 RESOLUTION
ON THE PROGRAM FOR LEGISLATION IN 2004 

NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992, amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the National Assembly, tenth session;

Pursuant to the Law on the Organization of the National Assembly and the Law on Enacting Legal Normative Documents;

After considering the Report No. 151/UBTVQH11 dated October 23, 2003 of the Standing Committee of the National Assembly on the proposed Program for Legislation in 2004 and the opinions of the National Assembly deputies;

RESOLVES

Article 1: The National Assembly hereby adopts the Program for Legislation in 2004 as follows:

A. THE OFFICIAL PROGRAM

I. LEGAL PROJECTS

1. At the fifth session (expected in May 2004):

a) Submit to the National Assembly for approval:

1. The Civil Procedure Code;

2. The Inspection Law;

3. The Law Amending and Supplementing Certain Provisions of the Law on Credit Organizations;

4. The Inland Waterway Transport Law;

5. The Enterprise Bankruptcy Law (amended);

6. The Law Amending and Supplementing Certain Provisions of the Law on Protection, Care and Education of Children;

7. The Law Amending and Supplementing Certain Provisions of the Law on Complaints and Petitions;

8. The Resolution of the National Assembly on the Rules of Operation of the Standing Committee of the National Assembly (amended);

9. The Resolution of the National Assembly on the Rules of Operation of the National Ethnic Council and Committees of the National Assembly (based on the consolidation of the Rules of Operation of the National Ethnic Council and the Rules of Operation of Committees of the National Assembly).

b) Submit to the National Assembly for comments:

1. The Electricity Law;

2. The Competition Law;

3. The Law on Enacting Legal Normative Documents of People's Councils and People's Committees;

4. The Law Amending and Supplementing Certain Provisions of the Publishing Law;

5. The Land Tax Law;

6. The Law Amending and Supplementing Certain Provisions of the Forest Protection and Development Law;

7. The Law Amending and Supplementing Certain Provisions of the Education Law;

8. The National Security Law.

2. At the sixth session (expected in November 2004):

a) Submit to the National Assembly for approval:

1. The Electricity Law;

2. The Competition Law;

3. The Law on Enacting Legal Normative Documents of People's Councils and People's Committees;

4. The Law Amending and Supplementing Certain Provisions of the Publishing Law;

5. The Land Tax Law;

6. The Law Amending and Supplementing Certain Provisions of the Forest Protection and Development Law;

7. The Law Amending and Supplementing Certain Provisions of the Education Law;

8. The National Security Law.

b) Submit to the National Assembly for comments:

1. The Civil Code (amended);

2. The Commercial Law (amended);

3. The Vietnam Maritime Code (amended);

4. The Drug Law;

5. The Vietnam Railway Law;

6. The Law on Signing and Implementing International Treaties;

7. The Public Security Police Law;

8. The Defense Law;

9. The State Audit Law.

II. PROJECTS FOR ORDINANCES:

1. The Ordinance on Plant Varieties;

2. The Ordinance on Animal Breeds;

3. The Ordinance on Religion;

4. The Ordinance on Judicial Appraisal;

5. The Ordinance on National Reserve;

6. The Ordinance Amending and Supplementing Certain Provisions of the Ordinance on Administrative Litigation Procedures;

7. The Ordinance on Protective Service Work;

8. The Ordinance on Tendering;

9. The Ordinance on Anti-dumping;

10. The Ordinance on Anti-subsidy;

11. The Ordinance on Legal Aid;

12. The Ordinance Amending and Supplementing Certain Provisions of the Ordinance on Thrift and Prevention of Wastefulness;

13. The Ordinance on Veterinary Medicine (amended);

14. The Resolution of the Standing Committee of the National Assembly on Civil Transactions Regarding Housing with Foreign Elements Established Before July 1, 1991;

15. The Ordinance on Prevention and Control of HIV/AIDS (amended);

16. The Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs and Their Families, War Invalids, Veterans, and Those Who Have Contributed to the Revolution (amended).

B. PREPARATORY PROGRAM:

I. Draft laws:

1. The Enforcement of Criminal Sentences Law;

2. The Law on Compulsory Purchase and Seizure of Personal and Organizational Property;

3. The Vietnam Civil Aviation Law (amended);

4. The Social Insurance Law;

5. The Law on Vietnam's Sea Areas;

6. The Law on Associations;

7. The Housing Law;

8. The Law on Health Care for the People (amended);

9. The Electronic Commerce Law;

10. The Youth Law;

11. The Dike Law;

12. The Real Estate Business Law;

13. The Tourism Law;

14. The Investment Law (applicable to both domestic and foreign investment);

15. The Law Amending and Supplementing Certain Provisions of the Environmental Protection Law.

II. Draft ordinances

1. The Ordinance on Strike Settlement Procedures;

2. The Notarization Ordinance;

3. The Ordinance on Blood, Tissue, Organ Transplantation and Autopsy;

4. The Ordinance Amending and Supplementing Certain Provisions of the Ordinance on the Reserve Mobilization Force;

5. The Ordinance on Protecting Key National Security Facilities;

6. The Ordinance on Seizing Ships at Sea.

Article 2: Add the following items to the Program for Enacting Laws and Ordinances of the National Assembly during the 11th term (2002-2007):

1. The Real Estate Business Law;

2. The Electronic Commerce Law;

3. The Gender Equality Law;

4. The Ordinance Amending and Supplementing Certain Provisions of the Ordinance on Thrift and Prevention of Wastefulness;

5. The Ordinance on Court Fees and Fines;

6. The Ordinance on War Veterans.

Article 3:

1. The Standing Committee of the National Assembly shall direct the implementation of the Program for Legislation in 2004.

2. Drafting agencies and agencies submitting draft laws and ordinances shall have plans to organize specific implementation to ensure that all projects are submitted on schedule, of high quality, and that guiding documents are issued promptly.

3. The National Ethnic Council and Committees of the National Assembly shall have plans to proactively coordinate with the main drafting agencies and other relevant agencies to improve the quality of draft projects, prepare audit reports, and assist the Standing Committee of the National Assembly in incorporating and revising draft laws and ordinances; strengthen supervision over the issuance of guiding documents for implementing laws and ordinances.

4. The Government shall take measures to intensify the promotion and introduction of laws to ensure that all agencies, organizations, and citizens understand and implement them uniformly.

This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the eleventh term, fourth session, on November 26, 2003.
