Pursuant to the Atomic Energy Law 2008;

Pursuant to Decree No. 55/2025/NĐ-CP dated March 2, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 70/2010/NĐ-CP dated June 22, 2010 of the Government detailing and guiding implementation of certain Articles of the Atomic Energy Law regarding nuclear power plants;

On the proposal of the Director of the Radiation and Nuclear Safety Agency;

The Minister of Science and Technology issues this Circular amending and supplementing certain provisions of Circular No. 13/2009/TT-BKHCN dated May 20, 2009 of the Minister of Science and Technology guiding preliminary nuclear safety assessment for the location of nuclear power plants during the stage of deciding on investment policy.

Article 1. Amending and supplementing certain provisions of Circular No. 13/2009/TT-BKHCN dated May 20, 2009 of the Minister of Science and Technology guiding preliminary nuclear safety assessment for the location of nuclear power plants during the stage of deciding on investment policy as follows:

1. Supplement Clause 3 of Section I as follows:

"3. The investor shall prepare an investment construction report for the nuclear power plant including contents about the construction site, restricted residential areas, controlled residential areas, land use requirements, and other contents as prescribed in Clauses 1 and 2 of Article 17 of Decree No. 70/2010/NĐ-CP dated June 22, 2010 of the Government detailing and guiding implementation of certain provisions of the Atomic Energy Law regarding nuclear power plants."

2. Amend and supplement Point a of Clause 6 of Section II as follows:

"a) Restricted residential areas and controlled residential areas must comply with the following conditions to minimize the impact of ionizing radiation on the community:

- The restricted residential area is the zone surrounding the nuclear power plant and ensuring the following requirements simultaneously:

+ The effective whole-body dose of a person standing at the boundary outside the restricted residential area does not exceed 0.1 mSv/year under normal operating conditions according to design;

+ The effective whole-body dose of a person standing at the boundary outside the restricted residential area does not exceed 0.25 Sv (25 rem) and the equivalent dose to the thyroid from I-131 does not exceed 3 Sv (300 rem) within two hours after a hypothetical accident occurs.

- The controlled residential area is the zone surrounding the restricted residential area where a person at the boundary outside this zone receives a total effective whole-body dose not exceeding 0.25 Sv (25 rem) or an equivalent dose to the thyroid from I-131 not exceeding 3 Sv (300 rem) during the time when a hypothetical radioactive cloud passes through."

3. Supplement Point h of Clause 6 of Section III as follows:

"h) The calculation program in the safety analysis concerning the impact of radiation on the community shall be carried out in accordance with Article 9 of Circular No. 12/2015/TT-BKHCN dated July 20, 2015 of the Minister of Science and Technology on safety analysis for nuclear power plants."

Article 2. Implementation clause

1. This Circular takes effect from the date of signature.

2. The Head of the Office, the Director of the Radiation and Nuclear Safety Agency, the Heads of agencies and units under the Ministry of Science and Technology, and organizations and individuals related to this matter are responsible for implementing this Circular.

3. During the implementation process, if there are difficulties or obstacles, organizations and individuals are requested to promptly reflect these issues to the Ministry of Science and Technology for guidance or consideration and resolution./.
