THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Plant Protection and Quarantine Law 2001;

Pursuant to Decree No. 86/2003/ND-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 88/2003/QD-BNN dated September 4, 2003 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Plant Protection Department;

Considering the proposal of the Director of the Plant Protection Department and the Director of the Cadre and Civil Servant Affairs Department,

 

DECISION:

Article 1. Position and Functions

The Plant Quarantine Sub-Department Region I is a subordinate unit under the Plant Protection Department, with the function of state management over plant quarantine, having legal personality, its own seal, operational funds, and bank accounts as prescribed by law.

The scope of operation of the Plant Quarantine Sub-Department Region I includes the provinces of Hai Phong, Thai Binh, Hung Yen, Hai Duong, and Quang Ninh.

The headquarters of the Plant Quarantine Sub-Department Region I is located at No. 2 Tran Quang Khai Street, Hai Phong City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Implement plant quarantine for objects subject to export, import, temporary import for re-export, temporary export for re-import, transit, and handle objects subject to plant quarantine according to the provisions of laws and international agreements on plant quarantine that Vietnam has signed and joined;

2. Issue certificates of plant quarantine and certificates of fumigation disinfection practice according to the provisions of law;

3. Collect fees and charges related to plant quarantine work according to the provisions of law;

4. Manage and implement disinfection according to the provisions of law;

5. Train and provide professional training on plant quarantine and disinfection for provincial plant protection sub-departments within the region;

6. Guide, inspect, and urge the implementation of domestic plant quarantine work for provinces and cities within the region;

7. Conduct specialized inspections according to the assigned level and resolve complaints and denunciations regarding plant quarantine according to the assigned authority;

8. Participate in building standards, procedures, and experimental surveys on plant quarantine;

9. Participate in international cooperation programs on plant quarantine;

10. Manage civil servants, finance, assets, and other resources assigned;

11. Perform other tasks assigned by the Director of the Plant Protection Department.

Article 3. Organizational Structure

1. Leadership of the Sub-Department

The leadership of the Plant Quarantine Sub-Department Region I consists of the Sub-Department Director and Deputy Sub-Department Directors appointed by the Director of the Plant Protection Department according to regulations.

The Sub-Department Director manages the activities of the Sub-Department, is responsible before the Director of the Plant Protection Department and the law for the activities of the Sub-Department and assigned tasks. Deputy Sub-Department Directors assist the Sub-Department Director and are responsible before the Sub-Department Director and the law for the execution of assigned tasks. The number of Deputy Sub-Department Directors shall not exceed two.

2. Management Structure of the Sub-Department

2.1 Supporting Departments:

a) Administrative General Department;

b) Technical Department;

c) Export and Import Plant Quarantine Department.

2.2 Affiliated Quarantine Stations:

These stations have their own seals to perform quarantine tasks according to the provisions of law.

The Director of the Plant Protection Department shall prescribe the operating regulations of the unit.

Article 4. Effective Date.

This Decision takes effect fifteen days from the date of publication in the Official Gazette of the Government. This Decision replaces Decision No. 84/NN-TCCB/QD dated February 8, 1994 of the Minister of Agriculture and Food Industry (now the Ministry of Agriculture and Rural Development) concerning the functions, tasks, powers, and organizational structure of the Plant Quarantine Sub-Department Region I. Any previous regulations contrary to this Decision are abolished.

Article 5. Responsibilities for Implementation

The Head of the Office of the Ministry, the Director of the Cadre and Civil Servant Affairs Department, the Director of the Plant Protection Department, Heads of relevant agencies and units under the Ministry, and the Director of the Plant Quarantine Sub-Department Region I are responsible for implementing this Decision.
