CIRCULAR

Regulations on the development and support for implementing the domestic market trade promotion program in 2009

Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Resolution No. 30/2008/NQ-CP dated December 11, 2008 of the Government on urgent measures to prevent economic decline, maintain economic growth, and ensure social welfare; Decision No. 12/2009/QD-TTg dated January 19, 2009 of the Prime Minister on the implementation plan for Resolution No. 30/2008/NQ-CP dated December 11, 2008 of the Government on urgent measures to prevent economic decline, maintain economic growth, and ensure social welfare;

Pursuant to Decision No. 529/2009/QD-TTg dated April 24, 2009 of the Prime Minister on the budget for implementing the domestic market trade promotion program in 2009;

Chapter I GENERAL PROVISIONS

Article 1. Scope of Regulation

These Circulars regulate the development and support for implementing the domestic market trade promotion program in 2009 (hereinafter referred to as the Program), which has been approved by the Minister of Industry and Trade.

Article 2. Applicability

Organizations with legal personality established under the provisions of law from all economic sectors that wish to participate in the Program, have their proposals approved by the Appraisal Council, and are approved by the Minister of Industry and Trade must comply with the provisions of these Circulars and relevant laws when implementing activities.

Chapter II CONTENT OF THE PROGRAM AND SUPPORT PRINCIPLES

Article 3. Content of Program Activities

The Program, decided and approved by the Minister of Industry and Trade, includes the following main activities:

1. Community business capacity support activities - Market research on consumers, distribution networks, and traders; compilation and provision of research results. + Implementation period: Third and Fourth Quarter of 2009. - Organization of seminars and roundtable discussions. + Implementation period: August 2009.

2. Organization of agricultural product fairs and village craft product fairs in the South and North - Agricultural product fair and village craft product fair in the South. + Fair organization period: (one week) in November 2009. - Agricultural product fair and village craft product fair in the North. + Fair organization period: (one week) in March 2010.

3. Activities to bring Vietnamese goods to rural areas, industrial zones, and urban areas - Bringing Vietnamese goods to rural areas. + Implementation period: From August 2009 to August 2010. - Sales fairs for workers in industrial zones. + Implementation period: From August 2009 to August 2010. - Weekend sales fairs for Vietnamese goods in urban areas. + Implementation period: From August 2009 to August 2010.

4. Communication activities - Communication activities through television, newspapers, and online media. + Implementation period: From August 2009 to August 2010. - Publication of materials. + Implementation period: From August 2009 to August 2010.

Article 4. Principles and Levels of Support

1. Full funding for community business capacity support activities, including: - Market research on consumers, distribution networks, and traders; compilation and provision of research results; - Organization of seminars and roundtable discussions.

2. Full funding for communication activities, including: - Communication activities through television, newspapers, and online media; - Publication of materials.

3. Funding at 70% for organizing agricultural product fairs and village craft product fairs in the South and North, including: - Agricultural product fair and village craft product fair in the South; - Agricultural product fair and village craft product fair in the North.

4. Funding at 70% for activities to sell goods in rural areas, industrial zones, and urban areas, including: + Bringing Vietnamese goods to rural areas; + Sales fairs for workers in industrial zones; + Weekend sales fairs for Vietnamese goods in urban areas.

5. The level of remuneration for the Secretariat and the Appraisal Council; the level of support for project evaluation and appraisal shall be stipulated by the Minister of Industry and Trade in the Decision establishing the Appraisal Council and the Secretariat. Other expenditure items shall be implemented according to current regulations. The source of expenditure shall be from the Program's budget.

Chapter III PROCEDURES AND PROCEDURES FOR IMPLEMENTING THE PROGRAM

Article 5. Appraisal Board for the Program

The Minister of Industry and Trade decides to establish and promulgate the Regulation on the organization and operation of the Appraisal Board for the Program.

Article 6. Procedures for Receiving and Processing Applications

1. The Ministry of Industry and Trade publishes a tender invitation to participate in the Program on its electronic information website.

2. Organizations with legal personality and a desire to participate in activities under the Program shall prepare and submit tender documents (in accordance with the tender invitation) via email or fax, and simultaneously send them directly through postal service or in person to the Domestic Market Department (Ministry of Industry and Trade) no later than 10 (ten) working days from the end date of the tender document submission period (as indicated by the postmark on the tender document envelope). Organizations participating in the tender must ensure consistency between tender documents submitted via email or fax and those sent directly or through postal service.

3. Organizations whose proposals have been approved by the Minister of Industry and Trade shall organize and implement according to the content, schedule, and report results to the Ministry of Industry and Trade and the Ministry of Finance no later than 15 (fifteen) days from the end of the Gregorian year and the end of the activity (following the model attached to this Circular).

Article 7. Procedures for Granting and Settling Funds

After the proposal has been approved by the Minister of Industry and Trade, based on the budget estimate and implementation schedule, the Ministry of Finance will temporarily allocate funds to the winning bidder to carry out the Program. The Ministry of Finance will provide detailed guidance on the procedures for temporary allocation and settlement of funds. Units using state budget funds to implement activities under the Program must adhere to their intended purpose, comply with regulations, and be subject to inspection and supervision by authorized agencies; at the end of the Gregorian year and upon completion of activities, they must settle the funds used according to current regulations.

Chapter IV IMPLEMENTATION ORGANIZATION

Article 8. Effective Date

This Circular takes effect 45 days from the date of signature.

Article 9. Assignment of Responsibilities

1. The Ministry of Industry and Trade assigns the Domestic Market Department to lead in drafting plans, organizing the implementation, and compiling reports on the results of the Program.

2. The Appraisal Board, Secretariat, heads of relevant units within the Ministry of Industry and Trade, related ministries and sectors, and organizations assigned to implement activities under the Program are responsible for implementing this Circular and other relevant laws. During the implementation process, if there are any difficulties or issues arising, they should promptly reflect these to the Ministry of Industry and Trade for timely resolution.
