Detailed Implementation of Certain Provisions of the Law on Encouragement and Reward and Decree No. 152/2025/NĐ-CP dated June 14, 2025 of the Government for the Ministry of Home Affairs

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

Pursuant to Decree No. 25/2025/NĐ-CP dated February 21, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 152/2025/NĐ-CP dated June 14, 2025 of the Government stipulating the delegation of authority and power in the field of encouragement and reward; detailing and guiding the implementation of certain provisions of the Law on Encouragement and Reward;

At the proposal of the Director of the Office of the Ministry of Home Affairs;

The Minister of Home Affairs issues this Circular detailing the implementation of certain provisions of the Law on Encouragement and Reward and Decree No. 152/2025/NĐ-CP dated June 14, 2025 of the Government for the Ministry of Home Affairs.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular details the implementation of Clause 4 Article 24; Clause 3 Article 26; Clause 3 Article 27; Clause 3 Article 28; Clause 6 Article 74; Clause 2 Article 75; Clause 4 Article 76; Clause 6 Article 84 of the Law on Encouragement and Reward 2022; stipulates the contents delegated under Clause 2 Article 6 of Decree No. 152/2025/NĐ-CP dated June 14, 2025 of the Government stipulating the delegation of authority and power in the field of encouragement and reward; detailing and guiding the implementation of certain provisions of the Law on Encouragement and Reward (hereinafter referred to as this Circular).

Article 2. Applicability

This Circular applies to civil servants, public officials, employees, and workers of agencies and units under the Ministry of Home Affairs; individuals and groups performing tasks related to the fields of work of the Ministry and sector of Home Affairs; individuals, groups, and households with achievements and contributions to the construction and development of the Ministry and sector of Home Affairs.

Chapter II

OBJECTS, CRITERIA, FILES, PROCEDURES FOR CONSIDERING THE AWARD OF

ENCOURAGEMENT AWARDS AND REWARD FORMS WITHIN THE AUTHORITY OF THE MINISTRY AND ITS AGENCIES AND UNITS;

RECOGNITION OF THE LEVEL OF COMPLETION OF TASKS BY INDIVIDUALS AND GROUPS

MATTER OF RECOGNIZING THE LEVEL OF COMPLETION OF TASKS

OF INDIVIDUALS AND GROUPS

Article 3. Criteria for awarding the title "Advanced Worker"

1. The title "Advanced Worker" is awarded annually to individuals of agencies and units under the Ministry of Home Affairs who meet the criteria stipulated in Clause 1 Article 24 of the Law on Encouragement and Reward 2022.

2. The evaluation for the title "Advanced Worker" for specific cases shall be carried out in accordance with the provisions of Clause 5 Article 2 of Circular No. 15/2025/TT-BNV dated August 4, 2025 of the Minister of Home Affairs stipulating measures to organize and guide the implementation of the Law on Encouragement and Reward and Decree No. 152/2025/NĐ-CP dated June 14, 2025 of the Government stipulating the delegation of authority and power in the field of encouragement and reward; detailing and guiding the implementation of certain provisions of the Law on Encouragement and Reward (Circular No. 15/2025/TT-BNV).

3. The title "Advanced Worker" shall not be evaluated for any of the following cases:

a) Individuals whose total non-participation in work as prescribed by law during the year of consideration for reward is three months or more, except in cases of maternity leave as stipulated in Clause 5 Article 4 of Decree No. 152/2025/NĐ-CP dated June 14, 2025 of the Government stipulating the delegation of authority and power in the field of encouragement and reward; detailing and guiding the implementation of certain provisions of the Law on Encouragement and Reward (Decree No. 152/2025/NĐ-CP);

b) Individuals newly recruited for less than six months as stipulated in Point d Clause 5 Article 2 of Circular No. 15/2025/TT-BNV and individuals signing their first labor contract for less than six months.

Article 4. Standards and Recipients for the Award of the "Flag of Excellence" from the Ministry of Home Affairs

1. The "Flag of Excellence" from the Ministry of Home Affairs shall be awarded annually to collectives leading the competition movement organized by the Cluster or Group under the Ministry of Home Affairs and meeting the standards prescribed in Clause 1 of Article 26 of the Law on Encouragement and Rewards 2022.

2. The "Flag of Excellence" from the Ministry of Home Affairs shall be awarded to collectives leading the competition movement launched by the Ministry of Home Affairs with a duration of implementation of three years or more when summarizing the competition movement.

3. The recipients for the award of the "Flag of Excellence" from the Ministry of Home Affairs include:

a) Departments, the Office of the Ministry, agencies assisting the Party Committee of the Ministry, the National Archives and Document Management Department, the Salary and Social Insurance Department, the Employment Department, the Overseas Labor Management Department, the War Invalids and Martyrs Department, the Central Reward and Commendation Board;

b) University of Labor and Social Welfare, Information Technology Center, Institute of State Organization Science and Labor, State Organization and Labor Magazine, Dân Trí Newspaper, Overseas Labor Center, Overseas Employment Support Fund;

c) Provincial Departments of Home Affairs under central cities.

Article 5. Standards and Recipients for the Award of the "Outstanding Labor Collective"

1. The "Outstanding Labor Collective" shall be awarded annually to collectives meeting the standards prescribed in Clause 1 of Article 27 of the Law on Encouragement and Rewards 2022.

2. The recipients for the award of the "Outstanding Labor Collective" are collectives of agencies and units under the Ministry of Home Affairs, including:

a) Departments, the Office of the Ministry, agencies assisting the Party Committee of the Ministry, the National Archives and Document Management Department, the Salary and Social Insurance Department, the Employment Department, the Overseas Labor Management Department, the War Invalids and Martyrs Department, the Central Reward and Commendation Board;

b) University of Labor and Social Welfare, Information Technology Center, Institute of State Organization Science and Labor, State Organization and Labor Magazine, Dân Trí Newspaper, Overseas Labor Center, Overseas Employment Support Fund;

c) Units constituting the agencies and units specified in points a and b of Clause 2 of this Article.

Article 6. Standards and Recipients for the Award of the "Advanced Labor Collective"

1. The "Advanced Labor Collective" shall be awarded annually to collectives meeting the standards prescribed in Clause 1 of Article 28 of the Law on Encouragement and Rewards 2022.

2. The recipients for the award of the "Advanced Labor Collective" are collectives of agencies and units under the Ministry of Home Affairs, including:

a) Departments, the Office of the Ministry, agencies assisting the Party Committee of the Ministry, the National Archives and Document Management Department, the Salary and Social Insurance Department, the Employment Department, the Overseas Labor Management Department, the War Invalids and Martyrs Department, the Central Reward and Commendation Board;

b) University of Labor and Social Welfare, Information Technology Center, Institute of State Organization Science and Labor, State Organization and Labor Magazine, Dân Trí Newspaper, Overseas Labor Center, Overseas Employment Support Fund;

c) Units constituting the agencies and units specified in points a and b of Clause 2 of this Article;

d) Units constituting the agencies and units specified in point c of Clause 2 of this Article.

Article 7. Standards for the Award of the Certificate of Merit from the Ministry of Home Affairs

1. The Certificate of Merit from the Ministry of Home Affairs shall be awarded or posthumously awarded to individuals who have exemplary compliance with the Party's policies, state laws, and achieve one of the following criteria:

a) Outstanding achievements recognized in competition movements initiated or implemented by the Minister of Home Affairs;

b) Achievements with significant impact in one of the fields or sectors under the management of the Ministry of Home Affairs;

c) Contributions to economic and social development, application of scientific and technological progress, social work, humanitarian aid, and public services managed by the Ministry of Home Affairs according to the law;

d) Individuals within the Ministry of Home Affairs who have been consecutively awarded the title of "Model Worker at the Base Level" twice or have been recognized as having outstandingly completed their tasks for two consecutive years or more, during which time at least two initiatives were recognized and effectively applied at the base level, or two scientific research projects, scientific programs, and science and technology works were successfully applied at the base level;

đ) Individuals who have worked for ten years or more (for men) or eight years or more (for women) in agencies or units under the Ministry of Home Affairs, with many achievements or outstanding achievements contributing to the development of the agency or unit; five consecutive years before the nomination period were rated as satisfactorily completing their tasks, during which time they were rated as outstandingly completing their tasks at least once. Individuals nominated for the award on the occasion of the anniversary of the establishment or traditional day of the agency or unit (round year);

e) Individuals who have worked in the Ministry and Provincial Departments of Home Affairs under central cities and are nominated for the award before retirement as follows:

For individuals working in agencies or units under the Ministry of Home Affairs: Five consecutive years before retirement were rated as satisfactorily completing their tasks or better;

For individuals working in Provincial Departments of Home Affairs: Holding the position of Director or Deputy Director of the Provincial Department of Home Affairs for five years or more, during which time they were continuously rated as satisfactorily completing their tasks or better.

2. The Certificate of Merit from the Ministry of Home Affairs shall be awarded or posthumously awarded to business leaders, intellectuals, scientists who have exemplary compliance with the Party's policies, state laws, and achieve one of the criteria prescribed in point a, point b, or point c of Clause 1 of this Article, or have achievements and contributions to the construction and development of the Ministry and the Home Affairs sector.

3. The Certificate of Merit from the Ministry of Home Affairs shall be awarded to collectives that have exemplary compliance with the Party's policies, state laws, internal unity, and meet one of the following criteria:

a) Outstanding achievements recognized in competition movements initiated or implemented by the Minister of Home Affairs;

b) Outstanding sudden achievements with significant impact in one of the fields or sectors under the management of the Ministry of Home Affairs;

c) Contributions to economic and social development, application of scientific and technological progress, social work, humanitarian aid, and public services managed by the Ministry of Home Affairs according to the law;

d) Agencies and units under the Ministry of Home Affairs that have been consecutively recognized as outstandingly completing their tasks for two years or have been awarded the title of "Outstanding Labor Collective" for two consecutive years, implementing democracy at the grassroots level, organizing competition movements well; caring for the material and spiritual life of the collective; practicing thrift, combating waste; preventing corruption and negative practices;

đ) Agencies and units under the Ministry of Home Affairs established for ten years or more, of which five consecutive years before the nomination period were rated as satisfactorily completing their tasks or better and are nominated on the occasion of the anniversary of the establishment or traditional day of the agency or unit (round year);

4. The Ministry of Home Affairs' Certificate of Merit shall be awarded to individuals and collectives under ministries, councils, sectors, provinces; individuals and collectives under associations, social funds, charitable funds, non-governmental organizations; individuals and collectives under enterprises, economic organizations who model themselves after good implementation of the Party's guidelines, State policies and laws, with achievements and contributions in the process of coordinating to fulfill the tasks of the Ministry of Home Affairs or meet the criteria specified in points a, b, c of Clause 1 of this Article or points a, b, c of Clause 3 of this Article or have achievements and contributions to the construction and development of the Ministry of Home Affairs sector.

5. The Ministry of Home Affairs' Certificate of Merit shall be awarded to exemplary households who well implement the Party's guidelines, State policies and laws, making significant contributions to society in fields within the scope of management of the Ministry of Home Affairs.

6. The Ministry of Home Affairs' Certificate of Merit shall be awarded to Vietnamese individuals and collectives residing abroad; foreign individuals and collectives who have made achievements and contributions to the construction and development of the Ministry of Home Affairs sector.

Article 8. Criteria for awarding Certificates of Merit

Heads of agencies and units with legal personality under the Ministry of Home Affairs shall present Certificates of Merit to individuals, collectives, and households according to the following criteria:

1. Individuals who model themselves after good implementation of the Party's guidelines, State policies and laws and meet one of the following criteria:

a) Achieving outstanding results recognized through competition movements initiated or implemented by the agency or unit head;

b) Achieving many results or outstanding results with wide influence in their field of management;

c) Excellently completing tasks; having good moral qualities; maintaining internal unity; consistently studying to improve professional and vocational skills;

d) Making contributions to the development of the agency or unit, and being considered for presentation on the occasion of the anniversary of establishment or traditional day of the agency or unit (full year);

2. Collectives who model themselves after good implementation of the Party's guidelines, State policies and laws, maintain internal unity, and meet one of the following criteria:

a) Achieving outstanding results recognized through competition movements initiated or implemented by the agency or unit head;

b) Achieving many results or outstanding results with wide influence in their field of management;

c) Excellently completing tasks; without complaints or accusations; effectively implementing grassroots democracy; caring for the material and spiritual life of members; practicing thrift and combating waste; fully implementing systems and policies for members;

d) Demonstrating outstanding achievements in the process of building and developing the agency or unit, and being considered for presentation on the occasion of the anniversary of establishment or traditional day of the agency or unit (full year);

3. Households who model themselves after good implementation of the Party's guidelines, State policies and laws, making significant contributions to localities and society in fields within the scope of management of the agency or unit.

4. Vietnamese individuals and collectives residing abroad; foreign individuals and collectives who have made achievements and contributions to the construction and development of the agency or unit.

5. Individuals, collectives, and students at the University of Labor and Social Welfare who achieve outstanding results during their studies, training, and moral cultivation.

Article 9. General provisions on files and procedures for commendation within the authority of the Minister

1. The application file for commendation must be submitted within the prescribed time limit, with the correct components and contents. Individuals, groups, and households are responsible for the accuracy of their reports on achievements for which they seek commendation. Heads of agencies and units are responsible for the accuracy of the application file for commendation for individuals, groups, and households before submitting it to the competent authority for commendation.

2. Application files for commendation from agencies and units must have the unified opinion of the Ministry’s leadership in charge before being sent to the Standing Committee of the Ministry of Home Affairs’ Competition and Commendation Council.

3. The preparation of the application file for commendation for the Ministry’s leadership shall be chaired by the Ministry’s Office, in coordination with relevant units.

4. The preparation of the application file for presenting the "Competition Flag of the Ministry of Home Affairs" and the "Commendation Certificate of the Ministry of Home Affairs" to individuals and groups under central cities and provinces shall be chaired by the Provincial Department of Home Affairs or advised by them.

5. In cases where individuals have retired, and the unit has been dissolved or merged, the receiving unit shall be responsible for considering and proposing commendation; for retired individuals (or those who have died or passed away), the application file for commendation shall be submitted by the Cadre and Civil Servant Organization Department to the competent authority for consideration and decision.

6. Commendation for Vietnamese individuals and groups residing abroad, and foreign individuals and groups, shall be carried out in accordance with the provisions of the Law on Competition and Commendation 2022 and related documents concerning commendation involving foreign elements.

7. Soliciting opinions from relevant agencies before submitting to the Minister for consideration and commendation shall be advised by the Ministry’s Office through the Standing Committee of the Ministry of Home Affairs’ Competition and Commendation Council.

If the relevant functional agencies have not provided their opinions or have not reached a consensus on commendation or have given different opinions beyond the deadline for providing written opinions from the Ministry of Home Affairs, the Ministry’s Office shall compile and report to the Minister for consideration and decision.

Within ten working days from the date of receipt of full opinions from relevant agencies, the Ministry’s Office shall compile and submit to the Minister for consideration and commendation in accordance with regulations.

8. Collectives of agencies and units or Competition and Commendation Councils at all levels must conduct voting when examining the title of "Outstanding Competitor of the Ministry of Home Affairs," "Outstanding Competitor at the Grassroots Level," and "Competition Flag of the Ministry of Home Affairs."

For individuals and collectives proposed for the award of the title of "Outstanding Competitor at the Grassroots Level" and the "Competition Flag of the Ministry of Home Affairs," there must be an agreement rate of eighty percent or more from the collective of the agency or unit or the Competition and Commendation Council at the level concerned, calculated based on the total number of members of the collective or council. For individuals proposed for the award of the title of "Outstanding Competitor of the Ministry of Home Affairs," there must be an agreement rate of ninety percent or more from the collective of the agency or unit or the Competition and Commendation Council at the level concerned, calculated based on the total number of members of the collective or council.

The results and agreement rates of the collective of the agency or unit or the Competition and Commendation Council at the level concerned must be reflected in the minutes of the competition assessment and commendation examination.

9. Time for submission of application files for commendation

a) For commendation for outstanding performance: Based on the annual summary plan of the work of the Ministry or the direct instructions of the Minister, the Standing Committee of the Ministry of Home Affairs’ Competition and Commendation Council shall advise on issuing guidance documents on the time for submission of application files for commendation for outstanding performance annually;

b) For commendation for mid-term and final reviews of competition movements or specialized competitions launched by the Prime Minister or the Minister of Home Affairs: Follow the specific guidelines for each competition movement;

c) For commendation for outstanding achievements or outstanding achievements of a sudden nature: The head of the agency or unit shall prepare the application file for commendation and send it to the Standing Committee of the Ministry of Home Affairs’ Competition and Commendation Council immediately after the individual or group achieves outstanding or suddenly outstanding achievements;

d) For application files for commendation intended for presentation at conferences, anniversary ceremonies, traditional day celebrations, or organizational congresses: The application file for commendation shall be sent to the Standing Committee of the Ministry of Home Affairs’ Competition and Commendation Council at least twenty-five working days prior to the scheduled date of the conference, anniversary ceremony, traditional day celebration, or organizational congress of the agency or unit;

đ) For commendation for individuals before retirement: Within ten days from the date the individual receives the decision to retire and enjoy social insurance benefits, the employing unit shall prepare the application file for commendation and send it to the Standing Committee of the Ministry of Home Affairs’ Competition and Commendation Council for compilation and submission to the Minister for consideration and presentation of the Commendation Certificate.

Article 10. Documents, Procedures for Proposing to Award Certificates of Merit and Commendations within the Authority of the Minister of Public Security and Heads of Units with Legal Entity Status under the Ministry of Public Security, 1. Units under the Ministry of Public Security shall prepare documents for submission to the competent authority for consideration and decision on awarding commendations such as "Public Security Ministry Model Worker," "Unit Model Worker," "Advanced Worker," "Public Security Ministry Flag of Competition," "Outstanding Labor Collective," "Advanced Labor Collective," and Certificates of Merit.

2. The units' departments responsible for competition and reward work under the Ministry of Public Security shall compile and review the documents, report to the Competition and Reward Council at the unit level; submit to the Head of the unit for awarding commendations such as "Unit Model Worker," "Advanced Worker," "Advanced Labor Collective," and Certificates of Merit according to the provisions of Clause 1, Article 80 of the Competition and Reward Law 2022, and submit to the Minister for consideration and awarding commendations within the Minister's authority as stipulated in Clause 2, Article 79 of the Competition and Reward Law 2022.

3. The Ministry Office shall review the documents, report to the Competition and Reward Council of the Ministry of Public Security for submission to the Minister for consideration and awarding commendations such as "Unit Model Worker," "Advanced Worker," and "Advanced Labor Collective" to individuals and collectives under the Ministry Office and units without legal entity status under the Ministry of Public Security.

4. Based on the results of the evaluation for commendations such as "Public Security Ministry Model Worker," "Public Security Ministry Flag of Competition," and "Outstanding Labor Collective" by the Competition and Reward Council at the unit level, the Ministry Office shall compile and report to the Competition and Reward Council of the Ministry of Public Security for submission to the Minister for consideration and decision.

5. The documents and procedures for proposing to award the "Public Security Ministry Flag of Competition" to leading collectives in the competition movement initiated by the Minister of Public Security for a period of three years or more when summarizing the movement shall be carried out according to specific guidelines for each competition movement.

Article 11. Documents and Procedures for Proposing to Award Certificates of Merit from the Ministry of Public Security

Timely rewards for outstanding achievements and thematic rewards must meet the leadership requirements of the Ministry regarding time and be based on the principle that achievements are recognized accordingly, specifically:

1. Documents and procedures for rewarding outstanding achievements and thematic competitions

a) Units shall base their proposals for rewards on the results and achievements of individuals and collectives or guidance documents for summarizing the competition movements and thematic competitions issued by the Standing Committee of the Competition and Reward Council of the Ministry of Public Security, seek approval from the responsible leadership of the Ministry, prepare documents for submission to the Standing Committee of the Competition and Reward Council of the Ministry of Public Security;

b) The Ministry Office shall compile and review the documents; report and seek opinions from the Standing Committee or the Competition and Reward Council of the Ministry of Public Security, submit to the Minister for consideration and decision.

a) The Heads of units shall propose and submit to the Minister for consideration and rewarding individuals and collectives with outstanding and excellent achievements and significant contributions to the development of their units;

2. Documents and procedures for rewarding on the occasion of celebrating the founding day or traditional day (anniversary year) of agencies and units

The units' departments responsible for competition and reward work have the responsibility to advise the Heads of units to coordinate with the Standing Committee of the Competition and Reward Council of the Ministry of Public Security to report and seek approval from the responsible leadership of the Ministry regarding rewards for individuals and collectives, including types of rewards, recipients, quantity, and sources of reward funds; prepare documents for submission to the Standing Committee of the Competition and Reward Council of the Ministry of Public Security.

3. Documents and procedures for rewarding individuals and collectives with achievements and contributions in the process of coordinating to implement tasks of the Ministry of Public Security

a) The Heads of units shall propose and submit to the Minister for consideration and rewarding individuals and collectives with outstanding and excellent achievements and significant contributions to the development of their units;

a) Based on the results of coordination in implementing the tasks of the Ministry of Public Security, the Ministry Office shall send documents requesting units under the Ministry of Public Security to propose rewards for individuals and collectives from ministries, sectors, provinces, or Heads of units under the Ministry of Public Security to proactively propose rewards for individuals and collectives with direct achievements in implementing their own unit's tasks; report to the responsible leadership of the Ministry before preparing documents for submission to the Standing Committee of the Competition and Reward Council of the Ministry of Public Security;

b) Based on the proposals from units, the Ministry Office shall compile and submit to the Minister for consideration and opinion on the proposal and list of proposed rewards (provisional). Based on the Minister's instructions, the Ministry Office shall cooperate with relevant agencies to implement the procedures and processes for proposing rewards as prescribed.

4. Documents and procedures for rewarding individuals and collectives belonging to associations, social funds, charitable funds, and non-governmental organizations

a) Based on the documents proposing rewards from associations, social funds, charitable funds, and non-governmental organizations, the Department of Non-Governmental Organizations shall compile and review the documents, seek approval from the responsible leadership of the Ministry, and prepare documents for submission to the Standing Committee of the Competition and Reward Council of the Ministry of Public Security;

The proposal for rewards from the Department of Non-Governmental Organizations must include the following information: the Department's opinion on the achievements in organization and activities of associations, social funds, charitable funds, and non-governmental organizations; the content of the achievements proposed for rewards; the source of funding for rewards for rewarded individuals and collectives; documents seeking opinions from units under the Ministry of Public Security (if any);

b) The Ministry Office shall solicit opinions from related agencies and seek opinions from the Standing Committee or the Competition and Reward Council of the Ministry of Public Security, compile and submit to the Minister for consideration and decision.

5. Documents and procedures for rewarding individuals and collectives belonging to enterprises and economic organizations with achievements in employment and labor safety

a) Based on the documents proposing rewards from units, the Employment Bureau shall compile and review the documents, seek approval from the responsible leadership of the Ministry, and prepare documents for submission to the Standing Committee of the Competition and Reward Council of the Ministry of Public Security;

a) On the basis of the commendation proposal files from agencies and units, the Employment Bureau will consolidate and review the files, submit for approval by the Ministry's leadership responsible for such matters, and prepare the commendation proposal file to send to the Standing Committee of the Ministry of Home Affairs' Competition and Commendation Council;

The report proposing commendation from the Employment Bureau must ensure the following information: The Bureau's opinion on achievements in the field of employment and labor safety within the scope of state management by the Ministry of Home Affairs; the content of the proposed commendation achievements; the source of funds for commendation expenses for individuals and groups being commended; documents seeking opinions from units under the Ministry of Home Affairs (if applicable).

5. Documents and procedures for rewarding individuals and collectives belonging to enterprises and economic organizations with achievements in employment and labor safety

6. Documents and procedures for proposing commendation for individuals before retirement

a) The unit employing civil servants, public officials, employees, and workers shall base on the work process, time holding positions of the individual, compare with conditions and standards, seek the opinion of the People's Committee of the province (for Heads of Provincial Departments of Home Affairs); establish the commendation proposal file according to regulations and send it to the Standing Committee of the Ministry of Home Affairs' Competition and Commendation Council to implement the commendation procedure.

b) The Office of the Ministry will consolidate, review the files, seek the opinion of the Standing Committee of the Competition and Commendation Council, and submit to the Minister for consideration and decision.

7. Documents and procedures for annual commendation

a) Based on the results of quality assessment and task completion level of individuals and groups; based on the results of reviewing and recognizing the effectiveness of applying initiatives; the effectiveness of applying scientific topics, scientific projects, scientific and technological works, heads of agencies and units shall convene meetings to evaluate and propose commendation titles and forms for individuals and groups under their management authority; report to the responsible leaders of the Ministry and prepare the commendation proposal file to be sent to the Standing Committee of the Ministry of Home Affairs' Competition and Commendation Council.

b) Based on the criteria and conditions for commendation, the Office of the Ministry will build a comprehensive report, review commendations; propose organizing a meeting of the Competition and Commendation Council of the Ministry of Home Affairs' Agency and the Ministry of Home Affairs' Competition and Commendation Council to evaluate commendations.

c) On the basis of the evaluation results of the Council, the Office of the Ministry will consolidate and report to the Minister for consideration and decision.

8. Documents and procedures for commendation for other cases

a) Heads of agencies and units under the Ministry with functions of advising the Minister on sectors and fields under the Ministry of Home Affairs' management are responsible for consolidating and reviewing commendation proposal files related to achievements in the professional field of the agency or unit, submit for approval by the responsible leaders of the Ministry, and prepare the commendation proposal file to be sent to the Standing Committee of the Ministry of Home Affairs' Competition and Commendation Council.

The report proposing commendation must ensure the following information: The unit's opinion on achievements within the scope of its advisory functions; the content of the proposed commendation achievements; the source of funds for commendation expenses for individuals and groups being commended; documents seeking opinions from units under the Ministry of Home Affairs (if applicable).

5. Documents and procedures for rewarding individuals and collectives belonging to enterprises and economic organizations with achievements in employment and labor safety

Article 12. Quantity and components of documents; time to notify the results of review, commendation results for competition titles and commendation forms within the authority of the Minister and heads of agencies and units with legal personality under the Ministry of Home Affairs

1. Quantity of documents

The quantity of documents for proposing to award competition titles and commendation forms within the authority of the Minister and heads of agencies and units with legal personality under the Ministry of Home Affairs includes one set (original) and electronic documents of the commendation file, except for documents containing state secrets.

2. Components of documents

a) A proposal for considering the award of commendation titles and forms of reward;

b) Report on achievements of the awardee;

c) Minutes of competition evaluation or commendation examination:

Minutes of collective competition evaluation of the agency or unit or the Competition and Commendation Council at various levels in the case of proposing the competition titles "Outstanding Labor Collective", "Advanced Labor Collective", "Advanced Worker".

Minutes of competition evaluation and voting results of the collective agency or unit or the Competition and Commendation Council at various levels in the case of proposing the competition titles "Model Soldier at the Base", "Model Soldier of the Ministry of Home Affairs", "Competition Flag of the Ministry of Home Affairs".

Minutes of evaluation of the Competition Group or Cluster organized by the Ministry of Home Affairs in the case of proposing to award the "Competition Flag of the Ministry of Home Affairs".

Minutes of commendation examination of the collective agency or unit or the Competition and Commendation Council at various levels in the case of proposing to award Certificates of Merit or Letters of Commendation.

d) Decision or document confirming by the Minister regarding the initiative that has been effectively applied and has potential for replication within the Ministry of Home Affairs or scientific topics, scientific projects, scientific and technological works that have been accepted and effectively applied, having influence within the Ministry of Home Affairs in the case of proposing to award the title "Model Soldier of the Ministry of Home Affairs".

Decision or document confirming by the competent agency or unit regarding the initiative or scientific topic, scientific project, scientific and technological work in the case of proposing the title "Model Soldier at the Base", Certificates of Merit of the Ministry of Home Affairs with standards related to initiatives, scientific topics, scientific projects, scientific and technological works.

Detailed contents of the commendation proposal file shall be implemented according to the model prescribed in Appendix I issued together with this Circular.

b) In cases where the conditions and criteria for rewards are met, the Cadre and Civil Servant Organization Department will submit to the competent authority for consideration and decision on rewards according to regulations; within 10 working days from the date the Reward Decision is issued, the Cadre and Civil Servant Organization Department will notify in writing to the agency or unit proposing the reward and advise on organizing the presentation according to regulations.

a) For competition titles and commendation forms within the authority of the Minister of Home Affairs

In cases meeting the conditions and standards for commendation as prescribed, the Office of the Ministry shall implement the procedure for proposing the Minister to consider and decide on commendation or submit to the competent authority for commendation and notify the proposing unit within 25 working days from the date of receiving complete documents as prescribed.

In cases not meeting the conditions and standards, within 10 working days from the date of receiving complete commendation proposal documents, the Office of the Ministry shall notify the proposing unit.

b) For competition titles and commendation forms within the authority of heads of agencies and units with legal personality under the Ministry of Home Affairs

For cases meeting the conditions and criteria for commendation as prescribed, the department advising on competition and commendation work shall implement the procedure to propose the head of the agency or unit to consider and decide on commendation or submit it to the competent authority for commendation and notify the proposing unit within fifteen working days from the date of receiving complete files in accordance with regulations.

For cases not meeting the conditions and criteria, within seven working days from the date of receiving complete commendation proposal files, the department advising on competition and commendation work shall notify the proposing unit.

Article 13. Regulations on recognizing the level of completion of tasks by individuals and collectives under the management authority of the Ministry of Interior., collective under the management authority of the Ministry of Interior

The recognition of the level of completion of tasks by individuals and collectives of agencies and units under the Ministry of Interior shall be carried out in accordance with the regulations of the Party, state laws, and the regulations of the Ministry of Interior.

Chapter III

PROCEDURES FOR ISSUING REPLACEMENTS AND REISSUING COMMENDATION ITEMS;

PROCEDURES FOR REVOKING DECISIONS ON AWARDS OF COMPETITION TITLES,

FORMS OF COMMENDATION UNDER THE AUTHORITY OF THE MINISTRY

AND AGENCIES AND UNITS UNDER THE MINISTRY OF INTERIOR

Article 14. Documents and procedures for issuing replacements and reissuing commendation items under the authority of the Ministry of Interior

1. Individuals, collectives, and households wishing to issue replacements or reissue commendation items shall prepare documents to send to the Standing Board of Competition and Commendation of the Ministry of Interior. The file consists of one set (original copy), including:

a) A letter proposing replacement or reissue from the collective or an individual's application for replacement or reissue when the commendation item is damaged, unusable, or lost due to objective reasons such as natural disasters, floods, fires, or printing errors (in accordance with Model 2.1 and 2.2 in Appendix II issued together with this Circular);

b) The damaged commendation item proposed for replacement (for cases proposing replacement).

2. The Office of the Ministry shall compare with the stored files, confirm, compile, and report to the Standing Board of Competition and Commendation of the Ministry of Interior for consideration and decision on issuing replacements or reissuing commendation items for individuals, collectives, and households within fifteen days from the date of receipt of the application for replacement or reissue.

Replacements and reissues of commendation items shall be implemented for the "Ministry of Interior Meritorious Soldier" badge, "Ministry of Interior Competition Flag," commemorative medals in fields under the management authority of the Ministry of Interior, and certificates of commendation forms and competition titles.

Replacements and reissues shall be purchased and printed by the Office of the Ministry according to the prescribed models as follows:

The model of commemorative medals, the "Ministry of Interior Competition Flag," and the "Ministry of Interior Meritorious Soldier" badge shall be implemented in accordance with the Government's regulations.

The model of the certificate for replacement or reissue shall be signed by leaders who have completed their terms of office according to the design at the time the individual, collective, or household was commended, wherein: The achievement content is written according to the commendation decision, the right side below the certificate bears the pre-printed seal and signature of the authority granting the commendation at that time (the pre-printed seal and signature are reproduced from the seal and signature in the previously awarded certificate; the commendation decision; the document introducing the signature of the Ministry of Interior; the document stipulating the seal model of the Ministry of Public Security); the left side below the certificate states "Commendation Decision number, day, month, year, golden book number" and "certified reissued certificate number: .../GCN-BNV." When individuals, collectives, or households receive a replacement or reissue certificate, they will also receive a certificate of replacement or reissue (Model 2.4 in Appendix II issued together with this Circular).

The model of the certificate for replacement or reissue signed by incumbent leaders shall be implemented according to the current certificate model.

3. The Office of the Ministry shall be responsible for liquidating or disposing of and destroying the collected commendation items in accordance with the replacement regulations.

Article 15. Documents, Procedures for revoking decisions to confer commendation titles and reward forms within the authority of the Minister and Heads of agencies and units with legal personality under the Ministry of Home Affairs

1. Individuals, groups, households that commit acts falling under the cases stipulated in Clause 2, Article 93 of the Law on Competition and Rewards 2022 shall have their commendation title awarding decision and reward form revoked and be required to return any physical rewards and money received.

2. Based on the conclusion of the competent authority determining that individuals, groups, or households have committed violations falling under the cases stipulated in Clause 2, Article 93 of the Law on Competition and Rewards 2022,, the rewarding unit shall be responsible for proposing the competent authority to issue a decision to revoke the decision to confer commendation titles and reward forms and to recover any physical rewards and money received.

3. The application for revoking the decision to confer commendation titles and reward forms consists of one set (original copy) including:

a) A proposal from the agency or unit requesting recovery of the commendation title and reward form for individuals, groups, or households;

b) A summary report from the unit directly proposing rewards regarding the reasons for requesting the competent authority to revoke the decision to confer commendation titles and reward forms (attached with the Reward Decision).

4. The Office of the Ministry shall be responsible for compiling the documents and submitting them to the Minister for consideration and decision to revoke reward decisions for commendation titles and reward forms within the authority of the Minister of Home Affairs.

The advisory department implementing competition and reward work of agencies and units with legal personality under the Ministry shall be responsible for compiling the documents and submitting them to the Head of the agency or unit for consideration and decision to revoke reward decisions for commendation titles and reward forms within the authority of the Head of the agency or unit.

5. The deadline for compiling and submitting to the competent authority for consideration and revocation of reward decisions for commendation titles and reward forms is 10 working days from the date of receiving all documents as prescribed.

Article 16. Recovery of Physical Rewards and Money Awards for Commendation Titles and Reward Forms within the Authority of the Minister and Heads of Agencies and Units under the Ministry of Home Affairs

1. Within 15 working days from the date of receipt of the decision to revoke the reward decision of the Minister and the Head of the agency or unit under the Ministry of Home Affairs, individuals, groups, or households shall be responsible for returning all physical rewards and money awards received to the unit that proposed the rewards and paid the money awards to individuals, groups, or households.

2. The Office of the Ministry and the advisory department implementing competition and reward work of agencies and units under the Ministry of Home Affairs shall be responsible for urging individuals, groups, or households to return physical rewards within the specified time and organizing the recovery of money awards according to regulations; recovered money awards shall be deposited into the state budget or the competition and reward fund as prescribed.

Chapter IV

ORGANIZATION AND ACTIVITIES OF THE COMPETITION AND REWARD COUNCIL

MINISTRY OF HOME AFFAIRS AND THE COMPETITION AND REWARD COUNCIL AT THE LOCAL LEVEL

Article 17. Organization of the Competition and Reward Councils at Various Levels under the Ministry of Home Affairs

1. The Competition and Reward Councils at various levels under the Ministry of Home Affairs include:

a) The Competition and Reward Council of the Ministry of Home Affairs;

b) The Competition and Reward Council at the local level, including the Competition and Reward Council of the Ministry's Agency and the Competition and Reward Councils of agencies and units with legal personality under the Ministry of Home Affairs.

2. The Competition and Reward Council of the Ministry of Home Affairs

a) The Competition and Reward Council of the Ministry of Home Affairs is established by the Minister of Home Affairs, responsible for advising and consulting the Minister on competition and reward work of the Ministry and the Home Affairs sector;

b) The members of the Competition and Reward Council of the Ministry of Home Affairs include: Chairman, Vice Chairmen, and Council Members;

The Chairman of the Council is the Minister of Home Affairs; the Vice Chairmen include: the Deputy Minister in charge of the Office of the Ministry as the Permanent Vice Chairman of the Council; the Director of the Personnel Department, the Director of the Organization and Cadre Department, and the Head of the Central Competition and Reward Board as Vice Chairmen of the Council; the Council Members are decided by the Minister after examination;

c) The Standing Body of the Competition and Reward Council of the Ministry of Home Affairs includes the Chairman, Vice Chairmen, and Secretary of the Council;

d) The Office of the Ministry is the Standing Body of the Council. The Director of the Competition and Reward and Communication Department, Office of the Ministry, is a Member兼任秘书。

3. The Competition and Reward Council of the Ministry's Agency

a) The Competition and Reward Council of the Ministry's Agency is established by the Minister's decision, responsible for advising and consulting the Minister on competition and reward work for the Office of the Ministry and agencies and units without legal personality under the Ministry of Home Affairs;

b) The members of the Competition and Reward Council of the Ministry's Agency include: Chairman, Vice Chairmen, and Council Members

The Chairman of the Council is the Leader in charge of the Office of the Ministry; the Vice Chairmen include: the Director of the Office of the Ministry as the Permanent Vice Chairman of the Council, the Director of the Organization and Cadre Department as the Vice Chairman of the Council; the Council Members are decided by the Minister after examination;

c) The Standing Body of the Competition and Reward Council of the Ministry's Agency includes the Chairman, Vice Chairmen, and Secretary of the Council;

d) The Office of the Ministry is the Standing Body of the Council. The Director of the Competition and Reward and Communication Department, Office of the Ministry, is a Member兼任秘书。

4. The Competition and Reward Councils of agencies and units with legal personality under the Ministry of Home Affairs

a) The Competition and Reward Councils of agencies and units with legal personality under the Ministry of Home Affairs are established by the Heads of the agencies and units, responsible for advising and consulting on competition and reward work within their management scope;

b) The members of the Competition and Reward Councils of agencies and units with legal personality under the Ministry of Home Affairs include: Chairman, Vice Chairmen, and Council Members;

The Chairman of the Council is the Head of the agency or unit; the Vice Chairmen include: the deputy head in charge of competition and reward work as the Permanent Vice Chairman of the Council; the head of the advisory department implementing competition and reward work of the agency or unit as the Vice Chairman of the Council, and the Council Members are decided by the Head of the agency or unit after examination;

c) The Standing Body of the Competition and Reward Council includes the Chairman, Vice Chairmen, and Secretary of the Council;

d) The advisory unit responsible for implementing the work of competition and reward is the Standing Office of the Council. The Council Secretary is a civil servant or officer directly advising on the implementation of competition and reward activities of the agency or unit.

Article 18. Activities of the Competition and Reward Council of the Ministry of Home Affairs and the Competition and Reward Council at the grassroots level

1. The Council and the Standing Office operate under a collective system with individual responsibility; meetings are organized according to the requirements of the competition and reward work.

2. The Council and the Standing Office convene when at least two-thirds of the total number of members attend.

3. At each Council meeting, if a Council member is absent, they must appoint someone to attend the meeting in their place to ensure continuity and decision-making authority regarding matters related to the field they are responsible for; the opinion of the person attending in place of the member is considered the opinion of the Council member. The person attending in place is responsible for the opinions they participate in discussing during the meeting as well as decisions made by the Council; they can vote on competition and reward assessments and participate in resolutions on discussion contents of the Council; immediately report to the Council member about the content and results of the meeting.

4. The assessment and awarding process is conducted through voting or ballot. Balloting is implemented for cases where awards are given for commendation titles, national-level award forms, "Competition Flag of the Ministry of Home Affairs," "Outstanding Soldier of the Ministry of Home Affairs," "Grassroots Outstanding Soldier," and other cases as decided by the Chairman of the Council.

In cases where individuals or groups meet the percentage of votes but exceed the award ratio, the results are taken from highest to lowest; in the final case, if there are equal votes, the result is determined by the voting or balloting of the Council Chairman.

5. Depending on the content of the meeting, the Council Chairman may decide to invite additional heads of agencies or units related to the meeting. Invited representatives can express their opinions but do not have the right to vote or ballot.

6. Council members operate on a concurrent basis.

7. In cases where a Council meeting is not organized, the Standing Office of the Council is responsible for sending documents and materials, soliciting the opinions of each Council member or the Standing Office; compiling and reporting to the Council Chairman for consideration and decision.

8. The Council may use the seal of the agency or unit.

9. The Competition and Reward Council of the Ministry of Home Affairs is subject to the guidance, supervision, and inspection of the Competition and Reward Council of the Central Government regarding competition and reward work. Grassroots Competition and Reward Councils cooperate with each other during the implementation of tasks related to competition and reward work and are also subject to the guidance, supervision, and inspection of the Competition and Reward Council of the Ministry of Home Affairs regarding competition and reward work.

Chapter V

IMPLEMENTATION

Article 19. Effective Date

1. This Circular takes effect from December 1, 2025.

2. Circular No. 15/2023/TT-BNV dated October 15, 2023, issued by the Minister of Home Affairs detailing the implementation of certain provisions of the Law on Competition and Reward for the Home Affairs sector, and Circular No. 16/2023/TT-BLDTBXH dated December 29, 2023, issued by the Minister of Labor, Invalids, and Social Affairs detailing and guiding the implementation of certain provisions of the Law on Competition and Reward in the labor, war invalids, and social sectors shall cease to be effective from the date this Circular takes effect.

3. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.

Article 20. Transitional Provisions

Files submitted to the Ministry of Home Affairs (as evidenced by the receipt stamp) before the date this Circular takes effect shall continue to be processed according to the provisions of Circular No. 15/2023/TT-BNV dated October 15, 2023, issued by the Minister of Home Affairs detailing the implementation of certain provisions of the Law on Competition and Reward for the Home Affairs sector.

Article 21. Organization of Implementation

1. The Office of the Ministry of Home Affairs, heads of agencies and units under the Ministry of Home Affairs; ministries, sectors, central agencies; People's Committees and Provincial Departments of Home Affairs of centrally governed cities; relevant agencies, organizations, units, and individuals are responsible for organizing the implementation of this Circular.

2. During the implementation process, if there are difficulties, relevant agencies, organizations, units, and individuals are requested to promptly reflect them to the Ministry of Home Affairs for consolidation, review, amendment, and supplementation as appropriate./.
