PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

At the proposal of the Minister of Construction,

DECISION:

Article 1. Adjustment and supplementation of the target groups eligible to purchase housing and land plots on installment in residential clusters in flood-prone areas:

The households eligible for purchasing housing and land plots on installment are those currently residing in areas that are not safe during floods and must be relocated to live in residential clusters and areas with embankments to ensure long-term safety and stability, including:

- Households falling within the scope defined in Article 1 of Decision No. 105/2002/QĐ-TTg dated August 2, 2002 issued by the Prime Minister;

- Households that have migrated from other places and are legally residing in the locality;

- Households currently living in areas prone to landslides and not safe during floods and storms.

Article 2. Adjustment and supplementation of the loan mechanism for housing construction:

1. For households that need to relocate to live in existing residential clusters and embankment areas and wish to construct their own houses, they may borrow funds from the Social Policy Bank to build houses under the following conditions:

a) The house has been completed according to the regulations of the People's Committee of the province or centrally-administered city;

b) The list of households eligible to borrow funds from the Social Policy Bank to build houses is confirmed by the provincial People's Committee or delegated to the district People's Committee for confirmation.

The amount of loan, loan term, interest rate, policy of encouraging early repayment, and other borrowing conditions shall be implemented in accordance with Decision No. 105/2002/QĐ-TTg dated August 2, 2002 issued by the Prime Minister regarding policies for households in flood-prone areas to purchase housing and land plots on installment in residential clusters in the Mekong Delta.

For households that are approved to reside in existing residential clusters and embankment areas but do not require loans to construct their own houses, they will still follow the policy of purchasing housing on installment as stipulated in Decision No. 105/2002/QĐ-TTg dated August 2, 2002 issued by the Prime Minister.

2. Adjustment of the loan amount for households approved to reside in existing residential clusters and embankment areas who purchase housing on installment or borrow funds to construct their own houses as follows:

a) For households approved to reside in existing residential clusters and embankment areas who are classified as poor and extremely difficult, unable to afford roofing and flooring, the loan amount will be increased from seven million dong to nine million dong per household (an increase of two million dong per household compared to the provisions in Decision No. 105/2002/QĐ-TTg dated August 2, 2002 issued by the Prime Minister).

The households eligible for this increased loan amount are those relocating to existing residential clusters and embankment areas after this Decision takes effect.

b) The number of households eligible for the increased loan amount will be approved by the provincial People's Committee or delegated to the district People's Committee for approval through evaluation at the grassroots level in accordance with regulations.

The above provisions shall only apply to households moving to existing residential clusters and embankment areas from the date this Decision takes effect.

Article 3. In the short term, it is allowed to temporarily refrain from collecting land use fees and stamp duty when processing procedures for issuing certificates of land use rights and ownership of houses for households living in residential clusters in flood-prone areas. The Ministry of Finance shall take the lead and coordinate with the People's Committees of provinces in flood-prone areas to guide the implementation of this matter.

Article 4. Implementation

1. The People's Committees of provinces and centrally-administered cities in the Mekong Delta, which are frequently flooded, shall be responsible for:

a) Vigorously directing and promptly addressing difficulties and obstacles within their jurisdiction to complete the work of raising ground levels and constructing embankments in existing residential areas; accelerating the progress of essential infrastructure projects (water supply, drainage, and internal transportation); constructing houses and promptly arranging households to move into residential clusters safely, gradually stabilizing them in accordance with the set goals and tasks;

b) Being accountable to the Prime Minister for ensuring the completion of the basic program for building residential clusters and housing in 2005 and completing the entire program by 2006;

c) Specifying the scale, standards, and quality of houses constructed by households to serve as a basis for loan approval;

d) Directing the management and guiding households to construct houses in residential clusters and embankment areas in compliance with planning and construction boundaries;

e) Directing the confirmation of houses after households have completed construction in accordance with regulations to serve as a basis for loans; directing the evaluation and approval of lists of poor and extremely difficult households eligible for increased loans to purchase housing on installment or to construct their own houses as prescribed;

f) Prohibiting the use of residential clusters as resettlement sites for individuals displaced by other local programs and projects.

2. The State Bank of Vietnam shall direct the Social Policy Bank to implement lending and recovery of loans for housing construction in accordance with regulations; simultaneously taking measures to simplify procedures to accelerate the disbursement of loans for households eligible to move into residential clusters in flood-prone areas.

3. The Ministry of Construction shall be responsible for regularly inspecting and urging localities to implement the Program to ensure its objectives and schedule are met effectively.

4. The Ministry of Finance, the Ministry of Construction, the State Bank of Vietnam, and related ministries and agencies shall cooperate and guide localities in implementing the contents of this Decision effectively in accordance with their functions and responsibilities.

Article 5. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 6. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairmen of People's Committees of provinces and centrally-administered cities: An Giang, Dong Thap, Long An, Kien Giang, Hau Giang, Vinh Long, Tien Giang, Can Tho are responsible for enforcing this Decision./.
