CIRCULAR

OF THE MINISTRY OF LABOUR DECREE NO. 20/LD-TT ON SEPTEMBER 17, 1982 REGARDING THE APPLICATION OF PROFESSIONAL STANDARDS FOR STATE CIVIL SERVANTS

Implementing Decision No. 117-HDBT of the Council of Ministers dated July 15, 1982 on the issuance of List No. 1 of state civil servant positions, up to now, professional standards for some civil servant positions have been completed and issued, and are continuing to be developed for other positions.

The application of professional standards for civil servants must be closely linked with the education of revolutionary spirit and scientific nature for each civil servant, aiming to enhance responsibility, organizational discipline awareness, and scientific working methods. Therefore, when professional standards for civil servants are issued, heads of agencies need to organize training sessions for each position so that each person can voluntarily accept and implement them. It is necessary to thoroughly implement the following measures:

1. For civil servants who do not meet the professional standards, various solutions may be applied:

- Due to voluntary willingness and circumstances permitting, they may be transferred to a suitable position according to their capabilities.

- They may be allowed to retire according to the regulations and policies stipulated.

- They may be sent for further study if they are young and have prospects.

- If the civil servant themselves have a determination to strive and are trusted by the collective, they may retain their current position but must have a plan for training to meet the professional standards within a period of 1 to 2 years depending on the level of requirements.

2. For civil servants who meet the professional standards, several points should be noted:

- Require them to establish work regulations reflecting their position within the organization, relationships with other civil servants and organizations, and determine the process of activities to complete assigned tasks.

- Make them clearly understand specific goals to strive for higher standards, thereby fostering a learning and training movement and a positive spirit.

3. For civil servants who exceed the standards for a higher position than the one they are currently responsible for:

- In this case, they will be immediately reassigned if the head has carefully considered and obtained the agreement of the trade union and the party committee.

- There is no limit to the number of civil servants reassigned due to exceeding these standards, but the head must certainly take full responsibility for their decision.

4. Resolving surplus civil servants:

Due to organizational restructuring, applying scientific working methods, establishing positions and professional standards, the organizational structure will become leaner, stronger, and more effective. Therefore, there will be a surplus of civil servants. The solution is as follows:

- Surplus civil servants will be resolved according to the State's policies recorded in existing decisions.

- The resolution of surplus civil servants must be carefully considered, with comprehensive political, economic, and ideological measures to ensure that it does not cause unrest in the agency or unit.

5. For civil servants who have accepted responsibility for the assigned standards:

The head must truly lead by example and implement their own professional standards. One of the top standards for the head is to manage the organization based on its structure, specifically:

- is a communicable disease or parasite listed by the MinistryDetermining the long-term position of the civil servant's role, allowing them to accumulate experience and become a capable assistant. Reorganization and transfer of staff should only be done as a last resort.

- Assigning tasks according to professional standards requires high quality and effectiveness, each person must strive to excel, therefore, the head must first cooperate with the trade union to provide better living conditions and working tools. Encouragement and motivation must be provided to each individual.

While the Ministry of Labour is studying new salary and allowance systems, all levels and sectors must fully implement the current economic incentive policies.

6. Recruitment:

Recruitment of new civil servants must be based on positions and professional standards. From now on, any agency recruiting without adhering to positions and professional standards will bear full responsibility before the State.

It is recommended that all sectors and levels report any difficulties encountered during implementation to the Ministry of Labour for research and resolution.
