CIRCULAR
Regarding the addition of plant species to the List of Plant Species Protected
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;amend Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Intellectual Property Law No. 50/2005/QH11 dated November 29, 2005;  The Law Amending and Supplementing Certain Provisions of the Intellectual Property Law No. 36/2009/QH12 dated June 19, 2009;
On the basis ofDecree No. 104/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Intellectual Property Law concerning rights over plant varieties;
The Ministry of Agriculture and Rural Development adds the following plant species to the List of Plant Species Protected:
Article 1. Adding five plant species with the following names to the List of Plant Species Protected:
1.       Cauliflower ( Brassica oleracea L. Convar botrytis (L.) Alef. var. botrytisL.);
2.       Eggplant ( Solanum melongena L.);
3.       Yardlong Bean (Vigna unguiculata (L.) Walp. subsp. sesquipedalis (L.) Verdc.);
4.       Snow Pea ( Pisum sativum L.);
5.       Common Bean ( Phaseolus vulgaris L.).
Article 2. This Circular takes effect forty-five days from the date of issuance.
Article 3.The Head of the Ministry's Office, the Director of the Crop Production Department, the Heads of units under the Ministry, and related organizations and individuals are responsible for implementing this Circular./.
