Issuing the Internal Regulations of Compulsory Education Institutions

Pursuant to Decree No. 02/2014/ND-CP dated January 10, 2014, stipulating the regime for applying and enforcing administrative sanctions involving placement in educational institutions for compulsory education;

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director General of the Criminal Enforcement and Judicial Assistance Bureau,

The Minister of Public Security issues this Circular on the Internal Regulations of Compulsory Education Institutions.

Article 1. Internal Regulations of Compulsory Education Institutions

1. Attached hereto are the "Internal Regulations of Compulsory Education Institutions".

2. Visits, meetings; receipt and sending of letters, money, gifts; telephone communications of compulsory education institution inmates shall be carried out in accordance with other regulations issued by the Minister of Public Security.

Article 2. Applicability

This Circular applies to management agencies of compulsory education institutions; compulsory education institutions; inmates currently serving decisions at compulsory education institutions pursuant to administrative sanction decisions of People's Courts and organizations and individuals related to the enforcement of decisions to place in compulsory education institutions.

Article 3. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from June 29, 2015 and replaces Decision No. 168/QĐ-BCA(V26) dated April 5, 1999 of the Minister of Public Security on the Internal Regulations of Compulsory Education Institutions.

2. Directors of the General Bureaus, Heads of units under the Ministry, Directors of Public Security, Directors of Fire Prevention and Fighting Police in provinces and centrally-administered cities, and related organizations and individuals are responsible for implementing this Circular.

In the course of implementing this Circular, if there are difficulties or obstacles, local public security units, organizations, and individuals related to it shall report to the Ministry of Public Security (through the Criminal Enforcement and Judicial Assistance Bureau) for timely guidance.

COMPULSORY EDUCATIONAL FACILITIES

(Attached hereto is Circular No. 21/2015/TT-BCA dated May 14, 2015 of the Minister of Public Security)

To maintain discipline and create favorable conditions for inmates to comply with decisions to place in compulsory education institutions, the Minister of Public Security promulgates the Internal Regulations of Compulsory Education Institutions as follows:

Article 1. Provisions on Compliance with Orders and Time Schedules

Inmates of compulsory education institutions must:

1. Strictly comply with orders and instructions of compulsory education institution staff.

2. Adhere to regulations concerning orders, time schedules for study, work, living, rest, cultural, artistic, physical exercise, sports, entertainment, and leisure activities.

3. Quickly form lines according to teams when called; maintain order and strictly follow orders and directions of compulsory education institution staff.

Article 2. Provisions on Maintaining Internal Order, Eating, Sleeping, and Living Activities

Inmates of compulsory education institutions must comply with the following provisions:

1. Provisions on roll call and headcount.

2. Eat on time; wear long pants, shirts, shoes, or sandals when going to eat, not causing disorder; receive and consume meals as prescribed and in designated areas.

3. Sleep on time, lie down in designated places, not causing disorder.

4. Maintain personal hygiene and follow regulations for prevention, examination, and treatment of illness.

5. Have short hair but not shaved heads, beards, or mustaches for males, and neat appearance for females.

6. Prohibitions on organizing parties, eating, lighting fires, cooking in dormitories, residential areas, learning and working areas, infirmaries, collective activity areas; writing, drawing, hanging, pasting pictures, spitting, littering anywhere within compulsory education institutions.

7. Prohibitions on smoking cigarettes or tobacco in dormitories, infirmaries, disciplinary rooms, visiting rooms, libraries, reading rooms, learning and collective activity areas, workshops, and places where fire or explosion may occur, areas with signs prohibiting fire or smoking, and other similar places.

8. Prohibitions on tattooing, piercing, attaching metal or other objects to oneself or others, dyeing hair, growing long fingernails or toenails and painting them, engaging in homosexual acts, or sexual relations between inmates or with others.

9. Prohibitions on storing or using alcohol, beer, narcotics, and other stimulants; machinery, communication devices, weapons, poisons, explosives, flammable materials, chemicals, radioactive substances, and items that may cause harm to oneself or others.

10. Prohibitions on storing or using books, newspapers, documents, films, tapes, electronic memory cards, unhealthy cultural products; connecting, transmitting illegal information, images outside or on the Internet, media.

11. Prohibitions on proselytizing, performing rituals, fortune-telling, promoting, coercing other inmates to participate in superstitious or unorthodox activities, committing superstitious or unorthodox acts, establishing or joining groups, factions.

12. Prohibitions on gambling, betting on anything, in any form, among inmates or with others.

13. Prohibitions on threatening, oppressing, fighting, infringing upon one’s own or another person’s body.

Article 3. Provisions on Etiquette and Conduct

Inmates of compulsory education institutions must:

1. Use Vietnamese in communication (except in cases where Vietnamese is not known); address staff members as "cán bộ" or "quý khách" and refer to oneself as "tôi" when speaking with compulsory educational institution staff members, visitors, or those conducting business at compulsory educational institutions; address other inmates as "anh" or "chị" and refer to oneself as "tôi" during study, work, conferences, competitions, sports events, ceremonies, or collective activities. Outside of these activities, inmates should address each other appropriately according to Vietnamese customs and cultural traditions based on age. When called by name, inmates must respond with "có".

Remove hats or caps, stand at attention, maintain a distance of between three and five meters, and greet staff members or visitors upon encountering them at compulsory educational institutions. The greeting must reflect a friendly attitude and include appropriate responses such as "vâng," "dạ," "thưa," or saying "thank you" or "sorry" at the right time. In cases where a team or group of inmates encounters staff members or visitors, the Team Leader or Group Leader must instruct all inmates to stand at attention, remove their hats or caps, hold them in their right hand, and have the Team Leader or Group Leader represent the team or group in greeting the staff members or visitors.

2. Remove hats or caps, hold them in the right hand, report clearly the full name, team, or group when entering or exiting the gates of compulsory educational institutions. If moving in a team or group, form two rows, remove hats or caps, hold them in the right hand for the right row and in the left hand for the left row, and the Team Leader or Group Leader must report clearly the name of the team or group and the number of people in it.

Timely and truthfully report to compulsory educational institution staff members about any violations of laws or internal regulations by other inmates.

Article 4. Provisions on Clothing and Personal Living Items

Inmates of compulsory education institutions must:

1. Wear trousers and shirts bearing the stamp "TRẠI VIÊN" on the front of the trousers and back of the shirt; on the left chest of the shirt, affix the inmate's name and the last seven digits of their file number (excluding underwear and undershirts).

2. Wear long trousers and shirts that are neat, tidy, clean, and buttoned up properly when participating in study, work, conferences, competitions, sports events, ceremonies, collective activities, meeting relatives, entering or exiting the gates of compulsory educational institutions, or interacting with outsiders.

3. Deposit valuables and documents such as gold, silver, jewelry, foreign currency, Vietnamese currency, stocks, bonds, electronic payment cards, watches, machinery, equipment, Identity Cards, Citizen Identification Cards, household registration books, passports, vocational certificates, diplomas, certificates, other valuable documents, and unused clothing and personal items at the compulsory educational institution.

4. Fold, arrange neatly and orderly, keep clean, air out, and store in designated places clothing, quilts, mosquito nets, blankets, and personal living items. Do not bring into the dormitory any tools or personal living items except those provided according to regulations and two sets of regular clothing, one winter coat, one cotton pillow, a plastic cup, a toothbrush, toothpaste, shampoo, soap for bathing and washing clothes, a plastic comb, plastic hair clips, white paper, writing pens, plastic-framed glasses, medications prescribed by compulsory educational institution health staff, feminine hygiene products, and bags for personal items as specified.

5. Do not lend, alter, repair, write, draw, erase, or deface the stamps on issued clothing.

Article 5. Provisions on study, work, vocational training, culture, arts, physical education, sports, recreation, entertainment

Inmates of compulsory education institutions must:

1. Actively, conscientiously, and seriously participate in study, work, vocational training, cultural activities, arts, physical education, sports, recreation, and entertainment.

2. Respectfully and courteously behave appropriately towards compulsory educational institution staff during study, work, vocational training, cultural activities, arts, physical education, sports, recreation, and entertainment; properly maintain and prevent loss or damage to documents, books, and notebooks.

3. Strictly comply with discipline, regulations, and guidance from compulsory educational institution staff during study, work, vocational training, cultural activities, arts, physical education, sports, recreation, and entertainment; shall not resist, be lazy, evade, or obstruct other inmates' study, work, vocational training, cultural activities, arts, physical education, sports, recreation, and entertainment; shall not hire or force other inmates to serve or perform their tasks or those of other inmates under any form; shall not arbitrarily move, deliberately damage, or destroy machinery, tools, materials, products, or other items, or take machinery, work equipment out of the compulsory educational institution without the consent of compulsory educational institution staff, or bring them into inmate living areas.

Article 6. Provisions on protecting and maintaining property

Inmates of compulsory education institutions must:

1. Protect and maintain one's own property, others' property, trees, flowers, ornamental plants, grass in the compulsory educational institution; promptly report to compulsory educational institution staff about any acts infringing upon such property; shall not buy, sell, exchange, lend, or borrow anything between inmates or with others; shall not tap, connect, or steal electricity from the compulsory educational institution or elsewhere.

2. Compensate for damages according to the law if causing damage to the compulsory educational institution's property or others' property./.
