Regarding the issuance of permits for the construction of new inland waterway vessels

THE MINISTER OF TRANSPORTATION

Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating the tasks, powers, responsibilities for state management, and organizational structure of the Ministry of Transport.

Pursuant to Decree No. 40/CP dated July 5, 1996 of the Government on ensuring traffic order and safety on inland waterways.

At the proposal of the Heads of the Legal Affairs Department and the Vietnam Inland Waterways Administration,

DECISION:

Article 1. All organizations and individuals, whether Vietnamese or foreign, residing and operating legally in Vietnam, before constructing new vessels to participate in passenger transport, cargo transport, tourism services, and sports activities on Vietnamese inland waterways, must obtain permission from the competent state management authority.

Article 2. Any organization, enterprise, or individual wishing to construct new inland waterway vessels must submit an application according to the forms attached to this Decision.

Article 3

1. The Vietnam Inland Waterways Administration shall manage the issuance of permits for the construction of new vessels uniformly throughout the country and directly issue permits for the construction of motorized vessels with a power of 135 horsepower or more, non-motorized vessels with a carrying capacity of 200 tons or more, and test vessels.

2. Provincial Departments of Transport and Departments of Transport and Public Works shall issue permits for the construction of new vessels outside the scope defined in Clause 1 of this Article at the local level and report periodically to the Vietnam Inland Waterways Administration (according to the form provided).

Article 4. Upon receipt of complete permit applications for the construction of new vessels, the issuing authority shall examine them, and within no more than 15 days, notify the applicant of the result.

Article 5. The validity period of the permit for the construction of new vessels shall not exceed six months from the date of issuance. If the holder of the permit does not commence implementation within the time limit specified in the permit, the permit becomes invalid.

Article 6. This Decision takes effect from September 1, 1996

Any violation of this Decision shall be subject to administrative penalties under current regulations.

Article 7. The Heads of the Ministry's Office, Heads of the Ministry's advisory departments, the Director of the Vietnam Inland Waterways Administration, Directors of Provincial Departments of Transport, Directors of Provincial Departments of Transport and Public Works, and related units are responsible for implementing this Decision.
