JOINT CIRCULAR No. 20-LB/TT REGULATES THE SYSTEM OF SUBSIDIES IN KIND FOR WORKERS ENGAGED IN CONDITIONS WITH HAZARDOUS FACTORS, APPLICABLE TO BOTH THE PRODUCTION AND BUSINESS SECTOR AND THE ADMINISTRATIVE AND PUBLIC SERVICE SECTOR. THE LEVEL OF SUBSIDY IS DETERMINED BASED ON THE TIME SPENT WORKING AND THE SPECIFIC TYPE OF WORK.

1992 REGULATING THE SYSTEM OF SUBSIDIES IN KIND FOR WORKERS OPERATING IN HARMFUL CONDITIONS
Workers operating in harmful conditions shall be entitled to subsidies in kind.
Pursuant to Article 17 of the Labour Protection Ordinance issued by the State Council on September 10, 1991, which stipulates that "workers operating in conditions with hazardous factors shall be entitled to subsidies in kind."
To implement Circular No. 02-TTg dated January 9, 1963 of the Prime Minister regarding the system of subsidies in kind suitable for the current reform situation;
After soliciting opinions from the General Confederation of Labour of Vietnam and relevant ministries and sectors, the Joint Ministry of Labour - Social Affairs and Health issues this circular to regulate the system of subsidies in kind for workers operating in harmful conditions.
I - PRINCIPLES OF SUBSIDIES IN KIND
1. In order to protect health and prevent occupational diseases, employers must first improve working conditions, enhance safety and hygiene equipment.
After implementing measures to improve working conditions but still unable to eliminate harmful factors, workers must be provided with subsidies in kind.
2. This system shall only apply to those directly exposed and working in harmful environments.
Once harmful factors at the workplace have been eliminated, the provision of subsidies in kind at that location shall cease.
3. The system of subsidies in kind must be organized so that workers can eat and drink on-site during their rest breaks and cannot be paid in cash.
In special cases such as scattered, mobile work or small groups, subsidies in kind may be provided to workers, who are required to use them appropriately.
4. The Ministry of Labour - Social Affairs will issue a list of occupations and jobs eligible for subsidies in kind, uniformly applicable to all grassroots units nationwide.
II - CONDITIONS FOR SUBSIDIES IN KIND
Workers must work in places with one of the following harmful factors to be entitled to subsidies in kind.
1. Exposure to chemical substances, toxic gases, dust, etc., exceeding permissible hygiene standards set by the Ministry of Health.
2. Exposure to physical factors such as temperature, noise, radiation, electromagnetic fields, pressure, optical radiation, etc., exceeding permissible hygiene standards set by the Ministry of Health.
3. Exposure to harmful biological factors such as viruses, bacteria, parasites causing infectious diseases.
III - OBJECTIVES OF SUBSIDIES IN KIND
A - ITEMS AND EXPENSES
1. Milk is a common food item used for detoxification; enterprises may substitute other items (such as eggs, tea, fruits, etc.) appropriate to each occupation with equivalent value and detoxifying effect.
The Ministry of Health will provide guidance on using appropriate items for detoxification in specific industries.
2. For work over four hours, full rations are provided; for work between two and four hours, half rations are provided.
3. Costs for purchasing items for subsidies: in production and business establishments, they are included in cost of production or circulation expenses but not in unit wage rates; in administrative and public service units, they are recorded in regular expenses without being part of the wage fund (according to Circular No. 1258-TC/HCVX dated July 14, 1992 of the Ministry of Finance).
4. The cost of purchasing items for subsidies is calculated based on the local milk price. Enterprises with the capacity should provide more than the prescribed amount.

IV - SCOPE AND APPLICANTS
All workers in the production and business sector (including defense) as well as administrative and public service units, if required to work under conditions harmful to health as specified in Part II of this Circular, shall be entitled to the system of subsidies in kind for workers.
Students and trainees working in harmful environments shall also be entitled to the system of subsidies in kind.
1. Enterprises need to review and convert from old subsidy levels to new ones according to this Circular. Old Levels 1 and 2 (Circular No. 12-TT/LB dated August 29, 1981 of the Joint Ministry) correspond to New Level 1. Old Level 3 corresponds to New Level 2, Old Level 4 corresponds to New Level 3. New Level 4 is the highest level for radiation subsidies.
V - IMPLEMENTATION
If there are new occupations requiring special subsidies, they must be agreed upon by the Ministry of Labour - Social Affairs and the Ministry of Health.
2. Previous regulations conflicting with this Circular are abolished. This Circular takes effect from November 1, 1992.
+ The Joint Ministry requests all ministries, provincial people's committees, and centrally-administered city people's committees to disseminate and urge subordinate units within their jurisdiction to fully comply with the provisions of this Circular.
Departments of Labour - Social Affairs and Health, and Health Departments are responsible for inspecting and urging all units subject to this Circular to operate within the territorial scope of their respective regions.
