified electronic copy from the original Seafarer’s Logbook;

g) Two color photographs measuring 3cm x 4cm with white background taken within six months prior to submission of the dossier (two photos for direct submission or postal submission, one file photo for electronic submission);

2. The training institution shall accept and review the dossier; if the dossier does not comply with the regulations, the training institution shall immediately guide the organization or individual to complete the dossier according to the regulations;

3. Within two working days from the date of receiving complete dossiers, the training institution shall submit one set of dossier directly to the Vietnam Maritime Administration or through postal service or online public service system. The dossier includes:

a) Request letter of the training institution regarding the approval of the list of trainees participating in the refresher course and officer examination according to the model prescribed in Appendix XIII of this Circular;

b) One set of trainee dossier (attached);

4. The Vietnam Maritime Administration shall accept, review, approve the dossier, and issue a decision recognizing the list of qualified participants for the training course and examination within five working days from the date of receiving complete and valid dossiers. If not qualified, a written notification with detailed reasons must be provided;

5. Based on the report of the Officer Examination Board, within five working days, the Vietnam Maritime Administration shall issue a decision recognizing the results of the officer examination and issuing the CPC;

6. Fees for issuing the CPC for officers, masters, and engineers shall be implemented in accordance with the regulations of the Ministry of Finance.

Article 61. Responsibilities of subjects implementing administrative procedures; revocation of Professional Certificates, Recognition Certificates, Confirmation Certificates, and Certificates of Competency for seafarers

1. Organizations and individuals shall be responsible under the law for the legality and validity of the files submitted to implement administrative procedures.

2. The competent authority issuing, reissuing Professional Certificates, Recognition Certificates, Confirmation Certificates, and Certificates of Competency must perform their duties within their jurisdiction, according to procedures and deadlines; they shall not require additional documents not specified in this Circular as part of the file and shall not be responsible for the legality and validity of the files submitted by organizations and individuals to implement administrative procedures.

3. Professional Certificates, Recognition Certificates, Confirmation Certificates, and Certificates of Competency for seafarers will be revoked in cases of falsification of documents in the file, or if there is tampering, buying, renting, or lending of Professional Certificates, Recognition Certificates, Confirmation Certificates, and Certificates of Competency.

4. The competent authority issuing, reissuing Professional Certificates, Recognition Certificates, Confirmation Certificates, and Certificates of Competency has the authority to revoke them.

Chapter IV

 MINIMUM SAFE MANPOWER FOR SHIPS

Article 62. Framework for minimum safe manpower

1. General provisions for Vietnamese ships

a) Minimum safe manning for deck department based on gross tonnage (GT):

(*) In cases where the Deck Officer holds a relevant Professional Certificate to operate the GMDSS equipment on board, the position of Radio Officer GMDSS may not be required.

b) Minimum safe manpower framework for the engine department based on the total power of the main engines (kW):

2. For ships with complex and diverse electrical equipment, the shipowner may arrange for an Electrical Engineer Officer and an Electrical Technician.

3. Minimum safe manpower for certain special cases:

a) For tugboats and construction vessels operating regularly in a specific area with short working hours, based on a written proposal from the shipowner: The Ship Registration Authority decides the minimum safe manpower for the vessel in accordance with its actual usage and operation, ensuring that the minimum safe manpower does not fall below one Master, one Deck Officer, one Able Seaman on Watch (AB), one Chief Engineer, one Engineer Officer, and one Oiler on Watch (AB). For small tugboats and construction vessels with a lower minimum safe manpower framework than stipulated here, no reduction shall be made;

b) For non-self-propelled barges without accommodation for crew, the minimum safe manpower is 0 (zero) persons. During operation, they must always have tugboats or towboats providing support to ensure safety as prescribed;

c) For passenger ships and Ro-Ro passenger ships, in addition to the manpower framework prescribed in Clause 1 of this Article, additional positions must be arranged: One (1) crew member responsible for passengers for ships carrying up to 200 passengers, Two (2) crew members responsible for passengers for ships carrying up to 300 passengers, Three (3) crew members responsible for passengers for ships carrying up to 500 passengers, Four (4) crew members responsible for passengers for ships carrying more than 500 passengers. The number of crew members responsible for passengers shall be clearly stated in the notes section of the Certificate of Minimum Safe Manpower. For passenger ships and Ro-Ro passenger ships operating on fixed routes in Vietnamese waters with planned travel time between two ports under six hours, based on a proposal from the shipowner, the Ship Registration Authority may reduce the minimum safe manpower of the ship compared to the framework prescribed in Clause 1 of this Article: One (1) deck crew member for ships with a gross tonnage of 500 GT or more (excluding the positions of Master and Chief Mate); One (1) engine crew member for ships with a main engine power of 750 kW or more (excluding the position of Chief Engineer). For ships with a gross tonnage under 500 GT and a main engine power under 750 kW, no reduction shall be made."

4. For government service ships as defined in Article 1 of this Circular, pilot transfer ships, and other types of ships with special technical features, based on a written proposal from the shipowner, the Ship Registration Authority decides the minimum safe manpower for the ship in accordance with its actual usage and operation. The proposal from the shipowner shall specify the positions and number of crew members necessary to ensure the safety of the ship's operations and the rest periods of the crew.

5. The Certificate of Minimum Safe Manpower shall be issued simultaneously by the Ship Registration Authority at the place of registration when organizations and individuals complete the procedure for obtaining the Ship Registration Certificate, in accordance with the model prescribed in Appendix XIV of this Circular.

Article 63. Crew Allocation on Vietnamese Ships

1. The ship owner shall be responsible for allocating crew members to work on Vietnamese ships in accordance with the conditions stipulated in Article 59 of the Vietnam Maritime Code and the working age as prescribed by labor laws.

2. Crew allocation to assume positions on Vietnamese ships must meet the following requirements:

a) Must have appropriate professional certificates. Crew members may be allocated to assume positions lower than those specified in their GCNKNCM and restricted positions, but they cannot be allocated to assume positions higher than those specified in their GCNKNCM. Crew members with GCNKNCM for deck officers, engine officers and above are permitted to assume the position of ordinary seaman on watch OS, able seaman on watch AB, oiler on watch Oiler, and able seaman on watch AB.

b) Crew members assigned to work on oil tankers, chemical carriers, liquefied gas carriers, passenger ships, Ro-Ro passenger ships, ships operating in polar waters, and high-speed craft as prescribed by the HSC Law; and ships using low flashpoint fuel as prescribed by the IGF Code, in addition to GCNKNCM and other GCNHLNV required when working on general ships, must also hold GCNHLNVĐB corresponding to each position on such ships.

3. The master of a passenger ship must have at least 24 months of experience in the position of master on non-passenger ships of the same class or at least 24 months of experience in the position of chief mate on passenger ships.

Article 64. Exemptions

1. In cases where the master or engineer-in-charge on board a ship at sea can no longer perform their duties, the ship owner or ship operator may allocate the officer with the highest rank to replace the master or engineer-in-charge so that the voyage can continue to the nearest port. For other positions, the master or officer with the highest rank, appointed by the ship owner or ship operator, decides to assign other crew members to replace them.

2. In cases where a ship is in a foreign port and due to force majeure, the ship's complement does not meet the minimum safety manning certificate issued, based on the report and proposal of the ship owner, the Vietnam Maritime Administration may consider allowing the ship to sail to the nearest possible port to replace or supplement crew members. This provision does not apply to the single GMDSS radio officer position on board.

Chapter V

TRAINING ON BOARD SHIPS

Article 65. Responsibilities of Training Institutions for Crew Members

1. Training institutions for crew members must develop plans for trainees' practical training on ships according to the training program requirements.

2. If training institutions for crew members do not have training vessels, they must cooperate with other training institutions or ship owners to obtain vessels for training purposes.

3. Contact ship owners to accept trainees for practical training on ships as required by the training program.

Article 66. Responsibilities of Ship Owners Regarding Acceptance of Trainees for Practical Training on Ships

Accepting trainees, arranging accommodation and meals, creating favorable conditions for trainees, instructors, and trainers during practical training on ships. Confirming the time spent in positions by trainees on ships in the Crew Logbook, reporting electronically into the Vietnam Maritime Administration's crew management database, and being responsible for the confirmation made.

Article 67. Responsibilities of the Master, Chief Engineer, and Marine Officers for Trainees on Board Ships

1. The Master, Chief Engineer, and Marine Officers shall undertake the task of guiding trainees, lecturers, and instructors during their practical training on board ships.

2. The Master, Chief Engineer, and Marine Officers are responsible for guiding, training, instructing, confirming, and evaluating the contents and results of practical training of trainees on board ships according to the training schedule.

3. The Master is responsible for confirming the time of disembarkation of trainees from ships in the Seafarer's Logbook and is accountable for such confirmation.

Article 68. Responsibilities of Trainees on Board Ships

1. Trainees on board ships must have a Seafarer's Logbook and a vocational training certificate appropriate to the type of ship they are training on.

2. Trainees must comply with the regulations and rules of the ship owner, perform tasks as directed by the Master, Chief Engineer, Marine Officers, lecturers, and instructors.

3. The rights and responsibilities of trainees working on Vietnamese ships are implemented in accordance with Vietnamese laws and relevant international treaties to which the Socialist Republic of Vietnam is a member.

Chapter VI

IMPLEMENTING PROVISIONS

Article 69. Effective Date

1. This Circular takes effect from September 1, 2023.

2. Repeal Circular No. 03/2020/TT-BGTVT dated February 21, 2020, issued by the Minister of Transport regarding the professional standards, professional certificates, training, and instruction of seafarers and the minimum safety manning levels of Vietnamese ships.

3. Professional certificates, Certificates of Recognition, Certificates of Confirmation, Certificates of Certification of seafarers, and Certificates of Minimum Safety Manning Levels of ships issued before the effective date of this Circular remain valid until the expiration date stated on these certificates or until they are renewed.

4. Training institutions for seafarers shall establish electronic databases for managing trainees, managing examinations, scheduling training courses, and linking them to the Vietnam Maritime Administration's seafarer database by July 1, 2024.

5. Training institutions for seafarers shall develop procedures for issuing and reissuing vocational training certificates and establish procedures for managing and storing records.

Article 70. Implementation Organization

1. The Vietnam Maritime Administration is responsible for organizing the implementation of this Circular in coordination with related agencies and organizations.

2. The Director of the Ministry’s Office, the Inspector General, Heads of Departments, the Director of the Vietnam Maritime Administration, Heads of agencies, organizations, and individuals related to this Circular are responsible for its implementation./.
