Regulations onawarding the Commendation Medal "National Security Protection"

Pursuant to the Law on Competition and Reward dated June 15, 2022; Pursuant to the Law on Forces Participating in Ensuring National Security and Public Order at the Grassroots Level dated November 28, 2023;

Decree No. 98/2023/NĐ-CP dated November 31, 2023 of the Government detailing certain provisions of the Law on Competition and Reward

On the basis of Political Work; December These Circulars stipulate the principles, subjects, criteria, files, procedures for proposing and presenting the Commendation Medal "National Security Protection" (hereinafter referred to as the Commendation Medal). Article 2. Principles for awarding the Commendation Medal;

"a) State agencies, organizations, and individuals owning power plants operating within the territory of the Socialist Republic of Vietnam connected to the national power grid, except strategic multi-purpose hydropower plants, small renewable energy power plants applying the avoided cost tariff, power plants and units providing ancillary services, independently invested energy storage systems, and power plants applying the electricity purchase price mechanism as stipulated in relevant authorized documents;" 1. The Commendation Medal shall be awarded only once to an individual.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

2. The Commendation Medal shall not be awarded to individuals who have been awarded the Medal "Distinguished Soldier," the Medal "For National Security," or Orders for their contributions in the People's Public Security Force.

3. The Commendation Medal shall not be awarded to individuals whose titles of People's Public Security members have been revoked; who are under criminal investigation; who are placed in compulsory educational facilities; or individuals collaborating with the People's Public Security Force but were dismissed due to betrayal or violations of unit management regulations.

4. Individuals currently under disciplinary review or having complaints, accusations, inspections, or investigations without final conclusions from competent authorities, or involved in corruption or negative issues reported by the media that require verification, shall not be considered for the Commendation Medal until such issues are resolved. If they meet the criteria after receiving a conclusion from the competent authority, they may be proposed for the Commendation Medal. For individuals disciplined, upon completion of their disciplinary period, the time for assessing achievements for the Commendation Medal will start from the end of the disciplinary period.

5. The examination, presentation, and use of the Commendation Medal for individuals collaborating with the People's Public Security Force must ensure absolute confidentiality according to operational requirements. Local public security units organize the presentation of the Commendation Medal but keep decisions, certificates, and Commendation Medals in the force files managed by the unit.

SUBJECTS, CRITERIA, FILES, PROCEDURES FOR PROPOSING THE AWARD OF THE COMMENDATION MEDAL

Article 3. Awarding the Commendation Medal in Foreign Affairs Work

1. Subjects and Criteria:

Chapter II

a) Individuals who are leaders of the Party and State; leaders and members of the Central Party Committees of ministries, agencies, mass organizations, with outstanding achievements in leading and directing work to ensure national security and public order and protect national security;

b) Foreign nationals or overseas Vietnamese who have made positive contributions to building, consolidating, and developing friendly relations and cooperation between Vietnam and other countries; between foreign organizations and international organizations and the Ministry of Public Security in the cause of protecting national security;

c) In cases where individuals have made outstanding achievements or significant contributions in the cause of protecting national security, as determined by the leadership of the Ministry of Public Security.

2. Files for Proposing the Award of the Commendation Medal include:

a) A proposal from the head of the local public security unit recommending the award (original);

b) A list of individuals recommended for the award of the Commendation Medal, confirmed by the head of the local public security unit (original);

c) A document with the approval of the leadership of the Ministry of Public Security regarding the award of the Commendation Medal (copy).

3. Procedures:

a) Cases under point a, Clause 1 of this Article shall prepare two sets of files for the award of the Commendation Medal (including electronic files) and send them to the Ministry of Public Security Office for consolidation, evaluation of achievements, and submission to the leadership of the Ministry of Public Security (through the Political Work Department) for examination and decision;

b) Cases under point b, Clause 1 of this Article shall prepare two sets of files for the award of the Commendation Medal (including electronic files) and send them to the Foreign Relations Bureau for consolidation and submission to the leadership of the Ministry of Public Security (through the Political Work Department) for examination and decision;

c) Cases under point c, Clause 1 of this Article shall prepare two sets of files for the award of the Commendation Medal (including electronic files) and send them to the Political Work Department for submission to the leadership of the Ministry of Public Security for examination and decision.

3. Procedure:

a) In cases under Point a Clause 1 of this Article, prepare a file requesting the award of a Commemorative Medal (two sets, accompanied by an electronic file) to be sent to the Ministry of Public Security's Office for consolidation, evaluation of achievements, and submission for review and decision by the Ministry of Public Security leadership (through the Political Work Department);

b) In cases under Point b Clause 1 of this Article, prepare a file requesting the award of a Commemorative Medal (two sets, accompanied by an electronic file) to be sent to the Foreign Affairs Department for consolidation and comments, and submission for review and decision by the Ministry of Public Security leadership (through the Political Work Department);

c) In cases under Points c Clause 1 of this Article, prepare a file requesting the award of a Commemorative Medal (two sets, accompanied by an electronic file) to be sent to the Political Work Department for submission for review and decision by the Ministry of Public Security leadership.

Article 4. Granting Commemorative Medals in the mass movement for national security protection

2. Files for Proposing the Award of the Commendation Medal include:

a) Individuals who are leaders at all levels of party committees, administrative bodies, mass organizations, political-social organizations (from commune level upwards); leaders of public educational institutions with legal personality; leaders of enterprises, economic groups, state-owned corporations holding positions from department level upwards for ten years or more (as of the date of application) with achievements in the mass movement for national security protection and having been awarded at least once for their contributions to national security protection; agencies, units, localities under their responsibility have not seen complex social evils or serious incidents related to security and order;

b) Individuals who are members of Security and Order Protection Teams within forces participating in security and order protection at grassroots level, having worked for fifteen years or more for males, ten years or more for females (as of the date of application), including time served in the People's Security Ward and former part-time village police before, and multiplied by two when calculating service time in particularly difficult socio-economic areas, border regions, and islands according to the provisions of the Law on Competition and Awards;

2. The dossier for granting Commemorative Medals includes:

a) A report from the head of the police unit or locality (original);

b) A list of individuals proposed for granting Commemorative Medals, confirmed by the head of the police unit or locality and the working agency or unit (original);

c) Certificates of merit or Awards for achievements in national security protection for individuals falling under point a, Clause 1, Article 4 (copies).

3. Procedure:

a) Police units and localities establish dossiers for granting Commemorative Medals (two sets, accompanied by electronic files) to be submitted to the Department of Mass Movement for National Security Protection before May 30 each year;

b) The Department of Mass Movement for National Security Protection compiles and evaluates the achievements of individuals proposed for granting Commemorative Medals by police units and localities, and submits them to the Minister of Public Security (through the Political Work Department) for examination and decision.

Article 5. Granting Commemorative Medals to individuals collaborating with the People's Public Security Forces

2. Files for Proposing the Award of the Commendation Medal include:

a) Individuals collaborating with the People's Public Security Forces in protecting national security and combating crime, having collaborated for fifteen years or more for males, ten years or more for females; if recognized by the managing and using unit as not violating work principles and regulations and completing assigned tasks satisfactorily, they will be considered for granting Commemorative Medals;

b) Individuals who have not reached the required collaboration period but have achieved outstanding results or have been injured and are no longer capable of continuing to collaborate will also be considered for granting Commemorative Medals.

2. Dossier, procedures, and reporting lines:

a) Based on the achievements of individuals and in accordance with the specified criteria, the head of the police unit or locality prepares a report requesting approval for awards from the leader of the Ministry of Public Security responsible for the relevant field regarding achievements and the list of individuals proposed for granting Commemorative Medals;

b) After receiving approval from the leadership of the Ministry of Public Security to grant Commemorative Medals, the head of the police unit or locality establishes a dossier consisting of two sets: a report (original) sent to the Minister of Public Security (through the Political Work Department) only stating the number of individuals agreed upon by the leadership of the Ministry; a document with the agreement of the leadership of the Ministry of Public Security (copy), without sending the list and achievement reports of the individuals proposed for granting Commemorative Medals;

c) The Political Work Department reports to the leadership of the Ministry of Public Security for signing the decision to grant Commemorative Medals (the Decision only states the number of individuals receiving Commemorative Medals) and hands over the physical medals to the police unit or locality for presentation and archiving of the dossier.

3. Individuals collaborating with the People's Public Security Forces who fail to comply with confidentiality requirements as stipulated will have their decisions revoked and the medals withdrawn.

Article 6. Granting Commemorative Medals to officers, soldiers, and contractual workers in the People's Public Security Force

1. Recipients, criteria: Officers, non-commissioned officers, and soldiers of the People's Public Security Force, as well as public security workers who have worked for at least five years but do not meet the criteria for receiving the Bronze Medal "Distinguished Soldier" upon retirement or transfer to another profession shall be considered for the granting of Commemorative Medals; contractual workers in the People's Public Security Force who have worked for at least ten years and have been evaluated by their units as having satisfactorily completed assigned tasks upon retirement shall also be considered for the granting of Commemorative Medals.

2. The dossier for granting Commemorative Medals includes:

a) The report of the head of the public security unit or locality (original copy);

b) A list of individuals proposed for the granting of Commemorative Medals with confirmation from the head of the unit (original copy).

3. The public security unit or locality shall establish a dossier proposing the granting of Commemorative Medals (two sets, including electronic files) to be submitted to the Minister of Public Security (through the Political Work Department) for examination and decision.

Article 7. Presentation of Commemorative Medals

1. The presentation of Commemorative Medals takes place on the occasion of the anniversary of the People's Public Security Day, the National People's Security Day (August 19 each year), or during conferences, commemorative ceremonies, or when requested by the leadership of the Ministry of Public Security.

2. Public security units and localities shall organize the presentation of Commemorative Medals to individuals proposed by the units or localities.

3. Individuals receiving Commemorative Medals shall be presented with certificates, frames, Commemorative Medals, boxes for Commemorative Medals, and accompanying cash awards not exceeding 0.6 times the base salary (as stipulated in point d, Clause 1, Article 58 of Decree No. 98/2023/NĐ-CP dated December 31, 2023 of the Government detailing certain provisions of the Law on Encouragement and Reward).

4. In cases where decisions, certificates, or Commemorative Medals are damaged or lost, the public security unit or locality shall submit a written request to the Political Work Department to report to the leadership of the Ministry of Public Security for replacement or reissue.

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Effective Date

1. This Circular takes effect from April 28, 2025.

2. Circular No. 11/2021/TT-BCA dated January 26, 2021 of the Ministry of Public Security regarding the granting of the Commemorative Medal "National Security Protection" ceases to be effective from the date this Circular takes effect.

3. If the referenced documents in this Circular are amended, supplemented, or replaced by other documents, the content of the references shall be implemented according to the new documents.

Article 9. Responsibility for implementation

1. The heads of public security units and localities are responsible for implementing this Circular and ensuring the accuracy of the dossiers proposing the granting of Commemorative Medals submitted by their units, guaranteeing that eligible recipients are proposed for the granting of Commemorative Medals in accordance with this Circular.

2. The Political Work Department is responsible for inspecting and urging the implementation of this Circular.

3. The Planning and Finance Department is responsible for ensuring funding for printing certificates, manufacturing Commemorative Medals, boxes, frames, and accompanying cash awards. During the implementation process, if there are difficulties or obstacles, relevant public security units, organizations, or individuals shall report to the Ministry of Public Security (through the Political Work Department) for timely guidance.
