- Relevant ministries and agencies shall coordinate with the People's Committee of Ha Tay Province in implementing the restructuring and renewal plan for state-owned enterprises.

APPROVING THE ADJUSTED PLAN FOR REORGANIZATION AND MODERNIZATION OF STATE ENTERPRISES UNDER THE PEOPLE'S COMMITTEE OF HA TAY PROVINCE State UNDER THE URBAN DEVELOPMENT CORPORATION OF HA TAY PROVINCE

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on State-Owned Enterprises dated November 26, 2003;
Pursuant to Decision No. 155/2004/QĐ-TTg dated August 24, 2004 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises and independent accounting subsidiaries under state-owned corporations;
Considering the proposal of the People's Committee of Ha Tay Province,
DECISION:
Article 1. APPROVES THE ADJUSTED PLAN FOR REORGANIZING AND MODERNIZING SOME STATE ENTERPRISES UNDER THE PEOPLE'S COMMITTEE OF HA TAY PROVINCE AS FOLLOWS:
1. CAPITALIZE THE FOLLOWING STATE ENTERPRISES:
a) IN 2006 AND 2007:
- HA TAY PRINTING FACTORY;
- HA TAY PORT COMPANY;
- HA TAY HIGHWAY MAINTENANCE AND REPAIR COMPANY I;
- HA TAY HIGHWAY MAINTENANCE AND REPAIR COMPANY II.
b) IN 2008:
- HA DONG URBAN ENVIRONMENT COMPANY;
- SON TAY URBAN ENVIRONMENT COMPANY;
- HA DONG WATER SUPPLY COMPANY;
- SON TAY WATER SUPPLY COMPANY.
2. MERGE THE FOLLOWING STATE ENTERPRISES IN 2006:
- MERGE QUOC OAI IRRIGATION WORKS OPERATING COMPANY AND PHUC THO IRRIGATION WORKS OPERATING COMPANY INTO PHU SA-DONG MO IRRIGATION WORKS OPERATING COMPANY;
- MERGE SUOI HAI FISHERIES AND TOURISM SERVICES COMPANY INTO BA VI IRRIGATION WORKS OPERATING COMPANY.
3. THE PEOPLE'S COMMITTEE OF HA TAY PROVINCE SHALL DEVELOP A REORGANIZATION AND MODERNIZATION PLAN FOR THE CURRENT 10 IRRIGATION WORKS OPERATING COMPANIES WITH THE AIM OF CONCENTRATING MANAGEMENT AND THEN CAPITALIZING OR CONVERTING INTO A JOINT STOCK COMPANY WITH A SINGLE SHAREHOLDER TO BE SUBMITTED TO THE PRIME MINISTER FOR APPROVAL IN THE FOURTH QUARTER OF 2006.
Article 2. THE CHAIRMAN OF THE PEOPLE'S COMMITTEE OF HA TAY PROVINCE SHALL DIRECT THE IMPLEMENTATION OF THE REORGANIZATION AND MODERNIZATION OF THE STATE ENTERPRISES UNDER THE PROVINCE IN ACCORDANCE WITH THE CONTENT AND TIMELINE APPROVED BY THE PRIME MINISTER. ANY AMENDMENTS OR ADDITIONS MUST BE APPROVED BY THE PRIME MINISTER.
Article 3. THE MINISTRIES OF FINANCE, PLANNING AND INVESTMENT, LABOUR, INVALIDS AND SOCIAL AFFAIRS AND RELATED AGENCIES SHALL COOPERATE WITH THE PEOPLE'S COMMITTEE OF HA TAY PROVINCE IN THE IMPLEMENTATION OF THE ABOVE MENTIONED PLAN.
Article 4. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE.
THE CHAIRMAN OF THE PEOPLE'S COMMITTEE OF HA TAY PROVINCE AND THE HEADS OF RELATED AGENCIES ARE RESPONSIBLE FOR THE ENFORCEMENT OF THIS DECISION./.
