PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the State Budget Law No. 01/2001/QH11 dated December 16, 2002;
Considering the proposal of the Minister of Finance,
DECISION:
Article 1. The State shall provide financial support from the State Budget to political-social occupational organizations, social organizations, and social-occupational organizations that engage in activities related to state tasks, in accordance with the provisions of this Decision.
Article 2.
1. Operating funds for political-social occupational organizations, social organizations, and social-occupational organizations shall be self-funded according to the law. The State does not allocate personnel quotas or operating funds to these organizations.
2. The State Budget shall provide financial support to political-social occupational organizations, social organizations, and social-occupational organizations for activities related to state tasks based on the following principles:
a) The State Budget shall fully or partially fund activities assigned by the Prime Minister (for central-level political-social occupational organizations, social organizations, and social-occupational organizations); or by the People's Committee Chairpersons at various levels (for local-level political-social occupational organizations, social organizations, and social-occupational organizations).
b) The State Budget shall fund products, works, and activities carried out by political-social occupational organizations, social organizations, and social-occupational organizations that have practical value and bring substantial benefits to society, as confirmed by competent authorities.
c) The State Budget shall fund other activities as decided by the Prime Minister or by the People's Committee Chairperson of provincial-level cities directly under the Central Government, including:
- The State Budget shall continue to fund the operations of political-social occupational organizations, social organizations, and social-occupational organizations currently allocated personnel quotas until 2005.
- The State Budget shall partially fund conferences summarizing exemplary advanced movements nationwide, upon permission from competent authorities.
- The State Budget shall partially fund congresses held during the term of political-social occupational organizations, social organizations, and social-occupational organizations.
- In special cases, political-social occupational organizations, social organizations, and social-occupational organizations may be granted partial funding by the State Budget for the acquisition, construction, purchase, or rental of office premises, as decided by the Prime Minister or by the People's Committee Chairperson of provincial-level cities directly under the Central Government.
Article 3. The State Budget shall provide support to political-social occupational organizations, social organizations, and social-occupational organizations based on their self-generated revenue, current financial expenditure regulations, and the annual budget capacity of each level.
The Prime Minister shall decide or authorize the Minister of Finance to decide the level of support from the Central State Budget for central-level political-social occupational organizations, social organizations, and social-occupational organizations; and the People's Committee Chairpersons at various levels shall consider and decide the level of support from local State Budgets for local-level political-social occupational organizations, social organizations, and social-occupational organizations.
Article 4. The process of providing financial support from the State Budget for activities related to state tasks for political-social occupational organizations, social organizations, and social-occupational organizations shall be implemented as follows:
Annually, within the period for preparing the State Budget estimate, political-social occupational organizations, social organizations, and social-occupational organizations shall prepare a budget estimate based on their planned activities for the year, unit revenues, supported activity content, current financial expenditure standards, and send it to the Ministry of Finance (for central-level organizations) and to local financial agencies (for local-level organizations).
Financial agencies at all levels shall compile the support budget estimates based on the needs of political-social occupational organizations, social organizations, and social-occupational organizations and the budget capacity of the State Budget at each level, and submit them for approval by the competent authority.
Article 5.
1. Financial agencies at all levels shall be responsible for disbursing support funds according to the approved budget estimate, cooperate with relevant government agencies to inspect the use of State Budget-supported funds to ensure compliance with regulations and purposes, and review the settlement of support funds according to the regulations.
2. Political-social occupational organizations, social organizations, and social-occupational organizations shall be responsible for managing, using, and settling State Budget-supported funds in accordance with regulations, transparently, and openly.
Article 6. This Decision shall take effect from the date of signing.
Article 7. The Minister of Finance shall guide the implementation of this Decision.
Article 8. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Heads of central-level political-social occupational organizations, social organizations, and social-occupational organizations, and Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
