CIRCULAR

REGULATIONS ON THE LEVEL OF COLLECTION, COLLECTION REGIME, PAYMENT, MANAGEMENT AND USE OF FEES AND CHARGES FOR THE NATIONAL DOMAIN NAME ".VN" AND INTERNET ADDRESS (IP) IN VIETNAM

Pursuant to the Law on Fees and Registration Fees dated November 25, 2015;

Pursuant to the State Budget Law dated June 25, 2015;

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to Decree No. 72/2013/NĐ-CP dated July 15, 2013 of the Government on management, provision, use of Internet services and information on networks;intention, supply, use Internet services and information on the network;of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsp, based on the Government's Decree No. 120/2016/NĐ-CP dated August 23, 2016, stipulating functions, tasks, and tax policies,

The Minister of Finance issues this Circular regulating the level of collection, collection regime, payment, management and use of fees and charges for the national domain name ".vn" and Internet address (IP) in Vietnam.IThis Circular regulates the level of collection, collection regime, payment, management and use of fees and charges for the national domain name ".vn" and Internet address (IP) in Vietnam.u:

Article 1. Scope of Regulation and Applicability

a) Domestic and foreign organizations and individuals who are granted registration and use of the national domain name ".vn"; domestic organizations that are granted registration and use of Internet addresses (IP) in Vietnam;

b) State agencies authorized to grant registration and use of the national domain name ".vn" and Internet addresses (IP) in Vietnam;

c) Other organizations and individuals related to the collection, payment of fees and charges for the national domain name ".vn" and Internet addresses (IP) in Vietnam.

The fee payer is an organization or individual within or outside Vietnam that has been registered and uses the national domain name ".vn", and domestic organizations that have been registered, granted, managed and used Internet addresses (IP) in Vietnam as stipulated in the Telecommunications Law and Decree No. 72/2013/NĐ-CP dated July 15, 2013 of the Government on management, provision, use of Internet services and information on networks.

Article 2. Fee and Charge Payers

The Vietnam Internet Network Information Center, assigned by the Ministry of Information and Communications to grant registration and use of the national domain name ".vn" and Internet addresses (IP) in Vietnam, is responsible for collecting fees and charges as prescribed in this Circular.

Article 3. Organizations collecting fees and charges

1. This Circular annexes the Table of Collection Levels for Registration Fees and Maintenance Fees for the National Domain Name ".vn" and Registration Fees and Maintenance Fees for Internet Addresses (IP) in Vietnam.

Article 4. Rates of Fees and Charges

2. Registration Fees and Maintenance Fees for the National Domain Name ".vn" and Registration Fees and Maintenance Fees for Internet Addresses (IP) in Vietnam shall be collected in Vietnamese Dong (VND).

2. Organizations collecting fees and charges shall declare fees and charges monthly and settle accounts annually as prescribed in Clause 3 Article 19; pay fees and charges into the state budget as prescribed in Clause 2 Article 26 of Circular No. 156/2013/TT-BTC dated November 6, 2013 of the Minister of Finance guiding the implementation of certain provisions of the Law on Tax Management; the Law Amending and Supplementing Certain Provisions of the Law on Tax Management and Decree No. 83/2013/NĐ-CP dated July 22, 2013 of the Government.

Article 5. Declaration, Payment of Fees and Charges

1. Within the latest by the second day of each week, the fee collection organization must deposit the amount of fees collected in the previous week into the account for pending payment to the State budget opened at the Treasury.

2. Organizations collecting fees may retain 90% (ninety percent) of the total amount of fees collected to cover costs for granting registration and managing, maintaining technical infrastructure, developing activities of the national domain name ".vn" and Internet addresses (IP) in Vietnam, and collecting fees as prescribed in Article 5 of Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges; including the following items: a) Annual membership fees for regional and international organizations responsible for domain names, addresses, and network numbers that Vietnam participates in;

Article 6. Management and use of fees and charges

1. The organization collecting charges shall remit the entire amount of charges collected into the State budget according to the current State budget classification.

b) Participation in international Internet-related meetings, seminars, and training sessions that Vietnam must fund itself;development c) Research and development expenses for scientific and technological innovation serving management, operation, promotion, and development of domain name registration and maintenance, and Internet address registration and maintenance in Vietnam.

The remaining 10% (ten percent) of the total amount of fees collected shall be paid into the state budget according to the current state budget classification.on1. This Circular takes effect from January 1, 2017, replacing Circular No. 189/2010/TT-BTC dated November 24, 2010 of the Minister of Finance on the level of collection, collection regime, payment and management and use of registration fees for the national domain name, maintenance fees for the national domain name, and Internet addresses in Vietnam.

2. Matters related to the collection, payment, management and use of fees and charges not covered in this Circular shall be implemented in accordance with the guidance provided in Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges; Circular No. 156/2013/TT-BTC dated November 6, 2013 of the Ministry of Finance guiding the implementation of certain provisions of the Law on Tax Management; the Law Amending and Supplementing Certain Provisions of the Law on Tax Management and Decree No. 83/2013/NĐ-CP dated July 22, 2013 of the Government and Circulars of the Minister of Finance on printing, issuing, managing and using tax receipt forms and other amending, supplementing or replacing documents (if any).

3. Organizations and individuals subject to payment of fees and charges and relevant agencies are responsible for implementing this Circular. In the process of implementation, if there are difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for consideration and guidance.
