AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 09/2015/TT-BYT DATED MAY 25, 2015 ISSUED BY THE MINISTER OF HEALTH ON THE CONFIRMATION OF ADVERTISING CONTENT FOR SPECIAL PRODUCTS, GOODS, AND SERVICES UNDER THE MANAGEMENT OF THE MINISTRY OF HEALTH
On the basis of Law on Advertising dated June 21, 2012;
On the basis of Law on Chemicals dated November 21, 2007;
Decree No. Decree No. 181/2013/NĐ-CP dated November 14, 2013 of the Government detailing the implementation of certain provisions of the Law on Advertising;
Decree No. Government Decree No. 95/2022/NĐ-CP dated November 15, 2022 stipulating functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Health Environment Management Department;
The Minister of Health issues this Circular amending and supplementing certain articles of Circular No. Circular No. 09/2015/TT-BYT dated May 25, 2015 issued by the Minister of Health on the confirmation of advertising content for special products, goods, and services under the management of the Ministry of Health.
Article 1. Amendments and supplements to certain articles of Circular No. 09/2015/TT-BYT dated May 25, 2015 issued by the Minister of Health on the confirmation of advertising content for special products, goods, and services under the management of the Ministry of Health
1. Repeal Point d Clause 1 Article 12.
2. Supplement Point c following Point b Clause 2 Article 12 as follows:
"c) Chemicals, insecticides, and bactericides for household and medical use of the entity requesting the confirmation of advertising content whose main office is located within the jurisdiction of the Provincial Health Department."
Article 2. Effective Date
This Circular takes effect from November 28, 2024.
Article 3. Transitional Provisions
1. Organizations and individuals who have been granted certificates confirming the content of advertisements for chemicals, insecticides, and bactericides for household and medical use before this Circular takes effect may continue to advertise according to the regulations.
2. Organizations and individuals who have submitted applications for certificates confirming the content of advertisements for chemicals, insecticides, and bactericides for household and medical use before this Circular takes effect shall implement according to the provisions of Circular No. 09/2015/TT-BYT.
3. The reissuance of certificates confirming the content of advertisements for chemicals, insecticides, and bactericides for household and medical use issued by the Health Environment Management Department - Ministry of Health before this Circular takes effect shall be carried out as follows:
a) In cases where certificates confirming the content of advertisements for chemicals, insecticides, and bactericides for household and medical use are reissued due to loss or damage as stipulated in Clause 1 Article 21 of Circular No. 09/2015/TT-BYT, the entity named on the certificate confirming the content of advertisements or the entity authorized according to regulations shall reissue at the Health Environment Management Department - Ministry of Health;
b) In cases where certificates confirming the content of advertisements for chemicals, insecticides, and bactericides for household and medical use are reissued as stipulated in Clauses 2, 3, and 4 Article 21 of Circular No. 09/2015/TT-BYT, the entity named on the certificate confirming the content of advertisements or the entity authorized according to regulations shall reissue at the Provincial Health Department where the main office of the entity named on the certificate confirming the content of advertisements is located;
c) The procedures for reissuing certificates confirming the content of advertisements for chemicals, insecticides, and bactericides for household and medical use shall be carried out according to the provisions of Article 21 of Circular No. 09/2015/TT-BYT.
Article 4. Responsibilities for Implementation
The Director of the Health Environment Management Department, the Head of the Legal Affairs Department, the Director of the Office of the Ministry, the Inspector General of the Ministry, Heads of Departments and Directors of Bureaus under the Ministry of Health; Directors of Provincial Health Departments and relevant agencies, organizations, and individuals are responsible for implementing this Circular.
During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals shall report to the Ministry of Health (Health Environment Management Department) for examination and resolution./.
