DECISION OF THE MINISTER OF HOME AFFAIRS

Regarding the approval of the Charter of the Vietnam Physical Society

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

- Based on Decree No. 102/SL-L004 dated May 20, 1957 regarding the right to establish associations,

- Based on Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies,

- Considering the proposal of the Chairman of the Vietnam Physical Society and the Director of the Department of Non-Governmental Organizations;

DECISION:

Article 1. Approves the Charter of the Vietnam Physical Society which was adopted at the Fifth National Congress of Delegates on June 28, 2002.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Chairman of the Vietnam Physical Society and the Director of the Department of Non-Governmental Organizations shall be responsible for implementing this Decision.

 

 

CHARTER

VIETNAM PHYSICAL SOCIETY

PART I
NAME, AIMS, AND OBJECTIVES

Article 1. The Society shall be named the Vietnam Physical Society

International trade name: Vietnam Physical Society.

Article 2. The Vietnam Physical Society is a voluntary social-professional organization of Vietnamese citizens engaged in research, teaching, application, and dissemination of knowledge in physics.

The Vietnam Physical Society is a member of the Vietnam Association for Science and Technology.

Article 3. The purpose of the activities of the Vietnam Physical Society:

To gather and unite members to help each other improve their professional skills, contribute to training talents, promote the dissemination of physics knowledge in Vietnam, apply physics to serve the cause of industrialization and modernization of the country and national defense.

Article 4. The Vietnam Physical Society operates throughout the country with its headquarters in Hanoi. The Society has legal personality, seals, symbols, media outlets, and separate accounts as prescribed by law.

The Vietnam Physical Society may join regional and international physics societies in accordance with the provisions of law.

PART II

TASKS AND POWERS

Article 5. Tasks of the Society

1. Organize regular academic activities for members and those who are interested in physics.

2. Contribute opinions to state agencies regarding policies and measures to promote the development and application of physics in the country and the content of physics teaching programs in schools. Participate in consulting, reviewing, and appraising scientific and technological projects and socio-economic projects when requested.

3. Support individual members or groups of members directly involved in solving national science and technology issues related to physics.

4. Organize scientific awards to encourage the development of talent among the physics cadre, particularly young talent.

5. Build and develop relations with international physics and technology organizations in accordance with the provisions of law.

6. Protect the rights and legitimate interests of members in accordance with the provisions of the Society's Charter.

7. Report on the organizational and operational situation of the Society when required.

Article 6. Rights of the Society:

1. Represent organizations and members in activities related to the objectives, purposes, and tasks of the Vietnam Physical Society.

2. Enter into scientific research contracts, implement research topics, and provide services with organizations or individuals as needed in accordance with current laws.

3. Sponsor members and affiliated organizations, implement scientific research activities, participate in evaluating research works and projects in the field of physics and science and technology when invited.

4. Proactively participate in building programs and projects in the fields of physics and technology to propose solutions to relevant state management agencies for the development of the physics and high technology sectors.

5. Be permitted to publish books and journals of the Society in accordance with the provisions of law.

6. Organize training sessions and seminars to disseminate new knowledge in the fields of physics and high technology.

7. Reward and recommend rewards from competent authorities to organizations and members who have achieved results in realizing the objectives, purposes, and tasks of the Vietnam Physical Society.

CHAPTER III
MEMBERS

Article 7. Members of the Vietnam Physical Society:

1. Organizational members: Organizations operating in the field of physics that recognize the charter of the Vietnam Physical Society, voluntarily work for the Society, submit an application to join the Society, and appoint representatives to participate in the Society shall be considered for admission into the Society.

2. Individual members: Vietnamese citizens engaged in research, teaching, application, and dissemination of physics both domestically and internationally, who agree with the charter of the Society, voluntarily apply to join the Society to be admitted as members.

3. Supporting members: Organizations and Vietnamese citizens, including Vietnamese citizens residing abroad, who recognize the Charter of the Vietnam Physical Society and financially support the activities of the Society will be recognized as "supporting members" after approval by the Executive Board.

4. Honorary members: Domestic and foreign scientists who have made significant contributions to the development of physics in Vietnam will be invited by the Executive Board to join as "honorary members" of the Society.

Honorary members and supporting members are not eligible to participate in the leadership board of the Society or vote on issues of the Society.

Article 8. Responsibilities of Members:

1. Respect the objectives and purposes, comply with the Charter and resolutions of the Society.

2. Actively participate in the activities of the Society.

3. Promote membership recruitment, protect the honor and reputation of the Society.

4. Unite and assist colleagues within and outside the Society.

5. Participate in organizational activities at a local level of the Society, pay membership fees fully.

Article 9. Rights of Members:

1. Participate in activities, discussions, and voting on all matters of the Society. Be eligible for nomination and election to higher-level congresses and participation in the Executive Board of the Society.

2. Receive assistance from the Society in both moral and material aspects in Society activities and professional work.

3. Be protected by the Society regarding legitimate and justifiable rights in their profession.

4. Enjoy other benefits stipulated by the Society.

5. Requesting to leave the Association.

PART IV
ORGANIZATION AND ACTIVITIES OF THE ASSOCIATION

Article 10. The organization and operation of the Society follow the principle of centralized democracy, voluntariness, self-management, and self-financing. The structure of the Society includes:

1. At the Central level: Vietnam Physical Society.

2. At the grassroots level: Branches. In each agency, school, research institute, etc., with five members or more can establish a branch.

Depending on the actual situation in provinces and centrally-administered cities (hereinafter referred to as provinces), provincial physical societies may be established. The establishment is decided by the Provincial People's Committee according to the law.

Article 11. The highest leading body of the Vietnam Physical Society is the National Congress of Delegates, held every five years. When necessary, the Executive Board may convene an extraordinary congress, which is convened when at least two-thirds of the total number of Executive Board members or at least half of the total number of regular members propose it. The composition and number of delegates are determined by the current Executive Board of the Central Society.

Responsibilities of the Congress:

- Summarize and evaluate the activities of the Society during the previous term, discuss directions and action plans for the next term.

- Approving amendments to the Regulations (if any).

- Elect the Central Executive Board and the Central Inspection Board.

- Deciding important matters concerning the purpose, mission, rights, and responsibilities of the Association.

Article 12. The Central Executive Board of the Society is the leading body between two congress terms. The number of Central Executive Board members is set by the Congress and directly elected. During the period between two congresses, if deemed necessary, the Executive Board may elect additional members of the Executive Board, with the total number in the term not exceeding 20% of the number of Executive Board members elected by the Congress.

The Executive Board has the following responsibilities:

- Lead the implementation of the Congress resolutions.

- Lead the implementation of the Society's Charter.

- Develop relations with domestic and international organizations, contributing to the development of the Association.

- Elect the Central Standing Board, President, Vice Presidents, and General Secretary.

- The Central Executive Board meets regularly once every six months (except in emergencies).

Article 13. The Standing Committee of the Central Executive Board of the Association consists of the Executive Board, which includes the Chairman, Vice Chairmen, Secretary General, and some members, with the number of members in the Executive Board not exceeding one-third of the total number of members of the Central Executive Board of the Association.

The tasks of the Standing Board include:

- Leading the implementation of Decisions of the Central Executive Board of the Association between two sessions of the Central Executive Board.

- Recognizing subordinate Executive Boards and issuing membership cards.

- Develop plans and report on the activities of the Association as prescribed by the Central Executive Board of the Association.

- Monitoring the activities of Associations, Branches, and specialized subcommittees.

- The Executive Board convenes regularly once every three months. When necessary, upon the proposal of the Chairman and the Secretary General, the Executive Board may convene extraordinary meetings.

Article 14. The Chairman of the Association is elected from among the standing members by the Central Executive Board, presides over meetings of the Central Executive Board of the Association and the Executive Board, directs and implements Resolutions of the Central Executive Board of the Association and the Executive Board, and is responsible under the law for all activities of the Association.

Article 15. The Vice Chairmen are elected by the Central Executive Board of the Association, assigned by the Chairman to lead specific aspects of the Association's activities.

Article 16. The Secretary General is elected by the Central Executive Board of the Association, permanently handles tasks assigned by the Chairman, and manages all activities of the Central Office of the Association.

Article 17. Upon the request of the Secretary General, the Executive Board may consider and decide to establish specialized subcommittees and organizations serving the development of the Association when necessary. Establishment shall be in accordance with the provisions of the law.

Article 18. The Inspection Board:

The Inspection Board is elected by the Congress and has the following responsibilities:

- Inspecting the implementation of Resolutions of the Congress, Regulations, rules, and annual work programs of the Association.

- Inspecting members' activities to commend and reward them, while identifying violations of the law to promptly correct them.

- Inspecting economic and financial activities of the Association and its affiliated organizations; examining and resolving complaints and petitions.

CHAPTER V
ASSETS AND FINANCES

Article 19. Sources of income of the Association:

- Membership fees collected annually from members (the specific amount is determined by the Central Executive Board of the Association).

- Income from the Association's activities such as services, consulting, publishing, seminars, training courses...

- Donations and sponsorships from domestic and foreign organizations and individuals.

Expenditures of the Association include expenses for scientific and technical activities, consulting and service activities, communication work, vocational training, international cooperation, membership fees, office expenses, insurance, welfare, and administrative costs of the management machinery of the Association.

Article 20. The Association's finances are managed according to the regulations of the Central Executive Board of the Association based on compliance with state financial-accounting systems. Idle funds of the Association (if any), including foreign currencies, are allowed to be deposited for savings to increase the Association's fund.

Article 21. When the Association or its organization is dissolved, assets and funds must be inventoried, reported to the Central Executive Board of the Association. Dissolution shall be carried out in accordance with the provisions of the Law.

Chapter VI
REWARDS AND DISCIPLINE

Article 22. Organizations and members with outstanding achievements will be commended by the Association or recommended for commendation by competent state authorities.

Article 23. Organizations and members who damage the reputation of the Association, violate the Charter and Resolutions of the Association, will be disciplined from reprimand, warning to expulsion. In cases where material damage is caused, in addition to disciplinary measures, compensation must also be made in accordance with the Law.

Article 24. Organizations and individuals who are members of the Association and fail to pay membership fees for one year or do not participate in three consecutive sessions without reason shall be removed from the list of members.

Chapter VII
IMPLEMENTING PROVISIONS

This Charter consists of seven chapters and twenty-six articles, which were adopted on June 28, 2002, at the National Congress of the Vietnam Physical Society and shall take effect from the date it is approved by the competent state authority.

Only the National Congress of the Association has the right to supplement and amend this Charter./.
