OF THE MINISTRY OF EDUCATION NUMBER 20-TT/GD SEPTEMBER 1, 1976 ON ANNUAL SUMMER VACATION REGIME FOR TEACHERS IN SCHOOLS
The holiday and annual leave regime for state cadres, workers, and officials has been prescribed by the Prime Minister in Decree No. 28/TTg dated January 28, 1959.
On May 6, 1971, the Ministry of Labor issued Circular No. 05/TT-LD, consolidating previous regulations on rest regimes for cadres, workers, and officials and making necessary supplements and amendments to suit new circumstances.
In the field of education, on July 4, 1959, the Ministry of Education issued Circular No. 25-TT-CS and subsequent documents stipulating the summer vacation regime for teachers at all levels and disciplines.
To rationalize the working and resting regimes annually for teachers and to further encourage and motivate female and male teachers in their educational work, the Ministry of Education, after consulting with the Ministry of Labor and the Ministry of Finance, issues this circular, consolidating previous documents on the rest regime for teachers and making necessary supplements and amendments to ensure uniform implementation throughout the sector.
1. After completing one year of educational and teaching work, during the summer vacation period, all teachers (including those in their probationary period) shall be granted a one-month summer vacation (30 days, including Sundays) and shall continue to receive full salary - not applying the general annual leave regime of 10 or 12 days for cadres, workers, and officials, in order to create conditions for teachers to restore their health, visit family, and relatives.
2. Teachers who are ethnic Vietnamese or ethnic minorities working in highland areas, remote islands, or regions with a regional allowance of 20% or more (referred to as highlands), and teachers from other places working in remote and isolated areas (as defined in Joint Circular No. 30-TT/LB dated August 28, 1974 of the Ministry of Education and the Ministry of Finance and regulated by the Provincial People's Committee) shall be granted a one-and-a-half month summer vacation (45 days, including Sundays).
3. If travel difficulties or long distances result in a total travel time exceeding five days during the summer vacation, additional leave will be considered and granted starting from the sixth day.
The authority issuing the summer vacation leave certificate for teachers is the Department of Education (for primary and secondary school teachers) and the Provincial Education Departments (for high school teachers) and the Principals of schools under the Ministry.
Example: Teacher X, originally from Nghe An, works in the highland region of Lai Chau and is entitled to a 45-day summer vacation each year. Due to the long distance and travel difficulties, it takes Teacher X seven days to travel both ways (with a certificate from the traffic management agency). Therefore, Teacher X is entitled to two additional days off.
4. Within one year (from June 1 of the current year to May 1 of the following year), if a teacher's sick leave accumulates to three months or more but less than six months (or the number of teaching hours is less than half of the standard hours in a year), then that year the teacher will only be entitled to half of the stipulated summer vacation days. If the accumulated sick leave exceeds six months (or half of the standard hours), then the teacher will not be entitled to a summer vacation that year.
The maternity leave and leave due to child illness of female teachers will not be counted towards the sick leave mentioned above and will still be governed by previous regulations.
Example: a) Teacher A, a high school teacher, has a standard teaching hour quota of 16 hours per week multiplied by 32 weeks, totaling 512 hours per year. During the year, Teacher A's accumulated sick leave is 180 hours, which is less than half of the standard hours in a year (or 100 days of sick leave). Thus, that year, Teacher A will only be entitled to half of the stipulated summer vacation days.
b) Teacher B, a primary school teacher, has a standard teaching session quota of 6 sessions per week multiplied by 32 weeks, totaling 192 sessions per year. During the year, Teacher B's accumulated sick leave is 96 sessions (equivalent to four months) and then takes additional sick leave during the summer vacation for over two months. Therefore, Teacher B's total sick leave exceeds six months, so Teacher B will not be entitled to a summer vacation that year.
Each year, after the end of the academic year, based on plans for teacher training during the summer, educational management agencies need to arrange for all teachers to take their summer vacation according to the stipulated regime. The organization of summer vacation for each teacher can be conducted in one or two phases.
In special cases where work requirements necessitate mobilizing some Principals, Deputy Principals, and teachers to work during the summer, thus preventing them from taking their full vacation days, schools should make efforts to arrange compensatory leave in the first semester of the next academic year and generally not consider payment in lieu of the unutilized vacation days (as stipulated in Circular No. 5-TT/LD dated May 6, 1971 of the Ministry of Labor).
Mobilization of teachers for summer work is decided by the Provincial Education Departments and the duration of such mobilization shall not exceed ten days.
6. Teachers who take more vacation days than stipulated will have the excess days deducted from their vacation days in the following year.
7. Principals and Deputy Principals must participate in teaching according to the working regime for teachers prescribed by the Ministry of Education and are entitled to the summer vacation as teachers. In cases where they are permitted to be exempted from teaching duties, they will enjoy the annual leave regime like other cadres, workers, and officials.
8. In addition to the summer vacation regime, teachers are also entitled to personal leave and full salary in the following cases:
- For the death of parents, parents-in-law, spouse, or children, teachers are entitled to one to three days of leave (excluding travel time).
- When teachers get married and the wedding does not coincide with the summer vacation period, the school will arrange for one to three days of leave and deduct it from the summer vacation days of that year.
9. If a teacher dies before taking the summer vacation, the family will be compensated for the salary of the days of vacation to which the teacher was entitled but did not take.
10. During the annual summer vacation, teachers may combine visits to their families and will be reimbursed for train and bus fares once a year (both ways) up to a designated location (as directed in point a, section 4, part III of Circular No. 05-TT/LD dated May 6, 1971 of the Ministry of Labor).
11. This circular applies to all teachers teaching in normal schools, general schools, agricultural and cultural supplementary schools, and labor general schools.
The officials and teachers working at educational management agencies who are detached from teaching shall be subject to the annual leave regime as prescribed generally by the State.
This Circular takes effect from the date of issuance and replaces all previous documents of the Ministry of Education concerning the rest regime for teachers.
