Regarding the issuance of regulations on the content, procedures, and formalities
for power development planning
THE MINISTER OF INDUSTRY
Pursuant to Decree No. 74/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Pursuant to Decree No. 45/2001/NĐ-CP dated August 2, 2001 of the Government on electricity activities and electricity usage;
Pursuant to the Investment Management and Construction Regulation issued together with Decree No. 52/1999/NĐ-CP dated July 8, 1999 and amended and supplemented by Decree No. 12/2000/NĐ-CP dated May 5, 2000 of the Government;
Delegating the Management Boards of High-Tech Zones in provinces and centrally governed cities the authority to approve plans for importing finished products to combine with export products and to approve the liquidation of machinery, equipment, transportation means, materials, and raw materials of joint ventures, wholly foreign-owned enterprises, export processing enterprises, and contractual joint ventures under the management of the delegated authority.
DECISION:
Article 1. Issued together with this Decision are the Regulations on the content, procedures, and formalities for power development planning, applicable to the preparation, approval, and management of implementation of national power development planning, provincial power development planning, district power development planning, county power development planning, town power development planning, and city power development planning directly under provinces.
Article 2. This Decision shall take effect 15 days from the date of signature and replace previous regulations on power planning management work.
Article 3. The Heads of the Ministry's Office, the Heads of the Ministry's Inspectorate, the Heads of Departments, Bureau Chiefs under the Ministry, People's Committees of provinces and centrally governed cities, General Directors of Vietnam Electricity Corporation, and organizations and individuals engaged in electricity activities are responsible for implementing this Decision./.

(ANNEXED TO DECISION

PART I
General Provisions
Article 1.
1.Power development planning includes:
a)National power development planning;
b)Provincial power development planning (hereinafter referred to collectively as province);
c)District power development planning, county power development planning, town power development planning, and city power development planning directly under provinces (hereinafter referred to collectively as county).
2.Stages of planning:
a)National power development planning is prepared for each ten-year period, considering the prospects for the next ten years.
b)Other power development planning is prepared for each five-year period, considering the prospects for the next five years.
3.This regulation applies to organizations and individuals participating in electricity activities.
Article 2.
Power development planning is the goal, direction, solution, and policy mechanism for the development of the electricity industry, the development and improvement of power sources and grids, aimed at ensuring safe and continuous electricity supply for economic sectors, public services, people's livelihoods, and national defense and security, based on the efficient and economical use of the country's energy resources.
Article 3.
Only consulting organizations with permits to operate in the field of power development planning may participate in preparing national power development planning and provincial power development planning.
Chapter II
Content, procedures, and formalities for the construction, review, and approval of power development planning
Article 4.
1.National power development planning includes the following main contents:
a)Current state of national power and evaluation of the implementation of power development planning in the previous phase.
b)Overview of the economic and social situation and the energy system in Vietnam.
c)Forecast of electricity demand.
d)Economic and technical criteria for power source and grid projects.
đ)Evaluation of primary energy sources, exploitation capacity, import-export capacity of energy, and forecast of fuel prices for electricity production.
e)Program for developing power sources.
g)Program for developing grids.
h)Regional grid interconnection.
i)Program for rural electrification.
k)System dispatching and information for the Vietnamese power system.
l)Environment and environmental protection in power development.
m)Summary of construction volume and investment capital for the national power development program.

2.Provincial power development planning includes the following main contents:
a)Evaluation of the current state of local power and the implementation of planning in the previous phase.
b)Current status and target for economic and social development in the planning phase.
c)Forecast of electricity demand.
d)Evaluation of potential for developing power sources locally.
đ)Evaluation of the ability to exchange electricity with adjacent areas.
e)Evaluation of electricity supply conditions in remote, difficult-to-reach areas, and special economic zones (if any).

3.District power development planning includes the following main contents:
a)Evaluation of the current state of local power and the implementation of planning in the previous phase.
b)Current status and target for economic and social development of the locality in the planning phase.
c)Forecast of load demand.
d)Evaluation of potential for developing power sources locally.
đ)Evaluation of the ability to exchange electricity with adjacent areas.
e)Evaluation of electricity supply conditions in remote, difficult-to-reach areas, and special economic zones (if any).
g)Balancing capacity and electricity for important time periods during the planning phase.
h)Selection of some reasonable power source and grid development options.
i)Calculation and comparison of economic and technical criteria for selected options.
k)Selection of the optimal district power development option.
l)Summary of construction volume and investment capital for the planning phase.
m)Financial analysis of the selected option.

Article 5.
Procedures and formalities for drafting outlines and registering capital for power development planning as follows:
1.For national power development planning:
According to the five-year cycle, the Ministry of Industry approves the draft budget estimate and registers the state budget capital plan according to current regulations.
2.For provincial power development planning:
According to the five-year cycle, the Department of Industry drafts the budget estimate and submits it to the Provincial People's Committee for approval and registers the state budget capital plan for provincial power development planning according to current regulations.
3.For district power development planning:
Every five years, the Industry Department shall prepare a framework and budget for the power development planning work according to the power development needs of each region, submit it to the Provincial People's Committee for approval and coordinate the local budget funds for this work in accordance with current regulations.
4.The unit price establishment and cost of reviewing the power development planning shall be carried out in accordance with current regulations.
Article 6.
The procedure for developing the power development plan is as follows:
1.For national power development planning:
a)Based on the state budget capital plan allocated for national power development planning, the Ministry of Industry shall select consulting organizations with sufficient capacity to develop the plan.
b)The selected consulting organization shall carry out the National Power Development Plan in accordance with the approved framework and the assigned deadline.
c)During the planning process, the consulting organization must implement intermediate reporting steps as prescribed to seek opinions from relevant agencies and complete the plan.
d)After completing the plan, the consulting unit shall submit it to the Ministry of Industry for review and report to the Prime Minister for approval. The documents for submission include:
5sets of draft plans.
15copies of the summary report of the draft plan.
2.Provincial power development planning:
a)Based on the state budget capital plan allocated for planning work, the Industry Department shall select consulting organizations with sufficient capacity to develop the plan.
b)The selected consulting organization shall carry out the provincial power development planning in accordance with the approved framework and the assigned deadline.
c)During the planning process, the consultant must implement intermediate reporting steps, seek opinions from the Provincial People's Committee and Vietnam Electricity Corporation to perfect the plan.
d)Upon completion, the planning proposal is reviewed by the Industry Department and reported to the Provincial People's Committee for approval and submitted to the Ministry of Industry for approval. The documents for submission include:
5sets of completed planning proposals.
15sets of summary reports of the planning proposals.
3.County power development planning:
a)Based on the local state budget capital plan allocated for planning work, the Provincial People's Committee shall instruct the Industry Department to select consulting organizations with sufficient capacity to develop the plan.
b)The selected consulting organization shall carry out the county power development planning in accordance with the approved framework and the assigned deadline.
c)During the planning process, the consultant must implement intermediate reporting steps, seek opinions from relevant provincial departments and provincial electricity companies to perfect the plan.
d)Upon completion, the plan is sent to the Industry Department for review. The documents for submission include:
5sets of completed planning proposals;
10copies of the summary report of the planning proposal;
e)Based on the review results of the Industry Department, with the participation of relevant departments, the Provincial People's Committee shall issue a decision to approve the plan and instruct the Industry Department to direct its implementation.
Article 7.
The procedures for reviewing and approving the power development plan are as follows:
1.For the national power development plan, the power development plan of Hanoi City and Ho Chi Minh City:
a)Within 45 days from receiving complete valid documents, the Ministry of Industry shall lead, cooperate with relevant ministries, sectors, localities, and Vietnam Electricity Corporation to conduct a review of the planning proposal. In necessary cases, the Ministry of Industry may hire consultants for review and counter-expertise to serve the review work;
b)After receiving formal written comments from relevant ministries, sectors, and localities on the planning proposal, the Ministry of Industry shall complete the review report and submit it to the Prime Minister for consideration and approval;
c)In case the planning proposal requires supplementation and modification, the Ministry of Industry shall request the consultant to make changes and supplements. Within 15 days from when the plan has been completed, the Ministry of Industry shall complete the review report and submit it to the Prime Minister for consideration and approval.
2.For the provincial power development plan:
a)Within 45 days from receiving complete valid documents, the Ministry of Industry shall lead, cooperate with relevant localities, and Vietnam Electricity Corporation to conduct a review of the plan. In necessary cases, the Ministry of Industry may hire consultants for review and counter-expertise to serve the review work;
b)After receiving formal written comments from relevant localities and Vietnam Electricity Corporation on the planning proposal, the Planning and Investment Department of the Ministry of Industry shall complete the review report and submit it to the Minister of Industry for consideration and approval;
c)In case the plan requires modification, the Ministry of Industry shall request the consultant to make changes and supplements. Within 15 days from when the plan has been completed, the Planning and Investment Department shall complete the review report and submit it to the Minister of Industry for consideration and approval.
3.For district power development planning:
a)Within 15 days from receiving the approval request for the power development plan and complete valid documents, the Industry Department shall lead, cooperate with relevant agencies and provincial electricity companies to conduct a review, prepare a review report, and submit it to the Chairman of the Provincial People's Committee for consideration and approval;
b)In case the plan requires modification, the Industry Department shall request the consultant to make changes and supplements. Within 15 days from when the plan has been completed, the Industry Department shall complete the review report and submit it to the Chairman of the Provincial People's Committee for consideration and approval.
Chapter III
Management and Implementation of Power Development Planning
Article 8.
Division of Responsibility for Managing and Implementing Power Development Planning as follows:
1.The Ministry of Industry is responsible for managing and implementing the national power development planning and provincial power development planning; directing the implementation of independent power projects according to the approved planning;
2.The Provincial People's Committee is responsible for directing and urging the implementation of power development planning within their jurisdiction;
3.Vietnam Electricity Corporation, organizations, and individuals involved in the power sector are responsible for implementing the national power development planning, provincial power development planning, and county power development planning related to them in accordance with the approved planning.
Article 9.
Amendments and Supplements to Power Development Planning Shall Be Conducted As Follows:
1.The Prime Minister shall approve amendments and supplements to the national power development planning, the power development planning of Hanoi City, and Ho Chi Minh City, based on the proposal of the Ministry of Industry;
2. The Minister of Industry shall approve the amendment and supplementation of the provincial power development plan upon the proposal of the Provincial People's Committee or Vietnam Power Corporation.
3. The Chairman of the Provincial People's Committee shall approve the amendment and supplementation of the district power development plan upon the proposal of the Department of Industry.
4. The investor shall not be permitted to implement projects that are inconsistent with the power development plan already approved by the competent authority.
5. Projects of Group A and B (as classified according to the current investment management regulations) which are not included in the approved plans may only proceed with investment preparation steps (feasibility study report, investment research report) upon permission from the Prime Minister based on the report of the Ministry of Industry. Within thirty days from receiving the request to supplement the project into the plan, the Ministry of Industry shall be responsible for reviewing and reporting to the Prime Minister, while also informing the requesting agency.
Article 10.
The reporting system regarding the implementation of the power development plan is as follows:
1. The Department of Industry of the province and Vietnam Power Corporation shall be responsible for compiling and reporting to the Ministry of Industry on the implementation status of the approved power development plans before December 20 each year.
2. The Department of Industry and the provincial power corporation shall be responsible for reporting to the Provincial People's Committee on the implementation status of the provincial power development plan before December 10 each year.
3. After being approved, the power development plan will be publicly announced. The Ministry of Industry shall be responsible for announcing the National Power Development Plan. The Provincial People's Committee and the municipal people's committees directly under the central government shall be responsible for announcing the provincial power development plan and the district power development plan.

b) Classify loads according to economic sectors, structure of electricity consumption by sector, paying particular attention to large industrial loads, loads serving irrigation, and loads for economically disadvantaged regions.
Evaluate the current status and management mechanism of low-voltage power grids, losses, and electricity prices in different economic zones of the locality.
d) Provide an overall assessment of the implementation of the previous planning phase, including main strengths and weaknesses, causes, and lessons learned.
Chapter II. Characteristics and directions for economic and social development.
2.1. Natural and socio-economic characteristics of the locality.
Summarize and assess the socio-economic development situation of the locality over the past five years in the following areas:
a) Agriculture.
Total cultivated area, natural characteristics.
Types of crops.
Total irrigated area suitable with natural conditions and crops.
b) Local industry and small-scale cottage industry.
Summarize the development situation of local industry, small-scale cottage industry, total value of products.
Situation of electricity consumption by local industrial enterprises and small-scale cottage units.
c) Central industries located in the locality.
Industrial enterprises and factories located in the locality.
Production situation and level of electricity consumption over the past five years.
d) Various service activities, cultural and social life of the people.
2.2. Directions for socio-economic development during the planning period.
Based on the approved comprehensive socio-economic development plan of the locality, summarize the main socio-economic development goals of the locality, emphasizing the following aspects:
a) Forecast of population development and rural urbanization.
b) Development of agricultural production, irrigation systems serving agriculture.
c) Development of local industry and small-scale cottage industry, central industries located in the locality. It is necessary to emphasize projects with feasibility, and economically disadvantaged areas to formulate appropriate and effective power grid systems.
d) The relationship between socio-economic development and power development.
Chapter III. Forecast of electricity demand.
3.1. Methodology and basis for forecasting electricity demand.
a) Introduce models and methods for forecasting electricity demand.
b) Select models and methods for forecasting electricity demand that are suitable for the locality's circumstances.
3.2. Load zoning for electricity.
Load zoning must be consistent with the approved overall development plan of the locality and the financial feasibility of major industrial projects. On this basis, clearly define:
a) High feasibility industrial zones.
b) Industrial projects without clear financial feasibility, unable to calculate clear economic benefits.
c) Urbanizing residential areas.
d) Pure agricultural residential areas with normal economic development.
đ) Economically difficult or extremely difficult areas.
3.3. Calculation of electricity demand.
Based on Sections 2.1 and 2.2, determine load zones according to socio-economic development targets. For each load zone, determine the following basic parameters:
a) Consumption capacity of typical years in the planning proposal.
b) Electricity demand by planning years.
c) Total demand for capacity and energy in typical years during the planning period. For agricultural loads, consider the special load profile where the maximum capacity utilization time is very short (a few hours a day) to appropriately calculate capacity.
3.4. Comments on the results of electricity demand calculation.
Comments on the ability of local power sources and national power system sources to meet load demands in planning years, and professional, economic-technical recommendations.
Chapter IV. Power Development Scheme.
4.1. Views and design standards for the power development scheme.
Based on the current regulations' requirements for power supply safety, propose views and design standards for the power development scheme. These views and design standards are clearly defined for each voltage level in the planning:
High-voltage transmission system (220, 110kV).
Medium-voltage distribution network.
Low-voltage power network.
4.21. Propose power development options.
Balance power sources and loads for each region and locality corresponding to each planning phase.
Based on analyses, conclusions, and recommendations from Chapters I and II, balance power sources and loads, and propose several power improvement and development options. Then, using expert methods, select three typical options:
a) Option I meets the maximum load for the locality's socio-economic development needs (no investment capital limit, locality has no financial difficulties).
b) Option II meets the maximum load for residential areas and high feasibility industrial zones, projects already approved and financially guaranteed by the State.
c) Option III has limited investment capital.
4.23. Power source and grid development scheme.
a) Develop a power grid improvement and development scheme for the selected options in Section 4.21.
b) Choose technical features of independent power sources, power generation substations, and power lines for each option.
4.4.3 Selection of options.
a) Calculate economic-technical indicators for the grid and power sources for the above options.
- Power loss, voltage, energy in the power grid system, power distribution on the line, etc.
- Economic-technical indicators of power sources.
- Economic, financial, and social indicators.
b) Select the option.
