REGULATIONS
MANAGEMENT OF IMPORT AND EXPORT OF BANKING-SPECIFIC EQUIPMENT AND MACHINERY
(Issued together with Decision No. 206/1998/QĐ-NHNN6, dated June 11, 1998 of the Governor of the State Bank of Vietnam)
Banking-specific equipment and machinery are those items with technical features and value in bank operations such as production, preservation, transportation, counterfeit prevention, etc.
The State Bank of Vietnam is assigned by the Government the task of managing the import and export of banking-specific equipment and machinery according to the Government's export and import policy for each period.
This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.
Article 1: Annually, the State Bank of Vietnam agrees with the Ministry of Commerce to submit to the Government for approval and publication the list of banking-specific equipment and machinery managed for import and export by the State Bank (Annex No. 01).
Article 2:Enterprises with business licenses for the import and export of relevant industries may engage in the import and export of banking-specific equipment and machinery (except those items classified as confidential within the banking industry, Annex No. 02).
Article 3:The Governor of the State Bank of Vietnam assigns the Head of the Issuance and Treasury Department to be responsible for reviewing and approving the import and export of banking-specific equipment and machinery (including samples) by domestic and foreign enterprises engaged in import and export activities, in accordance with these Regulations.
Article 4: Enterprises outside the banking industry are not permitted to import or export banking-specific equipment and machinery classified as confidential within the banking industry. In exceptional cases, permission must be obtained from the Governor of the State Bank of Vietnam.
II. SPECIFIC PROVISIONS
Article 5: The State Bank of Vietnam assigns units with import and export functions within the State Bank to handle the import and export of items classified as confidential within the banking industry.
Article 6:Enterprises engaged in the import of used banking-specific equipment and machinery must comply with the current regulations of the Ministry of Science and Technology and Environment.
Procedures for issuing import and export permits:
Article 7: 8.1. Enterprises shall submit to the Issuance and Treasury Department, State Bank of Vietnam:
Article 8: A letter requesting permission to import or export (detailing the main contents according to the model in Annex No. 03).
Copies of the enterprise establishment license and the import and export business license (certified true copies).
Catalogs introducing technical specifications, code symbols, brand names, and country of manufacture of the goods.
8.2. Within no more than ten days from the date when enterprises have submitted all required documents as stipulated in Article 8.1, the Issuance and Treasury Department shall be responsible for reviewing and issuing the permit or providing a written response explaining the reasons for not issuing the import and export permit for banking-specific equipment and machinery to the enterprise.
Provisions on reporting requirements:
9.1. For enterprises granted annual quotas for the import and export of banking-specific equipment and machinery:
Article 9: They must report to the Issuance and Treasury Department of the State Bank of Vietnam on their implementation of import and export activities monthly; at year-end, they must provide a written report and evaluation of the results achieved.
9.2. For enterprises granted quotas for the import and export of banking-specific equipment and machinery on a voyage-by-voyage basis:
After completing the import and export activities, they must provide a written report and evaluation of the results achieved.
III. IMPLEMENTATION PROVISIONS
Enterprises engaged in the import and export of banking-specific equipment and machinery are obligated to comply with these Regulations and other national regulations on import and export. Any violations will be subject to legal action depending on the severity.

Article 11: Amendments and supplements to this Regulation shall be decided by the Governor of the State Bank.
