JOINT MINISTRY OF CULTURE - LABOUR - FINANCE DECREE NO. 202 - TT/LB DATED DECEMBER 30, 1985 GUIDING THE IMPLEMENTATION OF SUBSIDIES FOR PROFESSIONAL CULTURAL AND ART ACTIVITIES. 30 - 12 - 1985 GUIDELINES FOR IMPLEMENTING SUBSIDIES FOR PROFESSIONAL CULTURAL AND ART ACTIVITIES - SCREENING AND MUSEUM PRESERVATION.

In accordance with the spirit of Resolution No. 8 of the Central Committee of the Party, Term V, and to implement Decree No. 235 - HĐBT dated September 18, 1985 of the Council of Ministers on improving the wage system for state employees, the Joint Ministry of Culture - Labour - Finance guides the implementation of subsidies for professional cultural and artistic activities within the cultural sector as follows:

I. REGARDING THE SUBSIDY SYSTEM FOR PERFORMING ARTISTS.

Performing art labor is both internal mental work and has a unique form of expression. To encourage the development of creative talent and achieve high-quality performance, professional performing artists are entitled to the following subsidy systems:

1. Subsidy for rehearsal practice.

The following levels of subsidy for rehearsal practice aim to compensate for physical and intellectual exertion during direct labor rehearsals, applied according to each rehearsal session.

a) A rate of 8 dong (eight dong) per rehearsal session applies to performers who undertake main roles in programs and plays in arts disciplines with heavy labor intensity such as acrobatics, dance, music, opera, traditional drama, wind instruments.

b) A rate of 6 dong (six dong) per rehearsal session applies to performers who undertake main roles or equivalent roles in programs and plays in arts disciplines such as Cheo, cải lương (reformed hat戏改良剧), spoken drama, folk drama, song and dance, puppetry, symphonic music, orchestras of opera and ballet, and acrobatic arts that have equivalent training intensity not covered under point a.

c) A rate of 4 dong (four dong) per rehearsal session applies to performers practicing secondary or minor roles in all performing arts programs and plays.

- The above subsidy system only applies to performers directly involved in rehearsing programs and plays approved in the unit's activity plan and those requiring regular rehearsal before performance.

- Rehearsals outside the plan, basic training, self-training, or rehearsals for programs and plays based on contractual needs, and performers not directly involved in rehearsals, do not qualify for this subsidy.

- Art units hiring performers through contracts for recruitment into permanent positions, accompanying training performers, probationary performers, if selected by the unit to play roles in programs and plays requiring direct rehearsal for performance, also enjoy the above rehearsal session subsidy rates.

- Those directly guiding performers in program and play rehearsals receive the same rehearsal subsidy as specified in point a.

- If a performer or rehearsal guide suffers an accident or unexpected illness during rehearsal and must stop to seek treatment, they still receive the subsidy for that rehearsal session.

2. Subsidy after performance.

a) For performers directly participating in performances:

- A rate of 10 dong (ten dong) per performance applies to performers with talent undertaking main roles in all arts programs and plays.

- A rate of 8 dong (eight dong) per performance applies to performers undertaking secondary roles or non-main roles in programs and plays and musicians required to serve throughout the entire performance.

- A rate of 6 dong (six dong) per performance applies to supporting performers (playing crowd roles) in all arts disciplines and musicians serving in the orchestra not covered under the higher rates.

b) For staff and workers serving the performance:

Technical officers, workers, and staff in art units assigned to directly serve the performance receive the following subsidy after each performance:

- A rate of 7 dong (seven dong) per performance applies to those responsible for sound and lighting technology, serving throughout the entire performance.

- A rate of 6 dong (six dong) per performance applies to those responsible for stage decoration, scene changes, and backstage support.

- A rate of 5 dong (five dong) per performance applies to those engaged in indirect support services for the performance.

c) For the director (also called the performance conductor), responsible for managing the entire performance, receives the following subsidy:

10 dong (ten dong) per performance for conductors with talent and reputation.

8 dong (eight dong) per performance for conductors not covered under the 10 dong rate.

In cases where a performer is assigned the role of performance conductor,

in addition to the performance subsidy, they also receive an additional 50% of the 8 dong rate.

d) Outdoor performances without fixed stages, performers and staff serving the performance also receive an additional 20% of the post-performance subsidy stipulated in point 2, sub-points a, b, and c.

e) Traveling to perform outside the unit's premises according to the approved schedule, in addition to the above subsidies, members performing these tasks also receive travel expenses and accommodation allowances. If due to difficulties, performance cannot be carried out, they do not receive the post-performance subsidy but only travel expenses and accommodation allowances.

g) Recording performances for broadcasting and television, due to political task requirements, receive a subsidy equal to 80% of the rates specified in point 2, sub-points a, b, and c.

h) For the team leader and deputy team leader who are classified according to the leadership salary scale, in addition to the standard working hours (8 hours per day), if they lead the team for performances without directly performing themselves, the extra working hours beyond the standard will be counted for compensatory leave. If compensatory leave cannot be arranged, those extra hours will be compensated with overtime pay as prescribed in Point 11, Article 5 of Decree No. 235-HĐBT dated September 18, 1985, issued by the Council of Ministers, and Circular No. 22-LĐ/TL dated November 20, 1985, issued by the Ministry of Labor guiding the implementation of the system of night shift and overtime allowances for workers and staff.

For performers (not classified according to the leadership salary scale) who both directly perform and are assigned the duty of team leader or deputy artistic team leader when leading the team for performances, in addition to receiving performance allowances, they also receive additional responsibility allowances of 7% of their basic salary for team leaders and 5% of their basic salary for deputy team leaders. This allowance is only applicable during the period of兼任职务。

i) Cases where performance allowances are not applicable.

- The performance allowances mentioned above apply only to performances listed in the approved activity plan of the unit. Performances outside the plan, contractual performances based on specific requests for which the unit has already paid performance allowances... are not eligible for these performance allowances.

- The performance allowances mentioned above do not apply to performers who do not directly perform, contracted performers who are not under the management of the unit and have been paid contract fees, and administrative staff and workers who do not directly serve the performance.

3. Allowance for working in dangerous and arduous conditions - difficulties.

Due to the characteristics of artistic labor involving many arduous and dangerous performance items, and the difficult portrayal of character inner actions, the following art disciplines shall enjoy a 5% (five percent) allowance of the rank salary:

- Circus arts (animal breeding, training, and performance, contortionist circus, acrobatics, sports, balance acts, and other circus disciplines with equivalent arduous and dangerous work intensity).

- Dance performers, ancient drama performers, wind instrument players, water puppetry performers...

The above allowance applies only to professional performers actually engaged in performance work. This 5% allowance is calculated based on the performer's basic rank salary and received concurrently with the monthly salary, but it does not accumulate into the rank salary for calculating other 10% rank salary allowances.

To ensure the implementation of the performance allowances stipulated in Points 1, 2, and 3 of Part I, the heads of artistic units must enhance the sense of responsibility of those responsible for organizing and implementing them. There should be participation in opinions from the Art Council of the unit, the performance and practice commanders, team leaders, and deputy team leaders to consider and decide correctly on the beneficiaries of the allowances prescribed. If there is a violation of the provisions above, the head of the artistic unit shall bear responsibility.

II. ALLOWANCES FOR INFORMATION ACTIVITIES - MOVIE SCREENING - MUSEUM PRESERVATION.

 SCREENING - MUSEUM PRESERVATION.

1. For professional mobile information teams, professional mobile movie screening teams, mobile museum exhibition teams, survey exploration teams, collection excavation archaeological teams, and relic restoration sites.

a) Staff members working in the aforementioned teams shall enjoy mobility allowances according to the operating area with the following rates:

- Mountainous, border, and island areas shall enjoy a 20% allowance of the rank salary or position salary.

- Midland areas shall enjoy a 15% allowance of the rank salary or position salary.

- Plain areas shall enjoy a 10% allowance of the rank salary or position salary.

b) The mobility allowance at point a shall be paid monthly based on actual travel and completion of the quantity and quality requirements set out in the operational plan. In cases where the required quota is not met, the competent authority shall base its decision on the specific circumstances to pay half or one-third of the aforementioned allowance.

c) Those who have received mobility allowances shall not receive residence allowances. For activities such as exploration, collection, excavation, and archaeological research, if the mobility allowance is lower than the residence allowance, then the residence allowance shall be granted. Specifically, for professional mobile information teams, since they are selected annually to attend training sessions, competitions, and performances organized by provincial, city, special zone, and central authorities, during these trips, staff members still receive current travel and residence allowances.

2. In addition to mobility allowances, staff members of professional mobile information teams, when required to rehearse new programs for service, shall also receive a rehearsal allowance of 3 dong (three dong) per session, applicable to those who actually participate in rehearsals, but not exceeding 10 (ten) sessions per month.

3. Film narrators of mobile movie screening teams and mobile museum exhibition teams, in addition to receiving mobility allowances, shall also receive a narration allowance of 2 dong (two dong) per session of film narration or mobile exhibition narration.

4. Movie projection activities at cinemas and fixed movie screening teams shall receive overtime allowances for sessions exceeding the daily plan. The overtime allowance rate is calculated as a percentage of the rank salary or position salary for the number of overtime hours worked (50% of the salary for regular days, 100% of the salary for Sundays, holidays, and New Year's Day) as prescribed in Section 11, Article 5 of Decree No. 235-HĐBT dated September 18, 1985, issued by the Council of Ministers.

Specifically, film narrators at cinemas and fixed teams shall receive a narration allowance of 3 dong (three dong) starting from the second session of the day, if they continue to narrate.

Based on the allowances and rates specified in Part II, the direct managing agencies of mobile information - movie screening - museum preservation activities shall closely monitor and organize classification of individuals entitled to different levels of allowances to ensure accuracy and fairness, avoiding disputes and envy among those receiving allowances.

III. IMPLEMENTATION PROVISIONS.

1. The funds for the allowances stipulated in this Circular for cultural-artistic activities shall be provided from the State budget and reflected in the financial plans of cultural-artistic activity units. Direct management agencies are responsible for preparing quarterly and annual revenue and expenditure budgets to submit to the same-level financial authorities for review and implementation.

Cultural-artistic units operating in the form of public services, public service with income, or business units must ensure the implementation of the above allowances.

The Departments of Culture and Information, Labor, and Finance are responsible for approving the activity plans, financial plans, and budget subsidies (in cases where income is less than expenditure) according to the current management regulations for operational units.

2. This Circular takes effect throughout the country from January 1, 1986.

Previous regulatory documents, including the levels of allowances for mobile film projection teams, exhibition teams, museum conservation teams, survey collection, and archaeological excavation teams as specified in Circular No. 15-LDTT dated January 7, 1985, issued by the Ministry of Labor guiding the implementation of the allowance system for mobile work, which conflict with this Circular, are hereby abolished.

Any difficulties encountered during implementation should be promptly reported to the Joint Ministries of Culture - Labor - Finance for study and resolution.
