THE MINISTER OF FINANCE

Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 02/2010/QD-TTg dated January 15, 2010 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Customs under the Ministry of Finance;

Considering the proposal of the Director General of the General Department of Customs, the Head of the Personnel Department,

DECISION:

Article 1. Establishing the Customs Reform and Modernization Board based on restructuring the Steering Board and the Customs Reform and Modernization Board.

The Customs Reform and Modernization Board shall be authorized to use the seal of the General Department of Customs during the implementation of assigned tasks.

Article 2. Tasks

The Customs Reform and Modernization Board shall have the following tasks:

1. Developing long-term, medium-term, and annual strategies and plans for customs reform and modernization to be submitted to the Director General of the General Department of Customs for reporting to the Minister of Finance for consideration and decision.

2. Taking the lead in coordinating the implementation of approved strategies, programs, and plans for customs reform and modernization.

3. Directing, guiding, inspecting, and evaluating the implementation of customs reform and modernization by organizations and units within the Customs sector.

4. Studying and applying modern customs management methods; organizing and directing pilot projects to expand throughout the Customs sector.

5. Coordinating the implementation of funded projects related to customs reform and modernization.

6. Cooperating with relevant units of the Ministry of Finance and other ministries and sectors in organizing the implementation of the strategy for customs reform and modernization.

7. Performing the role of the Permanent Representative Office assisting the National Steering Committee on the Single Window ASEAN Mechanism according to the Agreement and Protocol on the Establishment and Implementation of the Single Window ASEAN Mechanism.

8. Performing other tasks assigned by the Director General of the General Department of Customs and as prescribed by law.

Article 3. Organization of Operation

1. The Customs Reform and Modernization Board shall be headed by the Director General of the General Department of Customs.

The Deputy Directors General assist the Director General, including a permanent Deputy Director General. The Deputies shall enjoy the equivalent position allowance coefficient of Deputy Heads of Departments of the General Department of Customs.

Appointments, dismissals, and removals of leaders of the Customs Reform and Modernization Board shall be carried out in accordance with the provisions of law and the delegation of personnel management authority of the Ministry of Finance.

2. The Customs Reform and Modernization Board shall have several Task Forces decided by the Director General of the General Department of Customs.

Article 4. Method of Operation

1. The Director General of the General Department of Customs shall issue the Regulation on the organization and operation of the Customs Reform and Modernization Board.

2. The Director General of the General Department of Customs shall be responsible for mobilizing, assigning, arranging, and scheduling civil servants of the General Department to implement the tasks of the Customs Reform and Modernization Board, in accordance with the requirements of each period.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from the date of signature. Abolishing Decision No. 3219/QD-BTC dated October 5, 2004 of the Minister of Finance on the establishment of the Steering Board and the Management Board for the Implementation of Customs Modernization; Decision No. 1479/QD-BTC dated April 17, 2007 of the Minister of Finance on the reorganization and renaming of the Management Board for the Implementation of Customs Modernization to the Customs Reform and Modernization Board; Decision No. 1927/QD-BTC dated September 4, 2008 on amending and supplementing Decision No. 1479/QD-BTC dated April 17, 2007; Decision No. 3369/QD-BTC dated October 16, 2007 of the Minister of Finance on transferring international project management boards supporting customs reform and modernization to the Customs Reform and Modernization Board.

2. The Director General of the General Department of Customs, the Head of the Personnel Department, the Head of the Ministry of Finance's Office, and the heads of units under and affiliated with the General Department of Customs are responsible for implementing this Decision./.
