Pursuant to the Railway Law dated June 14, 2005;

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 51/2008/NĐ-CP dated April 24, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the General Director of Vietnam Railway Corporation and the Head of the Personnel Department.

DECISION:

Article 1. Amending and supplementing Article 5 of the "Regulations on standards for positions of railway staff directly serving train operations, conditions for training institutions, and contents and programs of training for railway staff directly serving train operations" issued together with Decision No. 67/2005/QĐ-BGTVT dated December 2, 2005 of the Minister of Transport as follows:

1. Clause 1 of Article 5 is amended and supplemented as follows:

"1. Train dispatchers:

a) Hold a diploma from a vocational college in Train Dispatching or a higher diploma in Rail Transport;

b) Have at least two years of direct work experience in either or both of the positions of station dispatcher and station train dispatcher;

c) Have passed the examination and met the requirements for train dispatching skills organized by the enterprise employing the position of train dispatcher."

2. Clause 2 of Article 5 shall be amended and supplemented as follows:

"2. Station dispatchers:

a) Hold a diploma from a vocational college in Train Dispatching or a higher diploma in Rail Transport;

b) Have at least one year of direct work experience in the position of station train dispatcher;

c) Have passed the examination and met the requirements for station train dispatching skills organized by the enterprise employing the position of station dispatcher."

3. Clause 3 of Article 5 shall be amended and supplemented as follows:

"3. Station train dispatchers:

a) Hold one of the following certificates: specialized certificate in station train dispatcher, train conductor, or a diploma from a vocational college or intermediate vocational college in Train Dispatching, or a higher diploma in Rail Transport;

b) Have at least one year of practical work experience in the positions of shunting supervisor, station clerk, locomotive coupling, and car coupling at the station;

c) Have passed the examination and met the requirements for station train dispatching skills organized by the enterprise employing the position of station train dispatcher."

"4. The latest date for payment of business registration fees is January 30 each year.

"4. Train conductors:

a) Hold one of the following certificates: specialized certificate in train conductor, station train dispatcher, or a diploma from a vocational college or intermediate vocational college in Train Dispatching, or a higher diploma in Rail Transport;

Have practical experience in the following jobs:

- For passenger train conductors: have at least one year of direct work experience in the position of assistant train conductor or freight train conductor;

- For freight train conductors: have at least one year of direct work experience in the position of shunting supervisor or have served as a train conductor for six consecutive months;

c) Have passed the examination and met the requirements for train conductor skills organized by the enterprise employing the position of train conductor."

5. Clause 5 of Article 5 is amended and supplemented as follows:

"5. Shunting supervisors:

a) Hold one of the following certificates: specialized certificate in shunting supervisor, station train dispatcher, train conductor, or a diploma from a vocational college or intermediate vocational college in Train Dispatching, or a higher diploma in Rail Transport;

b) Have at least six months of practical work experience in the positions of station clerk, locomotive coupling, and car coupling at the station;

c) Have passed the examination and met the requirements for shunting supervisor skills organized by the enterprise employing the position of shunting supervisor."

6. Clause 6 of Article 5 is amended and supplemented as follows:

"6. Station clerks:

a) Hold one of the following certificates: specialized certificate in station clerk, locomotive coupling, car coupling, shunting supervisor, station train dispatcher, train conductor, or a diploma from a vocational college, intermediate vocational college, or basic vocational college in Train Dispatching, or a higher diploma in Rail Transport;

b) Have at least three months of practical training in the positions of station clerk, locomotive coupling, and car coupling at the station;

c) Have passed the examination and met the requirements for station clerk skills organized by the enterprise employing the position of station clerk."

7. Clause 7 of Article 5 is amended and supplemented as follows:

"7. Locomotive and car couplers:

a) Hold one of the following certificates: diploma or specialized certificate in station clerk, locomotive coupling, car coupling, shunting supervisor, station train dispatcher, train conductor, or a diploma from a vocational college, intermediate vocational college, or basic vocational college in Train Dispatching, or a higher diploma in Rail Transport;

b) Have at least three months of practical training in the positions of station clerk, locomotive coupling, and car coupling at the station;

c) Have passed the examination and met the requirements for locomotive and car coupling skills organized by the enterprise employing the position of locomotive and car coupler."

8. Clause 8 of Article 5 is amended and supplemented as follows:

"8. Track, bridge, and tunnel patrolmen:

a) Are maintenance workers for railway tracks, bridges, and tunnels from level 4/7 upwards, hold a specialized certificate in track, bridge, and tunnel patrolman, or a higher diploma in Rail Transport or Railway Engineering;

b) Have at least one month of probationary period in the positions of track, bridge, and tunnel patrolman;

c) Have passed the examination and met the requirements for track, bridge, and tunnel patrolman skills organized by the enterprise employing these positions."

Article 2. This Decision shall take effect fifteen days after its publication in the Official Gazette. All previous regulations that conflict with this Decision are hereby abolished.

Article 3. The Heads of the Office of the Ministry, the Inspectorate of the Ministry, the Heads of Departments, the General Director of Vietnam Railway Corporation, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Decision.
