Pursuant to the Complaint and Denunciation Law 1998; the Law Amending and Supplementing Certain Provisions of the Complaint and Denunciation Law 2004, 2005;
Pursuant to the Anti-Corruption Law 2005;
Pursuant to the Press Law December 28, 1989; the Law Amending and Supplementing Certain Provisions of the Press Law June 12, 1999;
Pursuant to Decree No. 51/2002/NĐ-CP dated April 26, 2002 of the Government detailing the implementation of the Press Law; the Law Amending and Supplementing Certain Provisions of the Press Law;
Pursuant to the Regulation on Public Speaking and Providing Information to the Press issued pursuant to Decision No. 77/2007/QĐ-TTg of the Prime Minister dated May 28, 2007.
Considering the proposal of the Director of the Office of the Government Inspectorate,

DECISION:

Article 1. Issuing along with this Decision the "Press Spokesperson and Information Provision Regulations for the Government Inspectorate".

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Heads of Departments and Units under the Government Inspectorate are responsible for implementing this Decision./.

REGULATIONS

PRESS SPEAKERSHIP AND INFORMATION PROVISION FOR THE MEDIA OF THE GOVERNMENT INSPECTORATE
(Issued together with Decision No. 2016/2007/QĐ-TTCP dated September 26, 2007 of the Chief Inspector)

Chapter 1:

GENERAL PROVISIONS

Article 1Scope of Public Speaking and Provision of Information

This Regulation stipulates the system of public speaking and provision of information to the press of the Government Inspectorate in accordance with the laws on press and current laws.

Article 2. The person responsible for public speaking and providing information to the press of the Government Inspectorate

1. The Chief Inspector has the responsibility to speak publicly and provide information to the press or to appoint someone to speak publicly and provide information to the press (hereinafter referred to as the Spokesperson).

2. The Director of the Office of the Government Inspectorate is the official Spokesperson and provider of information for the Chief Inspector.

3. In cases of necessity, the Chief Inspector may delegate authority to others to represent the Chief Inspector in public speaking and providing information to the press.

4. The criteria for the Spokesperson shall be implemented according to Clause 3, Article 2 of the Regulation on Public Speaking and Providing Information to the Press issued together with Decision No. 77/2007/QĐ-TTg dated May 28, 2007 of the Prime Minister.

5. Only the Spokesperson of the Government Inspectorate may act on behalf of the Government Inspectorate in matters of public speaking and providing information to the press.

6. Information provided by the Spokesperson of the Government Inspectorate is considered official information of the Government Inspectorate.

7. Staff members of the Government Inspectorate who are not assigned the task of public speaking and providing information to the press shall not speak publicly or provide information to the press on behalf of the Government Inspectorate.

8. In cases where staff members are requested by the press to be interviewed, the person being interviewed must report and seek permission from the Chief Inspector in writing, specifying the interview content and can only be interviewed after receiving approval from the Chief Inspector.

Chapter 2:

PUBLIC SPEAKING AND INFORMATION PROVISION

Article 3Regular Public Speaking and Information Provision

1. Once a month, the Government Inspectorate organizes the provision of information about its inspection activities to the press.

2. Regular information provision is carried out through press conferences and posting on the electronic information website (Website) of the Government Inspectorate "address: http://thanhtra.gov.vn".

Article 4. Press Conferences and Interview Responses

1. The Government Inspectorate holds regular press conferences on Thursday mornings, at the end of each month.

2. During the press conference, the Spokesperson of the Government Inspectorate provides the following information to the press:

a) On the main activities of the Leadership of the Government Inspectorate;

b) On the situation and results of the activities of the Government Inspectorate and the Inspection sector (monthly, quarterly, semi-annually, annually), including:

- Work on drafting normative legal documents, promoting and educating the law on inspections, handling complaints and denunciations, and preventing corruption;

- Citizen reception work, complaint and denunciation resolution;

- Inspection activities; results of implementing inspection conclusions and recommendations of inspected entities and related agencies;

- Results of compiling reports on anti-corruption work in accordance with the law on anti-corruption;

- Other contents deemed necessary by the Government Inspectorate.

3. During the press conference, the Spokesperson of the Government Inspectorate is responsible for answering questions and interviews from the press. If the Spokesperson finds that the content of the question or interview exceeds their authority to answer or is unclear and requires further consultation, they may choose not to answer directly during the press conference but will respond later at a suitable time.

4. The content of information provided at the press conference is fully published on the electronic information website of the Government Inspectorate.

Article 5. Public Speaking and Information Provision in Emergency Situations

1. Between two regular press conferences, when there are important pieces of information that need to be published in the press, the Government Inspectorate will organize emergency press conferences or send written materials and provide information to the press.

2. In cases where urgent initial opinions of the Government Inspectorate are required due to incidents, the Spokesperson of the Government Inspectorate is responsible for promptly and accurately speaking publicly and providing information to the press regarding events and issues related to the incident, no later than two days from the occurrence of the incident.

3. When the press agency or the state management agency on press requests the Government Inspectorate to speak publicly and provide information on events and issues related to the Government Inspectorate or within the scope of management of the Government Inspectorate.

Article 6. Cases Where the Spokesperson Refuses to Speak Publicly and Provide Information to the Press

1. Matters listed in the State Secrets Catalogue, secrets of the Inspection Sector, and matters related to national security.

2. Inspection conclusions and examination conclusions of complaints directed by the Prime Minister when there is no directive from the Prime Minister on handling.

3. Information and documents outside the jurisdiction and functions of the Prime Minister.

4. Other cases as stipulated by law.

Article 7. Preparation of Content and Organization of Information Provision

1. The Director of the Office and the Spokesperson shall lead and coordinate with the Heads of Departments and Units under the Government Inspectorate to prepare the content of press conferences, answers to questions raised by the press, and other contents as directed by the Chief Inspector;

2. The Departments and units shall provide complete and accurate information contents to serve press conferences and information provision upon request of the Director of the Office and the Spokesperson.

3. The content of statements and information provided to the media must be reviewed by the Inspector General before publication.

Article 8. Authority, responsibility, and obligations of the Spokesperson

1. Has the right to request Departments and units within the Government Inspectorate to provide information, receive information, compile information, and organize regular and ad hoc information provision according to Articles 3 and 5 of this Regulation.

2. Has the right to refuse to make statements and provide information on issues that are confidential under Party principles and regulations and those outside the scope of authority for making statements.

3. When receiving opinions and recommendations regarding issues published or broadcast in the media related to the activities of the Government Inspectorate, the Spokesperson has the right to request Departments and units under the Government Inspectorate to provide information to respond to the media, in accordance with the Law on Press.

4. Shall be responsible under the law and before the Inspector General for the content of statements and information provided to the media.

5. Requests media agencies to correct false information published or posted related to the activities of the Government Inspectorate and the Inspection sector.

Chapter 3:

IMPLEMENTATION

Article 9. Implementation Provisions

1. The Director of the Office of the Government Inspectorate shall be responsible for inspecting and reporting to the Inspector General on the implementation and proposing amendments and supplements to this Regulation in accordance with requirements and actual circumstances.

2. Civil servants and officials under the Government Inspectorate who violate the provisions of this Regulation shall be subject to administrative or criminal disciplinary action depending on the nature, severity, and consequences caused, in accordance with current laws.

3. Inspectors of Ministries, ministerial-level agencies, agencies under the Government, and Inspectors of provinces and centrally-administered cities shall base on this Regulation to develop their own Regulations on Statements and Information Provision to the Media./.
